About this file
This is an Invitation for Bids (IFB) issued by the City of Cambridge, Maryland for on-call traffic calming and safety services. The project involves furnishing and installing signs, markings, and other traffic calming items designed to reduce vehicle speeds and enhance safety throughout Cambridge. The scope of work includes various traffic calming measures and safety improvements to be deployed across the city as needed on an on-call basis. The IFB permits piggyback purchasing by other Maryland jurisdictions, allowing additional municipalities to utilize the resulting contract. Specific response deadlines, site visit schedules, and award dates are outlined within the document to guide bidder participation and contract award timelines.
Pricing for this on-call contract is to be submitted by qualified bidders, with costs structured to accommodate variable project demands throughout the contract term. The contract structure allows for flexible deployment of traffic calming infrastructure based on city priorities and budget availability. As an on-call arrangement, this contract provides Cambridge with the ability to request services and materials as needed rather than requiring a single large upfront purchase, enabling responsive implementation of safety improvements across different neighborhoods and intersections. The piggyback provision extends cost-sharing benefits to other Maryland jurisdictions, potentially enhancing procurement efficiency across the region.

TASK ORDERS
16. ISSUANCE OF TASKS
For any work to be performed under this Contract, the Engineer shall issue a “Task Order Request” to the contractor for each project to be performed. The Task Order Request shall include the project layout, items to be used, and any special requirements or conditions for the task.
The Project Manager will make reasonable efforts to package tasks for an efficient use of the Contractor’s resources. Sample tasks likely to be performed under this Contract are shown in Appendix 1 and are provided for informational purposes only. Quantities shown are also for information purposes only.
Within 10 calendar days, the Contractor shall provide to the Project Manager:

• The Traffic Control Plan and fixed price for its implementation, if applicable, per Paragraph 23.
• A proposed start and end date for the work.

17. CANCELLATION OF WORK
Where the City cancels a Task Order through no cause of the Contractor, and where such Task Order includes any item listed in Schedule C, D, or E, the City shall either take possession of the material (and reimburse contractor for same), or direct that the Contractor return the material and the City shall reimburse the Contractor for any shipping and handling, re-stocking, or other related and documented costs.
18. CHANGES IN WORK
The Owner may at any time, as the need arises, order changes within the scope of the work without invalidating the Agreement. If such changes increase or decrease the amount due under the contract documents, or the time required for performance of the work, an equitable adjustment shall be authorized by change order.
The Owner may at any time, by issuing a field order, make changes in the details of the work. The Contractor shall proceed with the performance of any changes in the work so ordered by the Owner unless the Contractor believes that such field order entitles the Contractor to a change in contract price or time, or both, in which event the Contractor shall give the Owner written notice thereof within seven (7) days after the receipt of the ordered change. Thereafter the Contractor shall document the basis for the change in contract price or time within thirty (30) days. The Contractor shall not execute such changes pending the receipt of an executed change order or further instruction from the Owner.
19. DIRECTED REMOBILIZATION
Directed Remobilization occurs when the Contractor is directed in writing by the Project Manager to suspend, leave or defer the work for reasons beyond the Contractor's control.
Directed Remobilization may be authorized when the return to the site results from conditions including, but not limited to:
• Owner-directed suspension or resequencing of the work;
• Unavailable access to the work area;
• Conflicts with utilities, other contractors, public events, or City operations;
• Delays in Owner-furnished information, approvals, permits, or coordination;

Contractor is advised that City may direct the Contractor to apply an asphalt surface coat, the price for which shall be included in the Task proposal.
21. ADA REQUIREMENTS
When preparing a Task Request, the Project Manager may determine that curb or pavement adjustments are necessary to meet ADA requirements. Such work shall be assigned to a separate vendor; however, the City expects that the Contractor will coordinate construction activities with the vendor as necessary.
22. UNIQUE ITEMS
The Contractor is notified that this project is intended to demonstrate the efficacy of traffic calming activities in the City of Cambridge. As such the City may request that the Contractor furnish install unique items not contemplated herein. The pricing to furnish and install such items shall be submitted to the Project Manager for consideration, adjustment (if necessary), and approval.
23. ADDITIONAL SUPPLIES AND MATERIALS
No additional or independent payment shall be made for required additional supplies that are expressly included in the applicable technical specification; pricing shall be built into the Contractor’s unit prices. When the City requests material supply only beyond the required additional supplies, payment shall be made in accordance with the Material Supply Only provision.
24. MATERIAL SUPPLY ONLY
At the City’s request, the Contractor shall supply additional materials beyond those required in Paragraph 20. The Contractor may mark up the actual cost plus shipping and handling costs by 15%.
25. REMOVAL OF ITEMS
The Contractor is notified that the Owner may require the removal of items deemed to have not met their purpose. When requested by the Project Manager, the Contractor shall submit a proposal to remove such items. Where pricing for removal exists under an existing Bid Item, said pricing shall be used. Where pricing is not supplied in the Bid Items, Contractor shall submit pricing as a Task Proposal.
26. MAINTENANCE OF TRAFFIC
When a proposed Task is to be performed on a City or County-owned roadway of 25 mph or less, the cost of traffic control shall be incidental to the work unless otherwise permitted by the Project Manager.
When a proposed Task is to be performed on a State-owned roadway:
• the Contractor shall prepare a Traffic Control Plan along with a fixed price for its implementation.
• The cost of the Traffic Control Plan shall include all costs associated with the maintenance of traffic including, but not limited to, the furnishing, placement, maintenance, removal, related labor, tools, equipment and incidentals such as lights, cones, flags, vests, flaggers, flaggers, traffic manager, and temporary traffic signs, etc.
• The Engineer shall review, approve, disapprove, or request modification of the Traffic Control Plan and its price at his sole and reasonable discretion. When making his determination on the reasonableness of the cost for Maintenance of Traffic, the Engineer shall refer to the most recently published SHA Price Index for similar items of work in locations proximate to the City of Cambridge.
• All provisions and methods, materials, devices and flagging procedures for maintaining traffic shall comply with the requirements of the Maryland Manual of Uniform Traffic Control Devices (MMUTCD), current edition.
• Payment for implementation of the Traffic Control Plan shall be made at the completion of the Task.
27. FAILURE TO COMMENCE WORK IN A TIMELY MANNER; LIQUIDATED DAMAGES
The Contractor shall commence field work on each Task Order on the start date identified in the Contractor’s approved schedule and incorporated into the Task Notice to Proceed.
For purposes of this provision, commencement of work means that the Contractor has mobilized the labor, supervision, equipment, materials, and traffic-control devices reasonably necessary to begin productive field operations. Delivery of incidental materials, placement of equipment without an adequate work crew, administrative activity, or other nominal activity shall not constitute commencement of work.
If the Contractor fails to commence work on the approved start date, the Project Manager shall provide written notice of the failure to commence. The Contractor shall then have two calendar days from receipt of the notice to:
• Commence productive field operations; or
• Submit documentation demonstrating that the delay is excusable under this provision and request a revised start date.
If the Contractor does neither within the two-calendar-day cure period, the Contractor shall pay the City liquidated damages in the amount of $300 for each calendar day, beginning on the day after expiration of the cure period and continuing until the Contractor:
• Commences productive field operations;
• Receives a written schedule extension from the Project Manager; or
• Receives written direction from the Project Manager suspending or postponing the work.
Liquidated damages assessed under this provision shall not exceed ten percent of the total value of the affected Task Order, excluding any amount paid for mobilization or directed remobilization.
The parties acknowledge that the City’s actual damages resulting from delayed commencement—including administrative costs, inspection and project-management costs, disruption to City operations, public inconvenience, coordination costs, and delay to related work—would be difficult to determine precisely. The amount stated above represents a reasonable estimate of those damages and is intended as compensation to the City and not as a penalty.
Liquidated damages shall not be assessed to the extent that delayed commencement results from:
• A written suspension, postponement, or change directed by the City;
• Failure of the City to provide required access, approvals, plans, layouts, permits, or selections;
• A utility conflict or differing site condition that could not reasonably have been anticipated;
• Documented unavailability of an approved proprietary or special-order material, provided the Contractor timely ordered the material and promptly notified the Project Manager;
• Unusually severe weather or another event beyond the Contractor’s reasonable control;
• Delay caused by another City contractor or governmental agency; or
• Another excusable delay approved in writing by the Project Manager.
• The Contractor shall notify the Project Manager in writing within two business days after becoming aware of a condition that may delay commencement. The notice shall identify the cause, anticipated duration, measures being taken to mitigate the delay, and the requested revised start date. Failure to provide timely notice may constitute a waiver of the Contractor’s entitlement to an extension, except where the City had actual knowledge of the delaying condition.
• The City may deduct accrued liquidated damages from amounts otherwise due under the affected Task Order or any other amount payable to the Contractor under the Contract. Assessment of liquidated damages shall not prevent the City from exercising other contractual remedies, including termination for cause; however, the City shall not recover duplicative damages for the same period and consequence of delay.

• The requested adjustment exceeds five percent of the original documented material cost for the affected product.
The Contractor shall provide documentation of the manufacturer’s pricing at the time of bid and at the time a Task Order is placed.
