Section A - Solicitation/Contract Form

ADDITIONAL INFORMATION

This Full and Open (unrestricted) Solicitation is for the temporary office space for up to one-hundred sixty eight (168) personnel on the Naval Surface Warfare Center (NSWC) Corona site. This is considered a Commercial requirement (leasing temporary space) that is Firm-Fixed Price (FFP), with minor Construction in accordance with FAR Part 12 and FAR Part 13. Due to minor construction, FAR Part 36 and FAR Subpart 22.4 provision/clauses were incorporated within the solicitation.

The Temporary space shall be in place, completed by 7 May 2020. This includes utility hookup, Construction elements completed (see Section C and Section J for detailed description), and the Temporary facility in place, ready for Personnel to move into.

All questions shall be received by 5 August (7 Days), 5:00 PM Pacific Standard Time.

Section C - Descriptions and Specifications

STATEMENT OF WORK

The contractor is hereby advised that the United States Government and Agencies thereof are exempt from State and Local Government tax by virtue of Article 6 of the United States Constitution. No exemption certificate is required.

1. INTRODUCTION

This project consists of the lease, installation, maintenance, break-down, and land improvements required to provide temporary office space for up to one-hundred sixty eight (168) personnel on the Naval Surface Warfare Center (NSWC) Corona site. This will be located within the secured fence area to the north of building 506.

2. BACKGROUND

The space in the 500 area will be reserved to provide swing-space necessary to complete building renovations and modifications outlined within the facility five-year plan. Though traditionally provided through each individual construction contract, the amount of renovations requiring building evacuation planned would require extensive land improvements to house each contracts swing-space. Additionally, the recurring costs of mobilization, assembly, disassembly, and de-mobilization would prove to be a wasteful use of funds. This long-term swing-space will be capable of providing all necessary requirements for temporary moves and be capable of rapidly adjusting for future projects when needed, keeping contracts on-time and reducing complexity.

3. SCOPE

This requirement is considered a Non-Construction Requirement (Commercial lease), with minor construction elements. This project consists of the lease, installation, maintenance, break-down, and land improvements required to provide temporary office space for up to one-hundred sixty eight (168) personnel on the Naval Surface Warfare Center (NSWC) Corona site.

4. APPLICABLE DOCUMENTS

SEE SECTION J/SOLICITATION ATTACHMENTS/EXHIBITS

CDRLS/DIDS in Section J are Not Separately priced (NSP). Costs shall be included with each respective CLIN.

5. REQUIREMENTS

PROJECT DESCRIPTION

This project consists of the lease, installation, maintenance, break-down, and land improvements required to provide temporary office space for up to one-hundred sixty eight (168) personnel on the Naval Surface Warfare Center (NSWC) Corona site. This will be located within the secured fence area to the north of building 506.

The space in the 500 area will be reserved to provide swing-space necessary to complete building renovations and modifications outlined within the facility five-year plan. The primary components of the project/Building Design are as follows:

1. Fire Suppression

1.1 Must comply with UFC 3-600-01

1.2 Contractor shall provide a wet pipe, automatic fire sprinkler system that complies with all current building codes.

1.3 Contractor shall provide a Digital Alarm Communicator Transmitter (DACT) fire panel and monitoring alarm system capable of connecting to an automated response system.

1.4 A fire protection engineer will be required to ensure that the appropriate measures are taken to install a fire sprinkler system to current building code along with all necessary elements for egress.

2. Anti-Terrorism Standards - Must comply with UFC 3-600-01

3. Restrooms

3.1 Contractor shall install solid surface countertops with back and end splashes as needed and structural support with three (3) 19” x 21” integral sinks with strainer drain (no pop ups). New angle stops, supply lines, P-traps with ADA/ABA covers and ADA/ABA paddle handle faucets. Sinks will have appropriate aerators to be water efficient fixtures.

3.2 Contractor shall install four (4) commodes in the female restroom and two (2) commodes, three (3) urinals in the male restroom.

3.3 Contractor shall design toilet partitions, urinal partitions and all amenities so that at least one stall will meet the minimum ADA/ABA requirements, including grab bars, double toilet paper dispenser and toilet seat protection covers dispenser.

3.4 Contractor is responsible for all restroom accessories to make the restroom completely full and usable. This includes but is not limited to the following: toilet paper holders (standard size roll), toilet seat cover dispensers, napkin receptacles (women’s toilet stalls), hooks, etc.

3.5 Toilets and urinals shall be low flow and meet ADA/ABA requirements (One of each per restroom).

3.6 Contractor shall include a mirror above each sink.

3.7 Contractor shall include a paper towel dispenser (bi-fold) / trash receptacle in each restroom.

3.8 Contractor shall include exhaust fans that meet or exceed UFC 3-410-01.

4. Breakroom: Contractor shall provide a breakroom per architectural concept in the temporary building. This will include:

4.1 One (1) sink with two (2) sides. One side shall include a garbage disposal.

4.2 Space for one refrigerator with dedicated circuit.

4.3 Space for two (2) microwaves with dedicated circuits.

4.4 Dedicated circuit for one (1) coffee maker

4.5 Counter top with cabinet storage below and above.

4.6 GFCI outlets with dedicated circuit throughout the room.

4.7 One (1) bi-fold paper towel dispenser

5. HVAC: Central HVAC system shall be included and must conform to ASHRAE 62.1 standards for office space. The units shall not be visibly attached to the exterior of each section.

5.1 Windows: Exterior windows shall be at least 4’x4’ spaced 10’ on center around the exterior. Exterior windows must not have any bar coverings.

6. Exterior Styling

6.1 Siding: Exterior siding shall be aesthetically pleasing and options discussed with project manager prior to assembly.

6.2 Skirting: Contractor shall provide and install exterior skirting that extends from the bottom of the siding to the ground and fully surrounds the assembled building. Contractor shall provide, in addition, one (1) crawl space entrance on every third section placed.

6.3 Landscaping: Contractor shall restore landscaping to previous condition after installation and removal.

7. Interior Styling

7.1 Flooring

7.1.1 Office and Hallways: Contractor shall provide carpet tiles and 4” cove base in a neutral palette with subtle pattern that easily hides dirt and stains

7.1.2 Breakroom, Bathrooms, and Telecom room: Contractor shall provide Inlaid sheet flooring with matching 4” cove base.

7.2 Window Coverings: Contractor shall provide Manual rolling shades for each window. If conference rooms have windows, blackout shades will be installed in the conference rooms.

7.3 Lighting: Contractor shall provide LED lights, installed with motion sensors.

7.4 Walls shall be drywall with textured plater finish similar to existing buildings and painted white.

8. Electrical Layout

8.1 Contractor shall provide outlets along all walls at standard height and spacing.

8.2 Contractor shall provide six (6) floor mounted outlets centralized on each desk station per architectural concept.

8.3 Contractor shall provide GFCI outlets in kitchen/breakroom and restrooms.

8.4 Contractor shall provide LED lighting throughout the space with ceiling mounted occupancy sensors for energy management.

8.5 Lighting fixtures shall, at proper intervals, have emergency battery back-up with self-diagnostics.

8.6 All emergency lighting and exit signs shall be tied into a dedicated breaker and be properly labeled.

8.7 Site Improvements

8.7.1 Water

8.7.1.1 Potable Supply

8.7.1.1.1 Contractor shall, in coordination with NAVFAC utilities manager, provide connection to water main, trenched into ground, with shut-off valve and meeting UFC 3-430-09N requirements.

8.7.1.1.2 Connection location shall be as noted in site map drawing.

8.7.1.2 Fire Riser

8.7.1.2.1 Contractor shall supply and install a fire riser in accordance with UFC 3-600-01

8.7.2 Sewer

8.7.2.1 Contractor shall, in coordination with NAVFAC utilities manager, provide connection to sewer main, trenched into ground, and meeting UFC 3-430-09N requirements.

8.7.2.2 Connection location shall be as noted in site map drawing.

8.7.3 Electrical

8.7.3.1 Contractor shall provide and install electrical connection to main lines identified in site map drawing.

8.7.3.2 Contractor shall provide and install temporary poles for connection lines to the transformer.

8.7.3.3 Contractor shall connect power from main lines to distribution panels.

8.7.4 NMCI/ VoIP/RDT&E

8.7.4.1 Contractor shall provide three (3) server racks in IT room.

8.7.4.1.1 Rack #1 shall be designated as NMCI. Rack #2 shall be designated for VOIP and Rack #3 designated for RDT&E 1 and 2 networks.

8.7.4.1.2 Racks shall be 42 Rack Units high, 750MM wide, 1070MM deep.

8.7.4.1.3 Minimum front spacing from wall to rack front shall be 36”. Minimum spacing from wall to rack rear shall be 36”. Require minimum 42” at one end of the row. Other row end can be butted up to the wall.

8.7.4.1.4 Reference APC Model 3150 Racks

8.7.4.2 Communications infrastructure and telecommunications room shall be constructed in accordance with UFC 3-580-01. Contractor shall provide cat 6, plenum rated cable for all voice and data jack installations: (1 ea.) NMCI, (2 ea.) RTD&E, (1 ea.) Voice. Data cables shall terminated by the contractor at both ends with sufficient extra cable at the equipment cabinets for government personnel to provide final equipment connection.

8.7.4.2.1.1 Contractor shall terminate all cables in the server racks using contractor provided CAT6 rated 24 port PoE+ compliant, EIA/TIA 568B compatible 1U patch panels .

8.7.4.2.1.1.1 Contractor shall use TIA-568-B patch panels and punch down specifications.

8.7.4.2.1.1.2 Reference Model# N252-P24 Tripp Lite 24-Port Cat6 Patch Panel Rackmount 110 RJ45 Ethernet 1U 568B TAA

8.7.4.2.2 Contractor shall provide Cable Management for each rack. Rack #1 NMCI, Rack #2 VOIP, Rack #3 RDT&E.

8.7.4.2.2.1 Rack #1 Cable management will be done per NMCI requirements and specifications.

8.7.4.2.2.2 Rack #2 Cable management for the rack will be done using a vendor supplied horizontal tray bay, 2U in size between the 24(1U) port patch panel and each switch(1U), this 2U bay should allow the patch cable’s excess slack to be retained out of site when patch cables are connected vertically between patch panel and customer supplied switch. Refer to elevation diagram provided for design specs.

8.7.4.2.2.2.1 Reference Model# NP2 Neat-Patch for each horizontal 2U tray bay.

8.7.4.2.2.3 Rack #3 Cable management will be done using a vendor supplied vertical tray system on each side with a hinged cover compatible with server rack that allows excess slack to be retained vertically along the side when patched from vender supplied 24U patch panel and customer supplied switch. Vendor will also supply a 2U horizontal cable manager between every 4th 24U patch panel. Vendor will supply 1U horizontal cable manager after every switch allocated 1U space. Refer to elevation diagram provided for design specs.

8.7.4.2.2.3.1 Reference Part# AR7581A for vertical cable manager

8.7.4.2.2.3.2 Reference Part# QHF19-02-190 for horizontal cable management 2U format

8.7.4.2.2.3.3 Reference Part# QHF19-01—50 for horizontal cable management 1U format

8.7.4.2.3 NMCI cables (blue) will be installed in Rack #1.

8.7.4.2.4 VOIP cables (white) in Rack #2.

8.7.4.2.5 RDT&E (grey) cables will be installed in Rack #3, in a continuous grouping (RDT&E1 and RDT&E2)

8.7.4.2.6 All cables shall be tested in accordance with ANSI/TIA-1152 with test results provided to respective owners.

8.7.4.2.7 Contractor shall coordinate with NMCI, RTD&E and telephone personnel for cable numbering.

8.7.4.2.8 NMCI installation shall be in accordance with UFC 3-580-10, design: Navy and Marine Corps intranet (NMCI) standard construction practices.

8.7.4.3 New communication backboards in IT room as shown on concept floorplan. Backboard shall be ¾” fire rated.

8.7.4.3.1 Outside Plant (OSP) fiber optic and copper cables shall be mounted on the backboard.

8.7.4.3.2 The OSP copper shall be terminated on a Protected Entrance Terminal (PET) that is bonded to the Primary Bonding Busbar.

8.7.4.3.3 The OSP fiber optic shall be terminated in a wall mounted cross connect box.

8.7.4.3.4 Contractor shall bring over a 24 strand Single Mode cable from building 505. Termination in 505 will be SC connectors. Terminations in 500 trailer will be SC connectors.

8.7.4.3.5 Contractor shall bring over a 12 pair copper line from building 505 and mounted on the backboard in TR. A 12 pair copper connection point will be made available in bldg. 505.

8.7.4.4 Two(2) 20 Amp circuits shall be provided to each rack.

8.7.4.4.1 Circuits to be mounted in a double duplex receptacle.

8.7.4.4.2 Power receptacles shall be hung from ceiling in “whips”, above the racks, with enough length in the whips to reach the floor inside the racks.

8.7.4.4.3 Contractor shall installed 20 Amp convenience power receptacles on each wall. See reference drawing.

8.7.4.5 HVAC shall be provide to the TR using both building supply and returns. A secondary split system is required as a backup. ASHRAE guidelines for data processing environments shall be adhered to per TIA-569-D.

8.7.4.6 The drawings are in draft form for the estimating purposes. Final arrangement will be provided by cubicle manufacturer. Cubicle jacks shall be coordinated with the equipment manufacturer. Jacks shall be floor mounted, quad connection at each cubicle with one (1) NMCI connection, two (2) RTD&E Connections, and one (1) Phone connection all properly labeled. Jack Keys shall be colored the same as the cable (Blue, White, Grey)

8.7.4.7 All cabling shall terminate in the IT room, coming up through the floor and into the racks with enough excess to make proper connections.

8.8 Installation / Placement

8.8.1 Minimum clearance of 12” must be maintained between lowest member of the main frame and graded area under the modular trailers.

8.8.2 Grading must slope water away from the modular trailer site.

8.8.3 At all pier pad locations, soil must be compacted to 95%

8.8.4 No PTDF pier pads will be used. ABS or concrete pads shall be used.

8.8.5 Minimum of two access panels/doors at the trailer skirting for access into the crawl space under the trailers.

8.8.6 Engineered Earthquake Restraining Bracing System (ERBS) shall be used for resisting seismic design loads. Contractor to install per manufactures installation instructions. ERBS shall be designed by professional engineer; Plans shall be stamped/signed.

8.8.7 Seismic and Wind calculations to be performed per IBC 2015

8.8.8 Code of Federal Regulations, PART 3285-Model Manufactured Home Installation Standards shall govern installation UON.

8.9 Periodic Maintenance

8.9.1 HVAC

8.9.1.1 Contractor shall provide HVAC maintenance in accordance with ASHRAE 180.

8.9.2 Repairs

8.9.2.1 Contractor shall provide repairs of leased facilities within 24 hrs. of notification for emergency issues and within 10 business days for non-emergency.

8.10 Removal from Site

8.10.1 Contractor shall disconnect and remove the building at the end of the contract period.

8.10.2 Contractor shall restore site to original condition once removed.

9. Project Objectives

9.1 Facility Function: These facilities will serve as temporary office space for NSWC Corona personnel as current buildings are renovated and new space is constructed.

9.2 Safety Requirements

9.2.1 The contractor is responsible for ensuring that all work under contract meets Federal OSHA standards. The contractor is responsible for ensuring safe work performance of employees and subcontractors and bears sole responsibility for the safety of its employees. The contractor is expected to take all steps necessary to establish, administer, and enforce safety rules that will meet the current requirements of Federal Occupational Safety and Health Administration (OSHA).

9.2.2 All construction type activities shall follow the safety guidelines of EM385-1-1 (US Army Corps of Engineers Safety and Health Requirements Manual) and shall be consulted for a variety of hazardous activities associated to the statement of work.

9.2.3 The contractor is responsible for ensuring that all work under contract meets state OSHA standards and local requirements such as the states of Washington OSHA (WISHA), California OSHA (Cal/OSHA), Nevada OSHA (NVOSHA), or Hawaii OSHA (HIOSH) as applicable. These standards will apply for any contractor activity on federal property within the respected state.

9.3 Sustainable: To the greatest extent practical, integrate sustainable strategies and features into the design to minimize the energy consumption of the facilities; conserve resources; minimize adverse effects to the environment; and improve occupant productivity, health, and comfort to reduce the total cost of ownership of the project. Ensure sustainable strategies and features in the design phase are incorporated in the construction phase.

9.3.1 Energy Conservation: Energy conservation shall be in accordance with UFC 1-200-02. Design Energy Conservation.

9.3.2 Contractor shall provide a power metering device on the exterior of the building in compliance with UFGS 26 27 13.10 30 Section 2.1.

9.4 Building Commissioning: All systems and functions shall be verified with government prior to acceptance.

9.5 Accessibility Requirements: Barrier-free design should be in accordance with the requirements of the Uniform Federal Accessibility Standards (UFAS) as required by 42 U.S.C. 4151-4157, Architectural Barriers Act of 1968, and consistent with the 29 U.S.C. 794 Rehabilitation Act of 1973, but also meet the requirements of the Americans with Disabilities Act Accessibility Guidelines (ADAAG). Use the criteria that provide the greatest barrier-free design requirements. The soon to be released DOD Accessibility Standards will implement the US Access Board’s update of the ABA and ADA guidelines and supersede the requirements noted above.

9.6 Appropriate Design:

9.6.1 Design shall conform to the standard Performance Technical Specifications (Part IV) of this RFP, and the supplemental and more prescriptive specifications of this section (Part III) of the RFP.

9.6.2 Design shall comply with all Unified Facilities Criteria (UFC) as stated in Part 2 of this RFP, Section 01 33 00-Design Submittal Procedures.

9.6.3 All electrical work shall be done in accordance with city, state, and national codes to include but not limited to National Electrical Code (NFPA 70), California Rules for Overhead Electric Line Construction (GO-95) and California Rules for Construction of Underground Electric Supply and Communications Systems (GO-128).

9.7 Management and deliverables

9.7.1 Contractor shall conduct weekly update meetings with Government Point of Contacts and provide up-to-date schedule (CDRL A001) at each meeting to identify potential issues and communicate progress.

9.7.2 Contractor shall provide design drawings for approval at 60%, 90%, and 100% completion (CDRL A002) to ensure all requirements are met. Final drawings must be approved and stamped by a Professional Engineer.

9.7.3 Contractor shall provide As-Built drawings for all completed work in both PDF and AutoCAD format. (CDRL A002)

9.7.4 Contractor shall submit a Safety Program Plan to government no less than 20 days prior to start of installation (CDRL A003).

9.7.5 Contractor shall provide monthly financial reports covering from the first to last business day of each month beginning 30 calendar days after effective date of order (CDRL A004).

9.7.6 Contractor shall provide monthly Personnel Roster covering from the first to last business day of each month beginning 30 calendar days after effective date of order (CDRL A005).

9.7.7 Contractor shall provide monthly funds and man-hour expenditure reports covering from the first to last business day of each month beginning 30 calendar days after effective date of order (CDRL A006).

C-202-H001 ADDITIONAL DEFINITIONS–BASIC (NAVSEA) (OCT 2018)

(a) Department means the Department of the Navy.

C-204-H001 USE OF NAVY SUPPORT CONTRACTORS FOR OFFICIAL CONTRACT FILES (NAVSEA) (OCT 2018)

(a) NAVSEA may use a file room management support contractor, hereinafter referred to as "the support contractor", to manage its file room, in which all official contract files, including the official file supporting this procurement, are retained. These official files may contain information that is considered a trade secret, proprietary, business sensitive or otherwise protected pursuant to law or regulation, hereinafter referred to as “protected information”. File room management services consist of any of the following: secretarial or clerical support; data entry; document reproduction, scanning, imaging, or destruction; operation, management, or maintenance of paper-based or electronic mail rooms, file rooms, or libraries; and supervision in connection with functions listed herein.

(b) The cognizant Contracting Officer will ensure that any NAVSEA contract under which these file room management services are acquired will contain a requirement that:

(1) The support contractor not disclose any information;

(2) Individual employees are to be instructed by the support contractor regarding the sensitivity of the official contract files;

(3) The support contractor performing these services be barred from providing any other supplies and/or services, or competing to do so, to NAVSEA for the period of performance of its contract and for an additional three years thereafter unless otherwise provided by law or regulation; and,

(4) In addition to any other rights the contractor may have, it is a third party beneficiary who has the right of direct action against the support contractor, or any person to whom the support contractor has released or disclosed protected information, for the unauthorized duplication, release, or disclosure of such protected information.

(c) Execution of this contract by the contractor is considered consent to NAVSEA's permitting access to any information, irrespective of restrictive markings or the nature of the information submitted, by its file room management support contractor for the limited purpose of executing its file room support contract responsibilities.

(d) NAVSEA may, without further notice, enter into contracts with other contractors for these services. Contractors should enter into separate non-disclosure agreements with the file room contractor. Contact the Procuring Contracting Officer for contractor specifics. However, any such agreement will not be considered a prerequisite before information submitted is stored in the file room or otherwise encumber the government.

C-211-H018 APPROVAL BY THE GOVERNMENT (NAVSEA) (JAN 2019)

Approval by the Government as required under this contract and applicable specifications shall not relieve the Contractor of its obligation to comply with the specifications and with all other requirements of the contract, nor shall it impose upon the Government any liability it would not have had in the absence of such approval.

C-223-W002 ON-SITE SAFETY REQUIREMENTS (NAVSEA) (OCT 2018)

(a) The contractor shall ensure that each contractor employee reads any necessary safety documents within 30 days of commencing performance at any Government facility. Required safety documents can be obtained from the respective safety office. Contractors shall notify the Safety office points of contact below to report completion of the required training via email. The email shall include the contractor employee’s name, work site, and contract number.

(b) It is expected that contractor employees will have received training from their employer on hazards associated with the areas in which they will be working and know what to do in order to protect themselves. Contractors are required to adhere to the requirements of 29 CFR 1910, 29 CFR 1926 and applicable state and local requirements while in Government spaces. The contractor shall ensure that all on-site contractor work at the Government facility is in accordance with any local safety instructions as provided via the COR. The contractor shall report all work-related injuries/illnesses that occurred while working at the Government site to the COR.

(c) Contractors whose employees perform work within Government spaces in excess of 1000 hours per calendar quarter during a calendar year shall submit the data elements on OSHA Form 300A, Summary of Work Related Injuries and Illnesses, for those employees to the safety office, via the COR by 15 January for the previous calendar year, even if no work related injuries or illnesses occurred. If a contractor’s injury/illness rates are above the Bureau of Labor Statistics industry standards, a safety assessment may be performed by the Safety Office to determine if any administrative or engineering controls can be utilized to prevent further injuries/illnesses, or if any additional Personal Protective Equipment or training will be required.

(d) Any contractor employee exhibiting unsafe behavior may be removed from the Government site. Such removal shall not relieve the contractor from meeting its contractual obligations and shall not be considered an excusable delay as defined in FAR 52.249-14.

C-227-H008 GOVERNMENT-INDUSTRY DATA EXCHANGE PROGRAM (NAVSEA) (DEC 2018)

(a) The contractor shall actively participate in the Government Industry Data Exchange Program in accordance with the GIDEP Operations Manual, S0300-BT-PRO-010. The contractor shall submit information concerning critical or major nonconformances, as defined in FAR 46.407/DFARS 246.407, to the GIDEP information system.

(b) The contractor shall insert paragraph (a) of this clause in any subcontract when deemed necessary. When so inserted, the word "contractor" shall be changed to "subcontractor."

(c) The contractor shall, when it elects not to insert paragraph (a) in a subcontract, provide the subcontractor any GIDEP data which may be pertinent to items of its manufacture and verify that the subcontractor utilizes any such data.

(d) The contractor shall, whether it elects to insert paragraph (a) in a subcontract or not, verify that the subcontractor utilizes and provides feedback on any GIDEP data that may be pertinent to items of its manufacture."

C-228-H002 MINIMUM INSURANCE REQUIREMENTS (NAVSEA) (JAN 2019)

(a) In accordance with the clause(s) of this contract entitled "Insurance--Work On a Government Installation" (FAR 52.228-5) and “Liability and Insurance” (DFARS 252.217-7012), as applicable, the Contractor shall procure and maintain insurance, of at least the kinds and minimum amounts set forth below:

(i) Workers' compensation and employer’s liability coverage shall be at least $100,000, except as provided in FAR 28.307-2(a), if applicable

(ii) Bodily injury liability insurance coverage shall be written on the comprehensive form of policy of at least $500,000 per occurrence.

(iii) Automobile liability policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage. The amount of liability coverage on other policies shall be commensurate with any legal requirements of the locality and sufficient to meet normal and customary claims.

(b) To be approved by the Contracting Officer, insurance certificates must include the following cancellation policy statement: Prior to cancellation or material change in coverage, the contractor shall give 30 days written notice to the Contracting Officer.

(c) Physical work cannot begin until the insurance certificate has been approved by the Contracting Officer. Failure to provide an acceptable insurance certificate will not remove the contractor’s responsibility to meet the delivery requirements outlined in Section F and FAR 52.211-11, Liquidated Damages – Supplies, Services, or Research and Development, if applicable.

C-233-H001 DOCUMENTATION OF REQUESTS FOR EQUITABLE ADJUSTMENT--BASIC (NAVSEA) (OCT 2018)

(a) For the purposes of this special contract requirement, the term "change" includes not only a change that is made pursuant to a written order designated as a "change order" but also (1) an engineering change proposed by the Government or by the Contractor and (2) any act or omission to act on the part of the Government in respect of which a request is made for equitable adjustment.

(b) Whenever the Contractor requests or proposes an equitable adjustment of $100,000 or more per vessel in respect to a change made pursuant to a written order designated as a "change order" or in respect to a proposed engineering change and whenever the Contractor requests an equitable adjustment in any amount in respect to any other act or omission to act on the part of the Government, the proposal supporting such request shall contain the following information for each individual item or element of the request:

(1) A description (i) of the work required by the contract before the change, which has been deleted by the change, and (ii) of the work deleted by the change which already has been completed. The description is to include a list of components, equipment, and other identifiable property involved. Also, the status of manufacture, procurement, or installation of such property is to be indicated. Separate description is to be furnished for design and production work. Items of raw material, purchased parts, components and other identifiable hardware, which are made excess by the change and which are not to be retained by the Contractor, are to be listed for later disposition;

(2) Description of work necessary to undo work already completed which has been deleted by the change;

(3) Description of work not required by the terms hereof before the change, which is substituted or added by the change. A list of components and equipment (not bulk materials or items) involved should be included. Separate descriptions are to be furnished for design work and production work;

(4) Description of interference and inefficiencies in performing the change;

(5) Description of each element of disruption and exactly how work has been, or will be disrupted:

(i) The calendar period of time during which disruption occurred, or will occur;

(ii) Area(s) aboard the vessel where disruption occurred, or will occur;

(iii) Trade(s) disrupted, with a breakdown of manhours for each trade;

(iv) Scheduling of trades before, during, and after period of disruption;

(v) Description of measures taken to lessen the disruptive effect of the change;

(6) Delay in delivery attributable solely to the change;

(7) Other work attributable to the change;

(8) Supplementing the foregoing, a narrative statement of the direct "causal" relationship between any alleged Government act or omission and the claimed consequences therefor, crossreferenced to the detailed information provided as required above; and

(9) A statement setting forth a comparative enumeration of the amounts "budgeted" for the cost elements, including the material costs, labor hours and pertinent indirect costs, estimated by the Contractor in preparing its initial and ultimate proposal(s) for this contract, and the amounts claimed to have been incurred and/or projected to be incurred corresponding to each such "budgeted cost" elements.

(c) Each proposal in excess of $100,000 submitted in support of a claim for equitable adjustment under any requirement of this contract shall, in addition to the information required by paragraph (b) hereof, contain such information as the Contracting Officer may require with respect to each individual claim item.

(d) It is recognized that individual claims for equitable adjustment may not include all of the factors listed in paragraph (b) above. Accordingly, the Contractor is required to set forth in its proposal information only with respect to those factors which are comprehended in the individual claim for equitable adjustment. In any event, the information furnished hereunder shall be in sufficient detail to permit the Contracting Officer to cross-reference the claimed increased costs, or delay in delivery, or both, as appropriate, submitted pursuant to paragraph (c) of this requirement, with the information submitted pursuant to paragraph (b) hereof.

C-242-H001 EXPEDITING CONTRACT CLOSEOUT (NAVSEA) (OCT 2018)

(a) As part of the negotiated fixed price or total estimated amount of this contract, both the Government and the Contractor have agreed to waive any entitlement that otherwise might accrue to either party in any residual dollar amount of $1,000 or less at the time of final contract closeout. The term "residual dollar amount" shall include all money that would otherwise be owed to either party at the end of the contract, except that, amounts connected in any way with taxation, allegations of fraud and/or antitrust violations shall be excluded. For purposes of determining residual dollar amounts, offsets of money owed by one party against money that would otherwise be paid by that party may be considered to the extent permitted by law.

(b) This agreement to waive entitlement to residual dollar amounts has been considered by both parties. It is agreed that the administrative costs for either party associated with collecting such small dollar amounts could exceed the amount to be recovered.

C-244-H002 SUBCONTRACTORS/CONSULTANTS (NAVSEA) (OCT 2018)

Notwithstanding FAR 52.244-2(d) and in addition to the information required by FAR 52.244-2(e) of the contract, the contractor shall include the following information in requests to add subcontractors or consultants during performance, regardless of subcontract type or pricing arrangement:

(1) Impact on subcontracting goals,

(2) Impact on providing support at the contracted value,

(3) IF SEAPORT TASK ORDER - The results of negotiations to incorporate fee rate caps no higher than the lower of (i) SeaPort-e fee rate caps for the prime contractor, or in the case where the proposed subcontractor is also a SeaPort-e prime, (ii) fee rate caps that are no higher than the subcontractor's prime SeaPort-e contract.

C-245-H005 INFORMATION AND DATA FURNISHED BY THE GOVERNMENT--ALTERNATE I (NAVSEA) (MAY 2019)

(a) Contract Specifications, Drawings and Data. The Government will furnish, if not included as an attachment to the contract, any unique contract specifications or other design or alteration data cited or referenced in Section C.

(b) Government Furnished Information (GFI). GFI is defined as that information essential for the installation, test, operation, and interface support of all Government Furnished Material identified in an attachment in Section J. The Government shall furnish only the GFI identified in an attachment in Section J. The GFI furnished to the contractor need not be in any particular format. Further, the Government reserves the right to revise the listing of GFI as follows:

(1) The Contracting Officer may at any time by written order:

(i) delete, supersede, or revise, in whole or in part, data identified in an attachment in Section J; or

(ii) add items of data or information to the attachment identified in Section J; or

(iii) establish or revise due dates for items of data or information in the attachment identified in Section J.

(2) If any action taken by the Contracting Officer pursuant to subparagraph (1) immediately above causes an increase or decrease in the costs of, or the time required for, performance of any part of the work under this contract, the contractor may be entitled to an equitable adjustment in the contract amount and delivery schedule in accordance with the procedures provided for in the "CHANGES" clause of this contract.

(c) Except for the Government information and data specified by paragraphs (a) and (b) above, the Government will not be obligated to furnish the Contractor any specification, standard, drawing, technical documentation, or other publication, notwithstanding anything to the contrary in the contract specifications, the GFI identified in an attachment in Section J, the clause of this contract entitled "Government Property" (FAR 52.245-1) or "Government Property Installation Operation Services" (FAR 52.245-2), as applicable, or any other term or condition of this contract. C-246-H001 EXTENSION OF COMMERCIAL WARRANTY (NAVSEA) (OCT 2018)

The Contractor shall extend to the Government the full coverage of any standard commercial warranty normally offered in a similar commercial sale, provided that such warranty is available at no additional cost to the Government. The Contractor shall provide a copy of the standard commercial warranty with the item. The standard commercial warranty period shall begin upon the final acceptance of the applicable material or software. Acceptance of the standard commercial warranty does not waive the Government's rights under the "Inspection" clause, nor does it limit the Government's rights with regard to other terms and conditions of the contract. In the event of a conflict, the terms and conditions of the contract shall take precedence over the standard commercial warranty.

This certification concerns a matter within the jurisdiction of an agency of the United States and the making of a false, fictitious, or fraudulent certification may render the maker subject to prosecution under Title 18, United States Code, Section 1001.
