About this file
This is a Purchasing Affidavit form issued by the State of West Virginia Purchasing Division for RFQ No. ARFQ HOP15*11 related to dishwashing services or equipment. The affidavit serves as a mandatory compliance document required under W. Va. Code 5A-3-10a and must be completed and notarized by all prospective vendors prior to contract award. The form requires the vendor's authorized representative to affirm under penalty of law that neither the vendor nor any related parties owe debts exceeding one thousand dollars in aggregate to the state or its political subdivisions, nor are they in employer default status. Related parties are defined as entities connected to the vendor through blood, marriage, ownership, or contractual relationships where they would receive five percent or more of the total contract benefit or profit.
The affidavit includes specific exceptions allowing vendors to proceed if they have contested applicable taxes, workers' compensation premiums, or fees where the matter remains pending, or if they have entered into and are compliant with a payment plan or repayment agreement. Employer default is defined to include outstanding balances to workers' compensation funds, policy defaults, failure to maintain mandatory coverage, or failure to meet self-insured employer obligations, with an exception for vendors in compliance with approved repayment agreements with the Insurance Commissioner. The form requires notarization and includes fields for the vendor name, authorized signature, date, state and county of notarization, and notary public seal and commission expiration date.
