About this file

This is a Small Business Enterprise (SBE) goal memorandum from the City of Tucson, Arizona, establishing procurement guidelines for Proposition 411 funded projects in fiscal year 2025. The memorandum, dated July 16, 2024, sets a standardized 4% SBE participation goal for all Prop 411 construction Invitations for Bid issued between July 1, 2024, and June 30, 2025, as well as for Contract #240056, a Roadway Construction Job Order Contract. The related project, IFB No. 250042 for Prop 411 Wards 2 & 6 Mill and Fill, involves comprehensive street resurfacing across nine neighborhoods totaling approximately 17.87 centerline miles and 342,017 square yards of roadway treatment. The scope includes milling and replacing existing asphalt with 2-inch low volume PAG Mix 2, constructing 169 ADA-compliant curb access ramps, installing 25 speed humps, and replacing 2 speed tables. A pre-bid meeting is scheduled for October 21, 2024, at 2:00 pm, with final bids due October 30, 2024, at 2:00 pm Arizona time. The project completion timeline is 240 consecutive calendar days from the notice to proceed, with a performance and payment bond requirement of 100% of the contract amount.

Prime contractors must submit a Subcontractors List and SBE Commitment Form demonstrating compliance with or exceeding the 4% SBE goal, or alternatively submit a Good Faith Efforts form documenting affirmative steps taken to meet the goal and seeking a waiver, in whole or in part. Identified subcontracting opportunities include concrete, underground utility, traffic control, and trucking trade areas, with all first-tier subcontractors and SBE subcontractors having contracts valued at or above $5,000 required to be listed. The project is funded through Proposition 411 and incorporates federal compliance requirements including domestic preference provisions and equal opportunity guidelines. Liquidated damages are set at $2,790 per calendar day of delay. Comprehensive insurance coverage is mandatory, including commercial general liability, commercial automobile liability, and worker's compensation. The Engineer's Opinion of Probable Cost is $10,314,917. Project Managers retain the discretion to request project-specific goals on a case-by-case basis if the scope would likely justify a goal exceeding 4%.

From: Lloyd Windle

Subject: Prop 411 Projects for FY25

The SBE Program has analyzed the SBE goals assessed on Prop 411 projects during FY24. The results indicate that the majority of projects were assessed an SBE Goal between 4% and 5%.

For FY25, the SBE Program is assessing a goal of 4% for all Prop 411 projects issued between July 1, 2024, through June 30, 2025. The goal is applicable for newly issued Prop 411 construction IFBs and for Contract #240056 – JOC for Roadway Construction.

The attached SBE Goal Memo authorizes the Project Manager (PM) to incorporate an SBE Goal of 4% into Prop 411 projects during this time period. Attached are the Prop 411 SBE Provisions.

The prime contractors (bidders) must submit the Subcontractors List and SBE Commitment Form demonstrating how they meet/exceed the goal and/or seek a waiver, in whole or in part, by submitting the Good Faith Efforts (GFE) form documenting the affirmative steps taken to meet the goal. Please note that the SBE program is not introducing any new provisions with the waiver as the GFE has always been available for bidders to submit.

On a case-by-case basis, the Prop 411 PM may request a project specific goal if in their professional opinion the specific scope of the project would likely provide for a goal in excess of 4%.

Sincerely, Lloyd B. Windle II, C.P.M., CPPO, CPPB Contract Administration Manager
