GOVERNMENT PRE AWARD INQUIRY FORM

Page Section Para.

1 4/13/2022 13 1.ii 3

Page 13 of the RFP states the following:

Projects completed by the offeror or its corporate affiliates (e.g., subsidiaries, sister companies, predecessor companies and parent companies) in any capacity other than a prime contractor will be considered not relevant.

Projects completed by a proposed subcontractor will be considered not relevant.

The prime contractor does not have to self-perform all the work identified in the PWS; however, the prime contractor must demonstrate that it has managed projects that included these services.

With the exception of offerors covered by Mentor-Protégé Agreements approved by SBA, if the offeror is a JV, the offeror must demonstrate joint prime contractor relevant experience on at least one project; or each member of the JV must demonstrate prime contractor experience on at least one relevant project. If each member of the JV does not have at least one relevant experience project, the offeror will be considered unacceptable.

Additionally, we would like to callout FAR 15.305(a)(2)(iii) that states: “The evaluation should take into account past performance information regarding predecessor companies, key personnel who have relevant experience, or subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the instant acquisition”. With respect for FAR 15.305(a)(2)(iii) and the mention of a Mentor-Protégé Agreement approved by the SBA, will the Government allow both members of the agreement to submit relevant experience for Factor 1?

Yes. Per Factor 1, Corporate Experience, if the offeror is a Joint Venture (JV), recent/relevant experience should be submitted for projects completed by the JV entity. If the JV does not have such experience, recent/relevant experience shall be submitted for each JV partner (except for offerors covered by Mentor- Protégé Agreements approved by the Small Business Administration). This means that both members of any JV, including mentor-proteges, can submit relevant experience provided they served as the prime contractor. The exception for mentor-proteges simply means that they are not required to have at least one relevant project for each member or that they performed together, which allows a mentor-protege joint venture to satisfy the experience and past performance requirements though the JV's combined capabilities.

2 4/27/2022 12 52.212-2 ii)

Non-Price (Technical Factor) - Relevant Project

Requiring relevant projects to meet or exceed $750,000/year may reduce competition. Will the government consider lowering the threshold below $750,000?

The Government has reviewed the requirement and it remains unchanged.

Will the government consider aggregate past performance

vs. requiring each individual JV member to have relevant past performance at the required thresholds?

Non-Price (Technical) Factors:

Relevant Project

52.212-2 ii)124/27/2022

The past performance evaluations required under Factor 4, Past Performance, are dependent on the offeror's corporate experience and projects submitted in response to Factor 1.

Per Factor 1, Corporate Experience, if the offeror is a Joint Venture (JV), recent/relevant experience should be submitted for projects completed by the JV entity. If the JV does not have such experience, at least one relevant project shall be submitted for each JV member.

This requirement remains unchanged;

however, there is an exception to this requirement for JVs covered by an SBA-approved Mentor-Protégé Agreement, in which case the experience and past performance requirements may be satisfied through the experience of one or both of the JV members, or through projects completed by the JV entity if the JV has such experience.

For Factor 4, Past Performance, the Government will evaluate how well the offeror performed on the recent, relevant projects submitted under Factor 1, Corporate Experience, and on other relevant contracts documented in known

24 4/27/2022 13 52.212-2 (a) ii) (1)(i)

The restrictive statement: ‘Offerors shall not submit any project information under Factor 1 unless submitted on Attachment JM-1’ is followed by an exception for corporate affiliates. This presumably creates a clear advantage for larger corporations. Does the exception extend to Mentor- Protégé relationships, where the Mentor may rely on the Protégé’s experience, providing the offeror submit the a-b-c items listed (one-page narrative, org chart, and teaming agreement)?

See GPI Response #1.

SBA approved mentor-protégé agreements are not required to submit the corporate affiliate items referenced in paragragh (i) in Factor 1 of the RFP.

25 4/27/2022 13 52.212-2 (a) ii) (1) (i)

Does the statement, “Projects completed by a proposed subcontractor will be considered not relevant” apply to an SBA-Approved mentor fulfilling a subcontractor role for their protégé?

See GPI Reponse #1. Both members can submit experience under Factor 1, Corporate Experience, provided they served as the prime contractor.

26 4/27/2022 57 Content (b)(1)e.

Would you like confirmation of a recent VETS-4212 filing for a major subcontractor?

No. Confirmation of a recent VETS-4212 filing is only required for the prime contractor.

27 4/27/2022 59 Content (b)(1)f.

This paragraph references ’joint venture or partnership’.

Does the requirement to provide the latest three FY financial statements extend to the SBA-Approved Mentor fulfilling a subcontractor role for their protégé?

If the Mentor-Protégé is proposing together as the prime contractor on this solicitation, financial statements shall be submitted for each firm. If the Protégé is proposing as the prime contractor with the Mentor as a proposed subcontractor, only the Protégé is required to submit financial statements.

This para calls for the Essential Contractor Services Plan (ECSP), while Section F states the plan and list of personnel are to be submitted 15-days before start. Clause 252.237- 7023, RFP page 50, para (b) implies that ‘all contractor services’ are considered mission essential. The PWS does not specify essential services or personnel but does address compliance with NAS Kingsville’s Contingency Response Plan (CRP). We suggest delivering a comprehensive ECSP is contingent on having a copy of the CRP and post-award collaboration. Can you please confirm whether the ECSP is to be included in the Responsibility Determination Binder or rather, submitted as a post-award deliverable, within 15-days of contract start?

May we ensure 11-point for all narrative / text body and use 10-point for headers, footers, and graphics? Please note that the PWS, plus ELINs and JL-1 worksheets are at 10-point.

As stated in the RFP, all text (including text in all graphics, exhibits, tables, and headers/footers) will be in a font no smaller than 11 point, Times New Roman or Courier, with single line spacing.

Margins and text in the forms and attachments provided by the Government are exempt from the margin and font size requirements only and shall be submitted in the format required. See Amendment 0005 for update to Price Proposal Binder requirements.

The statement, ‘The airfield mowing will be accomplished at night or non-flying hours, normally 2400-0600.’ implies that no airfield mowing will be accomplished during flying operations. In order to develop and price a staffing plan and prepare operational work plans, can you please elaborate on the timeframes where airfield mowing ops can occur? With UHF-equipped mowers and depending on the wind conditions, can BASH mowing occur at safe (to be COR-specified) lateral distance from the taxiways and runway edges and runway centerline? Historically, what measure of airfield mowing can typically be accomplished during the PWS-defined regular working hours (e.g. Mon-Fri, 0730 - 1630)?

Per Annex 0200000, Spec Item 2.2.1, no mowing is to occur during flight operations. Night mowing is authorized between 2400 - 0600. Depending on flight schedule, mowing at night may be performed earlier than 2400; however, historical information is not available at this time.

The only ‘technical’ aspect within Factor 2 is the offerors’ staffing levels and labor hours (JL-1). Section F details the majority of deliverables (e.g. plans) to be submitted post-award. What specific technical topics of functional areas - in addition to the staffing and labor hours - are you expecting and intend to evaluate? In which topics or areas do you have ‘high interest’ in the offerors’ approach?

In addition to staffing and labor hours which will be evaluated under Factor 2, Technical Approach, the other non-price factors that will be evaluated for this solicitation include corporate experience, safety, and past performance. None of the factors are weighted more important over the others as this is an LPTA procurement.

The LPTA process is selected for this acquistion and the overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award. An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.
