PERFORMANCE WORK STATEMENT
PROPANE DELIVERY
COLD REGIONS RESEARCH AND ENGINEERING LABORATORY
HANOVER, NEW HAMPSHIRE
1. DESCRIPTION OF SERVICES. This is Contract is for automatic delivery of propane to various tank sites at the U.S Army Engineer Research and Development Center (ERDC) - Cold Regions Research and Engineering Laboratory (CRREL), 72 Lyme Road, Hanover, New Hampshire 03755. Work shall be in accordance with the Scope of Work outlined below.
Reoccurring Propane delivery is required to promote a healthy and safe work environment for heating buildings at the CRREL. The pricing for this contract will be set using a fixed margin cost per gallon of propane delivered on an auto-fill status. Pricing per gallon will be set at the Selkirk Wholesale Propane terminal cost the day of the delivery and the fixed margin cost will be added to each wholesale gallon cost of propane. It is not required that propane be purchased from the Selkirk Wholesale pipeline it will only be used as the price basis for the propane sold under this contract. (The fixed price margin cost shall be demonstrated in U.S. Currency per gallon $.00) The estimated propane usage per year is 15,000 gallons with the Option to increase the amount due to weather or added equipment that utilizes propane fuel.
CRREL requires the filling of seven (7) propane tanks at the Hanover, New Hampshire facility. Three (3) underground propane tanks are Government owned as specified below. The vender is required to provide 4 above ground propane tanks as specified below, any cost for vender provided tanks shall be included in the per gallon cost of propane. All seven (7) tanks require automatic recurring filling of tanks that shall be monitored by the awarded vendor and filled when the vendor deems necessary in a manner not to allow the Government to run dry of propane, and not to exceed the contracted amount. (AUTO DELIVERY). If any tank runs dry the Contractor will be responsible for filling the tank and restarting all associated equipment at no cost to the government.
Government owned underground tanks:
-Two (2) 500 gallon tanks at the Main Lab and RS/GIS Facilities -One (1) 1,000 gallon tank at the Greenhouse Facility Contractor supplied above ground tanks:
-Two (2) 500 gallon tanks at the Mobility Lab and Asphalt Lab Facility -Two (2) 125 gallon tanks at the E9-1-1 Facility
PRE-PERFORMANCE
The Contractor shall verify all aspects of services and contractor provided tank installation prior to performing any work and shall report any discrepancies to the Contracting Officer Representative (COR) including any resulting impact on the job. Contractor provided tanks shall be provided in a way not to interrupt the supply of propane to the facilities. The contractor shall submit a delivery plan to be approved by the COR for the delivery and installation of contractor provided tanks. Where applicable, the Contractor shall provide Material Safety Data Sheets.
| 2. | PERFORMANCE REQUIREMENTS SUMMARY. The Contractor’s performance requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success. [See Performance Requirements Summary (PRS) -- Appendix A] | |
| 3. | GOVERNMENT FURNISHED PROPERTY AND SERVICES The Contractor will be provided access to potable water. | |
| 4. | GENERAL INFORMATION. | |
| The Contractor shall develop and implement procedures to identify, prevent, and ensure quality compliance. As a minimum the Contractor shall develop quality control procedures addressing how the areas identified in the Appendix A, and a work schedule that captures all known requirements. | ||
| 4.2. | QUALITY ASSURANCE. The government will evaluate the Contractor’s performance in accordance with the PRS. | |
| 4.3. | HOURS OF OPERATION. Normal hours at USACRREL are Monday thru Friday from 0700 to 1600 excluding Federal holidays. Contract services shall be performed during normal working hours unless written otherwise specified in the contract or authorization is received from Contracting Officer (KO) or COR; or an emergency condition arises and the contractor is notified by the KO or COR. |
4.4 . SPECIAL EVENTS. The contractor will be notified by the COR of the event dates a week in advance to allow time for rescheduling of services.
4.5. CONTRACTOR LIABILITY. Government-owned or privately owned property damaged by the Contractor's operations under this contract shall be replaced or repaired to original condition by the Contractor at no additional cost to the Government.
| 4.6. | SECURITY REQUIREMENTS. | |
| 4.6.1. | U.S. Citizens. Contractor personnel must be U. S. citizens. All Contractor personnel are required to sign in with Security to obtain and wear security identification badges. A picture ID is required. Contractor personnel shall follow all sign-in and security regulations as directed by the CRREL Security Office and the TPOC. | |
| 4.6.2. | No Weapons Allowed. All persons and vehicles entering a US Government facility are subject to inspection for firearms, explosives and dangerous weapons, per RA 190-22. | |
| 4.6.3. General security requirements and guidance: The security requirements described below apply to all contract personnel (including employees of the prime Contractor (“Contractor”) and all subcontractor employees) supporting the performance requirements of this contract. The Contractor is responsible for compliance with these security requirements. Questions regarding security matters shall be addressed to the designated Government representative (e.g., Contracting Officer Representative (COR), Requiring Activity (RA) representative, or Contracting Officer (if a COR or other RA representative is not appointed)). Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE) installations, facilities and activities, and security awareness training contributes to those efforts. The Department of Defense (DoD) and Army security training requirements specified below, if applicable, are performance requirements; all applicable contract personnel shall complete initial training within 30 days of contract award or the date new contract personnel begin performance on the contract. Within five business days from the completion of training, the Contractor shall provide written documentation (e.g., email or memorandum) to the Government representative. The documentation shall include the names of contract personnel trained and which training they completed; the Contractor shall maintain training records as part of their contract files and be prepared to provide copies of training certificates to the Government representative. Contractor personnel and vehicles are subject to search when entering federal installations. Additionally, all contract personnel shall comply with Force Protection Condition (FPCON) measures, Random Antiterrorism Measures (commonly referred to as “RAMs”), and Health Protection Condition (HPCON) measures. The Contractor is responsible for meeting performance requirements during elevated FPCON and/or HPCON levels in accordance with applicable RA plans and procedures --this includes identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by the changes clause of this contract, should the FPCON or HPCON levels at any individual facility or installation change, the Government may implement security changes that affect contract personnel. The Contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identified in local policies or procedures. |
4.6.4.Physical security and access control requirements: All contract personnel requiring physical access to a federal installation or facility shall comply with the access control procedures of that location. Contract personnel requiring unescorted access to meet contract performance requirements on a DoD installation in the US shall be vetted by the installation/facility Provost Marshal/Directorate of Emergency Services/Security Office using the National Crime Information Center-Interstate Identification Index (commonly referred to as “NCIC-III”) and Terrorist Screening Database (commonly referred to as “TSDB”). Contract personnel shall comply with all personal identity verification requirements specified in installation/facility policies and procedures. Contract personnel who do not meet requirements for unescorted access to USACE facilities shall coordinate escorted access with the Government representative, as needed. Contract personnel who receive keys, access cards, or lock combinations that provide access to government-owned property shall comply with key and lock control procedures of the RA.
4.6.5. Suspicious Activity Reporting training (e.g. iWATCH, CorpsWatch, or See Something, Say Something): All contract personnel shall receive initial and annual refresher training from the RA representative on the local suspicious activity reporting program. This locally developed training provides contract personnel with general information on suspicious behavior, and guidance on reporting suspicious activity to the project manager, security representative or law enforcement entity.
4.6.6. Pre-screen candidates using E-Verify Program: Contractors shall comply with the requirements set forth in FAR clause 52.222-54 Employment Eligibility Verification and FAR Subpart 22.18 in using the E-Verify Program at (https://www.e-verify.gov/) (website subject to change) to meet the contract employment eligibility requirements. Contractors are encouraged to cooperate with Federal and State agencies responsible for enforcing labor requirements to include eligibility for employment under United States immigration laws in accordance with FAR 22.102-1(i). An initial list of verified/eligible candidates shall be provided to the COR no later than three business days after the initial contract award. When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, and submit it to the Contracting Officer to become part of the official contract file.
| 4.7. | SAFETY REQUIREMENTS. | ||
| 4.7.1. | Safety Regulations. Safety shall be in accordance with applicable provisions of U.S. Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1, available at http://www.usace.army.mil/CESO/Documents/EM385-1-1FINAL.pdf/ for review, and OSHA 29 CFR 1910 regulations, which covers personal protective equipment. All applicable state and federal safety regulations relating to protection of eyes, other extremities, and hearing protection shall be followed. Machinery and equipment shall be operated in accordance with the manufacturer’s instructions and recommendations. Ensure operation of machinery and equipment does not jeopardize pedestrian safety, use. | ||
| 4.7.2. | Accident Prevention Plan. Contractor shall prepare and submit an Accident Prevention Plan (APP) to the COR for approval by the USACRREL Safety Office seven (7) calendar days prior to the pre-performance meeting. The APP shall focus on the Contractor's Safety Programs and shall be site specific to the work being performed. This plan will be a statement of the company’s policy concerning accident prevention and any other guidance statements normally furnished new employees. The minimum basic outline for an Accident Prevention Plan is spelled out in EM 385-1-1 and attached in Appendix C. | ||
| 4.7.3. | Employee Safety Awareness. In order to help promote safety awareness, the Contractor shall insure that each employee reviews the Accident Prevention Plan prior to beginning work. | ||
| 4.7.4. | Operating Vehicles. Contractor personnel shall wear seatbelts at all times when driving on CRREL premises. Contractors shall obey speed limit of 10 mph. Contractor vehicles shall be equipped with back-up alarms. Particular care shall be used while operating vehicles in the Child Development Center parking area where small children will be entering and exiting. FAR clause 52.226-8 Encouraging Contractor Policies to Ban Text Messaging While Driving is applicable to this contract. | ||
| 4.7.5. | Material Safety Data Sheets. The Contractor shall provide Material Safety Data Sheets (MSDS’s) for any products or materials brought on the facility for use in the performance of this contract (e.g. ice melt, weed killer, etc…). No product may be used without the prior approval from the TPOC. | ||
| 4.7.6. | No Smoking. There is no smoking allowed in any ERDC building or facility, or within 50 feet of any building entrance. A designated smoking shack is located by the north FE parking lot. | ||
| 4.8. | Post Award Orientation. Prior to beginning any work under this contract, the Contractor shall meet formally with the Contracting Officer and/or TPOC/COR at a time, date and location established by the TPOC/COR for the purpose of coordinating the initiation of work. The Contractor and his/her Authorized Representative (if one is to be appointed) shall be present at this meeting. An Authorized Representative must be capable of making decisions on behalf of the company. |
APPENDIX A
PERFORMANCE REQUIREMENT SUMMARY (PRS)
FOR
SNOW AND ICE REMOVALSERVICES
INTRODUCTION
| A performance requirement summary (PRS) has been developed to evaluate contractor actions while implementing this PWS. It is designed to provide an effective surveillance method of monitoring contractor performance for each listed objective. |
| The PRS provides a systematic method to evaluate the services the contractor is required to furnish. This PRS is based on the premise that the Government desires to maintain a quality standard in the performance of the required services and that a service contract to provide the service is the best means of achieving that objective. |
| The contractor, and not the Government, is responsible for management and quality control actions to meet the terms of the contract. The role of the Government is quality assurance to ensure contract standards are achieved. |
| In this contract the quality control program is the driver for product quality. The contractor is required to develop a comprehensive program of inspections and monitoring actions. The first major step to ensuring a “self-correcting” contract is to ensure that the quality control program approved at the beginning of the contract provides the measures needed to lead the contractor to success. |
| Once the quality control program is implemented, careful application of the process and standards presented in the remainder of this document will ensure a robust quality assurance program. |
SURVEILLANCE: Government quality assurance (QA) is performed by the COR. Contract Deficiencies will be reported to the Contractor’s site supervisor, or Quality Control Inspector (if identified as different from the site supervisor), for correction. Customer complaints, although not considered a method of surveillance, will be investigated to establish validity. All valid complaints will prompt an inspection of the deficiency. It should be noted that the method of surveillance identified in the PRS table is intended to represent the primary method(s) anticipated for each requirement. However, the Government reserves the right to conduct quality assurance by any means necessary to ensure the requirements of the contract are being fully satisfied. ACCIDENT REPORTING: All accidents (whether injuries requires lost time or not) requiring medical attention, and property damage accidents in which the property exceeds $2,000 will be reported to the CRREL Safety Officer within 48 hours of accident. Accidents shall be reported using ENG Form 3394 available at http://www.usace.army.mil/inet/usace-docs/forms/engforms.htm. The contractor is also responsible for notifying the COTR who will notify the CRREL Safety Officer when one or more of their employees are severely injured, a fatal injury or when three or more persons are admitted to the hospital. ___________________________________
