PERFORMANCE WORK STATEMENT
Fuel Hauling Services Various Locations & Remote Sites Guam
| C.1. | GENERAL REQUIREMENTS |
| a. | The Contractor will furnish all labor, equipment to include pumps, fittings, hoses, positive displaced flowmeter, and tank trucks/transport trailers necessary for the transporting and handling of Government owned Fuel, Naval Distillate (F76), Turbine Fuel Aviation (JP5) & JP8 to various points on the island of Guam as specified in the schedule. |
| b. | The Contractor will perform the services between the hours of 7:30 AM and 4:00 PM, Monday through Friday, excluding Federal holidays, except as otherwise provided for. Services will be provided as directed by the designated Government employee(s) in the contract. Each order will specify the quantity of fuel to be transported and the site the fuel is to be delivered to. Each order will also specify the time and date that the Contractor is to report to the Government fueling facility for tank truck inspection and fuel on-loading. After taking on the fuel, the Contractor will, in all cases, immediately proceed to the fuel delivery site and off-load the fuel. The Government will normally place orders at least 24 hours in advance of the time the Contractor is required to report for inspection. Depending upon the assets the Contractor uses to transport the fuel, multiple trucks or multiple trips may be required to complete a Task Order. Contractor will possess sufficient resources to be capable of performing single order deliveries of 10,000 gallons or less within two hours of the time set in the Order for reporting for tank truck inspection. For single order deliveries between 10,000 and 40,000 gallons, delivery must be completed within eight hours of the time set for reporting for initial truck inspection. If an order results in multiple trips using one tanker truck, the tanker truck must be re-inspected before picking up each load of fuel. |
| c. | The NAVSUP Fleet Logistics Center Yokosuka Detachment, Guam Area Fuel Division (aka Defense Fuel Support Point Guam), phone numbers 343-2234/7106/7031, will coordinate all pick-up and delivery (movement) of F76, JP5 and JP8. |
| d. | After Hours Services. After hours services are services provided under an Order that requires an initial report time which falls between 4:00 PM and 7:00 AM, Monday through Friday, including weekends and Federal holidays. When this occurs, the entire order will be priced at the Contractor’s offered price for after hour services. |
| e. | Emergency Services. Emergency services are services where the order requires the Contractor to report for inspection less than 24 hours of the time of issuance of the order. Emergency service orders may require the Contractor to report for inspection within four hours of issuance of the order. Accordingly, the Contractor will receive less than 24 hours, but at least 4 hours of notice before the required report time. The Contractor may not invoice for nor is the Government obliged to pay at either the After Hours rate or the Emergency Service rate unless the order, as issued, indicates that special service is required and the order pricing reflects the higher rate. If the Contractor receives an order that does not indicate emergency or after hour service and the Contractor believes that a special rate should apply, the Contractor must immediately raise the issue with the designated Government employee(s) in the contract for placing orders before the Contractor acts to perform the Order. If the matter cannot be resolved at that time, the Contractor will proceed to perform the Order as directed and the issue will be addressed as a dispute under the disputes clause. When an Order calls for services that fall within the definition of both emergency services and after hour’s services, the higher rate will apply. The Contractor may invoice and the Government is obliged to pay the normal rate, the after-hours rate or the emergency rate as applicable. The rates are not additive and cannot be combined. |
| f. | Tank truck/trailer, equipment, pumps, fittings, hoses, and flow meter inspections are required prior to each fuel on- load in accordance with paragraph C.4. |
| C.2 | SPECIFIC PROCEDURES |
| a. | The Contractor will present his equipment for inspection at the designated place and time as required by the order. Tank truck/trailer, equipment, pumps, fittings, hoses, and flow meter inspections will take place at the DFSP Guam Truck Loading Facility. At this point, the Government Inspector will inspect the Contractor’s equipment and if it passes inspection, provide the Contractor’s equipment operator with two copies of DoD Issue Release/Receipt Document (DD Form1348-1A). |
| b. | Visual inspection of the interior of tank trucks, including all compartments, or transport trailers will be performed by a Government Representative to ensure compliance with paragraph c.4.b. Should the tank truck fail to meet the Government standards, the Contractor will be advised of the discrepancy. The Contractor is required to present equipment, i.e., pumps, fittings, hoses, and flow meter for inspection which is in proper order and which will pass inspection. Accordingly, if equipment, i.e., pumps, fittings, hoses, and flow meter fails inspection and the discrepancy cannot be remedied quickly (as determined by the designated Government employee(s)); the Contractor may be required to provide substitute equipment. |
| c. | After successfully completing the inspection, the Contractor will proceed directly to the designated loading point for fuel on-loading operations. |
NOTE: THERE IS ONE INSPECTION SITE AND ONE FUEL LOADING SITE. THESE SITES ARE LOCATED AT THE DFSP GUAM TRUCK LOADING FACILITY.
| d. | At the Truck Loading Facility, the Contractor will receive the designated fuel product and assist DFSP Guam personnel in loading the fuel. After loading, Contractor personnel will present two copies of DD Form 1348-1A to the Government Representative at the loading area for signature. The Contractor will then proceed directly to destination with the cargo and the two copies of DD Form 1348-1A. Prior to leaving the Truck Loading Facility, the Government Representative will seal the fuel cargo tanks being used and annotate the seal numbers on the DD Form 1348-1A. The Contractor will also ensure that the seals are present before departing |
| e. | After the fuel is loaded and prior to departure for the delivery site, the Contractor will notify the receiving activity of the expected time of delivery. |
| f. | At the destination/receiving activity, the Government Representative will check and remove all seals and otherwise check the load. The Contractor’s equipment operator will assist the receiving activity personnel in the discharge/off- load of the fuel. After unloading is complete, the Contractor’s equipment operator will retain one copy of the DD Form 1348-1A and hand carry one copy to DFSP Guam no later than the close of business the following day. |
| g. | Any other documents provided in the process of pick-up and delivery will be turned into DFSP Guam or distributed, as required. |
| C.3 | DELAY CHARGES |
A Government caused standby-delay, may occur subject to the following conditions:
| a. | When the Contractor reports at the time and place designated for inspection of his tank truck/trailer and the Government Representative to perform the inspection is not available, or if after inspection the Government is not prepared to load fuel, delay charges may be incurred. Delay charges may also be incurred if the Contractor, carrying a load of fuel, immediately proceeds to the location for fuel off- load and the activity to receive the fuel is not prepared to receive the fuel. Compensable delay requires the Contractor to take reasonable steps to seek out and report to the appropriate point of contact. Before the Contractor can invoice for delay charges, the Contractor must contact the designated Government employee(s) or DFSP Guam at 343-2234/7106/7031 for instruction and must comply with that instruction. The designated Government employee(s)may direct the Contractor to standby, return at a later time, or proceed to another location. If the Contractor is directed to return at a later time or to proceed to a different location, the Contractor may not invoice for standby, but such direction may constitute change under the changes clause. If the designated Government employee(s)directs the Contractor to standby, the Contractor may invoice for each hour of standby approved and incurred. The Contractor must contact the designated Government employee(s)again before incurring standby in excess of that amount which has been approved. The standby period begins 30 minutes after the designated Government employee(s) is contacted and approves standby and will run thereafter in hour increments. Periods less than 30 minutes are not included in the calculation of standby. Periods between 30 and 60 minutes constitute one hour of standby. For example, if the standby period is 89 minutes, the Contractor may invoice for only 1 hour. If the standby period is 90 to 149 minutes, the Contractor can invoice for 2 hours. Only standby time approved and permitted by the designated Government employee(s)will be considered for payment. Standby time not approved by the designated Government employee(s)will not be compensated. Standby charges are priced at a per hour rate and are additive to the price per gallon delivered charges. |
| b. | In order to invoice for standby, the Contractor will submit an itemized statement within three working days to DFSP Guam (for the designated Government employee(s) approval), with the following information: |
| (1) | Contract number/delivery order number |
| (2) | Reason of delay |
| (3) | Contractor's arrival time and departure time |
| (4) | Name and telephone number of Government Representative |
All standby periods will terminate at the start of the following actions:
| (1) | Operations for inspection, filling or discharge begin |
| (2) | Notification by designated Government employee(s) to cease standby |
| c. | Price for delays will be in accordance with the Exhibit Line Item (ELIN) - titled Delay Charges. |
| C.4 | QUALITY CONTROL AND SURVEILLANCE |
Quality control and surveillance requirements are intended to ensure that the quality of the fuel is maintained and that itis safely and timely delivered to its destination.
| a. | Required Tank Truck/Trailer Inspection |
| (1) | Prior to each on-load of fuel, all tank trucks and trailers to be used by the Contractor will be inspected as to their capability, suitability and cleanliness to perform the hauling mission by Government Inspectors. |
| (2) | Tank truck/trailer inspections are normally performed for each F76, JP5 and JP8 movement by a DFSP Guam Representative between the hours of 7:30 AM and 4:00 PM, Monday through Friday, excluding Federal holidays. In the case of after-hours service or emergency service orders, inspection may take place at any time scheduling of Inspection. The time to report for tank truck/trailer inspection will be set forth in the order. Although the designated Government employee(s) determines the report time, the designated Government employee(s) will consider input from the Contractor, the loading facility and the receiving activity. |
| (3) | The Government will record the results of its inspection with either acceptance or rejection. |
| b. | Tank Truck/Trailer Condition |
| (1) | Tank trucks or transport trailers will be maintained so as to be continuously in good condition and capable of passing inspection. The Contractor, at his own expense, is responsible for all flushing and draining required to meet cleanliness requirements. When applicable, the Contractor will comply with Table III of MIL-STD- 3004 which can be located at https://assist.daps.dla.mil/quicksearch/quicksearch_query.cfm |
| (2) | All equipment, i.e., pumps, fittings, hoses, and flow meter used to transport will be inspected prior to loading and will meet the following minimum standards before acceptance for loading: |
| (a) | No asphalt or former asphalt carrier will be presented for loading |
| (b) | Fuel carrying equipment will be marked in accordance with Section 172.336, Code of Federal Regulations Title 49 which can be located at http://www.gpo.gov/fdsys/ |
| (c) | Trucks will be equipped with a wire ground, preferably reel type. |
| (d) | The Contractor will have pumping capabilities to facilitate the discharge of F76, JP5 and JP8 from Contractor's tank truck to Government-owned vehicles, vessels or other receptacles. Pump can be diesel driven ignition, with a spark arrestor exhaust system and explosive-proof fittings on all electrical connections. |
| (e) | Tank compartments and/or valves will have the capability to be sealed to preclude any unauthorized access or discharge of contents after filling. Only a designated Government Representative will remove seals or open sealed compartments or valves. The Contractor may remove seals and unseal compartments or valves only in the event of an emergency or when directed by the Contracting Officer or designated Government employee(s). Examples of emergencies would include circumstances where such action is required to protect life, property or the release of fuel into the environment. In such cases, the Contractor will submit a written report describing the facts and circumstances that required the seals to be removed. This report will be provided to the designated Government employee(s) within five working days of the event. Seals will be serialized type furnished by the Government. Serial numbers will be recorded on the DD Form 1348-1A. |
| (f) | When the equipment has mechanical closures such as domes, vents, internal, and external valves, such closures will be free of rust, direct, and water contamination and in acceptable operating condition. Safety valves will not show evidence of being loose and/or leakage must not appear after outlet valves and caps are closed following the test loading of small amounts of product. If no leakage is evident, loading will be completed. |
| (g) | Tank trucks used for full capacity deliveries will have either certified calibrated fill markers or meters. Tank trucks used for less than full capacity deliveries will have certified meters, charts with dipsticks, or other metering devices acceptable to the Government. Prior to commencement of contract performance, the Contractor will submit to the Government a certification of calibration. Calibration may be performed by the Weight and Measures Branch, Department of Revenue and Taxation, Government of Guam, an authorized commercial vendor (as determined by DFSP Guam), or unauthorized Federal agency acceptable to the Contracting Officer at no additional cost to the Government. The certificate of calibration will indicate serial number of fill markers, meters, charts with dip stick, tank truck, and name of calibrating vendor or agency, and signature of individual who performed the calibration. Tanker fill markers with meters or charts with dip sticks will be recalibrated after each instance when a discrepancy between the loaded and discharge quantity is greater or less than 1/2 of one percent or seals on markers or meters have been broken or show signs of tampering. Markers and meters referred to above will be officially sealed, rigid and secure. Interior of tanks and trailer tanks will be free of loose or free rust, scale, sediment, water, or other foreign material. |
| (h) | All equipment, i.e., pumps, fittings, hoses, and flow meter or other surfaces that contact the fuel will be free of foreign material, lose or free rust, scale, sediment, and water. |
| (i) | If equipment contains a pump, all lines and hoses leading to and from the pump and the pump itself will be drained completely by the Contractor before reporting for inspection at the inspection facility. |
| (3) | If the Contractor presents a tank truck/trailer that is rejected by the Government Inspectors, the Contractor is responsible for presenting another tank truck/trailer within 1 hour to fulfill scheduled delivery. If the Contractor is unable to provide a timely replacement, the Government may choose to flush the tank truck. If so, the Contractor will reimburse the Government for all materials/supplies used to flush the Contractor's tank truck tank interior, hoses, and ports. |
| c. | Failure by the Government to reject a tank or trailer at inspection will not constitute a waiver of the Government's right to reject for such defects in the future. The Government is not liable for loss or harm resulting from failure to recognize or report deficiencies during the inspection process. The Contractor is responsible for contaminated fuel resulting from the Contractor's failure to meet any requirement in this contract, even if inspection fails to spot the defect. |
| d. | Contractor Actions during Loading and Unloading |
| (1) | Upon completion of loading, fuel samples will be taken by the Government Inspector from the dome opening of the equipment for testing and retention. |
| (2) | The Contractor will follow appropriate safety measures during loading and discharge operations. Blanking caps will be secured to all filling and discharge connections when not in use. Contractor personnel discovered smoking in an unauthorized or undesignated area of a Government facility will be immediately barred from Government premises. |
| (3) | Care will be taken to ensure that hatches, gaskets, and hose connections are maintained in an air and fluid-tight condition when closed or attached to fill and discharge connections. |
| (4) | Contractor (driver/operator) personnel will: |
| (a) | Begin the actual filling operation after clearance by the Government Inspector. |
| (b) | Connect the loading facility bonding cable to the equipment. Tank trucks will be provided with a brass or copper-bonding lug welded to the frame of the truck to provide secure bond. |
| (c) | After an inspection of the connection by the Government Representative, connect the bottom-loading nozzle to the tank fill pipe. Tank trucks/trailers must be equipped with suitable bottom loading connections. |
| (d) | Be in constant attendance during the filling Operation. |
| (e) | At no point leave his tank truck/trailer or equipment from the time presenting his equipment for loading until completion of the loading and departure from the fill stands. |
| (5) | All tanker seals will only be removed by an authorized receiving Government Representative who will visually check tanker fuel level in relation to the fill markers. If meters are installed, the Government Representative will record the start and ending master meter readings for each delivery. By signing the DD Form 1348-1A, the Government Representative attests that complete delivery was made, however, if any deficiencies are revealed, he/she will immediately report any deficiencies to DFSP Guam by calling 343-2234/7106/7031 for proper guidance. Contractor will meet all applicable requirements as per 33 Code of Federal Regulations, Parts 154 and 156 which can be located at http://www.gpo.gov/fdsys/. Contractor will be liable for all fuel spills which occur as a result of Contractor negligence or faulty equipment. If a spill occurs off of Government property, the Contractor is responsible for fuel spill clean-up operations. The clean-up will comply with current Environmental Protection Agency regulations. If a spill occurs on a Government facility, the Contractor will take immediate steps to mitigate the spill and will otherwise assist Government clean-up operations as directed by onsite Government personnel. The contractor will reimburse the Government for all costs incurred, i.e., labor costs, material costs and service charges associated with oil spill clean-up efforts in the event Government resources are used either to clean, assist, or monitor clean-up operations. This reimbursement requirement also applies in cases where the Government chooses to participate in a clean-up for a spill which occurs off of a Government facility. |
| (6) | Contractor will meet all applicable requirements as per 49 Code of Federal Regulations (CFR), Parts 171 to 179,”Hazardous Material Regulation” and 49 CFR Part 397, “Transportation of Hazardous Materials; Driving and Parking Rules” which can be located at http://www.dot.gov/ or http://www.gpo.gov/fdsys/. |
