About this file
This document is a Justification for Sole Source Procurement under $250,000 for the National Institute for Occupational Safety and Health (NIOSH). The procurement is for a maintenance agreement with CompuCom, Inc. for the OpenText ApplicationXtender/WebXtender imaging software suite and associated Kodak i2900 scanner hardware used in the Respiratory Health Division's Electronic Archive System, which supports the Coal Workers' Health Surveillance Program (CWHSP). The 13-user system includes multiple software components such as ApplicationXtender, WebXtender, ScanXtender, and Pegasus Scanfix, along with five Kodak scanners.
CompuCom is the sole authorized maintenance provider for this region, with exclusive rights from OpenText to perform maintenance, software updates, license key management, and specialized diagnostic support. The procurement is justified by OpenText's exclusive authorized reseller structure, which prevents other vendors from legally or technically performing the maintenance. The base period of performance is from 12/1/2025 to 11/30/2026, and failure to award this maintenance agreement would jeopardize NIOSH's compliance with statutory requirements of the Coal Mine Health and Safety Act by preventing the CWHSP archive system from remaining operational.

Base Period: 12/1/2025 to 11/30/2026
D. Justification:
1. The justification for this non-competitive action is:
In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”
Urgency
Exclusive licensing agreements/Proprietary data
Brand name required
Industrial mobilization
Other (e.g., compatibility, space issues, continuity, compatibility, etc.)
In accordance with FAR 8.405-6 “Limiting Sources” which states that, “the only circumstances that may justify the action are – (A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays; (B) Only one source is capable of providing the supplies or services required at the level of quality required

Rev. 5/14/19 because the supplies or services are unique or highly specialized; or (C) In the interest of economy and efficiency, the new work is a logical follow-up to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original BPA must not have been previously issued under sole-source or limited-sources procedures.”
Urgency
Only One Source
Logical Follow Up
Brand name required
2. Other facts supporting sole source procurement:
a. What can this product/service do that other products/services cannot do?
OpenText software and the associated ApplicationXtender imaging components require OEM-authorized maintenance, software updates, license key management, and specialized diagnostic support that only CompuCom is authorized to provide in this geographic region. OpenText permits only one authorized reseller per region, and CompuCom is the exclusive authorized provider for Southwestern Pennsylvania, Northwestern West Virginia, and Southeast Ohio. As a result, only CompuCom has access to the proprietary support tools, software update servers, license management utilities, and OEM-provided technical resources necessary to maintain the CWHSP archive system.
In 2003, NIOSH obtained approval from the previous OEM (Legato) to transfer our account to CompuCom due to the failure of the prior reseller to meet support requirements. Subsequent acquisitions by EMC2 and OpenText did not change CompuCom’s exclusive authorization. CompuCom provided an updated sole source letter on October 3, 2024 confirming that they remain the only authorized maintenance provider for this system.
Their continued support is essential to ensure the availability, security, and operational integrity of the CWHSP imaging and archival system mandated under federal statute. No other vendor can legally or technically perform this maintenance..
b. What other products/services were considered and why did they not meet the need?
No other vendors were considered because OpenText maintains an exclusive authorized reseller structure and CompuCom is the only provider authorized to deliver maintenance services for OpenText ApplicationXtender software and the integrated Kodak scanner environment in our region. Using a non-authorized vendor would void support rights, prevent access to necessary software updates, and risk system failure. Therefore, only CompuCom can meet the requirement.
3. Program Office efforts to seek potential offerors:
No additional market research was performed because OpenText requires that all maintenance be performed through an OEM-authorized reseller, and CompuCom is the sole authorized provider for this region. Market research cannot identify an alternative vendor capable of performing OEM-authorized support.
Failure to award this maintenance agreement would prevent NIOSH from keeping the CWHSP archive system operational, jeopardizing compliance with statutory requirements of the Coal Mine Health and Safety Act.
