Notes:
1. See Document 00202 for the Price Evaluation.
2. A firm-fixed-price is required for all line items. The following NAVFAC Language applies:
ALL OR NONE OFFERS - Offers are solicited on an “all or none” basis and FAR 52.215-1, INSTRUCTIONS TO OFFERORS-COMPETITIVE ACQUISITION in Document 00100, is hereby modified. Failure to submit offers for all line items listed shall be cause for rejection of the offer.
3. The Offeror SHALL include a price for ALL CLINs.
4. Multiple awards will not be made.
5. It is the Government’s objective to award CLIN 0001, without utilizing CLINs 0002 and 0003 (listed in order of priority), within the Military Construction funds available. For purposes of evaluating CLINs 0002 and 0003, the following will apply:
(a) All offers will be evaluated on the basis of the same deductive items.
(b) The low offeror is the offeror that offers the lowest aggregate amount for CLIN 0001, minus those deductive items that provide the most features within the fund available for award.
(c) The list of priorities in the price schedule is used only to determine the low offeror. After determining the low offeror, an award may be made on any combination of items if—
(i) It is in the best interest of the Government;
RFP N62742-19-R-1301
SF 1442 (Continued)
(ii) Funds are available at the time of award; and
(iii) The low offeror's price for the combination to be awarded is less than the price offered by any other responsive, responsible offeror.
6. The proposed price for CLIN 0001 minus deductive items (as applicable) plus CLIN 0004 will form the basis for the evaluation noted in Document 00202.
7. In the event there is a difference between a unit price and the extended total, the unit price will be held to be the intended offer and the extended total recomputed accordingly. If the offer provides a total but fails to enter a unit price, the total divided by the specified quantity will be held to be the intended unit price.
8. Payment for SLINs 0001AB through 0001AE shall be for actual quantities only. The unit prices will be used to adjust the contract price for any increase or decrease in the estimated quantities subject to the following clause:
a. FAR 52.211-18 Variation in Estimated Quantity (APR 1984)
If the quantity of a unit priced item in this contract is an estimated quantity and the actual quantity of the unit priced item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon an increase or decrease in costs due solely to the variation above 115 percent or below 85 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgment of the Contracting Officer, is justified.
(End of Clause)
9. For evaluation purposes only, in the event of a discrepancy between the extended price for the HAR and the actual calculation of the HAR percentage proposed multiplied by the Government Estimated Amount, the Government will use the percentage proposed and will adjust your proposal accordingly.
10. In the event there is a difference between the grand total and the calculation of the individual prices proposed to arrive at the grand total, the individual prices proposed for each CLIN will be held to be the intended price and the grand total will be adjusted accordingly.
11. The following notes apply to CLIN 0004 for Furniture, Fixtures and Equipment (FF&E):
a. Government Estimated Amount for FF&E. The Government Estimated Amount for FF&E, as shown above (CLIN 000401), includes the material cost, freight and installation charges. The Government Estimated Amount has been identified to provide Offerors with the projected magnitude of effort for FF&E. The total CLIN 0004 amount shall include all costs to procure, install and store the Furniture Fixtures and Equipment and includes the Prime Contractor’s proposed Handling and Administrative Rate (HAR).
b. Prime Contractor Handling and Administration Rate (HAR). Offerors may propose a HAR fee in CLIN 000402, up to but not to exceed 5%, for the handling and administration of the FF&E. This fee will account for all administrative costs; overhead; bonding fees, if any; administration of subcontractors; profit; and any other costs associated with and related to the coordination and processing of the procurement and installation of the FF&E. The
RFP N62742-19-R-1301
SF 1442 (Continued) prime contractor’s proposed HAR mark-up will be applied to the Government Estimated Amount to derive a total proposed price for CLIN 0004.
c. The prime contractor’s HAR percentage rate will be incorporated into the contract as proposed and will not be adjusted regardless of fluctuations in the Government Estimated Amount. The HAR is a fixed percentage rate that will be utilized in calculating the final price for the planned modification. When the final FF&E package is priced, the contractor’s proposed HAR percentage rate, as incorporated into the contract, will be applied to the selected supplier/vendor’s quote to arrive at a total proposed price for final negotiation of the planned modification.
d. It is anticipated that a planned modification will be awarded at least six months prior to the completion of the work. The planned modification will be issued after receipt of appropriate funding. A minimum of six months is required for the contractor to purchase, deliver and install the FF&E without impacting the overall completion date of the project. No schedule extensions will be granted if the planned modification is awarded at least six months prior to the contract completion date. If the Government decides to negotiate and award the planned modification less than six months prior to the contract completion date, the contractor may be entitled to a contract extension.
12. DFARS 252.247-7023, TRANSPORTATION OF SUPPLIES BY SEA. Within 30 days of each shipment, the Contractor is required to provide an electronic copy of the carrier's bill of lading to the Contracting Officer and to MARAD via e-mail. MARAD email: Marguerite.Speights@dot.gov. In addition, the Contractor shall notify the Contracting Officer when oceanic shipments have been initiated within 3 working days of shipment.
