JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Agency: U.S. Army TACOM Contracting Center, Rock Island, IL 61299-7630.

2. Description of Action: This action will result in a six-month extension of Time and Materials contract DAAE07-98-D-T061/DG01, option period 3. Award of this item is projected for the 4th

Quarter of FY09 and Operations and Maintenance Army (OMA) funds will be used. An acquisition plan is not required because it does not meet the dollar threshold for an acquisition plan.

3. Description of Supplies/Services:

There is an urgent requirement to extend option period 3 of the Mobile Parts Hospital (MPH) contract which includes labor, materials, and logistics support. The estimated dollar value is

$4,169,638.00. A new contract award for the continued sustainment of the MPH was planned for the first quarter of FY10. As such, an approved J&A authorizing sole source procurement to

Honeywell, in accordance with 6.302-1, was obtained for $9M in April 2009. Due to evolving requirements, including the deployment of a 4th module and the anticipated deployment of a 5th module, an amendment to this J&A was submitted increasing the ceiling price to $19.5M. This amendment was approved by Harry Hallock in June 2009. The anticipated new award date has been delayed until the end of second quarter 2010, therefore creating an urgent requirement to extend the current option period 3 of the existing contract. The proposed option period 3 extension, resulting in modification 15 of the contract is intended to act as a “bridge buy” for sustainment and support of the MPH until a new contract can be established. This “bridge buy” was determined to be required in late August 2009 when it became apparent the follow-on contract could not be executed by the end of the existing option period. This action will revise the period of performance of option period 3 to 23 MAR 2009 thru 22 MAR 2010.

4. Authority Cited: 10 USC 2304(c)(2), Unusual and Compelling Urgency as authorized by FAR

6.302-2.

5. Reason for Authority Cited:

As authorized by FAR 6.302-2, procurement by other than full and open competition is necessary in order to avoid a lapse in sustainment and support of the MPH modules under the current MPH contract; DAAE07-98-D-T061/DG01 with Honeywell. Per modification 15 to the contract, option period 3 ends on 28 Sep 09. The establishment of a new contract is projected to

Mobile Parts Hospital occur 2 nd

Qty FY10 (J&A Control #ACA090056 was approved on 25 Jun 09). J&A number

ACA090056 authorizes pursuit of a new procurement to result in a one-year time and materials type contract with two 100% option periods under the authority of FAR 6.302-1, Only One

Responsible Source (Honeywell).

Although an approved J&A was in place in June, the details of the SOW could not be solidified which caused delays in the solicitation and award phase of the new effort. This effort normally takes 180 days to complete. As a result of the unforeseen changes to the demand, the SOW could not be solidified in time to award the new contract in order to avoid a break in service for the Mobile Parts Hospitals.

It was immediately and urgently necessary to issue an extension to option period 3 via modification 15 of the current contract in order to prevent a lapse in MPH support between the end of the period of performance on 28 SEP 2009 and the development of the new contract in the

2nd Quarter of FY10.

6. Efforts to Obtain Competition: Due to the urgency of this proposed contract action and in accordance with FAR 5.202(a)(2), a synopsis will not be posted for this action. However, every effort will be made to alert other potential contractors and subcontractors for the new follow-on contract. The follow-on procurement action will be synopsized in the FedBizOps to alert interested contractors and subcontractors.

7. Actions to Increase Competition: Because the current requirement is considered urgent, no additional efforts will be performed to obtain additional competition for this procurement.

Honeywell is the supplier of the existing contract and is currently responsible for providing numerous personnel for staffing and maintaining the MPH modules . The cadre of expertise provided by Honeywell includes experienced technicians that are not only technically superior, but understand the unique culture in XXX. In addition to the skilled cadre of technicians in

XXX, Honeywell provides a wide variety of logistical support to the program; these logisticians have been with the MPH program since 09 March 2006 and have a unique understanding of the goals and objectives established by the MPH Program Manager.

8. Market Research: The current contract for sustainment of MPH was solicited for full and open competition in 2006 of which only two proposals were received due to the complexity of the task. Of the two proposals, Honeywell (formerly Dimensions International) was awarded the contract. Due to the urgency of the requirement and the previous authorization for sole source procurement per J&A control number: ACA090056, no further market research was conducted for this action.

9. Interested Sources: To date, no other sources have expressed an interest in writing. In

Mobile Parts Hospital accordance with FAR 5.202(a)(2), the proposed contract action will not be synopsized.
