8. Question: The RFP states single prices for CONUS Site Survey and OCONUS Site Survey within each year. With such potential variability among sites within CONUS & OCONUS, we recommend Navy provide some specifics to narrow the scope.
Answer: SOW Table 1 defines the proposed installations sites. The Government does not have specifics to provide.
9. Question:
(a) When can the Navy exercise Production CLINs?
(b) Does the Navy anticipate exercising CLINs 0001 and 0003 in parallel or so the Periods of Performance overlap?
(c) If so, how many months after award of CLIN 0001 will CLIN 0003 be exercised or is it the Bidders responsibility to recommend the exercise date?
(d) Please note that the model contract terms in 7.1 indicate that “acceptance of the FAT units constitutes ability of the Government to proceed with execution of production delivery orders.” However, Clause 52.209-3 “First Article Approval – Contractor Testing” in the model contract indicates that the contractor moves out on production at our own risk if we buy material, etc. before first article approval; does this mean that CLIN 0003 can be exercised prior to successful completion of CLIN 0001?
(e) How many months after contract award of CLIN 0001 would the Navy like to take acceptance of CLIN 0003 Production Units?
Answer:
(a) The Government can execute a delivery order for Production CLINs at any time after acceptance of FAT unit has been completed.
(b) No, the Government will execute Delivery Order 0001 for the FAT unit first. Then, only upon successful delivery and final acceptance of the FAT unit, will the Government execute Delivery Order 0002 for Production Quantities, pending availability of funds. The Delivery Schedule for CLIN 0001 FAT unit and CLIN 0003 Production units shall not overlap.
(c) Not applicable
(d) No, CLIN 0003 cannot be executed prior to successful completion of CLIN 0001.
(e) CLIN 0001 shall be delivered under Delivery Order 0001 of this IDIQ and will constitute the minimum ordering requirements. If, upon successful delivery and acceptance of the FAT unit, the Government decides to execute Delivery Order 0002 for Production unit(s), the Delivery Schedule shall be as follows:
“Delivery of Production units shall commence no later than nine (9) months after receipt of delivery order and continue at a rate of no less than one per month,” in accordance with Time of Delivery Clause (pages 45 through 47 of Solicitation N68335-15-R-0002).
