1.0 Introduction.

This is a non-personal services contract to provide Custodial Services at Katterbach Heliport Kaserne, Bismarck Kaserne, Shipton Kaserne and Urlas Area, Barton Barracks, Bleidorn Kaserne, Illesheim Kaserne and Oberdachstetten Franken Kaserne, USAG Ansbach. The Contractor shall perform to the standards specified in this Performance Work Statement (PWS).

Contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government. The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary as defined in this PWS. The Contractor is responsible for providing all approved and calibrated equipment and man power for basics service.

1.1 Background

Cleaning services are required to perform all required cleaning services IAW PWS such as restroom cleaning, offices and common use areas, basic cleaning services and window cleaning at Ansbach Barton- and Bleidorn Kaserne, Katterbach Heliport and Bismarck Kaserne, Shipton Kaserne, Urlas Area, Illesheim Storck Barracks, Oberdachstetten Franken Kaserne as well as Gymnasiums at Katterbach Kaserne and Storck Barracks Illesheim, USAG Ansbach. 1.2.1 Objectives

1.2.1 Work Responsibility

The Contractor shall perform all work and assume responsibility for planning, programming, administering, managing, and executing all functions necessary to provide the services specified in this PWS. The Contractor shall conduct work in accordance with this PWS and all applicable United States (U.S.), German, and local laws, regulations, standards, provisions, and directives to include applicable publications in Part 6.

The Contractor shall ensure that all work meets the level of service, performance standards, or tolerances specified in the PWS or in applicable referenced documents. The Contractor shall provide all the labor, materials, tools, equipment, and supervision to perform this requirement per the scope of work specification for the custodial with other related services.

1.2.2 Administrative Responsibility

The Contractor shall perform all related administrative actions required to provide services or perform work such as material requisitioning, quality control (QC), financial control, meetings, and correspondence. The Contractor shall also maintain accurate and complete records, files, and libraries of documents to include all U.S. German, and local regulations, standards, provisions, codes, laws, technical manuals, and manufacturers’ instructions and recommendations that are necessary and related to the functions being performed. The Contractor shall compile historical data, prepare required reports, and submit information as specified by the Deliverable List presented in this PWS.

1.3 Climatic Conditions. N/A

1.4 Facility Access

Access to U.S. installations and controlled areas is limited to personnel who meet security criteria and are authorized by Host Nation law to work in that country. Failure to submit required information/data and obtain required documentation or clearances in accordance with Army in Europe (AE) Regulation 190-16 (AE Reg 190-16) Installation Access Control or (AE) Regulation 604-1 for Germany specific contracts, will be grounds for denying access to U.S. installations and controlled areas. The Contractor shall ensure that any subcontractors used in performance of this contract complies with these requirements and that all employees, of both the Contractor and any subcontractor utilized by the Contractor, are made aware of and comply with these requirements. Should anything in this paragraph conflict with AE Reg 190-16 or (AE) Regulation 604-1, the regulation takes precedent. The Contractor shall be aware of and comply with the requirements associated with Installation Access Control. The Government is not liable for any costs associated with performance delays due solely to a firm’s failure to comply with installation Access Control System (IACS) processing requirements.

The Contractor shall return installation passes to the issuing IACS office when the contract is completed or when a Contractor employee no longer requires access.

1.4.1 Key Issue / Key Control

The Contractor shall establish and implement methods of making sure all keys/key cards issued to the Contractor by the Government are not lost or misplaced and are not used by

P a g e 5 | 29 unauthorized persons. NOTE: All references to keys include key cards. No keys issued to the Contractor by the Government shall be duplicated. The Contractor shall develop procedures covering key control that shall be included in the Quality Control Plan. Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas.

The Contractor shall immediately report any occurrences of lost or duplicate keys/key cards to the Contracting Officer. In the event keys, other than master keys, are lost or duplicated, the Contractor shall, upon direction of the Contracting Officer, re-key or replace the affected lock or locks; however, the Government, at its option, may replace the affected lock or locks or perform re-keying. When the replacement of locks or re-keying is performed by the Government, the total cost of re-keying or the replacement of the lock or locks shall be deducted from the monthly payment due the Contractor. In the event a master key is lost or duplicated, all locks and keys for that system shall be replaced by the Government and the total cost deducted from the monthly payment due the Contractor. The Contractor shall prohibit the use of Government issued keys/key cards by any persons other than the Contractor’s employees. The Contractor shall prohibit the opening of locked areas by Contractor employees to permit entrance of persons other than Contractor employees engaged in the performance of assigned work in those areas, or personnel authorized entrance by the Contracting Officer. The Contractor shall establish and implement methods of ensuring that all lock combinations are not revealed to unauthorized persons. The Contractor shall ensure that lock combinations are changed when personnel having access to the combinations no longer have a need to know such combinations. These procedures shall be included in the Contractor’s Quality Control Plan.

2.0 Requirements

2.1 Description of Services.

Reference is made to Technical Exhibit 01 – Common Level of Support - CLS 402 for the specific description of services to be accomplished under this contract respectively Performance Work Statement

2.1.1 Non-Personal Services.

The personnel rendering services under the subject contract, either by the contracts terms or the manner of its administration, are not under the supervision or control usually prevailing in a relationship between the Government and its employees. Non-personal service contracts are authorized by the Government in accordance with (IAW) Federal Acquisition Regulation (FAR) Subpart 37.104, under general contracting authority, and do not require specific statutory authorization.

2.2 General Information.

2.2.1 Transition (Phase In/Phase Out).

A Phase In/Phase Out transition period will not be used for this action.

2.2.2 Period of Performance (POP)

Reference the contract for details pertaining to the Period of Performance.

2.2.3 Place of Performance and Hours of Operation.

Semi & Annual Cleaning Requirements to prevent loss of working hours to ensure continuous work flow services shall be performed according to customer’s request, i.e. either after duty hours and on weekends, or during regular working hours. The appointments have to be made by the Project Supervisor with the building coordinator, prior to performance of all semi and annual cleaning (a minimum 1 week in advance). A list of the semi and annual cleaning-appointments shall be submitted to the COR. The same appointed Project Supervisor shall be

P a g e 6 | 29 present during basic cleaning at all times, to inspect and monitor the cleaning. Inspection reports shall be submitted to the COR after cleaning services have been performed at the individual locations. If deficiencies are found by the COR or Government Inspector, the Contractor shall re-perform the cleaning the next working day. Cleaning will be except when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. For other than Delivery Type Contracts, the Contractor will not be reimbursed when the government facility is closed for the above reasons.

The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.

2.2.3.1 Place of Performance.

The work to be performed under this contract will be performed at USAG Ansbach Military Communities to include:

Katterbach Heliport Kaserne Katterbach Bismarck Kaserne Shipton Kaserne and Urlas Area Ansbach Barton Barracks Ansbach Bleidorn Kaserne Illesheim Storck Barracks Oberdachstetten Franken Kaserne CDC/CYS Katterbach Gym Katterbach Gym Illesheim

2.2.3.2 Hours of Operation.

The Government facility office hours, facility operating hours, and the Contractor support hour requirements often coincide, however, they may differ. Please refer to the following.

Government Facility Office Hours: The Government facility office hours are from 07.30 hours through 16.00 hours, Monday through Friday except U.S. Holidays identified in paragraph

2.2.3.4 or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings.

Government Facility Operating Hours: The Government facility operating hours occur between the hours of 07.30 hours through 16.00 hours, Monday through Friday.

The Government facility is the Government facility is open for operations during the recognized U.S. Holidays identified in paragraph 2.2.3.6. The Government facility may close due to local or national holidays, emergencies, administrative closings, or similar Government directed facility closings and will be communicated by the COR to the Contractor.

Contractor Support Hours: The Contractor shall provide support between the hours of 07.30 hours through 16.00 hours, Monday through Friday when the facility is open during local or national emergencies, administrative closings, or similar Government directed facility closings.

The Contractor shall at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential. For other than firm fixed price contracts, the

Contractor will not be reimbursed when the Government facility is closed for the above reasons.

At Gymnasiums, the contractor shall provide day services between 1000 – 1400 hrs (4 hrs) Monday thru Friday and between 1000 – 1400 hrs Saturday and Sunday. The regular cleaning shall be performed after normal duty hours (2100 hrs) Monday thru Friday.

CDC/CYS: the contractor shall provide services between 0900 – 1400 hrs (5 hrs day service) and regular service between 1800 – 2200 hrs. Monday thru Friday.

Regular Cleaning services for locations other than CDC/CYS and Gyms shall be provided between 0700 and 1400 hrs and weekends between 1000 – 1400 hrs (4 hours day service).

2.2.3.3 Installation Closures.

When an unforeseen installation closure occurs on a regularly scheduled day of work, the Contractor shall reschedule the work to be performed the following day unless the following day is a Saturday, Sunday, a recognized Federal or US holiday (Refer to para. 2.2.3.6), and when routine work is not scheduled for that day; or reschedule the work for the next business day following the closure.

2.2.3.4 Federal Holidays.

U.S. Holidays:

Work shall be performed on U.S. holidays occurring during the normal workweek unless otherwise directed by the Contracting Officer. When a U.S holiday occurs on a Saturday or a Sunday, the holiday is observed on the preceding Friday or following Monday, respectively.

Contractor is not required to work on U.S. holidays which falls on the same day as the Host Nation Holidays.

Host Nation Holidays:

Work shall not be performed on local Host Nation holidays occurring during the normal workweek unless otherwise directed by the Contracting Officer.

German national and local holidays are:

2.3 Emergency Services.

2.3.1 Emergency Medical Treatment.

The Contractor or their employees shall immediately notify their supervisor of any accident

P a g e 8 | 29 requiring emergency medical treatment. The Contractor shall notify the COR the same day the accident happened. The Contractor shall be responsible for the emergency medical treatment services for Contractor personnel. (Deliverable A001)

2.3.2 Accident Reporting.

The Contractor shall provide a verbal report to the COR the same day the accident happened. A typed original report shall be delivered to the COR within five (5) business days of occurrence, whenever an accident involving personal injury or Government owned property occurs.

2.4 Contract Administration and Management.

2.4.1 Post Award Conference/Performance Evaluation Meetings.

The Contractor shall attend any post award conference convened by the contracting activity or contract administration office in accordance with FAR Subpart 42.5. The Contracting Officer, COR, and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. At these meetings the Contracting Officer will apprise the Contractor of how the Government views the Contractor's performance and the Contractor shall apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the Government.

2.4.1.1 The Contractor shall attend, participate in, and furnish input to scheduled and unscheduled meetings, conferences, and briefings that relate to the functions and services herein as required by the Government to provide effective communication and impart necessary information. The Contract Manager or designated representative shall attend meetings as requested by the Government. Meeting attendees shall at times include Contractor managerial, supervisory, and other personnel knowledgeable of the subject matter. Meetings may start or end outside of regular duty hours. If no post-award conference is conducted, contractor shall provide all Post-Award deliverables within 10 days after contract award.

2.4.2 The following provides the roles and their respective authority during the performance of the contract:

2.4.2.1 Contracting Officer (KO).

The KO is the only person authorized to make any changes in any of the requirements listed on this PWS; notwithstanding any provisions contained elsewhere in this contract, said authority remains solely with the KO. In the event the Contractor makes any change at the direction of any person other than the KO, the change will be considered to have been made without authority and solely at the risk and expense of the Contractor. All contract administration will be effected by the KO. Communications pertaining to contractual administrative matters shall be addressed to the KO. No changes in or deviations from the terms and conditions shall be effected without a written modification to the contract, executed by the KO authorizing such changes. The KO will approve all submittals and plans required in this PWS.

2.4.2.2 Contracting Officer’s Representative (COR).

The KO will appoint a COR during the performance of this requirement. Additional Government personnel may be designated to assist in contract oversight IAW (Army Regulation) AR 70-13, Management and Oversight of Service Acquisitions. Other surveillance personnel may be designated as COR and shall be trained and appointed IAW Department of Defense Instruction

(DoDI) 5000.72, Department of Defense (DoD) Standard for Contracting Officer’s Representative (COR) Certification. The COR will provide assistance in identification and resolution of problems, conflicts in priority, subtask requirement definitions, and other operations type problems. The COR will perform IAW the responsibilities and duties identified in the appointment letter.

2.4.2.3 COR Authority.

A letter of designation will be issued to the COR by the KO. A copy of the letter will be sent to the Contractor. The letter of designation states the responsibilities and limitations of the COR, especially with regard to changes in cost, price estimates, or changes in delivery dates. The COR is not authorized to change any of the terms and conditions with regard to cost, quantity, or schedule of the resulting order.

2.4.2.4 COR Functions.

The COR shall monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: assure the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the Contractor concerning technical aspects of the contract; issue written interpretations of technical requirements; monitor, document, and report Contractor's performance and notify both the KO and Contractor of any deficiencies; coordinate availability of Government-Furnished Property, and provides direction or assistance for site entry requests of Contractor personnel.

2.4.2.4.1 The Contractor shall not in any way represent the United States (U.S.) Government, or that it has the authority to contract or procure supplies for the account of the United States of America (USA).

2.4.3 Contractor Key Personnel.

Shall be designated in writing to the COR within five (5) days after contract award. The key personnel shall be available as specified within Paragraphs 2.4.3.1. The individuals designated as key personnel shall be able to understand, speak, read, and write the German and English language. (Deliverable A003)

2.4.3.1 Project Manager.

The Contractor shall perform continual management of the functional areas contained in this PWS and shall provide a Project Manager physically present on site during normal duty hours between 0700 – 1600 hrs. The Project Manager has to instruct and supervise his / her cleaning personnel and perform QC Inspections (partially together with the COR / QAE), if necessary.

The supervisor shall report daily prior to start of work to the COR that he / she is available and submit daily an inspection report to the COR which areas / buildings were controlled during or after cleaning service are provided. The Contractor supervisor shall be able to communicate in German and English language.

The Contractor shall perform continual management of the functional areas contained in this PWS and shall provide a Project Manager physically present on-site during normal duty hours.

The Project Manager shall conduct overall management coordination and shall be the central point of contact (POC) with the Government for performance of all work under the PWS. At the Post Award conference, the Contractor shall submit to the COR, in writing, the name, title, office, home and mobile telephone number of the Project Manager. A Contractor employee shall be designated to act for the Project Manager when work is being performed outside of duty hours, or during the Project Manager’s absence. Both the Project Manager and the Contractor

P a g e 10 | 29 employee filling in for the Project Manager, shall have full authority to act for the Contractor on all Contract matters relating to daily operation of this Contract. The Project Manager shall be available via email and cell phone during normal duty hours.

The Contractor shall be registered in this trade as a “Meisterbetrieb” and shall assign a qualified and skilled Project Manager and also a qualified and skilled Contract Manager in the building cleaning trade to act as “Contractor’s Agents” on site. Project Supervisor that will be assigned to this contract shall have a “Gesellenbrief”. The representative shall be accessible during normal duty and after work hours and have full authority to act for the Contractor on all matters relating to Contractor operations on this contract. Certificates shall be submitted to the Contracting Specialist at time of offer.

2.4.3.2 Quality Control Manager (QCM)

The Contractor shall designate a QCM performing on-site inspection during normal duty hours.

At a minimum, the QCM shall possess work experience in process control, quality data analysis, quality auditing, statistical sampling, and subcontractor quality control. The QCM shall have at least two (2) years of relative experience, and shall be responsible for the overall management and implementation of the Contractor's Quality Control Plan. Supporting documentation demonstrating the QCM relative experience of two (2) years shall be provided to the COR within thirty 30 days after award. (Deliverable A009)

2.4.4 Contractor Requirements.

2.4.4.1 Qualification Standards.

2.4.4.1.1 Special Qualifications / Certifications:

Prime Contractor: The work asked for in this PWS is to be accomplished by a contractor compliant to DIN ISO 9001 and DIN ISO 14001.

2.4.4.2 Contractor Identification.

The Contractor shall ensure that personnel be identified as a Contractor to distinguish themselves (e.g., badge, company logo, or uniform) from Government employees. The Contractor shall ensure that all correspondence, documents or reports produced by Contractors are suitably marked as Contractor products or that Contractor participation is appropriately disclosed Contractor owned/leased vehicles and equipment should be identified.

2.4.4.2 Standards of Conduct.

Contractor personnel’s conduct shall not reflect discredit upon the Government. The Contractor shall ensure all personnel present a professional appearance while working on the Government installation. The Contractor’s employees shall observe and comply with all local policies and procedures concerning fire, safety, environmental protection, sanitation, security, and possession of firearms or other lethal or illegal weapons or substance. The Contractor shall ensure all Contractor employees, providing services under this contract, conduct themselves and perform services in a professional, safe, and responsible manner. The Contractor shall remove, from the job site, any employee for reasons of misconduct or security. The Contractor shall ensure employee conduct complies with 41 USC 423, Procurement Integrity. The Contractor shall also ensure that no Contractor employees conduct political related activities or events on the installation. The removal of such a person shall not relieve the Contractor of the requirement to provide personnel to perform adequate and timely service.

2.4.4.3 Contractor Hiring Restrictions.

The Contractor shall not hire or sub-contract with off-duty or former Government employees whose employment would result in a conflict with AR 600-50, Standards of Conduct.

2.4.5 Business Relations.

The Contractor shall successfully integrate and coordinate all activity needed to execute the requirement of this PWS. The Contractor shall manage the timeliness, completeness, and quality of problem identification to a degree acceptable to the Government. The Contractor shall provide to the KO corrective action plans, timely identification of issues, and effective management of subcontractors. The Contractor shall ensure customer satisfaction and professional and ethical behavior of all Contractor personnel.

2.4.6 Cleaning Personnel

Contractor personnel shall act in a professional manner (Professionalism implies the proper handling of oneself in the workplace, adhering to regulations / policies, performing the job diligently and conscientiously, fulfilling duties to the best of one’s ability, being punctual, maintaining a businesslike attitude and demeanor, holding oneself to the highest possible standards of character and behavior proper to the field of employment, and presenting a neat, clean appearance.) All contractor personnel entering the government installation shall abide by the regulations of the installation. The Government reserves the right to request replacement of any Contractor employees.

2.4.6.1 Personnel Training

The Contractor shall provide the following types of employee training applicable to cleaning contracts:

2.4.6.1.2 Orientation Training

Orientation Training covering the topics below shall be started and completed within two (2) weeks prior starting work for all employees who have never received orientation training.

Employee(s) not previously trained in housekeeping may not be assigned to work until this training requirement is completed and submitted and approved by the COR. Employees who have had previous housekeeping training are required to complete retraining and / or specified training within two weeks after starting work. Orientation training shall include but not be limited of the following topics:

Proper care of preventive maintenance of Contractor and Government furnished equipment Proper handling and storage of chemical cleaning products Familiarization with local fire preventions, environmental and key control procedures Familiarization with local recycling and security procedures Familiarization with all contractor printed technical and procedural manuals Duties of each employee, and techniques for measuring quality of work performance Adherence to all work schedules

2.4.6.1.3 Training Records: Records of all employee training shall be documented and maintained by the Contractor. These records are subject to inspection by the COR.

2.5 Work Management.

Work requirements and timelines shall include coordination with the COR and DPW O & M Branch.

2.5.1 Coordination.

As a part of the work scheduling process, the Contractor shall coordinate all work with the DPW, O & M POC in charge of the facility where the work is to be done.

2.5.2 Disposal.

All refuse generated by this Contract shall be legally disposed of, meeting all Federal, State, county, and Installation guidelines for disposal (including disposal of hazardous materials).

Hazardous waste materials shall be disposed of IAW applicable Federal, State, and local statutes. Refuse shall be disposed of on a regular basis in order to ensure a neat and orderly appearance of the Contractor's area of responsibility and its surrounding areas. Roll-offs shall be used for large quantities of refuse. Large and bulk items shall be broken down to maximize the roll off dumpsters’ capacities. The burning of debris, waste material, and other salvageable items is prohibited on the Installation. The Contractor may be able to use Government provided recycling containers as available strictly for recyclable materials accepted by the Recycling Service Contract in effect at the time. Papers, plastics 1-7, aluminum and tin cans shall be recycled. Any misuse of the recycling containers shall be corrected by the Contractor as directed by the DPW or the applicable Quality Recycling Program (QRP) representative, the recycling contractor, or the COR.

2.5.3 Environmental Requirements.

The Contractor shall comply with all Environmental (ENV) Standards and Regulations.

2.5.3.1 Maintenance of Work Site.

The Contractor shall remove from the work area, at the end of each day and completion of the job, all waste, material, and by-products resulting from work performed. If applicable, the Contractor shall return usable material to a designated storage area for reuse. The Contractor shall ensure all job sites are secured during inclement weather to avoid damages or windblown materials.

2.14 Security

2.14.1 Access and General Protection/Security Policy and Procedures.

The Contractor and all associated subcontractors employees shall comply with applicable installation, facility, and local security policies and procedures. The Contractor workforce shall comply with all personal identity verification (PIV) requirements as directed by DOD, Headquarters Department of the Army (HQDA), and local policy. The KO/COR will request

P a g e 13 | 29 changes in Contractor security matters or processes if the Force Protection Condition (FPCON) at any individual facility or installation changes.

2.14.2 Rules, regulations, direction, and requirements issued by the Commander apply to the Contractor.

The Contractor shall become acquainted with and comply with all Government regulations as posted, or as required by the KO. Regulations, manuals, and technical documents applicable to this Contract are listed in Section 6.0 of this PWS. Control for classified publications requirements can be located in AR 380-5, Department of The Army Information Security Program, and secured in a filing type cabinet with a built-in locking device with tumblers and General Services Administration (GSA) approved security container.

2.14.2.1 Contractor Vehicle Registration.

Contractor and all associated subcontractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by DES) IAW Army Directive 2014-05. The Contractor shall provide all information required for background checks to meet installation access requirements, to be accomplished by the installation Provost Marshall Office or DES, or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes. 2.15 Security Training.

2.15.1 iWATCH Training.

The Contractor shall brief the local iWATCH program (training standards provided by the USAG Bavaria ATO to all of Contractor’s employees and associated subcontractors. This training is used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the USAG Bavaria Military Communities, Police Department and the COR.

The Contractor shall complete the training within 30 calendar days after contract award and within 30 calendar days of new employees commencing performance and send to the COR via both electronic and paper copy within 30 calendar days of completion. 2.16 Safety.

The Contractor shall safeguard and maintain all Government and Contractor property, as well as provide for the safety and well-being of personnel employed under this contract.

2.16.1 Safety Plan. N/A

2.16.2 Occupational Safety and Health (OSHA).

The Contractor shall comply with the Occupational Safety and Health Administration (OSHA) standards and all pertinent provisions 29 CFR Part 1910, Part 1917.152, Part 1915.501-509, and Part 1926; Federal and State environmental regulations.

2.17 Training, Physical Requirements, or other Expertise Required. N/A

2.18 Recycled Content Materials.

2.18.1 Environmental Compliance.

The Contractor shall comply with all Federal, State, local, and installation environmental laws, rules and plans. The Contractor shall use, store and dispose of all materials, chemicals, and equipment used in the performance of services on the installation IAW with industry standards, local, Federal and State laws, and according to manufacturers’ recommendations. The Contractor shall be financially liable for all fines and associated costs for non-compliance with local, Federal and State laws regarding hazardous waste management including but not limited to: hazardous materials spillage, improper handling and transportation and improper waste disposal. The Contractor shall make all environmental and hazardous material records available upon request from the KO or COR.

2.18.1.1 For materials that have Material Safety Data Sheets (MSDS) associated with them, the Contractor shall submit the SDS to the COR for approval five (5) business after contract award. The Contractor shall adhere to all applicable requirements of the Installation Hazardous Waste Management Plan. The Contractor shall provide all materials, labor, training, transportation, and equipment for the handling and storage of hazardous materials.

2.18.5.2 The Contractor is responsible to ensure that no goods and services used by the Contractor or any of its subcontractors deviate from USAG Bavaria Environmental Division Environmental Policy.

2.18.5.3 Compliance with Environmental Laws and Regulations: Contractor shall comply with all applicable Federal, State, and local environmental laws, statutes, regulations, executive orders, permits, Army regulations (with supplements), and European DIN, VDE and ISO regulations. Contractor shall immediately report any conflicts between applicable Federal, State, local environmental laws, statutes, Executive Orders, AR 200-1, and any specifications within this contract to the KO and COR. Any questions regarding EMS may be directed to the Installation EMS Coordinator or Contracting Officer’s Representative.

3.0 Performance Requirements and Standards.

3.1 Quality Assurance.

The Government will evaluate the Contractor’s performance under the contract IAW the Government’s Quality Assurance Surveillance Plan (QASP). The Performance Requirements Summary (PRS) defines the criteria of how the Contractor’s performance will be evaluated, the frequency of surveillance, and the items to be inspected. Although the Government will develop a QASP, Government surveillance of Contractor performance is not limited to the QASP, or the performance objectives, outlined in the PRS. The Government retains the right to evaluate all services required by the contract. The Government will perform inspections and tests in a manner that will not unduly delay the work.

Government Inspection Method:

(a) Unscheduled Inspections: The COR may inspect the Contractor’s performance with unscheduled inspections.

(b) Planned Inspections: The COR will monitor the Contractor’s performance using the monthly work schedule with the work time specified. At the time service shall be completed, the inspection will be performed. However, if services are accomplished after duty hours of the Government, the inspection will take place immediately at the beginning of the next following workday.

3.2 Quality Control Plan (QCP).

Quality control is the responsibility of the Contractor. The Contractor shall develop, implement and maintain an effective quality control program which shall be documented in a QCP to ensure services are performed IAW this PWS. The Contractor shall develop and implement procedures to identify, prevent, and ensure no recurrence of defective services. The Contractor’s QCP is the means by which they assure themselves that the work conforms to contract requirements. The basic principle of the plan is that the Contractor is responsible for quality control. The plan shall include a description of the inspection system to address services listed in this PWS, and a description of the methods to be used for identifying and preventing defects in the quality of services performed. The plan shall include a description of the Contractor’s inspection system to include specifics as to areas to be inspected on a scheduled and unscheduled basis, frequency of inspections, and the title and organizational placement of the Contractor’s inspectors. No lead person or first line supervisor shall be considered a Quality Control Inspector. The Contractor shall develop, maintain, and submit a QCP to the KO and the COR for acceptance within 30 business days after contract award. The Contractor shall submit any proposed changes in the QCP to the KO and COR for written approval five (5) business days prior to implementation. The Contractor shall develop and maintain a Quality Control Plan (QCP) to ensure services are performed in accordance with this PWS. The Contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor's QCP is the means by which it assures that the work provided complies with the requirements of the contract. At a minimum, the QCP must include the following to be acceptable: (Deliverable A004)

a) A chart showing the organizational structure and lines of authority, the names, qualifications, duties, responsibilities, and classification of each member of the Contractor's Quality Control Team.

b) How the Contractor will monitor work to ensure that performance complies with all timelines, deadlines, and goals.

c) How the Contractor will monitor work to ensure that performance complies with all specifications and requirements of the contract, including clauses.

d) How the Contractor will monitor and ensure staff qualifications remain current and valid throughout contract performance.

e) How the Contractor will ensure all keys issued will remain controlled items.

f) How the Contractor will inventory and track maintenance of all Government Provided

Equipment / Materials.

g) How the Contractor will identify, investigate, and correct any non-conforming performance and

h) How the Contractor will file and save all Quality Control related documents for the life of the contractor plus 5 years.

An analysis of quality control and timeliness reports shall be sent to the COR within 10 (ten) calendar days after the end of each Task Order. A final QCP shall be submitted to the KO through the COR for review and acceptance within 10 (ten) calendar days after date of contract award. After acceptance of the QCP, the Contractor will receive the KO’s acceptance in writing. Any changes to the accepted QCP will be required to be resubmitted for acceptance within 5 (five) calendar days.

The Contractor shall bring identified issues or potential problems that might affect future performance to the attention of the COR as soon as possible. Verbal reports will be followed up by written reports within 5 (five) calendar days.

3.2.1 Quality Control Files.

The Contractor shall maintain files of all inspections or tests conducted by the Contractor, to include any corrective actions taken. These files shall be subject to Government review at the COR’s discretion during the contract term, to include any extensions of contract term.

The Quality Control Files will be the property of the Government and shall be turned over to the Government upon completion or termination of the contract.

3.3 Customer Feedback Program.

The Contractor shall establish and operate a customer feedback program as part of the

QCP

7.0 Related Documents. N/A

7.1 Definitions and Acronyms

7.1.1 Definitions.

Although not inclusive of every term used within this PWS, the following provides a list of definitions used throughout this PWS and commonly used in the acquisition field.

7.1.1.1 Acceptable Quality Level (AQL). The AQL is the maximum percent defective (or the number of defects per hundred units) for the purposes of sampling inspection can be considered satisfactory.

7.1.1.2 Alternate Contracting Officer’s Representative (ACOR). An employee of the U.S.

Government provided by the RA and appointed by the KO to provide support to CORs in monitoring and documenting the Contractor’s performance. These alternate surveillance support personnel will serve as on-site representatives of the COR in performance of actual contract surveillance if they meet all COR training, experience requirements, and are appointed by the KO as an ACOR.

7.1.1.3 Child, Youth and School Services (CYS). Overarching naming convention for Child Development Center (CDC), Youth Activity Center, and School Age Services (SAS). CYS is used when referencing all programs.

7.1.1.4 Contract Administrator (CA). The official Government representative delegated authority by the KO to administer a contract. This individual, normally working in an appropriate contracting or procurement career field, advises on all technical contractual matters.

7.1.1.5 Contract Discrepancy. A failure of the Contractor to perform IAW contract requirements and specifications, e.g., a failure of the Contractor to provide, or provide on time, the required contract products or services; or it may result because delivered products or services do not meet specific contract requirements.

7.1.1.6 Contract Discrepancy Report (CDR). A report used to document other than satisfactory Contractor performance. The CDR requires the Contractor to explain, in writing, why performance is other than satisfactory; how performance shall be returned to satisfactory levels; and how recurrence of the problem shall be prevented in the future.

7.1.1.7 Contractor. A supplier or vendor awarded a contract to provide specific supplies or service to the Government. The term used in this contract refers to the prime.

7.1.1.8 Contractor Acquired Property (CAP). Property acquired, fabricated, or otherwise provided by the Contractor for performing a contract. Contractor retains title.

7.1.1.9 Contracting Officer (KO). A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the Government.

Note: The only individual who can legally bind the Government.

7.1.1.10 Contracting Officer’s Representative (COR). An employee of the U.S.

Government appointed by the KO to help administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

7.1.1.11 Defective Service. A service output that does not meet the standard of performance associated with the PWS.

7.1.1.12 Deliverable. Anything that can be delivered; can include non-manufactured things, such as meeting minutes or reports.
