RESPONSE TO INDUSTRY QUESTIONS

MAC PCB Follow-on: Additional response to Industry Questions Q: Fiber Mezzanine – Item 2 on BOM is obsolete.

A. If any are unavailable due to obsolescence and/or shortages, please do not populate (DNP) these components, and note the obsolescence and/or extended lead time on the quote.

Q: Will it be possible to use the JCP, ITAR and ISO accreditation of the affiliated company CAGE 5N111 in the place of the offeror being the new CAGE? Since they are affiliates of each other and the operation is moving locations it will be the same technical capability that is being evaluated. Please offer your comments.

A. No. Please refer to Federal Acquisition Regulation (FAR), Part 4.1800 and subparts. CAGE codes are used for a variety of purposes, including the identification of the true ownership of an entity. The Government, at ALL levels, must deal ONLY with the named contractor and their specific accreditations. When selling to the federal government, “offerors shall provide the contracting officer” your CAGE code prior to a contract award. “The contracting officer shall include the contractor’s CAGE code in the contract and in any electronic transmissions of the contract data to other systems.”

Q: If it will be acceptable to bid as the new CAGE code / entity, will it be also permissible to utilize Past Performance of the previous company CAGE 5N111 and count that towards the PP requirements in the solicitation? We have ample PP materials but under the original company, none will be valid under the new entity. Please offer your comments.

A. See above.

Q: If neither of these are permissible, will it be possible to bid as the original entity that 100% complies with the requirements (5N111) and then migrate the award to the new site/entity? Case would be made under the logic that the business activity has moved and the new entity is the more appropriate interface with the PCB program. Please offer your comments.

A. It would appear that you are requesting advance approval for a contract novation. That is not possible. A novation request will be considered at the time it is made (post award). See FAR Part 42.12. The basis for the determination of whether it is in the Government's best interest to recognize the proposed successor in interests is:

• The comments received from the affected contract administration offices and contracting offices; (FAR 42.1203(c)(1).) and

• A determination that the proposed successor is responsible under FAR 9.1, Responsible Prospective Contractors. (FAR 42.1203(c)(2).)
