About this file

This document establishes the Quick Quote Submission Standards for the Ohio Attorney General's Office (AGO) that govern how suppliers must submit bids and the terms under which the AGO will evaluate and award contracts.

Suppliers responding to AGO Quick Quotes must comply with all stated standards and instructions, with non-compliant submissions subject to rejection. The AGO reserves the right to reject any submission not in its best interest, decline to do business with any supplier, and cancel or reissue the Quick Quote at its sole discretion. All procurement activities and resulting purchases are governed by the laws of the State of Ohio, with performance contingent upon appropriated funds from the Ohio General Assembly. Suppliers offering goods or services under existing State Contracts (such as STS or MMA) must include the relevant State contract number and expiration date in their submission; the AGO may grant preference to State contract suppliers even if their pricing exceeds non-contract responses. Any supplier terms and conditions requiring AGO review must be submitted with the bid, though unilateral terms such as "click-through," "shrink-wrap," or "browse-wrap" agreements are not binding unless explicitly agreed to in writing by the AGO.

Additional requirements apply to specific circumstances. Suppliers reselling software must warrant that they have the right to grant licenses, possess all necessary permissions for the AGO to use the software for business purposes, and acknowledge that any License Provider terms apply subject to these Standards. All supplier employees, subcontractors, and subcontractor employees are subject to the Ohio Bureau of Criminal Investigation's Visitor and Non-FOP AGO Employee DNA Sample Collection protocol.

Ohio Attorney General’s Office (AGO) Quick Quote Submission Standards for Suppliers

(1) Compliance with Instructions. Suppliers must follow all Quick Quote Standards and Instructions.

Submissions that do not comply may be rejected. By submitting a bid, suppliers agree to these Standards.

(2) AGO Reservation of Rights. The AGO reserves the right to reject any submission not in its best interest, or the AGO may decline to do business with any responding supplier. The AGO may cancel or reissue this Quick Quote at its sole discretion.

(3) State of Ohio Contract Identification. If a supplier is offering goods or services under a State Contract (e.g. STS, MMA, etc.) the submission must include the State contract number and expiration date. The AGO may give preference to suppliers on a State contract, even if their pricing is higher than non-contract responses.

(4) Applicable Laws.

• Governing Law. This procurement and any resulting purchase shall be governed by the laws of the State of Ohio.

• Invalid Terms. Any term deemed void or unenforceable under Ohio law (including the Ohio Constitution and ORC 9.27) will be removed, with the remaining provisions remaining in effect.

• Certification of Funds. In accordance with ORC 126.07, performance by the AGO is contingent upon appropriated funds. If funding is not continued by the Ohio General Assembly, the purchase will terminate without further AGO obligation.

(5) Submission of Terms and Conditions. If a supplier requires the AGO to review specific terms and conditions, those must be submitted with the bid. Unless explicitly agreed to in writing by the AGO, no supplier terms or conditions will be valid or enforceable “Click-through,” “shrink-wrap,” “browse-wrap,” or unilateral terms are not binding. AGO employees are not authorized to modify these Standards.

IF APPLICABLE:

(6) Software License. If a supplier is reselling software (including licenses), supplier warrants that: (1) supplier has the right to grant the license, (2) supplier has all necessary permissions to sell and the AGO may use the software for business purposes, (3) in the event the supplier is not the provider of the product, the License Provider’s terms apply but in case of any conflict, these Standards shall control.

(7) BCI Visitor Policy. All supplier employees, subcontractors, and subcontractor employees are subject to the Ohio Bureau of Criminal Investigation’s (BCI) Visitor and Non-FOP AGO Employee DNA Sample Collection protocol attached to this Quick Quote.
