About this file

This is a Public Works Project Requirements document issued by the New Mexico Department of Workforce Solutions Labor Relations Division that outlines statutory and regulatory responsibilities for participants in public works projects valued at more than $60,000 in New Mexico. The document addresses obligations for three stakeholder categories: contracting agencies, general contractors, and subcontractors. All contractors and subcontractors bidding on public works projects exceeding $60,000 must maintain active registration with the Public Works and Apprenticeship Application (PWAA) website prior to bidding. General contractors are required to submit a complete Subcontractor List and Statements of Intent to Pay Prevailing Wages to the contracting agency within three days of award. The contracting agency must submit the Notice of Award and updated Subcontractor Lists to the PWAA website promptly and is responsible for closing the project in the PWAA system ninety days after project completion.

All subcontractors and tiers, excluding professional services, must comply with the Public Works Minimum Wage Act and pay prevailing wages regardless of contract amount. General contractors and subcontractors must ensure Public Works Apprentice and Training Act contributions are paid to either an approved Apprenticeship Program or the Public Works Apprentice and Training Fund, and must display the wage rate poster at the job site in an accessible location. Upon project completion, general contractors must submit Affidavits of Wages Paid to the contracting agency. Additional reference materials and forms are available through the New Mexico Department of Workforce Solutions Public Works web pages, and inquiries regarding public works projects should be directed to the Labor Relations Division at public.works@state.nm.us or (505) 841-4400.
