About this file
This document is Amendment 0006 to solicitation NAVMWR-26-R-0029 for the Repair of Admiral Baker Pool Complex at Naval Base San Diego. The amendment incorporates responses to 15 requests for information (RFIs) submitted by bidders and provides clarifications on project scope, design specifications, and material requirements.
Key clarifications include: bidders may justify and clarify their quotes; no property survey is available but a property summary map will be provided; CAD files of 15% drawings will be provided by the A&E firm; permitting is required only through NAVFAC (not City/County); the chain-link fence surrounding gazebos within the pool area (approximately 250 linear feet) should be demolished to facilitate patron access, while the perimeter pool complex fencing (approximately 660 linear feet) must remain; mold remediation is conditional—if mold is encountered during construction, work will be stopped pending assessment and remediation by Public Works with appropriated funds; fiber connection points are located in the main office; standing seam metal panels with water management systems are required (not metal shingle panels); the ice machine will be furnished by the Navy (Westlake Commercial 350LB Air Cooled model SK-329); deck segregation should remove internal chain-link fencing per Model Aquatic Health Code standards; flooding from adjacent slopes requires drainage solutions such as installing drains, constructing barriers, or elevating affected building sections; environmental studies are attached; and no parking lot improvements are included in scope. The pool was closed 10 years ago due to deteriorated pool plaster and water slide structure. The amendment was issued on 06 May 2026, with the contracting officer being Alanna Young.

Introduction:
The Department of the Navy (DON) is aware of the November 12, 2024 decision in Marin Audubon Society v. Federal Aviation Administration, No. 23-1067 (D.C. Cir. Nov. 12, 2024). To the extent that a court may conclude that the Council on Environmental Quality (CEQ) regulations implementing NEPA are not judicially enforceable or binding on this agency action, the DON has nonetheless elected to follow those regulations at 40 C.F.R. Parts 1500– 1508, in addition to DON’s procedures/regulations implementing NEPA at 32 C.F.R. Part 775, to meet the agency’s obligations under NEPA, 42 U.S.C. §§ 4321 et seq.
This Record of CATEX, prepared per reference (a) through (e), assesses the environmental effects and impacts related to renovating the pools and associated support facilities at Mission Gorge Recreation Area (MGRA), Naval Base San Diego (NBSD), San Diego, CA. A categorical exclusion is defined as “a published category of actions that do not individually or cumulatively have a significant impact on the human environment under normal circumstances, and therefore, do not require either an environmental assessment or an environmental impact statement.”
Purpose and Need:
A major renovation of the Admiral Baker pools and support facilities is needed to modernize the facilities, improve the customer experience and safety, and replace outdated equipment.
Proposed Action:
The pool will be resurfaced, the tile, overflow gutter system and water slide will be replaced, the
RECORD OF CATEGORICAL EXCLUSION
pool deck will be repaired or replaced, and the lighting will be upgraded to LED. Facility 22 is the wading pool, and it will be converted into a splash pad area. Facility 17 consists of office space and a Snack Bar. It will have all wood rot, mold, water and termite damage remediated, roof replaced, and all office space refinished. Facility 16 consists of office space, locker rooms, showers, and restrooms. It will be completely renovated and the roof will be replaced. The showers will be converted to individual showers and reconfigured to current standards.
The updated finish package includes but not limited to the exterior and interior wall (and covering), floor, ceiling, doors both interior and exterior, casework, counters, etc. The lighting will be updated to LED. The electrical system will need to be assessed to verify capacity for new installed equipment and will upgraded if necessary. The adequacy of mechanical systems will need to be assessed to determine if improvement in airflow can be made through cleaning or re-balancing HVAC system. The plumbing systems, interior and exterior grading need to be assessed to determine if there is potential for flooding or plumbing backups and provide recommended solutions. Equipment required for this project includes a crane for the pool slide installation, skid steer, scissor lifts, boom lifts, and concrete truck. Lead and asbestos survey results for the roof, concrete, and paint in and around building 17 were above 600 ppm for lead and positive for asbestos in 2024 and 2018, therefore, abatement is required, references (e-g).
Environmental Impact Analysis:
Environmental Management System Contractor must perform work consistent with the policy and objectives identified in Naval Base San Diego’s Environmental Management System (EMS) and perform work in a manner that conforms to objectives and targets, environmental programs, and operational controls identified by the EMS. In the event an EMS nonconformance or environmental noncompliance associated with the contracted services, tasks, or actions occurs, the Contractor must take corrective and/or preventative actions. In addition, the Contractor must ensure that its employees are aware of their roles and responsibilities under the EMS, and how these EMS roles and responsibilities affect work performed under the contract. The Contractor is responsible for ensuring their employees receive Environmental Awareness training prior to contract work start. Personnel doing work must be aware of: (a) the environmental policy; (b) the significant environmental aspects and related actual or potential impacts associated with their work; (c) the contribution to the effectiveness of the EMS, including the benefits of enhanced environmental performance; and (d) the implications of not conforming to the EMS requirements, including legal requirements and compliance obligations. Completion of training must be documented with training records provided to the NBSD EMS Coordinator who will retain associated records. EMS training can be arranged through the NBSD EMS coordinator (619-556-4975) or may be found at:
https://environmentaltraining.ecatts.com/home. An initial registration password for ECATTS may also be obtained by contacting the NBSD EMS Coordinator.
Hazardous Waste Any salvageable material/debris must be recycled in accordance with the Commander Navy Region Southwest (CNRSW) landfill diversion instruction (COMNAVREGSWINST 11350.1C).
Material determined to be non-salvageable by the contractor will be submitted to the contracting officer for written concurrence as to status. If the contracting officer concurs that the material is non-salvageable, he/she will provide specific direction to the contractor regarding disposal.
Contaminated debris or items determined to be a waste must be managed and disposed of in accordance with applicable Federal, state, city, and local regulations and the CNRSW Hazardous Waste, Universal Waste, Special Waste Management Plan. Waste fuel in existing emergency standby generator can either be sampled and repurposed or managed as hazardous waste. All contractor generated hazardous waste and co-generated hazardous waste transported off-site must be sampled, characterized, and profiled prior to exporting off-site and will be transported using the proper EPA ID number. Consult with the contracting officer to determine whether waste may be transported using the U.S. Navy EPA ID or if the contractor must obtain their own EPA ID prior to transporting.
NAVFAC SW has contracted an environmental service provider (ESP) to operate the HW facilities in the Metro San Diego Area of Responsibility (AOR). The ESP retains and archives copies of all signed HW manifests using EPA IDs that are owned or managed by the CNRSW.
Only designated individuals authorized in writing may sign HW manifests that use EPA IDs owned or managed by CNRSW. Authorization to sign HW manifests is dependent upon meeting qualifications contained in OPNAV M-5090.1 (Chapter 27, Section 3.5.c (1)), 40 CFR 262.23 – 25, 49 CFR 172.204 – 205, and 22 CCR 66265.16, including applicable training requirements, subsequent refreshers and maintenance of appropriate training records. The written contract with the ESP, authorize the ESP to perform HW manifest signing on behalf of CNRSW and installations in the Metro San Diego AOR, contact Noreas General Inquiries 619-545-6520. The ESP is not responsible for providing signature for non-hazardous waste manifests or bills of lading, please refer to the project contract for non-hazardous waste signature guidance.
The Department of Toxic Substances Control (DTSC) has classified friable and powdered waste containing more than one percent asbestos as a hazardous waste, and specifies special handling and disposal procedures. Friable Asbestos Containing Material (ACM) must be wetted and double-bagged for storage and transfer. Each asbestos package or container must have a caution label affixed to the outside. The label must be conspicuous and contain legible lettering that spells the following warning: "DANGER CONTAINS ASBESTOS FIBERS AVOID CREATING
DUST CANCER AND LUNG DISEASE HAZARD."
Wastes that contain only non-friable asbestos are not subject to hazardous waste management under state hazardous waste laws, regardless of their asbestos content; but are still regulated under air quality regulations.
If any person or operation that releases one pound or more of friable asbestos into the environment must comply with regulatory reporting requirements within 24 hours. Therefore, in the event of a release, please contact NBSD Environmental at 619-556-1357.
Hazardous Materials The asbestos survey results for roof, concrete, and interior plaster at building 17 indicates asbestos is present, references (e-g). However, for any work on materials or areas not previously surveyed and prior to any demo-related disturbance, the contractor must complete a comprehensive asbestos survey to include all areas and components where work is to be performed. The survey must be completed in compliance with San Diego Air Pollution Control District (APCD) Rule 1206, which includes but is not limited to samples being collected by a certified individual and samples analyzed by a National Voluntary Laboratory Accreditation Program (NVLAP) laboratory. When sampling for asbestos, Contractor must identify and sample asbestos-containing material (ACM) and analyze according to either phase contrast or polarized light microscopy based on standard analytical methods. Proposed sample frequencies for identified ACM will follow the Asbestos Hazard Emergency Response Act (AHERA) sample rules as a function of calculated square, lineal, or cubic footage and ACM type.
Contractor must submit the completed survey and required Asbestos Management Plan to the NBSD Asbestos Program Manager (APM) Holman (Frank) Pangelinan (619-634-9329) or Holman.f.pangelinan.civ@us.navy.mil for review and approval. The APM will determine and communicate with the Contractor notification requirements to APCD for compliance with Rule 1206. When disturbing at least 100 square feet or 20 cubic feet of Regulated Asbestos-Containing Material (RACM), Contractor is required to submit to the APCD a written notification ten (10) working days prior to beginning work. Contractor shall send a copy of the notification to the APM and construction Manager.
Asbestos workers must be trained in the relevant AHERA asbestos coursework that establishes them as competent personnel and be under medical surveillance with current medical releases.
ACM abatement must be conducted according to the proper Occupational Health and Safety Administration (OSHA) Class 1 through 4 categories and under correlative containment, decontamination, and air clearance requirements. Engineering controls, work practices, and personal protective equipment (PPE) will be implemented and ensured. All ACM that is abated (if applicable) will be handled and disposed of in accordance with National Emission Standards for Hazardous Air Pollutants (NESHAP) guidelines. Further, asbestos sample reports must contain both sample location maps (which illustrate the sampled areas, homogeneous materials (HM), sampled area/HM dimensions/extent/calculated square footage, and sample locations/HM) and analytical summary tables (with HM#, HM type/color, HM dimensions/calculated square footage, and sample results).
The lead survey for paint at building 17 indicates lead levels above California Code of Regulations (CCR) Title 8 threshold. However, for any work on materials or areas not previously surveyed and prior to any demo-related disturbance, additional lead testing will be required.
Contractor shall coordinate with NBSD APM listed above regarding lead-based paint (LBP), and for areas not tested, must evaluate chips/debris from painted surfaces for lead hazards in accordance with 29 CFR 1926.62. When work disturbs painted surfaces, assume lead is present and test impacted surfaces before disturbance: use >0.01% by weight or 100ppm as detection limit. Workers must be trained in lead hazard and under medical surveillance. Ensure engineering controls, work practices and PPE are implemented. Ensure waste disposal characterization is done and that there is safety/ industrial hygiene oversight. Contractor will also evaluate chips/debris from painted surfaces for any California Code of Regulations (CCR) Title 22 regulated metals to determine metal toxicity hazards. All contaminated debris will be disposed of in accordance with above guidelines.
Unexploded Ordinance Project area is located within Unexploded Ordinance (UXO) Site 5 in an area previously removed down to two to three feet. The project proposes some ground disturbing activities that extend below areas that were previously disturbed. Prior to contractor beginning activities, workers are required to receive munitions and explosives of concern (MEC) awareness training, including 3Rs (Recognize, Retreat, Report) training. Areas being disturbed may require an UXO technician escort to ensure safety in case munitions have penetrated below the 2-foot disturbance depth.
Contractor must coordinate with Jonathan Ma at 619-705-5448 or jonathan.ma.civ@us.navy.mil for documentation and training.
Utilities Prior to any subsurface excavation, the contractor will submit an A-E Safety Plan/APP to the NAVFAC SW Project Manager for approval. Underground Service Alert (USA) or Dig Alert will be notified before fieldwork to mark out known underground utilities that may conflict with the proposed project. Navy Public Works Center (PWC) procedures for subsurface operations will be followed and the NAVFAC Southwest Permit to Perform Subsurface Operations will be submitted at least 14 days before intrusive work at the site.
Storm Water If the combined project area including laydown area and dirt mounds will affect less than one acre of land, it does not require coverage under the state General Permit for Discharges of Storm Water Associated with Construction and Land Disturbance Activities (Order WQ 2022-0057-DWQ, NPDES No. CAS000002). To protect against storm water contamination from exterior sources including equipment and material laydown areas, the contractor must follow Naval Base San Diego established storm water best management practices (BMPs), enclosure (3). Area storm drains, including those in laydown areas, must be completely covered for the duration of construction and removed upon project completion.
Potable Water All work involving the potable water system must be conducted in accordance with Unified Facilities Guide Specifications (UFGS) 22-00-00 Part 3.9.3 flushing requirements, and NBSD letter dated 7 Apr 09 serial # N45MC.ri/0007 which includes requirements to work with NAVFAC Southwest Utilities to ensure cross-connections and/or contamination are not made with drinking water systems. Potable water laterals supplying water to structures being demolished will be terminated as close to the water main as possible to prevent creating “dead ends” in the water system.
Air Pollution Control Contractor must follow San Diego APCD Rules, including but not limited to Rule 67.21 restrictions on adhesive use, and Rule 67.0.1 requirements for architectural coatings. Products must meet APCD volatile organic compound (VOC) limits. Current Rule 67.0.1 requirements for architectural coatings are as follows: Flat Coatings VOC 50 g/L; Non-flat Coatings VOC 50 g/L.
Dust shall be kept under APCD Rule 55 Fugitive Dust Control limits as well as maintain compliance with nuisance Rule 51. Particulate matter must be kept under Rule 52 limits.
Containers used to store, transfer, apply, or otherwise employ materials containing VOC shall be closed when not in use per Rule 67.17(d)(l). Asphalt based sealant must be used instead of coal tar sealant to minimize polycyclic aromatic hydrocarbons released from the asphalt sealant.
Contractor is responsible for ensuring compliance with any APCD Rule changes prior to commencing the project.
Air permits must be obtained for the project as necessary, including use of portable emission units such as cold planers and asphalt grinders, and all fuel driven power sources such as generators and compressors (APCD Rule 11 Exemption states portable diesel fueled equipment less than 50 BHP, e.g., 49 BHP and below are exempt). It is the responsibility of the contractor to obtain air permits (if required) for equipment installed as part of this project. Contractor must ensure all rental equipment and/or sub-contractor owned equipment shall, if required, have copies on-site of all associated documents to include copies of rental contracts, CARB Registrations and or local APCD Permits to Operate.
Diesel-powered equipment must use only California Air Resources Board (CARB) approved fuel per California Code of Regulations (CCR) Title 13, Division 3 and Title 17, Division 3.
All self-propelled off-road equipment (ORE) and large spark ignition (LSI) equipment 25HP or greater must be compliant with the requirements of CARB regulations (13 CCR 2449 and 13 CCR 2775) including Diesel Off-Road Online Reporting System (DOORS), labeling, and idling limits.
Contractors are required to provide and retain copies of the valid Certificate of Reported Compliance (DOORS Certificate) for their fleet and their listed subcontractors, if applicable, per 13 CCR 2449(n). Contractor shall send copies of their certificate(s) to NBSD Environmental Air Program Manager Nick Critti at nick.j.critti.civ@us.navy.mil prior to bringing equipment on site.
Natural Resources The contractor shall adhere to all applicable Federal and State laws, including but not limited to Endangered Species Act (ESA), 16 U.S.C. 35; Migratory Bird Treaty Act (MBTA), 16 U.S.C.
703; Federal Noxious Weed Act of 1974, 7 U.S.C. 2801; and 33 Code of Federal Regulations (CFR) 320-330, Clean Water Act Section 404 and Rivers and Harbors Act Section 10 Regulatory Programs and implementing regulations.
The Migratory Bird Treaty Act (MBTA) of 1918 (16 U.S.C. 703-712) as amended, and EO 13186, Responsibilities of Federal Agencies to Protect Migratory Birds, require Federal agencies to minimize or avoid impacts on migratory birds listed in 50 CFR 10.13. If the project occurs during the nesting season (January 15th through September 15th), and there are any active nests in or near the project area, contractor must coordinate with the NAVFAC wildlife biologist (Michelle Maley, michelle.b.maley.civ@us.navy.mil or 619-705-5567). Active nests are those having egg(s) or nestling(s), and cannot be moved or disturbed.
The project is located within 500’ of California gnatcatcher habitat. Because noise from construction activities has the potential to affect the behavior of nesting gnatcatchers, work over 60 dB hourly leq needs to occur outside of California gnatcatcher nesting season, which is 15 Feb through 31 Aug.
Holes must be filled in a timely manner to avoid creating habitat for special status species (such as western spadefoot toad) or incidentally trapping wildlife. If holes are not filled within the same day, they need to be checked daily and all trapped animals must be removed and safely relocated.
To control the spread of non-native plants and impacts to adjacent native habitat, all equipment and/or vehicles must be cleaned and power-washed prior to arriving at the facility and project site.
Pressure washing must focus on removal of plant materials and seeds or mud containing seeds from all vehicle components including the undercarriage of construction equipment.
Cultural Resources Any unanticipated historic or archaeological materials discovered during ground disturbing activities shall be subject to further investigation, consistent with Stipulation 10 of the NBSD Programmatic Agreement. In this case, the excavation phase of the project shall cease. The contractor shall contact the Cultural Resources Dept. at 619-705-5656.

The proposed action is not expected to have an adverse effect on such areas because wetlands do not exist within or near the vicinity of this action, and the project does not require an Army Corps of Engineers permit.
d) Have an adverse effect on archaeological resources or resources listed or determined eligible for listing on the National Register of Historic Places (including but not limited to ships, aircraft, vessels and equipment) where the adverse effect has not been previously resolved through an agreement in compliance with Section 106 of the National Historic Preservation Act or has not been resolved through an agreement executed between the DON and the appropriate historic preservation office and other appropriate consulting parties:
Based on the information provided, the Cultural Resource Management Program has determined that the proposed action can be approved with a finding of "No Historic Properties Affected", consistent with Stipulation 8A of the PA and 36 CFR 800.4(d)(1).
No further compliance with Section 106 or 36 CFR 800 is required, unless the scope and potential effects change.
e) Result in an uncontrolled or unpermitted release of hazardous substances, or require a conformity determination under the standards of the Clean Air Act General Conformity Rule:
The proposed action is not expected to release hazardous substances. The proposed action would result in a minimal increase in emissions which will not exceed de minimis thresholds and is exempt from conformity requirements per 40 CFR 93.153 (c) (2). The undertaking will not result in the release of hazardous substances.
Greenhouse Gas: Based on reasonable assumptions, this proposed action will not individually or cumulatively meet or exceed the general emissions threshold of 25,000 metric tons of CO2 per year.
This CATEX serves as a Record of Non-Applicability for this project.
Determination:
The proposed action is within the scope of CATEX 34. No extraordinary circumstances are present in this case. Therefore, the proposed action is excluded from the requirement for further National Environmental Policy Act analysis. Provided the scope remains as proposed and standard Navy best management practices for safety and environmental compliance are implemented, the Navy has determined that the proposed action is within the scope of a categorical exclusion. None of the exclusions from reliance on a CATEX apply in this case. Therefore, the proposed action is excluded from the requirement for further NEPA analysis. This CATEX expires upon a change in conditions of the proposed action or the environment. This CATEX has been coordinated with the document owners of references (b), (c) and (d) and the staff at Naval Base San Diego.

Additional layers observed and analyzed.Note:
Bulk sample(s) submitted was (were) analyzed in accordance with the procedure outlined in the US Federal Register 40 CFR Appendix E to Subpart E of Part 763; EPA-600/R-93/116 (Method for Determination of Asbestos in Building Materials), and EPA-600/M4-82-020 (US EPA Interim Method for the Determination of Asbestos in Bulk Insulation Samples). Samples were analyzed using Calibrated Visual Estimations (CVES); therefore, results may not be reliable for samples of low asbestos concentration levels. Samples of wall systems containing discrete and separable layers are analyzed separately and reported as composite unless specifically requested by the customer to report analytical results for individual layers. This report applies only to the items tested. Results are representative of the samples submitted and may not represent the entire material from which the samples were collected. “None Detected” means that no asbestos was observed in the sample. “<1%” (less than one percent) or Trace means that asbestos was observed in the sample but the concentration is below the quantifiable level of 1%. This report was issued by a NIST/NVLAP (Lab Code 200982-0) accredited laboratory and may not be reproduced, except in full without the expressed written consent of Patriot Environmental Laboratory Services, Inc. This report may not be used to claim product certification, approval or endorsement by NIST, NVLAP, CA-ELAP or any government agency.

Ref: (a) WebESS ID# 1154/ESSDR 23-17
(b) NOSSAINST 8020.15E
(c) NAVSEA OP 5, Volume 1, Seventh Revision
1. As requested by reference (a), the Naval Ordnance Safety and Security Activity (NOSSA) reviewed the subject Explosives Safety Submission (ESS) Determination Request in accordance with references (b) and (c). Based on the information provided, NOSSA concurs that an ESS is not required to conduct general maintenance activities within unexploded ordnance (UXO) Site 5 at Naval Base San Diego, California.
2. Documentation provided in reference (a) supports the determination that a low likelihood of encountering munitions and explosives of concern (MEC) and/or material potentially presenting an explosive hazard (MPPEH) exists for the proposed project and the following conditions apply:
a. A majority of the programmatic work including both intrusive and non-intrusive activities involving general facilities maintenance and surveying will be in previously disturbed soil which is not expected to contain any MEC or MPPEH.
b. Limited activities including repair or replacement of similar equipment will occur in areas which have received fill and the depth of work will be restricted to the depth of previous disturbance.
c. Anomaly avoidance techniques will be employed by UXO-qualified personnel to avoid contact with MEC or MPPEH for both surface and subsurface activities in areas outside of the three-dimensional limits of previously disturbed soil.
d. Historic records indicate no military operations occurred in the Subarea D region. MEC and MPPEH are not expected to be encountered in this area.
e. Prior to commencing operations, all site personal will receive MEC Awareness training, including Recognize, Retreat, and Report procedures.
Subj: EXPLOSIVES SAFETY SUBMISSION DETERMINATION REQUEST FOR
GENERAL MAINTENANCE AND OTHER ACTIVITIES AT UNEXPLODED
ORDNANCE SITE 5 AT NAVAL BASE SAN DIEGO, CALIFORNIA
3. If surface or subsurface MEC or MPPEH is discovered on the site in Subarea D, in previously disturbed soil, or while employing anomaly avoidance techniques, the following steps must be taken:
a. For expended or unexpended small arms ammunition, note their description and location, notify the responsible Explosives Safety Officer (ESO) and the project manager. Qualified and authorized activity personnel may manage and disposition these items in accordance with reference (c) and applicable environmental regulations.
b. For items other than expended or unexpended small arms ammunition, the item will be avoided and its location and description will be reported to the responsible ESO and the project manager. An emergency response from the cognizant Explosive Ordnance Disposal detachment will be requested, if appropriate.
6. The NOSSA point of contact for this matter is Ms. Kristen McCahill, who can be contacted at 301-744-6825.
