1. RFP Attachment L-03, Past Performance Questionnaire:

Q. Where the Offeror is the subcontractor to a competitor who is being used as a past performance reference, is the Offeror required to reveal its Fee/Profit for the referenced contract?

A. The information requested in the RFP Attachment L-03, Past Performance Questionnaire, will not be changed. Offerors are not required to release proprietary data to its team members/competitors in order to comply with proposal preparations instructions.

2. RFP Provision L.17(c):

Q. Since workers' compensation forms contain personally identifiable information, will a table listing numbers of claims and total dollar value for each of the three years be sufficient to satisfy this requirement?

A. RFP Provision L.17(c) has been revised to request a summary statement for this information. Please see amendment NNK16565015R/000001.

3. RFP Attachment L-02, Past Performance Sample Letter:

Q. Attachment L-02, Past Performance Sample Letter, states “Please send the completed questionnaire directly to the KSC Contracting Officer no later than 12:00 p.m. (noon) local time, TBD at the following address:” Please provide the submittal deadline for Past

Performance Questionnaires.

A. The TBD has been revised to read “January 22, 2016.” Please see amendment

NNK16565015R/000001.

4. RFP Attachment L-03, Past Performance Questionnaire:

Q. We respectfully request the Government to remove the Estimated Cost as well as Fee/Profit detail as part of the PPQ requirement for contracts that we are citing that are Firm Fixed Price.

We can provide the Awarded Contract Value and Current Contract Value, but the additional information that is being requested is proprietary and further the Contracting Officer’s for the

FFP contracts that we intend to cite are unable to validate this information. We would note that the requirement is a violation of FAR 15.402(b) which mandates that a contracting officer shall

“Price each contract separately and independently and not—(1) Use proposed price reductions under other contracts as an evaluation factor; or (2) Consider losses or profits realized or anticipated under other contracts.” We also note that the requirement is a violation of the prohibition on obtaining cost or pricing data where there is adequate price competition.

A. The information requested in the RFP Attachment L-03, Past Performance Questionnaire, will not be changed. With regard to the statement concerning FAR 15.402(b) above, please refer to RFP Section M.4, Past Performance Factor, for the associated evaluation criteria.

5. RFP Provision L-6, Proposal Page Limitation Page 107 of 134 and Provision L.17, Volume II – Past Performance Page 120 of 134:

Past Performance Questionnaires (6 pages each) and safety performance history (including a statement summarizing any OSHA citations, OSHA 300a Forms, and Safety performance experience, including worker compensation claims and Experience Modification Rates) far exceed the 25 page limit imposed on this volume. We request that the government exclude the

Past Performance Questionnaires and safety performance information from this page limit.

A. RFP Provision L.6(a) has been revised to remove “questionnaire forms” from the table and

Provision L.17 has been revised to specify that the Past Performance questionnaire and the

OSHA forms are not subject to the page limits. Please see amendment

NNK16565015R/000001.

6. RFP Provision L.6(b):

Q. : The RFP states that 12-pt font is to be used for the proposal text, however no font requirement is currently specified for tables/graphics.

A. As stated in L.6(b), “Each side of the sheet, tab, or divider, containing proposal material will be counted as a page.” A divider or tab which only contains a section title will not be counted as a page. Please see amendment NNK16565015R/000001.
