About this file

This document is an amendment to a solicitation for construction services. The amendment reduces the period of performance from 165 days to 150 days for site preparation, excavation of a 38 foot by 62 foot concrete foundation, connection to utilities, and disposal of arsenic contaminated soil from the Naval Undersea Warfare Center Division Newport in Rhode Island. Offerors are advised that up to 80 cubic yards of arsenic contaminated soil may need to be disposed of offsite, and existing excavated soil may be reused as backfill if recapped with engineering controls as specified. The amendment also adds a contract clause for variation in estimated quantities and provides updated questions and answers regarding soil disposal and reuse options.

GENERAL INFO - AMENDMENT 0001

Questions and Answers

Question #1: To mitigate excessive costs, will the Navy provide a location on the base to store the excess arsenic contaminated soils in lieu of disposal off-site?

Answer #1: Offeror should include an allowance within its Contract Line Item Number (CLIN) 0001 price for proper off-site disposal of 80 cubic yards arsenic-contaminated soil. Should actual number of cubic yards vary either way by more than 15 percent, an equitable adjustment may be requested by either party.

Consistent with Appendix 2 of the Specification, NUWCDIVNPT may provide a temporary soil storage location to be coordinated with the construction manager once the contract is awarded. Soil must remain on site for analytical testing to be performed by an environmental professional—at Contractor expense—to determine appropriate disposal decision. All excess soil not to be used as backfill or that has been stockpiled for 60 days must be disposed of accordingly off site. Contractor shall provide Bill of Lading for all arsenic soil which leaves the site for disposal.

No soil may be stockpiled on site for more than 60 days without prior approval. Additional detailed information pertaining to soil control can be found in the “Naval Station Newport Soil Management Plan” and “Naval Station Newport Erosion and Sediment Control” instructions attached as Appendix 2 and Appendix 3 respectively in the project specification.

Question #2: Can existing soils excavated from trenches be reused as backfill in trenches or will the soils need to be exported and replaced with clean backfill?

Answer #2: Excavated arsenic soil may be used as backfill. This reused arsenic soil must be recapped with approved engineering controls as outlined in the Specification and drawings. Additional detailed information may be found in the “Naval Station Newport Soil Management Plan” and “Naval Station Newport Erosion and Sediment Control” instructions attached as Appendix 2 and Appendix 3 of the Specification.
