SUBSAFE IDIQ RFP N6660419R0035 - Industry Questions and Responses Q&A Posting #1
Question
No.
Section Pg.No. Industry Questions/Recommendations NUWC Response
HQ C-2-0037 ORGANIZATIONAL CONFLICT OF INTEREST (NAVSEA) (JUL
2000).
Offeror Comment: There is a high probability that Offeror will have a conflict of interest that would impact both current and future contracts.
Recommendation: Offeror recommends that this clause be waived. If not, Offeror is uncomfortable with developing a comprehensive mitigation plan that mutually benefits all parties and future contracts; which could result in a No Bid on the contract.
Organizational Conflict of Interest Mitigation Plan: Item 3.2
Recommendation: In conjunction with the request for removal of HQ C-2-0037
ORGANIZATIONAL CONFLICT OF INTEREST (NAVSEA) (JUL 2000) in its entirety Offeror similarly requests the removal of the requirement for submittal of an Organizational Conflict of Interest Mitigation Plan as required by Section L, Page (96), Item 3.2 of the solicitation.
Organizational Conflict of Interest Mitigation Plan: Item 3.2
Recommendation: In conjunction with the request for removal of HQ C-2-0037
ORGANIZATIONAL CONFLICT OF INTEREST (NAVSEA) (JUL 2000) in its entirety, as well as the request for the removal of the requirement for submittal of an Organizational Conflict of Interest Mitigation Plan as required by Section L, Page (96), Item 3.2 of the solicitation. Offeror similarly requests the removal of
Organizational Conflict of Interest Mitigation Plan from the Evaluation Factors as listed in Section L, Page (100), Item 3.2 of the solicitation.
Item 0001 (CLIN 0001) as listed Section B is stated as Cost Plus Fixed Fee
(CPFF) CLIN type however, it is not stated whether this is a CPFF-Completion or
CPFF-Level of Effort.
Offeror Recommendation: Offeror respectfully requests that the solicitation be updated to clearly specify CPFF-Completion or CPFF-Level of Effort for Item
0001 (CLIN 0001) in the CLIN description as contained in Section B.
7 B. p2-3 Are CLINs 0001 and 0002 Material Only or Material & Labor? CLINs 0001 and 0002 are for material. Services are to be procured under CLIN 0003
Item 0003 (CLIN 0003) as listed Section B is stated as Cost Plus Fixed Fee
(CPFF) CLIN type however, it is not stated whether this is a CPFF-Completion or
CPFF-Level of Effort.
Offeror Recommendation: Offeror respectfully requests that the solicitation be updated to clearly specify CPFF-Completion or CPFF-Level of Effort for Item
0003 (CLIN 0003) in the CLIN description as contained in Section B.
9 B. p3-6/93 Are we to assume that we are only proposing fee for these CLINs since the max value is provided for each CLIN?
The max value (plug number) for each CLIN includes fee. Contractors are to view the max value as a cap. Cost information in not being requested.
1 C. 24
Note in section (c) of clause HQ C-2-0037 OCOI (page 24) that it only calls out the instant contract and future
NUWCDIVNPT SUBSAFE or SUBSAFE related acquisitions. Since the requirement is undefined at the base level
(IDIQ type contract), work will be further defined at the order level. It is recommended that, if necessary, contractors should submit a high level mitigation plan. If awarded a contract, then at the order level the contractor and Government would review any possible OCOI further.
2 L. 96 See response to question #1
3 L. 99 See response to question #1
4 Does a secure area need to be designated for secret design work? The contractor should make provisions for a secure work space for classified design work
6 B. 2 CLIN 0001 will be utilized for completion efforts. This is specified in clause HQ B-2-0014
8 B. 4
The majority of the efforts under this multiple-award contract will be completion. Since it is anticipated that only a small amount of efforts could be LOE, CLIN 0003 will be utilized for both completion and LOE work. This is further specified in clauses HQ B-2-0014 and HQ B-2-0015
5 Does a secure area need to be designated for secret design work? See response to question #4
HQ B-2-0014 PAYMENTS OF FEE(S) (COMPLETION) (NAVSEA) (MAY 1993)
states “Applicable to CLINs 0001 and 0003”.
HQB-2-0015 PAYMENTS OF FEE(S) (LEVEL OF EFFORT – ALTERNATE I)
(NAVSEA) MAY 2010) states “Applicable to 0003”.
Offeror Recommendation: It is inappropriate for CLIN 0003 to be applicable to both the aforementioned clauses. Offeror respectfully requests that the solicitation be updated to accurately reflect the CLINs applicable to the aforementioned clauses.
UW C-2-0001 COST AND PERFORMANCE REPORTING (MAR 2017)
Comment: Offeror utilizes Cost Reporting as the tool for many programs and
Government Contracts
Offeror Recommendation: removal of all eCRAFT requirements and references from the clause and all references.
HQ G-2-0009 SUPPLEMENTAL INSTRUCTIONS REGARDING INVOICING
(NAVSEA)(APR 2015)
Offeror Recommendation: Removing “summaries of work charged during the period covered as well as overall cumulative summaries by individual labor categories, rates, and hours (both straight time and overtime) invoiced; as well as, a cost breakdown of other direct costs (ODCs), materials, and travel, by TI, SLIN, or CLIN level. For other than firm fixed price subcontractors, subcontractors are also required to provide labor categories, rates, and hours (both straight time and overtime) invoiced; as well as, a cost breakdown of ODCs, materials, and travel invoiced.”
Replace with: “summaries of cost incurred during the period covered as well as overall cumulative amounts for labor, material, travel, overhead, and other direct labor costs. Additional supporting documentation shall include Cost Element
Level reports for labor, material, travel, and FCCM on a cumulative basis at the
CLIN level.”
Offeror Comment: Please clarify the following note from page 43. Is this for
FFP CLINs only? Seems like this has a limited application that has not been defined.
“NOTE: In order to prevent delays in processing of invoices for payment the following process is hereby instated.”
Vendors cannot create and submit WAWF invoices until the item contracted for has been shipped and a reasonable time frame for delivery, inspection, and acceptance has passed.
5252.216-9122 LEVEL OF EFFORT – ALTERNATE I (MAY 2010) as found on page (50) of the solicitation requires the offer to provide the estimated man-hours of uncompensated effort as well as the average level of effort expenditure as per paragraphs (b) and (d) respectively.
Offeror Recommendation: As no actual effort is provided for by this solicitation, the contractor has no basis for prescription for these items via this submittal. It is respectfully requested that the solicitation be updated to reflect to “TO BE
FILLED IN AT ORDER LEVEL” for the aforementioned clause/paragraphs.
52.222-2 PAYMENT FOR OVERTIME PREMIUMS (JUL 1990)
Offeror Recommendation: Change the not to exceed value identified in paragraph (a) from $0.00 to “1.5 times the basic hourly rate (time-and-a-half)” or the overtime premium is paid for work-- as used in previous Government contract
12 G. 43 Reporting is required at the stated level of the clause
13 G. 43 This wording has a general application, and is stating that invoicing should not take place until work has been performed.
10 B. 7 See response to question #8
11 C. 26 It is a requirement of all NUWCDIVNPT contracts with services components for contractors to utilize eCRAFT.
Note wording in clause UW C-2-0001 "Compliance with this requirement is a material requirement of this contract."
15 I. 62 Since cost data is not being requested in the RFP, the $0.00 will remain in this clause. Any changes to this clause will be addressed at the order level
14 G. 50 Clause will be updated to state 'OFFEROR TO FILL IN AT ORDER LEVEL'
16 L 92 HQ L-2-0009- With there being NO defined work scope or material, can we submit the latest small business plan from a similar contract?
The small business subcontracting plan to be submitted should not mention any other contract. Contractors are to submit a plan specific to this RFP's SOW
HQ L-2-0009 SMALL BUSINESS SUBCONTRACTING PLAN (NAVSEA) (JUN
1990) as included in Section L, page (92) of the solicitation requires the contractor to submit a Small Business Plan as part of its written proposal in response to the solicitation. As no actual effort is provided for by this solicitation, the contractor has no basis for the development of the required Small Business
Plan. It is assumed that a SMALL BUSINESS SUBCONTRACTING PLAN would be a requirement at the ordering level for which actual work is contemplated providing the contractor with a basis for development of a SMALL BUSINESS
SUBCONTRACTING PLAN.
Offeror Recommendation: Offeror respectfully request the removal of the aforementioned requirement for Section L of the solicitation in its entirety. If the
Government is unwilling to remove this requirement in its entirety, it is respectfully requested that the Government provide the basis for the development of the Small Business Plan as required with the contractor’s submittal as specified by Section L of the solicitation.
Item 5.0, Factor 3 – Cost Price: It is understood from the solicitation that the submission of a proposed fee is relevant to CLINs 0001, 0002 and 0003.
Offeror Recommendation: Offeror respectfully requests that the solicitation be updated to accurately reflect the required submission of proposed fee for CLINs
0001, 0002 and 0003.
Small Business Participation Item 3.3
Offeror Recommendation: In conjunction with the request for removal HQ L-2-
0009 SMALL BUSINESS SUBCONTRACTING PLAN (NAVSEA) (JUN 1990)
Offeror similarly requests the removal of Item 3.3 Small Business Participation from the Evaluation Factors as listed in Section L, Page (100), Item 3.3 of the solicitation.
Could you please tell me if the Presolicitation posted as solicitation number
N6660419R0035 on FBO contains requirements similar to any work performed currently or in the past, or will this be a new requirement? This is a new requirement
If possible, can you please provide the most recent contract or task order number? Previous multiple award IDIQ: contracts N66604-10-D-034A, N66604-10-D-034B, N66604-10-D-034C
NOTE: The Government is in the process of responding to other questions received. Responses will be posted as soon as possible.
19 L 94-95 Are we to assume that we are only proposing fee for these CLINs since the customer has provided the max value for each CLIN?
Yes, only a fee percentage is required. Fee is to be included within the max value. No other cost information is required. (Cost analysis will take place at the order level.)
17 L 92
An Individual Subcontracting Plan is to be submitted at the basic level so as to not require a separate plan on each applicable task order. Note: DCMA does not consider a Master Subcontracting Plan an acceptable Individual
Subcontracting Plan because it does not include the dollar goals and percentage goals for Small Business
Concerns. An Individual Subcontracting Plan needs to contain positive goals for all Small Business Concerns
(small business (SB), veteran-owned small business (VOSB), service-disabled veteran-owned small business
(SDVOSB), HUBZone small business (HUBZone), small disadvantaged business (SDB, including ANCs and
Indian tribes), and women-owned small business concerns (WOSB). If an Offeror cannot propose a positive goal in the plan, the Offeror needs to provide rationale as to why it cannot propose a positive goal. Because this solicitation is for a MAC IDIQ, Offerors are encouraged to utilize the CLIN dollar values included in Section L when calculating a goal dollar amount for a proposed SB percentage goal. Note: Per DFARS 219.705-4, a Small
Disadvantaged Business (SDB) goal of less than 5% will require review and approval one level above the
Contracting Officer. The Offeror is reminded that these are proposed goals and that the Offeror will have flexibility during Delivery/Task Order performance to adjust from these proposed goals, based on the requirements and SB capabilities in the marketplace.
18 L. 98 Fee is to be proposed for the CPFF CLINs 0001 and 0003; CLIN 0002 is FFP
20 L. 100 The Small Business Participation pass/fail requirement will remain in the RFP as it is the intent of the Government to received information on intended subcontractors.
21 Attach. 4
*DD Form 254 Block 4 indicates that this is a follow on contract to N66604-10-D-
034A/B/C. Since Offeror has had limited dealings with this contract recently, Offeror would like to confirm that there will be both classified information and classified material received or generated under this contract.
There is a good likelihood that classified information and/or equipment will be received or generated as part of this contract
