About this file
This is a Payment Bond template document for the City of Waxahachie, Texas, executed in Ellis County for the City Facilities Remodel and Expansion CMAR Project at 820 Ferris Avenue and 401 S. Rogers Street. The payment bond serves as a financial guarantee that the selected Construction Manager at Risk (CMAR) contractor will pay all claimants supplying labor and materials to the contractor or its subcontractors during project execution. The bond is executed in five originals and binds the principal contractor and surety jointly and severally to the City of Waxahachie as owner. The bond's penal sum amount is to be determined based on the Guaranteed Maximum Price (GMP) upon contract award. The payment bond is required upon contract execution and is governed under V.T.C.A. Government Code Chapter 2253. Electronic proposals for CMAR services were due by March 11, 2026, at 10:00 a.m., with the anticipated selection date of April 6, 2026, and preconstruction services scheduled for April-May 2026, followed by GMP presentation in June 2026 and construction commencement in July 2026.
The payment bond must be accompanied by the attorney-in-fact's authority from the surety company, certified to include the bond date. The bond includes a waiver of notice provision, allowing the surety to waive notification of any changes, extensions of time, alterations, or additions to contract terms, work, plans, specifications, or drawings. The combined estimated project cost ranges between $11,682,983 and $16,430,348 depending on phasing at both facilities, with funding to be derived from bond sales. The selected CMAR must provide Performance and Payment Bonds equal to 100 percent of the Guaranteed Maximum Price, maintain comprehensive insurance coverage naming the City of Waxahachie as additional insured, and comply with all applicable Texas state and local laws and ethics regulations.
