About this file
This is a Community Noise Permit Approval issued by the State of Hawaii Department of Health, Indoor and Radiological Health Branch, for construction activities related to the seismic retrofit of three bridges on Haleakala Highway (Route 377) in Kula, Maui. Permit M26-003 was issued on April 15, 2026, and is valid through October 31, 2028, authorizing the Hawaii Department of Transportation, Highways division to conduct noise-generating construction activities during specified hours. Construction activities are permitted Monday through Friday from 7:00 a.m. to 6:00 p.m. and Saturday from 9:00 a.m. to 6:00 p.m., with no activities allowed on Sundays and holidays. Equipment emitting sound in excess of 80 dBA at or beyond the property line is further restricted to 9:00 a.m. to 5:30 p.m., Monday through Friday, and includes pile drivers, hoerams, hydraulic hammers, jackhammers, chipping guns, auger drills, rock drills, concrete saws, and compactors. The permit holder must notify surrounding occupants prior to operating impact-type equipment.
The permit is nontransferable and is granted upon compliance with all Hawaii Administrative Rules Chapter 11-46 and Department of Health regulations. Permit holders are required to implement noise abatement procedures if complaints arise, coordinate with nearby schools, libraries, hospitals, and rest homes to minimize adverse impacts, and maintain mufflers on all motorized equipment except specified pneumatic tools and pile hammers. The permit must be posted at the activity location at all times, and any modifications require written Department approval. Violations of permit conditions or operation with an expired permit may result in penalties up to $10,000 per day. Extensions or modifications must be submitted in writing at least three to four weeks prior to the requested date. The Director of Health retains authority to inspect the site, conduct noise testing, and recommend additional noise attenuation measures.
