About this file

This document is Amendment 0001 to Solicitation No. NAFUA1-26-R-0003, issued by the Defense Logistics Agency (DLA) NAF Contracting Office on September 22, 2026, for a ten-year food-service concession contract at DLA San Joaquin, Fort Belvoir, Virginia. The amendment extends the proposal submission deadline from November 2, 2026 to November 12, 2026 at 3:00 p.m. Eastern Time and incorporates a consolidated questions-and-answers document addressing 49 substantive topics concerning contract requirements and operations.

The contract encompasses food-service operations at two fixed facilities (Building 100 and Building 16) and a mobile food truck, requiring Monday-through-Friday operations from 6:00 a.m. to 2:00 p.m. for fixed facilities and 7:15 a.m. to 12:30 p.m. for the mobile truck. Historical net sales for March through August 2026 totaled $253,604.76 across all venues with combined average monthly sales of $42,267.46. The contractor must propose both a monthly concessionaire fee and a commission percentage of Gross Sales, paying whichever is greater monthly. Key requirements include ServSafe Level I certification for managers, compliance with food-safety standards (TB MED 530, AR 40-5, AR 40-657), calorie labeling, healthy-option identification, monthly menu and price approvals from the Contracting Officer's Representative, and comprehensive financial and POS reporting. The NAFI furnishes buildings, equipment, utilities, professional hood/exhaust cleaning, and mobile-truck fuel and maintenance, while the contractor maintains preventive equipment maintenance (with a $250 deductible per occurrence for fair-wear-and-tear repairs) and is fully responsible for contractor-owned equipment. Installation public-health oversight applies rather than county permitting; contractor personnel require installation access credentials with submission requested at least three business days in advance. The contract period runs from December 30, 2026 to December 29, 2036, with a 30-day transition window following award, and includes semi-annual joint equipment inventories conducted with the NAFI property representative.

NAFUA1-26-R-0003 Amendment 0001 Attachment 1

Attachment 1 – Consolidated Questions & Answers Solicitation No.: NAFUA1-26-R-0003

Amendment No.: 0001

Date: 28 October 2026

I. Current Contractor and Commercial Information

1. Current Operator / Temporary Contractor

Question: Is there a current operator, and who is it?

Response:

There is no long-term incumbent contract for this requirement. Current food-service operations are being performed under a temporary arrangement pending award and transition under Solicitation NAFUA1-26-R-0003. Offerors shall prepare proposals based on the solicitation and all amendments.

2. Current Temporary Contractor Agreement, Fees, and Modifications

Question: Can the Government provide the current temporary contractor’s agreement, lease, award document, pricing schedule, concession fee, commission rate, modifications, or other contract terms?

Response:

The NAFI will not provide the current temporary contractor’s agreement, lease documents, award pricing, fee schedule, commission rate, modifications, or other commercial terms.

The temporary arrangement does not establish the requirements, pricing, staffing, concession fee, commission rate, or other terms applicable to the resulting contract.

Offerors shall prepare proposals based on Solicitation NAFUA1-26-R-0003 and its amendments.

3. Current Temporary Contractor Costs, Staffing, Menus, and Pricing

Question: Can the Government provide current contractor operating costs, staffing, employee schedules, menus, prices, daily specials, catering menus, vendor agreements, labor costs, food costs, insurance, overhead, or profit?

Response:

The NAFI will not provide the current temporary contractor’s internal operating costs, staffing information, employee schedules, menus, pricing, financial data, vendor agreements, or other protected commercial information. Offerors shall develop their own cost assumptions, staffing approach, menu, pricing, and operating plan based on the solicitation and amendments.

4. Current Temporary Contractor Performance and Customer Feedback

Question: Can the Government provide temporary contractor performance ratings, customer complaints, corrective actions, customer feedback, operational challenges, or recommendations?

Response:

The NAFI will not provide contractor-specific performance ratings, complaints, corrective actions, subcontractor information, or internal oversight information.

II. Facilities, Equipment, Utilities, and Cleaning

5. Facility and Food-Truck Photographs

Question: Can the Government provide photographs of Building 100, Building 16, and the mobile food truck?

Response: The NAFI will not provide photographs of Building 100, Building 16, or the mobile food truck. Offerors are encouraged to review the solicitation attachments, including the available floor plans and NAFI-furnished equipment inventory, and to use the site-visit opportunity to inspect the performance locations and satisfy themselves regarding conditions that may affect proposal preparation and contract performance.

The site visit and solicitation attachments are the information available for this purpose. No additional photographs will be provided.

6. NAFI-Furnished Equipment Inventory

Question: Can the Government provide a complete inventory of NAFI-furnished kitchen equipment?

Response:

Attachment J-2 provides the NAFI-furnished equipment inventory.

The RFP identifies Attachment J-2 as the NAFI-Furnished Equipment Inventory.

7. Equipment Condition, Deficiencies, and Planned Replacements

Question: Can the Government identify current operating condition, known deficiencies, out-of-service equipment, and planned replacements, removals, or installations?

Response:

As of October 22, 2026, FMWR and Facilities report that all NAFI-furnished equipment intended for contractor use is operational. No known equipment deficiencies, out-of-service equipment, or planned replacements, removals, or installations have been identified. Any material status change identified before transition will be provided to the successful contractor.

8. Equipment Operational Status at Turnover

Question: Will all NAFI-furnished equipment be operational and ready for use at turnover?

Response:

Yes. As of October 22, 2026, NAFI-furnished equipment intended for contractor use is expected to be operational at turnover. The NAFI-designated property representative and the successful contractor will conduct a joint inventory during transition. The contractor shall promptly report any discrepancy or less-than-functional condition identified at turnover to the Contracting Officer.

9. Equipment Maintenance, Repair, Replacement, and Damage

Question: Who is responsible for preventive maintenance, repair, replacement, and contractor-caused damage for NAFI-furnished equipment?

Response:

The contractor is responsible for preventive maintenance of NAFI-furnished equipment used in the concession operation. Preventive maintenance includes scheduled inspection, cleaning, lubrication, adjustment, calibration, and minor component replacement necessary to minimize equipment malfunctions and deterioration.

For repairs resulting from fair wear and tear, the contractor shall pay the first $250 of maintenance or repair expense for each NAFI-furnished item per occurrence. The NAFI shall pay the amount exceeding $250. Repairs required because of contractor abuse, negligence, or damage caused by contractor personnel shall be paid entirely by the contractor.

Walk-in coolers and freezers are an exception. The contractor is not responsible for maintenance or repair of NAFI-furnished walk-in coolers and freezers. DLA Installation Management at San Joaquin is responsible for ensuring preventive maintenance of those units.

DLA Installation Management at San Joaquin is also responsible for maintaining the building structure and building utility systems to the point of connection with food-service equipment, including gas, water, sewer, ventilation, and electrical lines. The contractor remains responsible for damage caused by its personnel.

The contractor is fully responsible for maintaining, repairing, and replacing contractor-owned equipment.

10. Mobile Food-Truck Fuel, Maintenance, and Repairs

Question: Who is responsible for fuel, preventive maintenance, routine maintenance, and repairs for the mobile food truck?

Response:

The mobile food truck is NAFI-furnished property. For purposes of mobile food-truck operations, the NAFI will provide fuel for normal operations.

If the NAFI fuel station is unavailable and the contractor must purchase fuel to continue required operations, the contractor shall retain supporting receipts and promptly submit a reimbursement request to the Contracting Officer through the COR. Reimbursement is subject to Contracting Officer approval.

DLA Installation Management at San Joaquin Facilities Division will perform preventive maintenance, routine maintenance, and repairs for the NAFI-furnished mobile food truck.

The NAFI will bear the cost of such maintenance and repairs unless the need for repair results from contractor abuse, negligence, misuse, or failure to report a known condition in a timely manner.

Notwithstanding the general repair-cost allocation for other NAFI-furnished equipment, the contractor will not be responsible for the first $250 of maintenance or repair costs for the NAFI-furnished mobile food truck when the repair is not caused by contractor abuse, negligence, or misuse.

11. Refrigerated, Frozen, and Dry Storage

Question: Will the contractor have dedicated refrigerated, frozen, and dry-storage space in both buildings?

Response:

The contractor will be provided exclusive use of the refrigerated, frozen, and dry-storage areas assigned to the concession operations at Buildings 100 and 16.

Both locations include cold/freezer walk-in rooms, additional refrigerated or frozen storage, and dry-storage areas. Storage capacity and configuration vary by location; Building 16 has more limited storage capacity, while Building 100 has substantially larger storage areas.

The contractor shall maintain all assigned storage areas in a clean, orderly, secure, and sanitary condition and shall use the areas only for performance of the resulting contract.

12. Contractor-Owned Equipment and Facility Alterations

Question: May the contractor install contractor-owned kitchen equipment, storage, POS equipment, signs, or other improvements?

Response:

POS will be provided by the Contractor and Contractor-owned equipment may be used in performance of the contract, subject to installation safety requirements. Facility renovations, installations, utility connections, penetrations, decorating, painting, or other alterations require prior approval from DLA Installation Management at San Joaquin.

Associated costs are the contractor’s responsibility unless otherwise stated in the resulting contract.

13. Utilities, Trash, and Grease Disposal

Question: Are electricity, natural gas, water, sewer, trash disposal, grease disposal, and other utilities furnished at no additional charge?

Response:

Electricity, natural gas, water, sewer, trash disposal, and other building utilities necessary for operation of Buildings 100 and 16 will be provided at no additional charge to the contractor. The contractor remains responsible for facility structures or utility lines damaged through contractor fault or negligence.

14. Building 16 Mop Sink and Mop-Water Disposal

Question: Where is the mop sink in Building 16? Where does the contractor obtain water and dispose of mop water?

Response: The Building 16 custodial room located in the common seating area is designated for contractor use for custodial support activities. The NAFI will coordinate the successful contractor’s access to this room during transition.

The contractor shall use the mop sink in the custodial room as the approved source of water for mopping and as the approved disposal point for mop water. The contractor shall keep the area clean and comply with all applicable sanitation and environmental requirements.

15. Grease Traps, Hoods, Diffusers, and Exhaust Cleaning

Question: Who is responsible for grease traps, hoods, hood filters, diffusers, exhaust systems, and professional hood/exhaust cleaning?

Response:

The NAFI will provide and coordinate professional cleaning of the hood and exhaust systems through DLA Installation Management or another NAFI-designated provider at no additional cost to the contractor.

The contractor remains responsible for routine daily and operational cleaning of accessible hood surfaces, hood filters, diffusers, kitchen equipment, serving areas, and other assigned concession areas.

The COR will coordinate the timing of professional hood and exhaust cleaning with the contractor to minimize disruption to operations.

16. Professional Cleaning Before Contractor Opening

Question: Will the facility be professionally cleaned before the successful contractor begins operations?

Response: The NAFI will ensure that the assigned concession areas in Buildings 100 and 16 are professionally cleaned before the successful contractor begins operations.

This pre-opening cleaning is intended to provide the facilities in a clean condition at turnover. It does not relieve the contractor of responsibility for maintaining all assigned concession, kitchen, serving, storage, and dining areas in a clean, orderly, safe, and sanitary condition throughout contract performance.

17. Food Loss Due to Power Outage or Equipment Failure

Question: If contractor-owned food inventory is lost due to NAFI refrigeration failure or power outage not caused by contractor negligence, is reimbursement or other relief available?

Response:

For scheduled power outages, the NAFI will coordinate with the contractor on an alternate food-storage plan at no additional cost to the contractor.

For an unscheduled power outage or NAFI-furnished equipment failure not caused or contributed to by contractor negligence, the contractor shall immediately notify the COR and provide documentation of the loss and mitigation actions taken. The Contracting Officer will determine whether reimbursement or other contractual relief is appropriate. No reimbursement or relief is authorized unless approved in writing by the Contracting Officer.

18. Internet and Wi-Fi

Question: Is internet/Wi-Fi provided for contractor business operations, including POS systems, credit-card processing, contractor-owned computers, and printers?

Response:

Internet/Wi-Fi connectivity is provided at no cost to the contractor for contractor business operations, including POS systems, credit-card processing, contractor-owned computers, and printers. Contractor use remains subject to installation IT and security requirements.

Contractor access to the DLA network is not authorized unless separately approved.

III. Sales, Transactions, POS, Catering, and Demand

19. Historical Sales by Building and Service

Question: Can the Government provide monthly historical gross and net sales by Building 100, Building 16, mobile food truck, catering operation, meal period, and food-truck stop for the prior 12 to 24 months?

Response:

Available historical net-sales data are provided for the six-month period from 1 March 2026 through 31 August 2026. The NAFI does not have verified historical gross-sales data, meal-period sales data, food-truck stop-level sales data, or a 12- to 24-month breakout available for release.

Historical net sales for the six-month period were as follows:

Operating Area Six-Month Net Sales Average Monthly Net Sales

Building 100 and mobile food truck combined $165,711.64 $27,618.61

Building 16 $87,893.12 $14,648.85

Total $253,604.76 $42,267.46

Building 100 and the mobile food truck are reported as a combined category because they use the same point-of-sale system. The NAFI does not have a verified separate historical sales breakout for those two operations.

Catering revenue is not included in the figures above. The NAFI has limited historical catering information available.

The historical information is provided for proposal-planning purposes only. It does not guarantee future sales, patronage, revenue, transaction volume, or profitability. The figures are historical net sales and are not the basis for calculating concession payments under the resulting contract. Concession payments will be calculated using Gross Sales as defined in Section B-5.

20. Historical Net Sales Versus Gross Sales

Question: Does the Section C-4 historical net-sales figure include all venues and catering?

How does it reconcile with Gross Sales used to calculate concession payments?

Response:

Section C-4 historical net-sales information is provided for informational purposes only and is not the basis for calculating concession payments under the resulting contract.

For the resulting contract, Gross Sales include all sales of goods, food, beverages, and services, including catering, mobile operations, and delivery. Only actual sales taxes remitted to a taxing authority, documented employee meals, and actual refunds or credits for returned goods or unsatisfactory services may be excluded.

21. Transaction Counts, Patron Counts, and Meal-Period Data

Question: Can the Government provide transaction counts by location and meal period and clarify whether stated patron counts are purchasing customers, transactions, or estimated facility traffic?

Response:

FMWR reports average daily transaction counts for the period 1 March through 31 August 2026 of approximately 144 for Building 100 and the mobile food truck combined and approximately 81 for Building 16. Building 100 and the mobile food truck are combined because they use the same POS system.

The NAFI does not have verified separate transaction counts for Building 100 and the mobile food truck. The RFP’s stated patron figures are estimates for planning purposes only and are not guarantees of future customer demand or sales. The NAFI does not have verified historical sales or transaction data separately by breakfast and lunch for each venue.

22. Product-Level POS and Product-Category Sales

Question: Can the Government provide POS data identifying which products sell and in what quantities?

Response:

The NAFI will not provide product-level POS sales data, item-level quantities, or current temporary contractor sales information. Offerors are responsible for developing their own menu concept, product mix, pricing strategy, and operating approach in accordance with the solicitation requirements.

The solicitation identifies the required minimum food-service offerings and requires offerors to propose menu offerings, pricing, and a customer-service approach responsive to the DLA San Joaquin patron population. Historical sales information provided in the solicitation or by amendment, if any, is for general planning purposes only and does not establish a required menu, product mix, or sales guarantee.

23. Historical Catering Sales and Event Counts

Question: Can the Government provide historical catering sales, event counts, catering frequency, and confirmation whether catering revenue is included in historical sales?

Response:

Catering operations began recently. FMWR reports that one catering event has occurred to date and that catering revenue is not included in the historical financial information reported in Section C-4. The NAFI does not have sufficient historical catering-sales or event data to provide beyond this information. This information is provided for planning purposes only and does not guarantee future catering revenue, event frequency, or customer demand.

24. Historical Closure Calendar and Future Demand Changes

Question: Can the Government provide holidays, closures, training days, weather/emergency closures, reduced-service days, and anticipated changes in installation population or demand?

Response:

Regular food-service operations are not scheduled on Federal holidays. Other than Federal holidays, the NAFI does not have a recurring closure or reduced-service calendar to provide.

The NAFI cannot predict weather-related closures, emergencies, force-protection conditions, or other unforeseen events that may affect food-service operations. The NAFI also cannot guarantee future installation population, staffing, occupancy, customer traffic, or demand levels.

Any known material change to operating conditions that could affect contract performance will be communicated to the contractor as appropriate.

IV. Staffing, Operating Requirements, Menu, and Food Truck

25. Operating Hours

Question: What are the required operating hours for Building 100, Building 16, and the mobile food truck?

Response:

Building 100 and Building 16 are required to operate Monday through Friday from 6:00 a.m.

to 2:00 p.m. The mobile food truck is required to operate from 7:15 a.m. to 12:30 p.m.

26. Holidays, Weekends, Closures, and Reduced Service

Question: Are different operating-hour requirements applicable to weekends, Federal holidays, installation closures, emergencies, or reduced-service periods?

Response:

The required regular operating schedule is Monday through Friday, as stated in the solicitation. Routine weekend and Federal holiday operations are not required.

A contractor may request to operate on weekends or Federal holidays, or request reduced-service operations around holiday periods. Any such request must be submitted in writing to the COR for review and to the Contracting Officer for approval before implementation.

If an installation closure, emergency, or other event affects food-service operations, the NAFI will determine whether cafeteria and mobile food-truck operations will be suspended, reduced, or otherwise adjusted based on the circumstances. The contractor will be notified of any Government-directed operational change.

This response does not establish an entitlement to operate beyond the required schedule or to receive an adjustment to concession-payment obligations. Any such adjustment must be authorized in writing by the Contracting Officer.

27. Staffing Levels

Question: Are minimum staffing levels specified by venue, or may the contractor determine staffing based on demand?

Response:

The contractor is responsible for proposing and furnishing staffing sufficient to meet all operating, food-safety, customer-service, management, and uninterrupted-service requirements.

28. ServSafe, PIC, Food-Handler, and Food-Safety Requirements

Question: What ServSafe, Person in Charge, food-handler, food-safety, sanitation, and installation-specific training requirements apply?

Response:

The current solicitation requires on-site managers and supervisors to be Level I ServSafe certified and requires a ServSafe-certified manager or supervisor at each operating venue during operating hours. The contractor must comply with TB MED 530, AR 40-5, and AR 40- 657.

FMWR has advised that all employees require four hours of food-handler training; each cafeteria establishment requires a Certified Food Protection Manager serving as the Person in Charge; and the mobile food truck may require food-handler training only because food is prepared at Building 100.

29. Menu Variety, Specials, Portions, and Nutrition

Question: May the contractor offer daily specials, seasonal menus, barbecue, rotating international dishes, and other menu innovations? Are there required portion sizes, nutritional standards, or menu selections beyond the RFP?

Response:

The contractor may offer daily specials, seasonal menus, barbecue items, rotating international dishes, and other menu innovations, provided such offerings comply with the solicitation’s food-safety, sanitation, pricing, and approval requirements.

The contractor shall provide the required breakfast and lunch offerings identified in the solicitation and shall maintain current menu information at each operating venue. Daily or weekly specials must be posted for customer viewing.

The contractor shall display calorie information for menu items and clearly identify available healthy-option menu items. For purposes of this contract, a healthy option is a menu item identified by the contractor based on the item’s published nutritional information.

The contractor remains responsible for ensuring that all menu items and related nutritional information are accurate and current.

30. Initial Menu and Price Approval

Question: Must every initial menu item and selling price receive Government approval before operations begin?

Response:

Yes. Before beginning operations, the contractor shall submit a complete initial menu and price list for review and written approval by the COR. The submission shall include all menu items, portion sizes, calorie information, pricing, and supporting cost-of-goods-sold information sufficient to support the proposed pricing.

Initial menu prices must be competitive with, and no higher than, prices for the same or similar items in the local market area. The contractor may not implement the initial menu or price list until it receives written COR approval.

The COR’s menu and price approval is limited to confirming compliance with the solicitation’s menu, pricing, and customer-service requirements. Any change to a contract term or condition remains within the authority of the Contracting Officer.

31. Price Changes and Approval Timeframe

Question: What is the procedure and expected approval timeframe for menu changes or price increases?

Response:

The contractor shall submit all proposed menu changes and price changes in writing to the COR before implementation. Each request shall include, as applicable:

1. The current and proposed menu item or price;

2. The proposed effective date;

3. The reason for the requested change;

4. Updated calorie information, if applicable;

5. Supporting cost-of-goods-sold information; and

6. Information supporting the proposed price’s competitiveness with the local market.

The COR will provide written approval, disapproval, or a request for additional information within five business days after receipt of a complete request. The contractor shall not implement a menu or price change without prior written COR approval.

The contractor remains responsible for maintaining current menus, price lists, calorie information, and healthy-option designations at all operating venues.

32. Food-Truck Route, Stops, Parking, and Support

Question: What route and stops are approved for the mobile food truck? Are there designated parking locations with electrical power, potable water, wastewater disposal, or other support?

The mobile food truck shall operate on the currently approved mobile food-truck route and scheduled stops. The route may be adjusted when operational requirements warrant. Any routine change to the route, stops, days of service, or operating hours must be submitted for review and approved by the NAFI and Contracting Officer before implementation.

The mobile food truck is a mobile transport and point-of-sale operation, not a self-contained food-preparation kitchen. Food, beverages, and snacks are prepared and loaded before the truck departs for its scheduled stops. The driver alerts patrons of the truck’s arrival by sounding the vehicle horn.

Designated truck stops do not require electrical power, potable-water connections, wastewater disposal, or other utility support for normal operations.

33. Food-Truck Route and Hours Changes

Question: May the contractor adjust mobile-food-truck locations, route, or operating hours based on demand?

Response:

During a national emergency or other exigent circumstances, mobile-food-truck hours and route may be adjusted without prior approval. In all other cases, contractor requests to modify hours, days of service, route, or times must be submitted to the COR for review and approval by the NAFI and Contracting Officer before implementation.

34. Food-Truck Use for Special Events and Catering

Question: May the mobile food truck be used for special events, catering functions, or other installation activities?

Response:

Yes. The mobile food truck may be used to support approved special events, catering functions, and other installation activities. The contractor shall coordinate the requested event support with the COR and NAFI sufficiently in advance to allow scheduling, operational coordination, and advertisement of the event.

The mobile food truck is a mobile transport and point-of-sale operation, not a self-contained food-preparation kitchen. Food, beverages, and snacks must be prepared and loaded before the truck departs for the approved event or activity.

Event support shall not interfere with required regular food-truck route operations unless the NAFI and Contracting Officer approve an adjustment to the route, stops, or operating schedule.

V. Concession Fees, Financial Reporting, Insurance, and Wage Determination

35. Gross Sales Calculation

Question: Is the concession fee calculated before or after sales taxes, refunds, discounts, documented employee meals, credit-card fees, and other deductions?

Response:

Gross Sales include all sales, including cash, credit, debit, and charge transactions. Only actual sales taxes remitted directly to a taxing authority, documented employee meals, and actual refunds or credits issued for returned goods or unsatisfactory services may be excluded. Credit-card processing fees and ordinary discounts are not stated exclusions.

36. Fee Applicability to Cafeteria, Truck, Catering, and Delivery Sales

Question: Are cafeteria, mobile food-truck, catering, delivery, and other contract-related sales subject to the concession-fee calculation?

Response:

Gross Sales include goods, food, beverages, and services, including catering, mobile operations, and delivery. Those sales are included in the Gross Sales basis used to calculate concession payments.

37. Consolidated or Separate Fee Calculation

Question: Is the monthly concession payment calculated separately by venue or by comparing one monthly fee against a commission percentage applied to combined contract-wide Gross Sales?

For each applicable contract period, the contractor must propose a monthly concessionaire fee and a commission percentage of Gross Sales. The contractor shall pay the greater of the proposed monthly concessionaire fee or the proposed commission percentage of Gross Sales for each month of performance.

The fee table identifies a combined concession requirement for Building 100, Building 16, and the mobile food truck and any catering.

38. Minimum Concession Payment

Question: Is there a Government-established minimum concession payment regardless of actual sales?

Response:

The solicitation does not state a Government-established minimum concession payment.

Each offeror must propose a monthly concessionaire fee and a commission percentage.

The resulting contractor will pay the greater of those two amounts each month.

39. Fee Treatment During Government-Directed Closures

Question: Is the monthly concession fee reduced, prorated, waived, or payable in full during Government-directed closures or reduced operations?

Response:

If a Government-directed closure, facility repair, construction project, emergency, or other event outside the contractor’s control prevents food-service operations, the monthly concessionaire fee will be reduced in proportion to the percentage of scheduled operations that were unavailable during the affected month.

For example, if the facilities are unable to operate for 20 percent of the scheduled operating period during a month, the monthly concessionaire fee for that month will be reduced by 20 percent.

The commission percentage itself will not change. However, because commission payments are calculated using actual Gross Sales, the dollar amount of the commission payment will decrease if Government-directed closures or reduced operations result in lower sales.

Any fee adjustment must be documented and approved in writing by the Contracting Officer. This adjustment applies only to Government-directed closures or reduced operations not caused or contributed to by the contractor.

40. Financial Reporting, Payments, POS, and Audit Requirements

Question: What financial reporting, payment, POS, and audit requirements apply?

Response:

The contractor shall furnish POS terminals, cash registers, or similar business machines sufficient for anticipated customer traffic. The contractor must submit monthly concession payments and financial information with supporting POS detail, certify report accuracy, and support NAFI audit rights. Catering payments require a detailed monthly spreadsheet identifying catered functions and concession-fee calculations.

41. Insurance Requirements and Umbrella Coverage

Question: What insurance limits apply, and may umbrella or excess coverage satisfy the general-liability requirement?

Response:

Offerors shall refer to Section H-3, Insurance, of Solicitation No. NAFUA1-26-R-0003 for the required insurance types, minimum coverage amounts, additional-insured requirements, and proof-of-insurance requirements.

All required liability policies must name the NAFI and the United States Government as additional named insureds. Offerors should plan to meet the stated insurance requirement. The acceptability of an umbrella or excess-liability policy, if proposed, will be determined by the Contracting Officer before performance.

42. Wage Determination and Fringe Benefits

Question: Does the wage rate listed in the Wage Determination include the fringe-benefit amount, or must Health and Welfare fringe benefits be paid in addition?

The wage rates listed in Attachment J-4 are the minimum monetary wage rates for the applicable labor classifications. For specific questions regarding the Service Contract Labor Standards, contact the Department of Labor Wage & Hour Division.

VI. Permits, Inspections, Access, Transition, and Site Visit

43. County, State, and Installation Health Permits

Question: Are permits and inspections administered by installation public health, California authorities, San Joaquin County, or a combination?

Response:

For Buildings 100,16 and the mobile food truck, the contractor shall comply with applicable DLA San Joaquin installation public-health, food-safety, and inspection requirements. FMWR advises that fixed facilities located on the installation are generally subject to DoW public-health oversight rather than San Joaquin County permitting.

44. Contractor Responsibility for Permits and Government Assistance

Question: Who is responsible for obtaining permits, licenses, certifications, and associated fees? Will the Government ensure the facility is suitable for permit approval?

Response:

The food-service facilities under this solicitation are Department of War (DoW) facilities and are subject to installation public-health and food-safety inspection requirements.

Separate county or other outside food-facility permits are not required for Building 100, Building 16, or the mobile food truck when operating on the installation.

The contractor shall maintain all required personnel certifications, food-safety training, and operational approvals applicable to its performance and shall comply with all installation public-health, sanitation, safety, and inspection requirements. The contractor must successfully pass required monthly installation inspections.

The NAFI will provide the furnished facilities and will address confirmed facility deficiencies consistent with the resulting contract. However, the contractor remains responsible for its compliance with all applicable contract, installation, and operational requirements.

This response does not waive separate installation requirements related to vehicle operation, installation access, fire safety, or other approvals applicable to the mobile food truck or contractor personnel.

45. Existing Permits and Inspection Reports

Question: Can current permits and recent health-inspection reports be released?

Response:

The solicitation includes a DD Form 2973 Food Operation Inspection Report form. The NAFI will provide releasable facility inspection documentation, if available. The NAFI will not provide current temporary contractor inspection history, corrective actions, or contractor-specific performance records.

46. Installation Access, Credentials, and Background Checks

Question: What background checks, credentials, badges, vehicle-registration, and installation-access requirements apply, and what are the expected processing times?

Response:

Contractor personnel must comply with all installation requirements governing gate admission, force protection, badges, vehicle registration, security, safety, fire prevention, and environmental requirements.

Contractors should submit personnel-vetting and installation-access requests at least three business days before access is required. In many cases, processing may be completed sooner, including on the same day; however, expedited or same-day processing is not guaranteed.

The contractor is responsible for submitting complete and accurate access documentation and ensuring its personnel receive required approval before entering the installation or beginning performance.

47. Transition Period and Preparation Before Opening

Question: Will the successful contractor receive a transition period to inspect, clean, stock, and prepare facilities before opening?

The contractor shall commence occupation, performance, and transition activities on the date specified in the Notice to Proceed, which will be no later than 30 days after contract award. The NAFI will coordinate a final transition schedule for turnover of operations.

48. Joint Equipment Inventory and Condition Inspection

Question: Will the Government conduct a joint equipment inventory and condition inspection before the contractor assumes responsibility?

Response:

Yes. As part of the transition process, the NAFI-designated property representative and the contractor shall conduct a 100-percent joint inventory of all NAFI-furnished property included, or planned for use, under the contract before the contractor assumes responsibility.

The joint inventory will document the property transferred to the contractor and any observed condition discrepancies. Joint inventories will also be conducted every six months during performance and at contract completion.

The NAFI will identify the appropriate representative responsible for coordinating and completing the property-inventory process.

49. Written Answers and Amendment

Question: Will written answers be issued to all offerors and incorporated into a formal solicitation amendment?

Response:

Yes. Material clarifications, corrections, and changes will be provided to all prospective offerors through a written solicitation amendment. Offerors will be required to acknowledge any amendment.
