PERFORMANCE WORK STATEMENT (PWS)
FOR
Non-Hazardous Solid Waste Collection and Disposal Services
Puerto Rico Army National Guard Facilities
1.0 General:
1.1 Scope: The contractor shall provide all personnel, equipment, tools, materials, supervision, and quality control necessary, except as specified in Paragraph 3.0 as Government Furnished, to perform Non-Hazardous Solid Waste Collection and Disposal Services Puerto Rico Army
National Guard Facilities, as defined in this PWS.
1.2 Objectives: Acquire the service for managing solid waste (collection and disposal of non-hazardous waste) generated across various Federal and States facilities within PRARNG. The
Contractor shall be required to perform all services detailed within this PWS for the entire contract duration, encompassing the base year and all Government-exercised option years.
1.3 Background: The Puerto Rico Army National Guard (PRARNG) strategically operates various military facilities across Puerto Rico to ensure continuous readiness and effective military operations. These facilities require a reliable solid waste and disposal service to manage the waste generated during training exercises, deployments, and day-to-day activities.
Additionally, this contract aims to maintain strict control over non-hazardous solid waste, preventing any potential spread of pets and other environmental issues.
1.3.1 Period of Performance (PoP): The contract term consists of a base period and four (3) one-year option periods, structured as follows:
Base Year (FY26): April 2026 – March 2027 (52 weeks)
Option Year I (FY27): Abril 2027 – March 2028 (52 weeks)
Option Year II (FY28): April 2028 – March 2029 (52 weeks)
Option Year III (FY29): April 2029 – March 2030 (52 weeks)
1.4 General Information:
1.4.1 Place and Performance of Services: The contractor is responsible for conducting business between the hours of 7:30 AM and 4:00 PM, Monday through Friday, except on Federal
Holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar directed facility closings. In the event a scheduled service is impacted by such a closure, the service must be provided on the next available working day. No work shall be performed during non-duty hours, on weekends, or at any time when Government personnel are not available for inspection, unless prior written approval has been obtained from the authorized representative of the Puerto Rico Army National Guard. At the beginning of the contract, the Contractor must submit a detailed work itinerary for approval by the authorized
PRARNG representative. The contractor shall at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility/installation is not closed for the above reasons. When hiring personnel, the contractor shall keep in mind that the stability and continuity of the workforce are essential. The work to be performed under this contract will be performed at different facilities of the Puerto Rico Army
National Guard (PRARNG) within the geographical area of Puerto Rico mainland. See. Exhibit
3 for details in locations/pickups frequency and dumpsters capacity.
1.4.1.1 Telework: Not applicable.
1.4.1.2 Unscheduled gate closures by the Security Police may occur at any time causing all personnel entering or exiting a closed installation to experience a delay. This cannot be predicted or prevented. Contractors are not compensated for unexpected closures or delays. Vehicles operated by contractor personnel are subject to search pursuant to applicable regulations. Any moving violation of any applicable motor vehicle regulation may result in the termination of the contractor employee’s installation driving privileges.
1.4.1.3 The contractor’s employees shall become familiar with and obey the regulations of the installation, including fire, traffic, safety and security regulations while on the installation.
Contractor employees should only enter restricted areas when required to do so and only upon prior approval. All contract employees shall carry proper identification with them at all times and shall be subject to such checks as may be deemed necessary. The contractor shall ensure compliance with all regulations and orders of the installation, which may affect performance.
The Government reserves the right to direct the removal of an employee from Government property or revoke access to Government systems for misconduct, security reasons, or any overt evidence of communicable disease. Removal of contractor employees for reasons stated above does not relieve the Contractor from responsibility for total performance of this contract.
1.4.2 Recognized Holidays: The following are recognized United States (US) holidays. The contractor shall not perform services on these days:

1.4.3 Quality Control (QC): The contractor shall maintain effective quality control to ensure services are performed in accordance with this PWS. The contractor’s quality control is a means by which he assures himself that his work complies with the requirement of the contract. See
FAR 12.105 for Quality Requirements.
1.4.4 Quality Assurance (QA): The Government will evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government will do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and acceptable quality level(s) or defect rate(s).
1.4.5 Installation Access and Security Requirements. The contractor shall comply with all applicable installation/facility access and local security policies and procedures, which may be obtained from the COR. The contractor and all associated subcontractor employees shall provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services, or
Security Office. The contractor shall ensure compliance with all personal identity verification requirements as directed by Department of Defense (DoD), Headquarters Department of Army
(HQDA) and/or local policy (see PWS 6.0). Should the Force Protection Condition (FPCON) change, the Government may require changes in contractor security matters or processes.
1.4.5.1 Reserved.
1.4.5.2 For contractors that do not require a CAC, but require access to a DoD facility or installation: Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate
Identification (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05), and applicable installation, facility and area commander installation/facility access, and local security policies and procedures (provided by a Government representative).
1.4.5.3 Awareness Training (AT) Level 1: All contractor employees, including subcontractor employees, requiring access to Army installations, facilities, and controlled access areas shall complete AT Level 1 training within 30 calendar days after contract start date and within 30 calendar days of new employees commencing performance. The contractor shall submit certificates of completion for each affected contractor and subcontractor employee to the COR within 15 calendar days after completion of training by each employee or subcontractor personnel. 1.4.5.4 iWATCH Training: The contractor and all associated subcontractors with an area of performance within an Army-controlled installation, facilities or area shall brief all employees on the local iWATCH program (training standards provided by the requiring activity Antiterrorism
Officer (ATO)). This local developed training shall be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR or the KO.
This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance. The contractor shall report https://jko.jten.mil/courses/atl1/launch.html completion for each contractor employee and subcontractor employee to the COR within 15 calendar days after completion of training.
1.4.5.5 Communications Security/Information Technology (COMSEC/IT) Security. All communications with DoD organizations are subject to COMSEC review. All telephone communications networks are continually subject to intercept by unfriendly intelligence organizations. DoD has authorized the military departments to conduct COMSEC monitoring and recording of telephone calls originating from, or terminating at, DoD organizations.
Therefore, the contractor is advised that any time contractor personnel place or receive a call they are subject to COMSEC procedures. The contractor shall ensure wide and frequent dissemination of the above information to all employees dealing with DoD information. The contractor shall abide by all Government regulations concerning the authorized use of the
Government's computer network, including the restriction against using the network to recruit
Government personnel or advertise job openings.

1.4.5.11 OPSEC Training: In accordance with AR 530-1, Operations Security, new contractor employees shall complete Level I OPSEC training within 30 calendar days of their reporting for duty and annually thereafter. The contractor shall submit certificates of completion for each contractor employee to the COR within 15 calendar days after completion of training. Level 1

1.4.6 Physical Security. The contractor shall safeguard all Government property provided for contractor use. At the close of each work period, Government facilities, equipment and materials shall be secured.

1.4.8 Post Award Conference/Periodic Progress Meetings: The contractor agrees to attend any post award conference convened by the KO in accordance with FAR 42.5. The KO, COR and other Government personnel, as appropriate, may meet periodically with the contractor to review the contactor’s performance. At these meetings, the KO will apprise the contractor of how the
Government views the contractor’s performance and the contractor shall apprise the Government of problems, if any, being experienced. The contractor shall resolve outstanding issues raised by the Government. Contractor attendance at these meetings shall be at no additional cost to the
Government.
1.4.9 Contract Manager (CM): The contractor shall designate a CM who shall ensure performance under this contract. The name of this person, and an alternate who shall act for the contractor when the CM is absent, shall be designated in writing to the KO. The CM or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The CM shall work through the COR, to resolve issues, receive technical instructions, and ensure adequate performance of services. The CM shall ensure that contractor employees do not perform any services outside the scope of the contract without an official modification issued by the KO. The CM shall ensure contractor employees understand that services performed outside the scope of the contract are performed wholly at the expense of the contractor.
1.4.10 Identification of Contractor Employees: All contractor personnel attending meetings, answering Government telephones and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression that they are Government employees. The contractor shall ensure that all documents or reports produced by contractor personnel are suitably marked as contractor products or that contractor participation is appropriately disclosed. The contractor’s status as a “contractor” shall be predominantly displayed in all correspondence types (to include signature blocks on e-mail) and dealings with Government or non-Government entities. Contractor personnel shall wear identification badges distinguishing themselves as such. The badges shall have the company name, employee name and the word “contractor” displayed.
1.4.10.1 The contractor shall retrieve all identification media (including vehicle passes) from its employees who depart employment for any reason. The contractor shall return all identification media (i.e., badges and vehicles passes) to the KO within 14 days of an employee’s departure.
1.4.11 Combating Trafficking in Persons: The United States Government has adopted a zero-tolerance policy regarding trafficking in persons. Contractors and contractor employees shall not engage in severe forms of trafficking in persons during the period of performance of the contract;
procure commercial sex acts during the period of performance of the contract; or use forced labor in the performance of the contract. The Contractor shall notify its employees of the United
States Government’s zero tolerance policy, the actions that will be taken against employees for violations of this policy. The contractor shall take appropriate action, up to and including termination, against employees or subcontractors that violate the US Government policy as described at FAR 22.17.

1.4.14 Organizational Conflicts of Interest (OCI): The contractor and subcontractor personnel performing services under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent OCIs, as defined in FAR Subpart 9.5. The contractor shall notify the KO immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the
KO to avoid or mitigate any such OCI. The contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the KO. In the event the KO unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the KO may impose other remedies as he or she deems necessary, including prohibiting the contractor from participating in subsequent contracted requirements which may be affected by the OCI.

2.0 Definitions and Acronyms:
2.1 Definitions: This Performance Work Statement incorporate by reference definitions prescribed in the Revolutionary Federal Acquisition Regulation Overhaul (RFAO, or RFO) prescribed in Part 2.101 and implemented through Defense Acquisition Regulation (DFARS)
FAR Overhaul Class Deviation to implement the RFAO effective 1 February 2026 and in the
Defense Contract, Pricing and Acquisition Policy (DPCAP). In the event that a definition herein conflicts with definitions in RFO Part 2.101, the definition in the Part 2.101 shall govern, unless such is not included in the RFO Part 2.101, then the definition in the Legacy Federal Acquisition
Regulation (FAR) Part 2.101 shall apply.
2.1.1 Contractor: A supplier or vendor awarded a contract to provide specific supplies or service to the Government. The term used in this contract refers to the prime.
2.1.2 Defective Service: A service output that does not meet the standard of performance associated with the PWS.
2.1.3 Deliverable: Anything that can be physically delivered and includes non-manufactured things such as meeting minutes or reports.
2.1.4 Key Personnel: Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the PWS.
2.1.5 Physical Security: Actions that prevent the loss or damage of Government property.
2.1.6 Quality Assurance: The Government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
2.1.7 Quality Assurance Surveillance Plan (QASP): An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
2.1.8 Quality Control: All necessary measures taken by the Contractor to ensure that the quality of an end product or service shall meet contract requirements.
2.1.9 Subcontractor: One that enters into a contract with a prime contractor. The Government does not have “privity of contract” with the subcontractor.
2.1.10 Acceptable Waste. All types of combustible and non-combustible materials (excluding hazardous or special waste and sewage sludge) as normally and regularly appear in solid waste generated by offices, clubs, cafeterias, dining facilities, warehouses and other non-manufacturing activities.
2.1.11 Hazardous and Special Waste. Any material which poses a hazard to health and/or environment as defined in the Resource Conservation and Recovery Act (RCRA) of 1976 and regulations implementing those laws and similar local laws and regulations. Such wastes include but are not limited to those materials which are toxic, corrosive, ignitable or reactive, requiring special handling and procedures for disposal. This waste SHALL NOT be collected as part of this contract.
2.1.12 Transportation Vehicle. Any vehicle used for the transportation of solid waste from the point of waste origin to a point of further processing or ultimate disposal.
2.1.13 Containers. Suitable containers include dumpsters, recycling bins and totes. Containers are labeled with items both permitted and prohibited, and are non-leaking receptacles equipped with a lid. Containers must be of a size as detailed within this PWS.
2.1.14 Collection. Solid Waste collection is an organized and systematic method of transporting solid waste from the point of generation or from pickup points to site of disposal or a materials recovery facility.
2.1.15 Disposal. Disposal is the process of spreading and covering in sanitary fills, spreading and covering in landfills, and dumping in public dumps, or other solid waste disposal facility.
2.1.16 Solid Waste. Solid waste means all those materials that are not liquid waste but includes recyclables, refuse, rubbish, garbage, ash debris, yard waste and under certain conditions, hazardous waste.
2.1.17 Refuse. Is a category of solid waste. Refuse includes all garbage, ashes, debris, rubbish and other similar waste materials. Not included are explosive or incendiary wastes; recyclable materials; hazardous waste; and contaminated waste from medical or radiological processes.
2.1.18 Garbage. Garbage is a category of solid waste. Garbage means animal and vegetable waste (and containers thereof but not including recyclable containers) resulting from the handling, preparation, cooking and consumption of foods.
2.1.19 Ash. Ash is a category of solid waste. Ash means the residue from burned wood, coal, coke and other combustible material.
2.1.20 Debris. Is a category of solid waste. Debris, often referred to as “Construction and
Demolition” or “bulky waste”, means roofing materials, plastic siding, stone, masonry, brick, concrete, tile, Formica, plasterboard (drywall), non-recyclable glass, etc. Not included in this category are grass clippings, leaves, and yard waste, stumps, and wood waste, scrap metal and similar waste materials.
2.1.21 Rubbish. Is a category of solid waste. Rubbish means a variety of unsalvageable materials such as floor sweepings, paper wrappings, non-recyclable containers, cartons, and similar articles not used in preparing or dispensing food. It is easier to define rubbish as any material that is not a recyclable, not debris, not ash, not yard waste and not garbage.
2.1.22 Yard Waste. Is a category of solid waste. Yard waste means leaves, grass clippings, brush and small stumps.
2.1.23 Controlled Unclassified Information: means information the Government creates or possesses, or information an entity creates or possesses for or on behalf of the Government, that a law, regulation, or Governmentwide policy requires or permits an agency to handle using safeguarding or dissemination controls (32 CFR 2002.4(h)).
2.1.24 Federal Contract Information (FCI) means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government. It does not include information provided by the
Government to the public, such as on public websites, or simple transactional information, such as information necessary to process payments.
2.1.25 Serviced Location: Means location receiving the waste collection and refusal services described in Paragraph 5.0 and Technical Exhibit #3.
2.1.26 Serviced Location Representative: the point of contact, physically located at the serviced location, who provides access to the facility and physically accepts the services of waste collection and refusal. This person is NOT authorized to act on behalf of the Contracting Officer or the Contracting Officer Representative.

3.0 Government Furnished Property, Material, Equipment and Services (GFP/M/E/S): The
Government provide the property, material, equipment, and/or services listed below solely for the purpose of performance under this contract:
3.1 Property: Not provided.
3.2 Materials: Not provided.
3.3 Equipment: Not provided.
3.4 Services: Not provided.
3.5 Utilities: All utilities in the facility will be available for the contactor’s use in the performance of this contract. The contractor shall instruct employees in utilities conservation practices. The contractor shall operate under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount.
4.0 Reserved.
4.1 General: Except for those items specifically stated to be Government-Furnished in
Paragraph 3.0, the contractor shall furnish all materials and equipment required to perform these services as indicated in Paragraph 1.1.

5.0 Performance Tasks: The contractor shall provide non-personal service, supervision, inspection, quality control, logistics, supplies, materials, equipment, and subcontract services to perform in accordance with this Performance Work Statement and Performance Tasks. The prime contractor shall remain solely responsible for performance of this contract.
5.1. Task #1 Set-up Waste Collection Dumpster:
5.1.1. Waste Collection Dumpsters: The contractor shall provide and service a total of forty-four
(44) dumpsters of 8 cubic yard capacity, one (1) dumpster of 30 cubic yard capacity, and one (2) dumpster of 40 cubic yard capacity, to be distributed across various PRARNG facilities.
5.1.1.1. The Contractor shall place all required containers at their designated facilities within a period not to exceed ten (30) calendar days from the date of contract award.
5.1.1.2. The specific locations and service frequencies for each container are detailed in
Technical Exhibit # 3.
5.1.1.3. If a facility experiences an unforeseen increase in generated waste to the point that it may require increased frequency, the Contracting Officer Representative shall coordinate with the Serviced Location Representative and investigate reasons why of sudden increase (e.g., increased facility utilization, unforeseen tenants, etc.).
1. If the COR assesses the increase to be not due to irresponsible utilization of contracted waste dumpsters, the COR will coordinate with the Contracting Officer to consider a supplemental agreement to either exchange for a container of increased capacity or increased frequency of location, provided that this agreement is determined to be within the general scope of the PWS.
2. At NO time will the contractor, voluntarily or otherwise, exchange or increase frequency of services without express approval from the contracting officer and authorized through supplemental agreement.
3. If the contractor consciously changes any of the material aspects of this PWS without expressed approval by the contracting officer, the contractor acknowledges that such material change was unauthorized and may not be compensated for increased costs associated with the unauthorized change.
5.1.2. Task #2 Meet Waste Collection Dumpster Requirements: The contractor shall provide containers that meet the following requirements
5.1.2.1. 8 Cubic-Yards Containers: Containers with a capacity of 8 cubic yards shall be made of either metal or plastic. They must be properly painted and equipped with a plastic lid, side doors, and a pick-up handle. For any facility located within two (2) miles of the coastline, these containers must be made of plastic.
5.1.2.2. 30 Cubic Yards and 40 Cubic Yards Containers: Containers with a capacity of 30 or 40 cubic yards shall be made of metal and be properly painted.
5.1.2.3. Placement: All containers shall be placed in specific areas specified in Enclosure #4
Sites Layouts. Relocation of containers within the same site shall be submitted through the contracting officer representative to the contracting officer for review and consideration.
5.1.3. Task #3 Conduct Waste Management, Collection and Disposition:
5.1.3.1. The contractor shall provide weekly waste collection and refusal services to Puerto Rico
Army National Guard Readiness Centers and Fort Allen Training Center in accordance with
Technical Exhibit 3 – Estimate Workload. These are located across 19 towns and municipalities such as: Aibonito, Aguadilla, Arecibo, Cabo Rojo, Caguas, Cayey, Ceiba, Coamo, Juana Díaz, Guayama, Gurabo, Humacao, Mayaguez, Peñuelas, Ponce, San Juan, Toa Baja, Utuado, and
Vega Baja.
1. The containers furnished by the contractor remain as contractor property. The contractor shall be responsible for removal of unserviceable containers (see Paragraph 5.1.3.3). The contractor shall also remove all dumpsters provided under the performance of this PWS within 15 days upon completion of this period of performance unless otherwise such period is extended in writing by the contracting officer.
2. When servicing the dumpsters, the contractor shall return the containers to their original location after servicing, in an upright position with the lids securely in place (closed). The contractor shall be responsible for immediately cleaning up any spills, debris, or spilled waste which may occur during servicing of containers.
5.1.3.2. Task#3.1 Coordinate Servicing Schedule:
1. Within ten (10) business days after contract award, the contractor shall submit a detailed work itinerary via email to the Contracting Officer (KO) and the Contracting Officer's
Representative (COR).
2. This itinerary must clearly identify the proposed pickup day for each location. Default
Pickup Day: Unless otherwise specified in a contract line item, the proposed pickup day for each facility will be based on its location within the contractor’s established routes.
3. Government Concurrence: All schedules require written acceptance from the COR before the start of work. The contractor shall not commence services until this acceptance is received.
4. Schedule Changes: Once accepted, no changes shall be made to the collection schedule without obtaining prior written consent from the COR.
5. Service on Closures and Holidays: Services will not be performed on Federal Holidays or when a Government facility is closed due to emergencies, administrative closings, or other directives. In such cases, the service must be performed on the next available business day.
6. Work Outside Standard Hours: No work shall be performed during non-duty hours, on weekends, or when Government personnel are not available for inspection, unless prior written approval has been obtained from the COR.
7. Circumstances for Changes to Schedule: The Government may require the Contractor to make adjustments to the regular collection schedule for special events or other operational needs.
a. This may include altering the pickup time, day, or relocating containers.
b. The Government will provide the Contractor with a minimum of 72-hour notice for such changes.
c. These adjustments will be provided at no additional cost to the Government, provided they do not exceed the total number of collections specified per contract line item for that period.
8. Inclement Weather Conditions: The contractor shall continue to collect, transport, and dispose of solid waste material during periods of inclement weather unless such circumstances present risk to life or equipment.
a. In cases of severe weather, the Contracting Officer (KO) may authorize exceptions.
b. When such exceptions are granted, the contractor shall make up all missed collections within 24 hours after the severe weather conditions have passed, unless the KO authorizes additional time.
c. Rescheduling to provide make-up services shall not be a basis for a claim by the contractor for additional compensation.
5.1.3.3. Task #4 Perform Off-Site Disposal: The contractor shall transport and dispose of all solid waste at a licensed off-site disposal center selected by the contractor.
1. The contractor shall abide by all Federal, State and local laws and Army regulations as they pertain to disposal. The contractor shall be responsible for any permit or fees associated with the use of off-site disposal locations.
2. The contractor shall include in the invoice evidence of the landfill generated Waste
Manifest (Manifiesto de Desperdicios) in accordance with Department of Natural and
Environmental Resources (DNER, or DRNA for its Spanish acronym), to include:
a. Scale Ticket: This is the standard operational receipt issued at the facility's scale house. It typically includes:
(1) Weights: Gross, tare, and net weight of the disposed materials.
(2) Vehicle Info: License plate and origin of the load.
(3) Timestamps: Date and time of entry/exit, which is vital for the facility's operating logs.
3. The contractor shall only use State authorized and registered landfills for disposal. Use of clandestine landfills or disposal in any other location other than authorized by State and
Federal Regulation is NOT authorized.
5.1.3.3 Task #5 Maintain General Equipment and Vehicle Serviceability: The Contractor is responsible for the comprehensive maintenance of all equipment and vehicles used in this contract.
1. The Contractor shall maintain all provided containers in a clean and sanitary condition, ensuring they are free of unpleasant odors, dirt, debris, and pests, and that they remain in good, workable condition and easily accessible.
2. All cleaning, painting, repair, and other maintenance tasks for the containers shall be performed at an off-site location. Similarly, all trucks and trailers used for hauling and collecting waste shall be washed as required to ensure they are free of odor, dirt, and debris.
5.1.3.3 Task #6 Comply with Standards for Condition and Serviceability of Waste
Containers/Dumpsters: The Contractor shall maintain containers in a serviceable condition.
1. The containers are unserviceable if any one of the following conditions exist:
a. Container does not meet specifications (see Paragraph 5.1.1).
b. Container is not leak-proof (storm water pollution prevention compliant).
c. Container is not enclosed (except for roll-off containers designed to be open).
d. Doors, lids or hardware are missing, damaged, not operational, or do not close in the manner in which they were designed to close.
e. Over twenty-five percent (25%) of exposed surface is not a uniform color (painted if container is not molded or composite plastic).
f. Over ten percent (10%) of exposed surface is covered with rust.
g. Container exterior is damaged (substantial dents, holes, excessive scratches, burrs, ragged edges that present the container in an undesirable appearance).
2. Broken, unsafe, or defective containers are unacceptable and, upon identification, must be removed and replaced by the Contractor within a maximum period of ten (10) calendar days at no additional cost to the Government.
3. If container is broken, damaged, or deteriorated during lifting and placing, wear and tear, or reaches a condition making it unserviceable, the contractor shall be responsible to replace the container/dumpster for a serviceable one at no additional cost.
4. Containers/dumpsters furnished for the service of this PWS remain under the ownership of the contractor, therefore, the contractor shall be responsible for their maintenance, servicing, and inspection throughout the duration of the period of this PWS.
5.1.3.4. Task #7 Compliance with Waste Removal and Refusal Requirements. The removal, transporting and final disposal of the solid waste shall be done in accordance with all applicable laws, regulations and policies issued by the State and Federal Government and other government entities, such as cities, counties and towns. Solid Waste disposal is a heavily regulated activity, and the contractor should not submit a bid on this contract unless familiar with all applicable requirements.
1. The Contractor shall take the necessary precautionary measures to guarantee that when placing contractor equipment that adequate space is made available for the proper application of insecticides and rodenticides.
2. The Contractor shall take the necessary precautionary measures when selecting collection equipment to assure the prevention of scattering of refuse and windblown litter at the time of transfer from the collection vehicles to the contractor’s compaction equipment.
3. The Contractor shall take all actions necessary to clean and properly dispose of any hazardous materials caused by leaks and spills from his operation and equipment (i.e. fuel, motor oil, hydraulic oil, etc.), in accordance with Paragraph 6, Applicable Publications.
4. The contractor is responsible to remove Dumpsters/containers upon expiration of the contract. The contractor provided equipment shall be removed within ten (10) calendar days after expiration of the period of performance unless extended by the Contracting
Officer. The Government will not be responsible for any disposal costs after expiration of the contract.
5.2. General Administrative Conditions:
5.2.1. Contract Performance.
5.2.1.1. Installation Access and Security Requirements: Contractor personnel or any representative of the contractor shall abide by all security regulations and shall be subject to security checks prescribed to access to Government facilities and military installations.
1. The Contractor shall comply with all PRARNG policies regarding entry into the installation, rules of the road, contingency operations compliance, and photography prohibitions.
2. Contractor employees are authorized to have access to the installation for the purpose of work under this contract only and are not authorized in other facilities or areas without prior government authorization.
3. The Contractor must be aware that entry requirements are subject to change due to installations and world situations.
4. Failure to adequately plan for base clearance and access does not constitute an excuse for non-performance.
5. All contractor personnel operating motor vehicles in performance of this contract shall have a valid state operator’s license and shall operate all vehicles in accordance with policies and procedures established by the PRARNG.
6. The contractor’s vehicles shall have a company identification tag clearly visible while on site. Furthermore, all vehicles used to provide the service must be maintained in safe, fully operational condition, free of defects such as broken glass, damaged bumpers or lights, and fluid leaks.
7. The contractor is responsible for ensuring each vehicle possesses all licenses and permits required by current law. In the event of any type of spill (petroleum, oil, lubricant), escape of any type of fluid within the PRARNG facilities caused by the contractor vehicle, the
Contractor will be responsible for all costs associated with cleaning, fines and damages caused. Including any type of environmental damage, as established by state and federal laws.
5.2.1.1 Safety Considerations: The contractor shall maintain a safe working environment to prevent accidents and preserve the life and health of contractor personnel and Government personnel. The Contractor shall instruct employees in appropriate measures as specified by the applicable provisions of the Occupational Safety and Health Act, 1970, PL 91-596 (84 Stat
1590).
5.2.1.2. Other General Conditions and Considerations:
1. Interference with Government Operations: The Contractor shall schedule and arrange work so as to cause the least interference with the normal occurrence of Government operations and a mission. In those cases where some interference may be essentially unavoidable, the Contractor shall be responsible to make every effort to minimize the impact of the interference and inconvenience of the customer.
2. Protection of Government Property: The Contractor shall assume full liability and responsibility for any and all damages or claims for injury to persons or property that result from the services performed under this contract. The Contractor shall be responsible for any damage caused to PRARNG property, personnel, or visitors, as well as for damages caused to the property of any second or third party as a result of its operations. The
Contractor agrees to hold the Government harmless from any such claims arising from the
Contractor's performance under this contract.
3. Appointment of Contractor Contract Manager: The contractor shall provide a contract manager and alternate (s) who shall be responsible for the performance of this PWS. The name of the manager and alternate(s), who shall act for the contractor when the manager is absent, shall be designated in writing to the COR prior to the contract start date. These personnel may be contacted outside of normal duty hours for emergencies. The contract manager is the primary liaison between the Government and contractor personnel and subcontractors. The contractor contract manager shall ensure that:
a. The contracted and subcontracted employees under the performance of this PWS observe and comply with, all such existing and future laws, regulations, ordinances, by-laws, orders and decrees; and shall protect and indemnify the PRARNG against any claim or liability arising from or based upon the violation of any such laws, regulations, ordinances, by-laws, orders and decrees, whether by the Contractor or its agents or employees.
b. Provides in anticipation with a list of personnel who will be vetted for base access clearance to ensure uninterrupted or unduly delayed services. This includes identifications, licenses, permits and additional documents required by Installation
Access Control procedures.
c. Ensure timely submission of monthly invoices in accordance with contract clauses through Wide Area Workflow (WAWF) in Procurement Integrated Enterprise
Environment (https://piee.eb.mil/). For invoices to be approved, the contractor shall upload as attachments to the invoice (not to exceed 5 MB per file unless WAWF has a more stringent requirement) the following supporting documents:
(1) Number of Purchased Order (P.O.)
(2) Facility name
(3) Physical address where the facility is located.
(4) Quantity of containers
(5) Container capacity
(6) Name in block letters, as well as the signature of the authorized representative of the Contractor, which certifies that the service was provided.
(7) Name in block letters, as well as the signature of the authorized representative of
PRARNG, which certifies that the service offered.
(8) Date of the service
(9) Indicate about any situation that affected the service (if applicable).
NOTE: If the solid waste collection and disposal service is carried out and no staff is found at the facility for the required signature on the service sheet, the
Contractor must immediately contact the authorized representative of the
PRARNG who will proceed to verify that the service was provided. Under this situation, the authorized representative of the PRARNG will be the one who signs the service sheet, certifying that the service was provided.
d. Address and ensures are licenses and permits prescribed to collect, transport, refuse and dispose of solid waste are met in accordance with State and Federal Regulations.
e. Coordinate with COR or Anti-Terrorism Officer (ATO) Representative for all required training prescribed in this PWS (Awareness Training, OPSEC, iWATCH). This training is required for routine access.
(1) Contractors and subcontractors who have not been vetted for access will be subject to installation access policy for one time access (Day Pass).
(2) Contractors and subcontractors will be subject to the same record check prescribed in PWS Paragraph 1.4.5.2 and will be required to have a State
Sponsored Valid ID (Real ID) and provide information requested at the
Installation Visitor Control Center or Access Gate.
(3) Contractors and subcontractors shall not expect expedite processing for “Day-
Pass” and are subject to Installation Access Control hours of operations.
(4) If the contractors and subcontractors are unable to provide services resulting in missed service due to failure to coordinate for base access vetting and clearance, the contractor shall provide the services at later time coordinating with the COR at no additional cost.
(5) Failure to follow access procedures shall not constitute a basis for a claim or equitable price adjustment.
5.2.1.3. Release Reporting (Waste Spillage): Any release of oil, hazardous waste, or hazardous material, at any PRARNG facilities shall be immediately reported to the local fire department and the Environmental Management Office (EMO) during normal work hours through the COR.
1. This does not relieve the contractor of reporting requirements including local, State and
Federal laws (EPA or Department of Environmental Protection).
2. Any hazardous substance released to the environment resulting from contractor’s performance and negligence shall be the sole responsibility of the contractor and shall be cleaned up at no expense to the Government.
3. Any release shall be cleaned up to the standards set forth in federal and state law. Neither the need to comply with this provision nor any cost or delays caused by failure to comply with applicable environmental laws will be the basis for an extension of time for task or contract completion, an equitable price adjustment, or the relaxation of a contract requirement.
5.2.2. Service Contract Reporting.
5.2.2.1. In accordance with FAR 4.303 Service Contracts Inventory, reporting is required for contracts and first-tier subcontracts for services exceeding the threshold of total value of
4.303(b).
5.2.2.2. If conditions under 4.303(b) are met, the contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this performance work statement.
5.2.2.3. The contractor shall completely fill in all required data fields using the following web address: https://sam.gov. Log in and select Entity Registrations and then select Service Contract
Reporting.
5.2.2.4. The Contractor shall report the required information annually by October 31, for services performed under this contract during the preceding Government fiscal year (October 1-
September 30).

5.2.2.6. Failure to comply with these requirements may result in withholding of final payment.
