About this file
This is a Contractor's Payment Surety Bond template issued by the City of Palo Alto, California, for the Gas Main Replacement Project 25. The bond document serves as a financial security instrument required before a contractor can commence work on the designated public improvement project. The bond must be executed by the principal contractor and a licensed surety company authorized to conduct business in California. The bond amount must equal no less than 100 percent of the total contract sum as specified in the underlying agreement between the City and the contractor. The document establishes the surety's obligation to cover payment claims from all persons, companies, and corporations supplying labor, materials, or services to the project, as well as any amounts due under the California Unemployment Insurance Code related to project work and labor.
The payment bond protects claimants entitled under California Civil Code Section 9100, granting them direct rights of action against the surety for unpaid wages, materials, and services. The surety agrees that the bond remains enforceable regardless of any amendments, changes, change orders, modifications, or additions to the underlying contract, and expressly waives notice of such modifications. The surety also waives provisions of California Civil Code Sections 2845 and 2849. The bond requires execution by authorized representatives of both the contractor and surety, notarization by a California notary public, and includes a Certificate of Acknowledgment verifying the identity of signatories. The bond document specifies that the surety will pay reasonable attorney's fees if suit is brought upon the bond, with the amount to be determined by the court.
