About this file

This is a Construction Bid Addendum No. 1 issued by the Michigan Department of Technology, Management and Budget (DTMB) for the Net River Dam Modernization and Restoration project located on Net River Dam Road in Baraga County, Michigan. The addendum, issued on February 17, 2026, modifies the original bidding documents and becomes part of the contract with the same force and effect as if originally incorporated. A pre-bid meeting was held virtually via Microsoft Teams on February 13, 2026, at 1:00 PM, with 20 contractor representatives from firms including MJ VanDamme, Inc., Snow County Contracting, Inc., Coastal Construction Group, Power Construction Group, and others in attendance. The bid opening date is March 4, 2026. Key addendum items include updated epoxy dowel callouts on Sheet S-7.0 specifying #5 epoxy-anchored dowels at 12 inches on-center with minimum 12-inch embedment, updated backfill specifications in Section 02320, revised general conditions addressing federal prevailing wage requirements in Section 00700-19, and federal prevailing wage rate schedules and federal provisions included in Appendix III.

The project is federally funded, requiring compliance with Davis-Bacon Act prevailing wage requirements, Federal Provisions Addendum requirements, and Build America, Buy America (BABA) Act compliance. Prevailing wage rates for the Heavy Construction category in Baraga, Houghton, Keweenaw, Luce, Mackinac, Menominee, Ontonagon, and Schoolcraft Counties are established as of January 2, 2026, with rates varying by trade classification—ranging from $10.89 for landscape laborers to $45.98 for power equipment operators in underground construction. The contract requires Davis-Bacon wage compliance with certified payroll submissions using Department of Labor Form WH-347, contractor registration in the Federal System for Award Management (SAM), and a Unique Entity Identifier (UEI) maintained throughout contract performance. Michigan residency requirements mandate that 50 percent of persons employed on the work by the contractor shall have been Michigan residents for not less than one year before employment, unless exempted in writing by the owner or through collective bargaining agreements allowing interstate employee portability.

7.14.3.3. Construction Mechanics under this Contract are intended beneficiaries of the contractual prevailing wage, fringe benefit, and nondiscrimination nonretaliation requirements of the Contract. Any such Construction Mechanic aggrieved by failure of a contractor or subcontractor to pay prevailing wages or benefits as specified in the Contract, or by violation of section 7 of 2023 PA 10, in addition to any other remedies provided by law, may bring an action in a court of competent jurisdiction against such contractor or subcontractor for damages or injunctive relief and may be awarded reinstatement or other appropriate relief, and all damages sustained, together with actual costs and attorney fees at trial and on appeal.

This record shall be available for reasonable inspection by the State.

7.14.3.5 Contractor must immediately notify the Owner if Contractor’s state project registration or a Subcontractor’s state project registration is no longer valid (i.e. suspended, revoked or not renewed) at any time during the term of the Contract.

7.14.3.6. Contractor is to submit certified payrolls, including contractor and subcontractor, not later than 10-days after the end of a pay period to the Department of Labor and Economic Opportunity database via the internet through the Online Certified Payroll Submission process the Contractor signed up for to receive their State Project Registration, 2023 PA 10 as amended, MCL 408.1122. D. Cut out soft areas of subgrade not capable of in situ compaction. Backfill with embankment fill and compact to density equal to or greater than requirements for subsequent backfill material.

1. Shall unsuitable soils be encountered, test pits may be required in accordance with Section 02320 – Excavation, and as directed by the Engineer.

E. Prior to placement of backfill, compact subsoil to 95 percent of its maximum dry density as determined by the modified proctor method (ASTM D1557– Moisture-Density Relations of Soils and Soil-Aggregate Mixture Using 10 lb. (4.54 kg) Rammer and 18-inch (457 mm) Drop).

3.02 BACKFILLING

A. Backfill areas to contours and elevations. Use unfrozen materials.

B. Use existing excavated material for all areas to be landscaped (seed or sod).

C. Systematically backfill to allow maximum time for natural settlement. Do not backfill over porous, wet, frozen or spongy subgrade surfaces.

D. Place fill material in uniform and horizontal layers.

E. Unless otherwise noted in the Contract Documents or directed otherwise, all fill material shall be placed and compacted. Place and compact materials in continuous layers not exceeding 12 inches loose depth to a minimum of 95% of the Modified Proctor as determined by ASTM D1557.

F. Employ a placement method so not to disturb or damage foundations, walls, and utilities.

G. Maintain optimum moisture content of backfill materials to attain required compaction density.

H. Backfill against supported foundation walls. Do not backfill against unsupported foundation walls.

I. Make grade changes gradual. Blend slopes into level areas.

GEI Project No. 2304013 8 Section 02320

J. Remove surplus backfill materials from within grading limits. Stockpile surplus material in an Owner approved location onsite, easily accessible for future use.

K. Conduct of Work: Maintain and protect the fill in a satisfactory condition at all times until final completion and acceptance of all work under the contract. If in the opinion of the Engineer, the embankment material is unsuitable after being placed and before final acceptance of the work; the material shall be replaced in a satisfactory manner at no additional cost to the owner. The Contractor may be required to remove, without additional payment, any earthwork material placed outside the design lines.

L. Stockpiling of materials: Materials delivered to the site shall be stockpiled in the designated construction limits unit its use is required. No payment will be made for such stockpiling, protection or for the reloading and hauling of this material to its final position in the embankment. Stockpile different materials such as embankment fill, filter sand, etc. in separate piles without intermixing. Place, grade, and shape stockpiled material to drain surface water from stockpiles. Stockpile soil materials away from edge of excavations.

Disk clay prior to compaction if necessary to result in soil clod size smaller than 4-inches.

4. Place lifts of clay to form continuous monolithic material. Remove excessively dry or wet soil before placement of additional lifts. Combine each lift into previously placed lift with sheepsfoot roller or similar equipment to eliminate segregation of lifts. Prewetting of the previous lift may be needed if excessive drying between lift placement has occurred in the opinion of the Engineer and/or his onsite representative and demonstrated by moisture content field checks.

GEI Project No. 2304013 9 Section 02320
