About this file

This is a Payment Bond document issued by the City of Waxahachie, Texas, in Ellis County for the City Facilities Remodel and Expansion Construction Manager at Risk (CMAR) Project at 820 Ferris Avenue and 401 S. Rogers Street. The bond is executed in five originals and serves as a guaranty that the selected CMAR principal and surety will pay all claimants, including laborers and material suppliers, for work performed under the construction contract. The bond document establishes that the principal and surety are jointly and severally liable for fulfilling payment obligations related to the project, with the penal sum amount to be determined upon contract execution. The bond is governed by V.T.C.A. Government Code Chapter 2253 and includes provisions indicating that changes, extensions of time, alterations, or additions to contract terms, work scope, or specifications will not affect the surety's obligations, with the surety waiving notice of any such modifications.

The Payment Bond requires the selected CMAR to obtain surety authorization with an attorney-in-fact's authority certified to include the bond date prior to contract execution. Per the related RFP documentation, the selected CMAR must provide both Performance and Payment Bonds equal to 100 percent of the Guaranteed Maximum Price, maintain comprehensive insurance coverage naming the City as additional insured, and comply with all applicable Texas state and local laws. The combined project scope encompasses interior remodeling and expansion at both facilities, with 820 Ferris Avenue budgeted at $8,612,730 and 401 S. Rogers Street at $7,817,618, for a total estimated range of $11,682,983 to $16,430,348 depending on phasing completion. Electronic proposals were due March 11, 2026, with anticipated selection on April 6, 2026, preconstruction services scheduled for April-May 2026, GMP presentation in June 2026, and construction commencing July 2026.
