RFP N62742-21-R-1345
Notice No. 2
30 July 2021
PRE-PROPOSAL QUESTIONS & ANSWERS
WATERFRONT MULTIPLE AWARD CONSTRUCTION CONTRACT PRIMARILY FOR
THE SHIPYARD INFRASTRUCTURE OPTIMIZATION PROGRAM AT HAWAII,
WASHINGTON AND OTHER AREAS UNDER THE COGNIZANCE OF NAVFAC PACIFIC
NOTE: The following questions and answers are provided for INFORMATION ONLY. The RFP remains unchanged unless it is amended in writing on a Standard Form 30.
53. Please clarify that the 3 supplier quotes for concrete, combi-wall steel sheetpile system, tonnage for #14 rebar & specific construction cranes is only for the 60% design submittal/constructability review portion of the RFP & not the 35% design submittal?
ANSWER: Confirmed. 60% design submittal only.
54. RFP Factor 4 – Safety. If an offeror is a subsidiary of a corporate parent company and shares both management and direct labor personnel with the corporate parent company, and the offeror’s safety management, workers compensation insurance coverage and EMR rates are fully integrated with the corporate parent company, should the offeror include the combined TRC and DART rates and OSHA 300 and OSHA 300A logs for both the offeror and the corporate parent company if the offeror intends to include the parent company in its proposal under a Teaming Agreement.
ANSWER: An Offeror shall not submit combined TRC and/or DART rates if the Offeror has its own rates. However, per RFP Document 00202, Factor 4, para. (a), an Offeror that does not have its own TRC and/or DART rates shall (1) provide an explanation as to why they are unable to provide them and (2) submit TRC and DART information for the firm(s) that will be providing the on-site construction labor resources for the Offeror.
55. In order to complete SF 1442 (specifically Block 14) in the case of a joint venture, the joint venture will need to be registered in SAM to receive a CAGE code. However, since the requests for a time extension were not granted, it is possible that joint ventures will not have received their registration confirmation and CAGE code prior to the proposal due date. Please confirm that evidence (such as a printout of the pending approval) showing the joint venture’s registration request has been submitted and is in progress will be acceptable in lieu of the actual CAGE code, and that the CAGE code can be provided to NAVFAC when it is received.
ANSWER: RFP Document 00100, paragraph 1.9, incorporates FAR 52.204-7 System for Award Management (OCT 2018) which states, “an Offeror is required to be registered in SAM when submitting an offer or quotation, and shall continue to be registered until time of award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.” Further, FAR 4.1103(a) states “the contracting officer – (1) shall verify that the offeror or quoter is registered in SAM (see paragraph (b) of this section) at the time an offer or quotation is submitted.”
56. SAM registration can take more than two weeks to complete and is a process that is out of the control of the Contractors. Would NAVFAC recognize the SAM registration documentation with the proposal and allow Contractors to submit the CAGE Code after the proposal submission deadline but prior to the Seed Project task order award?
57. Amendment No. 0001, Document 00202, page 4. Note #4 specifies “If the Offeror is utilizing experience and past performance information of any entity other than (1) the Offeror;
(2) if the Offeror is a joint venture, its joint venture partners jointly and severally liable for the contract; or (3) a firm that has been acquired by the Offeror and is now part of the Offeror (separate legal entities are not considered part of the Offeror), the Offeror shall provide in its proposal a fully-executed teaming agreement or other contractual agreement….”
Are such Teaming Agreements to be provided within the Non-Price Proposal, under Factor 2 – Experience? Please clarify.
ANSWER: Yes. Provide Teaming Agreements within the Non-Price Proposal under Factor 2 – Experience.
58. Attachment A, Box 1. Please clarify how the Offeror is required to complete item 1 and item b. in Box 1 (marked with an asterisk). Can the Government supply an example?
For item 1. “1. Name of Firm that Performed the Relevant Individual Feature(s)*:” Is this the official entity/ JV, LLC that held the contract under which the project was performed?
For Item b., “Name of Firm that Experience is Claimed for*…” Is this the name of the subcontractor or the name of the Offeror, or both?
ANSWER: Item 1 shall identify the name of the firm that performed the work for each construction project submitted under Factor 2 – Experience. See Amendment No. 0002.
If Item 1 identifies that the project was performed by a Joint Venture (JV) whose JV member is a part of the Offeror, Item b shall identify the exact legal name of that JV member who the Offeror is claiming experience for.
Examples will not be provided.
