GENERAL INFORMATION
N66604-21-R-0222 Q&A
# Question Answer
1 Respectfully requesting a 30 day extension. At this time, the Government is not extending the due date of the solicitation.
2 Does the Government intend to release the Technical Data Package (TDP), referenced in Section C, Paragraph 3.0, from which bidders are to base their bids? If so, when and how can a bidder receive?
Offerors are expected to request the Applicable Document (AD) package, which contains the TDP as identified in Applicable Document 3.1. Offerors must be registered in JCP in order to request the AD package (see Section L for JCP instructions).
3 Section L (PDF Page 85) Instructions to Offerors appears to indicate that the FFP Parts ceiling for all offerors will be evaluated based on the identified values in Section L. However, Section M (pages 104-106) provides a detailed process by which offerors' proposed prices will be evaluated. Please provide clarity on the method of evaluation and how the ceiling for each CLIN will be established for FFP Parts CLINs 0011 - 0015.
Section L, page 85, provides plug numbers to establish the FFP Parts Ceiling for CLIN 0011-0015. Section M, pages 104-106, provides the evaluation method that will be used to evaluate the offerors proposed pricing for the parts list identified in Attachment 1 as part of the Governments best value determination .
4 Offerors are required to complete Attachment 1 – MK 695 TSTS Parts List.xlsx with stepladder values for MK 695 parts. Does the Government intend to purchase each of the items identified in this list?
The Government reserves the right to purchase some, all, or no parts from the Parts List identified in Attachment 1 .
5 Will the successful offeror be bound to the pricing provided in Attachment 1, or will Offerors have an opportunity to update pricing in Attachment 1 once the TDP is provided?
The successful offeror will not be able to revise their proposed pricing in Attachment 1 throughout performance. The TDP is provided as Applicable Document 3.1 .
6 The only payment clauses for FFP CLINs included in the RFP are FAR 52.232-1 and 52.232-2, which require delivery and acceptance of supplies prior to payment. This creates a significant financial impact on the contractor, and its ability to purchase material and pay suppliers.
Request the Government consider including FAR Clause 52.232-16, Progress Payments in Section I.
At this time, there is no intention from the Government to add FAR Clause 52.232-16 to the solicitation/contract based on the nature of the requirement.
7 Please provide a page count for section 3.1.2 content other than resumes.
Please see updated Section L Instructions to Offerors, which corrects this error.
8 Will the Government please clarify the page allotment for the STR description and resume?
Please see updated Section L Instructions to Offerors, which corrects this error.
9 Will the Government please clarify the page allotment for this response?
Please see updated Section L Instructions to Offerors, which corrects this error.
10 Will the Government confirm that a contractor’s inclusion of a statement confirming submission and date of submission of the VETS 4212 Report satisfies the solicitation requirement?
Offerors shall provide proof of their submission of the required annual VETS-4212, Federal Contractor Veterans Employment Report. The Government will verify the provided information is accurate.
11 Will the Government confirm that subcontractor’s inclusion of a statement in their proposal submission to the Government confirming their submission and date of submission of the VETS 4212 Report satisfies the solicitation requirement?
Offerors do not need to provide proof of their subcontractors VETS-4212 filing. Section L has been updated accordingly.
12 Will the Government please clarify the transition requirement? Please see updated Section M.
There is no transition plan requirement included as part of this RFP.
13 On pg. 91, the Key Personnel table appears to missing a seperating line between the ED4 - Engineer, Design IV and 23183 Electronics Technician Maintenance III labor categories. Will the Government please confirm the Key Personnel requirements for each labor category?
Please see updated Section L Instructions to Offerors, which corrects the formatting error in the table.
14 Section L 4.0 (f)(2) states “If actual direct labor rates are proposed, the offeror shall provide the effective date(s) of the actual labor rates and provide payroll journals or equivalent for all labor rates.” To comply with this requirement Offeror will provide a Human Resources/ Payroll screen-shot of Key Personnel providing supporting evidence of actual salaries. Please confirm that this screen-shot will not be considered a “picture” as prohibited in Section L, 1.3 (a).
Offerors may provide screenshots of payroll journals as supporting evidence of actual salaries.
15 In what part of the proposal should the SF 33, Cover Letter, RFP Fill- Ins be provided? Should it be part of the Cost Volume or a Stand-Alone volume?
Offerors shall provide these items as part of their Cost/Price volume. Please see updated Section L Instructions to Offerors.
16 The first and last sentence of this paragraph are in conflict. Please clarify if cost/price supporting information is required for CLINs 0011- 0015 and if CLINs 0011 – 0015 will be evaluated.
Please see updated Section L Instructions to Offerors, which corrects this error. Supporting information for the evaluation of CLINs 0011-0015 is required.
17 CPFF Tasking – The labor hour totals do not add correctly. There may be a type in the MANP3 labor category line Hours per year (300), and the 5 year total hours column (40,000) is incorrect. Please provide guidance on corrections to this table.
Please see updated Section L Instructions to Offerors, which corrects this error.

The qualifications listed in each individual proposed Key Personnel resume, not the specific individual, are the materially relevant aspects of the proposed Key Personnel partially forming the basis of award under C-237-H002, Substitution of Key Personnel. Therefore, even if a proposed Key individual becomes unavailable to the offeror between proposal submission and award, the Government will evaluate and make its award decision based on the qualifications listed on the proposed resume(s). When the Government awards a contract/task order under those circumstances, the Government will require the awardee to use the qualifications listed on the relevant proposed Key Personnel resume as the basis for replacing that individual under C-237-H002 during contract/task order performance.

If the signed LOI includes any references or enclosures, the offeror shall provide the references and enclosures with the LOI as part of the proposal. Failure to provide references or enclosures or submission of enclosures that violate DFARS 222.7402 and DFARS 252.222-7006 may render an offeror’s proposal ineligible for award. LOIs, inclusive of any references or enclosures, are not subject to a page limitation.
Note: Resumes are not required for Non-Key Personnel. Resumes submitted for Non-Key Personnel, apart from that of the STR, will not be evaluated.

(1) Offerors may propose the estimated labor mix shown in the table above or deviate. If an offeror’s proposed labor mix differs from the Government’s estimate by twenty percent (20%) or greater, in terms of either or both labor category and level of effort distribution, the offeror shall provide rationale to explain why the proposed deviation is appropriate. The rationale shall not exceed four (4) pages. In order for the labor mix rationale to demonstrate the proposed deviation is appropriate, it shall address.
(i) How the proposed labor mix deviation in terms of level and area of expertise (e.g., proposed labor categories) is suitable for performance of the SOW tasking, and associated complexity identified in the SOW; and
(ii) How relationships between labor categories will be structured and operate at the task level to accomplish the tasking efficiently and effectively (e.g., peer review process, senior to junior level oversight and interaction, etc.).
(2) Labor Categories cited must be titles listed at the NUWCDIVNPT Contracts Website:
http://www.navsea.navy.mil/Home/WarfareCenters/NUWCNewport/Partnerships/CommercialC ontracts/LaborCategories.aspx. For Labor Categories that provide for various Levels (I, II, III, IV), select the Level that matches the proposed individual. Note for Service Contract Labor
Standards (SCLS; formerly known as the Service Contract Act (SCA)) Labor Categories Only:
offerors may propose an SCLS labor category listed in the SCA Directory of Occupations (see http://www.dol.gov/whd/govcontracts/sca.htm) even if the SCLS labor category is not listed at the NUWC Division Newport Contracts Website. The appropriateness of any proposed SCLS labor category not listed at the NUWCDIVNPT Contracts Website shall be included in the offeror's explanation provided in accordance with paragraph 3.1.2(c)(1), above.
(3) Number of hours must be assigned to each Labor Category proposed. If a single labor category is proposed with both Key and Non-Key Personnel, the offeror shall break down the distribution of hours between Non-Key Personnel and each Key Person.
(4) The offeror shall include a breakdown of the proposed distribution of hours between the Government site and contractor site(s). The Government estimates ninety percent (90%) of the effort will be performed at the Contractor Site and ten percent (10%) of the effort will be performed at the Government Site. If an offeror submits a proposal with a Contractor to Government site ratio that deviates from the Government’s estimate by greater than ten percent (10%), the offeror shall include a rationale as to why the offeror deemed the proposed hours appropriate (2 page limit).
(d) If the use of personnel at facilities outside the local commuting area of NUWCDIVNPT are proposed, demonstrate that the personnel can be used effectively and efficiently, and that adequate management control exists over their use. If not proposing the use of personnel at facilities outside the local commuting area, the offeror’s proposal shall include a statement indicating as such (1 page limit).
(e) If the offeror proposes to perform any part of the proposed level of effort with employees working in excess of forty (40) hours per week, regardless of compensation arrangement, provide the following information:
(1) Identify all hours in excess of forty (40) hours per week by labor category whether at the prime or subcontract level.
(2) Provide a copy of the corporate policy addressing work in excess of forty (40) hours.
Include an assessment of its impact on work effectiveness and specify the extent to which employees are required or encouraged to perform work in excess of forty (40) hours.
(3) Identify the number of hours that will be performed without supervision and provide an assessment of the productivity of such effort.
(4) Provide a schedule of times when employees will work hours in excess of forty (40) hours per week, such as 4:30 P.M. to 5:30 P.M. Mondays through Thursdays or 8:00 A.M. to 12:00 P.M. on Saturdays for a total of forty-four (44) hours per week.
If not proposing personnel working in excess of forty (40) hours per week, the offeror’s proposal shall include a statement indicating as such (no page limit).
3.1.3 Management Approach – Subfactor 3
The Offeror shall describe its management approach to accomplish the work required for this requirement by addressing the following areas. The offeror’s response to each item listed below shall include any relevant discussion of utilizing, tasking and communicating with subcontractors, if applicable; to the extent such discussion is not otherwise captured in the offeror’s response to item (d).
a. Management processes the offeror uses to divide, distribute, assign, measure and control work and ensure repeatable desired results in terms of quality, schedule, and cost;
b. Management processes to identify and implement innovative solutions;
c. Ability to preserve stability and maintain technical expertise in the workforce;
d. Ability to manage subcontractors. The offeror’s response shall describe how the prime will 1) select which of its approved subcontractor(s) will perform individual technical instructions post award, including how it determines their qualifications; 2) ensure subcontractor(s) deliver on cost and on time; and 3) verify the subcontractor(s)’ quality standards;
e. Approach to encourage responsiveness to, and cooperation with, customers;
f. Approach to problem resolution; and
g. Ability to submit timely and accurate invoices and CDRLs.
3.2 Past Performance – Factor 2
(a) The Offeror shall provide three (3) past performance references, if available, that reflect recent relevant experience performed within the last three (3) years of the closing date of the solicitation that demonstrate the ability to handle work performed under this contract. Include a discussion on how the references provided are relevant to the work being proposed. Include contract/task order number, contract/task order type, program name, total contract/task order cost, short description of work performed, and names and valid telephone numbers for the Procuring Contract Officer (PCO), Contracting Officer’s Representative (COR), and Government Program Manager (PM).
(b) Each past performance reference shall not exceed two (2) pages per reference, for a total of six (6) pages.
(c) Subcontractors performing more than twenty-five percent (25%) of the total price of the contract shall also submit three (3) past performance references, if available, that reflect recent relevant experience performed within the last three (3) years and demonstrate the ability to handle work performed under this contract. Each past performance reference shall not exceed two (2) pages per reference, for a total of six (6) pages per subcontractor.
(d) The Government may also use other information such as the Contractor Performance Assessment Reporting System (CPARS) or other data available from Government sources to evaluate an offeror’s past performance. The Government reserves the right to limit or expand the number of references it decides to contact, and to contact references other than those provided by the offeror.
3.3 Small Business Participation – Factor 3
DO NOT SUBMIT DOLLAR AMOUNTS FOR THE SMALL BUSINESS PARTICIPATION
FACTOR.
The offeror shall provide sufficient detail to permit a complete evaluation. This factor applies to every offeror (U.S. and non-U.S.), regardless of size status or locations of working facilities or headquarters. Small Business Participation shall include the following:
(a) All offerors shall provide the names and CAGE codes of small business concerns (including the offeror if a small business concern) who would participate in accomplishing the proposed task order; the small business classification of each U.S. small business concern (i.e. SB, SDB, WOSB, HUBZone SB, VOSB, and SDVOSB); and a short description of the specific supplies or services to be provided by each small business concern. If a small business does not have a CAGE code, insert the word “None.” List all SB classifications that apply to each concern.
(b) All offerors, including offerors who are themselves U.S. small business concerns based on the North American Industry Classification System (NAICS) code and size standard applicable to this procurement, are to identify the extent to which U.S. small business concerns will be utilized as first-tier subcontractors in the performance of this proposed task order. U.S. small business concerns are defined (1) in FAR 19.001 and (2) by the criteria and size standards in FAR 19.102 for the applicable NAICS code.
(c) A small business offeror shall indicate the percentage of work performed by itself, as well as by any Small Business subcontractors. Proposals submitted by Large Business Concerns shall indicate the percentage of work performed by Small Business Subcontractors. The Small Business Participation percentage shall be calculated as follows:
Participation Percentage = Total Small Business Contract + Subcontract Dollars
Total Task Order Dollars
(d) The Government’s Small Business Participation objective for this task order is: 20%. The offeror is encouraged to propose a Small Business Participation objective percentage as high as is practicable, as long as the percentage is supported by the related Small Business participation approach outlined in paragraph (e) below. The offeror’s proposed Small Business Participation percentage for this task order shall be incorporated into the task order upon award.
(e) Provide an approach for how the offeror intends to meet the proposed Small Business participation percentage. The offeror shall provide rationale that demonstrates the tasks assigned to the selected Small Businesses are meaningful to the overall success of this task order. A Small Business Offeror shall include work performed as the prime contractor as well as any work performed by Small Business subcontractors. In addition, the offeror shall describe its management approach for involving SDB, WOSB, HUBZone SB, VOSB, and SDVOSB in the performance of this effort.
4.0 COST/PRICE
(a) Cost or pricing data and information other than cost or pricing data, from both the prime contractor and all subcontractors performing any part of the level of effort, shall be provided separately via email and in the format outlined below (see FAR 52.215-20 Alt I). Cost or pricing data provided may need to be certified prior to award (see FAR 52.215-20), and that a request for certification does not constitute “discussions” per FAR 52.215-1. No cost or pricing data shall appear in the Offeror’s technical proposal. Prime contractors, please note that FAR 52.215-12 is applicable to subcontractors proposed under this task order.
(b) The offeror shall provide detailed information to allow the Contracting Officer to determine the cost realism and reasonableness of the proposed costs. The offeror shall provide a single summary spreadsheet that supports the total amount of all CLINs listed in Section B. If the offeror uses additional spreadsheets to build CLIN pricing, these spreadsheets shall be submitted as part of the Offeror’s proposal.
------ The Offeror shall provide a level of effort by labor category, including subcontractor Offeror labor categories using eCRAFT categories. ------
(c) The prime offeror shall be responsible for justifying the reasonableness of each subcontractor offeror’s cost. The prime offeror shall indicate the type of subcontract proposed (i.e., cost type, fixed price, etc). Prime offerors and subcontractor offerors shall provide cost or pricing data as attachments to their proposals using a Microsoft Excel compatible spreadsheet. Offerors are encouraged to use the spreadsheet at the following link:
https://www.navsea.navy.mil/Home/Warfare-Centers/NUWC- Newport/Partnerships/Commercial-Contracts/Information-eCraft-/Cost-Price-Analyst.aspx
- Select from that page: Cost Analysis Spreadsheet
Offerors may alter the format and formulas of this spreadsheet for the sole purpose of accommodating their own accounting systems. Spreadsheets, either in the format above or contractor format, shall contain intact formulas used to calculate any aspect of the proposal (i.e.
burdened labor rates, fee, etc.). Spreadsheets provided without intact formulas are unacceptable and may render an Offeror’s proposal ineligible for award. However, prime offerors and subcontractor offerors shall provide a single spreadsheet supporting the total amount of all CLINs listed in Section B of the solicitation.
If the Offeror intends to subcontract 70% of the total cost of all work to be performed, the Offeror shall provide information required by FAR 52.215-22(c).
(d) Cost Line. (CLINs 0001 - 0005): Offerors shall include burdened labor costs of the prime contractor and the subcontractor(s) rounded to the whole dollar.
(e) Fixed Fee. (CLINs 0001 - 0005): Offerors shall include the prime contractor's fee on their labor and the prime contractor's fee on their subcontractor(s) rounded to the whole dollar.
(f) Incidental Material/Costs and Travel (CLINs 0006 - 0010): Offerors shall include an Incidental Material/Costs estimate of $418,150 and a Travel estimate of $981,000 (figures do not include burdens). The breakout of these estimates by CLIN is in the table below for proposal purposes:
Line Item Base/Option# Travel Incidental Material/Costs
TOTALS
0006 Base (Year 1) $ 196,200 $ 108,750 $ 304,950 0007 Option (Year 2) $ 196,200 $ 77,350 $ 273,550 0008 Option (Year 3) $ 196,200 $ 77,350 $ 273,550 0009 Option (Year 4) $ 196,200 $ 77,350 $ 273,550 0010 Option (Year 5) $ 196,200 $ 77,350 $ 273,550
TOTALS $ 981,000 $ 418,150 $1,399,150
Offerors may fully burden such costs and these costs shall be added to the material estimate.
Offerors are required to distribute these sums among subcontractors consistent with the narrative included in the technical proposal. Whenever a subcontractor proposes material costs, the subcontractor may fully burden such costs and these costs shall be added to the material estimate. Offerors shall not add fee to Material/ODC/Travel costs. Subcontractor proposals shall include a complete listing of all costs other than labor which are charged direct by the company exclusive of travel costs and purchased material which is incorporated into a deliverable item.
The Material/ODC estimate includes purchased incidental consumable materials, computer time, reproduction, telephone, shipping and any other costs that are charged direct (with the exception of labor and any Firm Fixed Price CLIN items). The Travel estimate includes travel expenses.
Offerors shall burden these estimates with applicable indirect rates (i.e. G&A, Material Handling). No detailed justification from offerors for these amounts is required. Offerors shall not apply fee to Material/ODC and Travel estimates.
The Government's Cost Realism evaluation of these costs may alter the additional costs on the basis of more accurate rate data or a Government Analysis and Estimate of the appropriate added costs. Any such alteration in the evaluated contract pricing will not, however, be reflected in the contract award.
Any offeror having an accounting system which includes, within overhead or G & A, the cost elements of material and travel/subsistence shall specifically state this fact in the cost proposal.
This will preclude these costs from being unduly considered in the Government's cost evaluation.
(g) Supporting Documentation Requirements:
(1) Offerors shall provide the Basis of Estimate (BOE) supporting the costs/prices provided in the Cost/Price Summary including a description of the assumptions and computations used to develop the proposed costs/prices. For materials, offerors shall describe their methodology for ensuring prices are fair and reasonable. The prime contractor shall be responsible for justifying the reasonableness of each subcontractor.
(Note material justification is not applicable if the Government is providing plug numbers)
(2) Direct Rate Supporting Documentation: The offeror shall provide details as to the basis of labor rates proposed (i.e., actual rates, wage rate determinations, bid level rates). If actual direct labor rates are proposed, the offeror shall provide the effective date(s) of the actual labor rates and provide payroll journals or equivalent for all labor rates. Offerors shall specify the current actual hourly wage rate for each Key Person proposed and provide payroll journals. If proposed direct labor rates vary from actual wages of Key Personnel, explain the basis for those rates. Trace proposed direct labor rates to proposed individual personnel. If proposed direct labor rates for non-key personnel are based on actual rates, offerors shall specify the current actual hourly wage rate for each non0key person proposed and provide payroll journals. Identify the date as of which the actual wage rate is current. If proposed direct labor rates vary from actual wages of non-key personnel, explain the basis for those rates. Failure to provide payroll journals for all key and non-key personnel proposed based on actual rates may render the proposal ineligible for award.
(3) Escalation: For the purposes of cost evaluation, offerors shall identify any escalation applied in its cost proposal for each labor category for each year, and provide detail within its cost narrative as to the methodology of how the escalation rates are applied (i.e., midpoint escalation, single point escalation, etc.).
(4) Indirect Rate Supporting Rate Documentation: Offerors shall provide the supporting information and identify the basis of proposed rates for indirect costs (e.g., Forward Pricing Rate Agreement and date of agreement, bidding rates and the date of submission;
or, actual rates used and the effective date, billing rates, and the date of approval, etc.).
(5) Uncompensated Overtime: For the prime and each subcontractor, in accordance with FAR 52.237-10, “Identification of Uncompensated Overtime”, if uncompensated time is included in the offer or any of the supporting cost data, the uncompensated time should be clearly identified with an explanation as to why it is needed. In addition, for any prime or subcontractor proposing uncompensated time, briefly summarize the company policy on uncompensated time and provide a copy of the policy. State what, if any, impact the policy may have on the efforts described in the Statement of Work/Performance Work Statement. Provide historical data to demonstrate that the proposed level of uncompensated overtime is realistic.
(6) Facility Capital Cost of Money (FCCOM): Offerors shall submit form CASB-CMF if proposing FCCOM and show the calculation of the proposed amount. Additional narrative may be submitted as a separate document, if necessary, to describe derivation of labor rates, use of uncompensated overtime pools to which indirect rates are applied, etc.
(7) Subcontracted Costs.
