CONTROL No. ACB090079

Program/Item: MD300

Est. Dollar Value: $479,850.00

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Agency: U.S. Army TACOM LCMC (RI) Rock Island, IL

61299-7630.

2. Description of Action: This action will result in a purchase order with Diagnostic Innovations LLC. Award is projected for 15 Sep

09 and FY09 Operations and Maintenance Army (OMA) dollars will be used. An acquisition plan is not required because it does not meet the dollar threshold for an acquisition plan.

3. Description of Supplies/Services: The Government intends to procure 35 each of the MD300 Universal Truck Diagnostics. The MD300 allows the Logistics Assistance Representatives (LARs) to troubleshoot a vehicle down to the smallest replaceable component. This system can quickly locate and diagnose the complex problems that affect multiple military vehicles electronic systems. Three diagnostic functions in one software package, Data Monitoring, Retrieves fault codes and Data

Reporting. The MD300 is the only software on the market that monitors several truck components simultaneously. Graphic Vehicle Interface

(GVI) displays vehicle components and their status. Graph up to four components individually visually displaying what components are reporting fault codes. Red indicates an active fault code, yellow indicates an inactive fault code, and green indicates no fault codes.

This system can instantly determine if a failure is affecting more than one system on the vehicle. The estimated value is $479,850.00.

The proposed contract will not include an option provision.

4. Authority Cited: 10 USC 2304(c)(2), Unusual and Compelling

Urgency as authorized by FAR 6.302-2.

5. Reason for Authority Cited: As authorized by FAR 6.302-2, immediate procurement of this item is necessary due to the length of time required for full and open competition, which would result in unacceptable delays in making this equipment available to XXX. The requirement was first identified in mid August 2009. This equipment will be issued to Logistics Acquisition Representatives (LARs) that are currently deployed in the Area of Responsibility (AOR) and to LARs that will be deployed by December 2009. Diagnostic Innovations is the only known source that can meet the Government’s required delivery date of 15 November 2009. Failure to acquire this equipment from

Diagnostic Innovations will prevent deploying LARs from receiving the necessary equipment and training prior to their deployment. If this test equipment is not provided in an expeditious manner to support

XXX, various mission assignments to sustain on-going military operations will be jeopardized and additional risk to the safety and welfare of soldiers will be incurred. It is not possible to provide estimates of additional expenditures (for injuries or deaths as a result of inadequate supplied equipment not being provided) that would be required if these items are not sent expeditiously.

6. Efforts to Obtain Competition: The synopsis for this procurement action was waived due to Unusual and Compelling Urgency, as authorized by the exception at FAR 5.202(a)(2).

7. Actions to Increase Competition: Competition may increase for the next procurement if there is sufficient time to conduct a sources sought synopsis.

8. Market Research: Due to the urgency of the requirement, limited market research was conducted. The TACOM LARs had previously acquired and tested a market sample of the MD300, so it was known to be able to fulfill their requirement. The MD300 was tested against a similar system. While the other system was a useful tool, it did not allow the LAR to troubleshoot to the level needed and will not provide the in-depth diagnostic capabilities that the MD300 provides. Market research showed that only Diagnostic Innovations could meet the required delivery date of 15 November 2009.

9. Interested Sources: To date, no other sources have expressed an interest in writing.

10. Other Factors: No additional factors other than those stated in paragraph 5.

11. Technical Certification: I certify that the supporting data under my cognizance which are included in the J&A are accurate and complete to the best of my knowledge and belief.
