CONTROL No. ACB100017

Program/Item: Remote Rocket

Assembly Software Modification

Program for the OH-58D Kiowa

Warrior Helicopter

Est. Dollar Value: $250,000.00

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

CONCURRENCE SHEET

1. Contracting Agency: U. S. Army TACOM Contracting Center, Rock Island, IL 61299-7630.

2. Description of Action: This action will result in a sole source contract with International

Defense Products (IDP) LLC. Award is projected for 2nd Quarter FY10 and Program

Management (PM) reimbursable funds will be used. An acquisition plan is not required because it does not meet the dollar threshold.

3. Description of Supplies/Services: This requirement is to implement a change to the OH-58D

Kiowa Warrior helicopter Rocket Remote Assembly (RRA). The RRA change implements the software modification program outlined in IDP’s RRA Engineering Change Proposal (ECP) dated 2 November 20009. This requirement consists of modification to the software, prototype fabrication, and Government acceptance test support of the circuit card assembly (CCA) software change for three (3) CCAs, Part Number 9870177-003. The end item is the OH-58D

Kiowa Warrior Helicopter. The estimated value is $250,000.00 for the 12-month period of performance. There is no option provision.

4. Authority Cited: 10 USC 2304(c)(1), Only One Responsible Source and No Other Supply or

Service Will Satisfy Agency Requirements as implemented by FAR 6.302-1.

5. Reason for Authority Cited: As implemented by FAR 6.302-1, procurement by other than full and open competition is necessary because IDP is the only known source capable of correcting the malfunction within the RRA, as identified within the ECP. The updated software will allow the RRA to set XXX. In addition, XXX.

Baldwin Electronics Inc. (BEI) Defense Systems Company was the original manufacturer of the

RRA, as the technical data package for the RRA was proprietary to BEI, who refused to sell the rights to the Government. The Defense Systems division of BEI went out of business in 1998.

To date, the Government does not own, nor has the RRA TDP available.

The Kiowa OH-58D Helicopter called for the rapid arming of much of the Army’s OH-58C fleet to the OH-58D armed configuration without benefit of a development program. Without a development program, many of the armament components, to include the RRA, were procured sole source and incorporated into the airframe by the prime contractor.

Program for the OH-58D Kiowa

When BEI went out of business several former BEI employees formed their own company, IDP.

IDP acquired the tooling, gauging, and testing equipment associated with the RRA from BEI, and has the knowledge base to manufacture the RRA. IDP has repaired the RRA for TACOM in the past with no deficiencies noted. An effort to reverse engineer the RRA is underway at

AMCOM and will take approximately three years to complete.

IDP is the only company capable of building the RRA and its subcomponents, in addition to correcting any malfunctions, as they have proven to have the technical expertise, facilities, and manufacturing experience required.

6. Efforts to Obtain Competition: Pursuant to FAR 5.207(c)(15), this requirement has been synopsized in FedBizOpps and all responsible sources may submit a proposal which shall be considered by this agency.

7. Actions to Increase Competition: A reverse engineering effort is underway. It is not scheduled to be completed for 3 years.

8. Market Research: Market research was conducted 23 November 2009 by Scott Johnson, Logistics Management Specialist, AMSTA-LCW-SAE, by searching the world-wide web and the Thomas Register to determine whether commercial items or non-developmental items are available that could meet the requirements and have determined that no commercial items or non-developmental items are available. However, we will require IDP and their subcontractors to incorporate, to the maximum extent practicable, commercial items or non-developmental items as components of the items required within the ECP.

9. Interested Sources: To date, no other sources have expressed an interest in writing for this acquisition.

10. Other Factors: There is no procurement history for this item.
