PRE-PROPOSAL QUESTIONS & ANSWERS

RFP NO. N62742-14-R-1310

FY14 MCON P-852, 3D RADIO BATTALION

MAINTENANCE / OPERATIONS COMPLEX

MARINE CORPS BASE HAWAII, KANEOHE BAY, HAWAII

NOTE: The following questions and answers are provided for INFORMATION ONLY. The RFP remains unchanged unless it is amended in writing on a Standard Form 30.

4. QUESTION: Document 00100, paragraph 1.2.a states that the PHASE-ONE PROPOSAL shall include Items (1) through (7). Item (4) requires information required by paragraph 1.7, Joint Ventures (JV), Limited Liability Companies (LLC), Limited Partnerships (LP), Teaming, Etc., which requires such offerors to provide a copy of the JV, LLC, LP, or teaming agreement.

Item (5) requires all information required by Factor 1, Technical Approach, of which Document 00202, Factor 1 - Technical Approach, paragraph (3) of the RFP states:

In addition to the narrative, the Offeror shall submit a signed copy of a joint venture agreement, partnership agreement, approved mentor protégé agreement (MPA), teaming agreement, or letter of commitment for each member of the Offeror’s team identified above (e.g., joint venture partner, partner, team member, subcontractor, parent company, subsidiary, or other affiliated company, etc.). The Government is requesting a copy of the JV, LLC, LP, Teaming, etc.

agreement under both Items (4) and (5). Please clarify if it is the Government’s intent for the offeror to submit duplicate documentation in the proposal.

ANSWER: See amendment no. 0001 that revised Document 00202.

5. Document 00202, Factor 2 – Experience requires completion of the Construction & Design Experience Project Data Sheet (RFP Attachment A) to demonstrate both the Offeror’s and Lead Designer’s Experience; however, the total length for each project data sheet shall not exceed one

(1) double-sided page (or two (2) single-sided pages). In completing the project data sheet, descriptions of the project should also address any sustainable features for the project, of which the factor requests to “(p)rovide applicable documentation on projects that were validated and/or certified through U.S. Green Building Council (USGBC) or the equivalent organization or process”. Please confirm that the provision of USGBC certification documentation is exempt from the two-page limitation for the data sheet.

ANSWER: See amendment no. 0001 which deletes the requirement to submit the USGBC certification.

6. Document 00202, Factor 3 – Past Performance, Subfactor 2 – Lead Designer’s Past Performance of the RFP states:

If a completed DD Form 2631, Performance Evaluation (Architect-Engineer) is available, it shall be submitted with the proposal for each project included in Factor 2 for Lead Designer’s Experience. If there is not a completed DD2631 evaluation then submit Past Performance Questionnaires (Attachment B) for each project included in Factor 2, Experience, for the Designer. The Offeror shall provide completed Past Performance Questionnaires (PPQ) with the proposal.

On Design-Build contracts, the contractor is the primary awardee/point of contact for the project owner and is the entity that receives a DD Form 2626 performance evaluation; as a result, the Lead Designer is not directly evaluated for design-build contracts. Furthermore, it has been our experience that designers are unable to obtain a completed PPQ for design-build projects from the Government as there was no direct contract between the two entities as the Lead Design Firm is a major subcontractor to the Contractor and the subconsultants are contracted under the Lead Design Firm. Lastly, it is our understanding that NAVFAC legal counsel has advised that all evaluations and supporting performance reviews must originate from the Construction Contractor Appraisal Support System (CCASS), of which Design-Build contractors and their team must await the formal issuance of the DD Form 2626 even after the project has been completed. Therefore, in the case of a Design-Build project, please confirm that a Lead Designer is able to rely upon the Contractor’s DD Form 2626 for Past Performance.

ANSWER: The Lead Designer may rely upon the Construction Contractors DD2626 for Past Performance as long as the DD2626 specifically evaluates the Lead Designer’s performance.

7. Document 00100, paragraph 1.7 requires the offeror to submit additional documentation and information for Joint Ventures, Limited Liability Companies, Limited Partnerships, and Teaming Arrangement entities:

a. A copy of the JV, LLC, LP, or teaming agreement.

b. A detailed statement outlining the following in terms of percentages where appropriate:

1. The relationship of the team/partners/parties in terms of business ownership, capital contribution, profit distribution or loss sharing.

2. The management approach in terms of who will conduct, direct, supervise, and control.

3. The structure and decision-making responsibilities of the partners/parties in terms of who will control the manner and method of performance of work.

4. Identify (by name and title) the personnel having the authority to legally bind the partners/parties (including authority to execute the contract documents and bonds).

c. A list of partners/parties, to include company name, DUNS and CAGE Numbers, Address, Point of Contract, Email address, phone number and facsimile number.

d. Address the average annual receipts for the past three fiscal years for each partner/member.

We intend to submit our proposal as a stand-alone Small Business General Contractor, however we plan on executing a teaming agreement with our Lead Design Firm. Please clarify if these questions apply to our design team partner.

ANSWER: Yes, the requirement applies to the teaming agreement between prime and designer.

8. Page 3 of 9 (1.7-d) of the N62742-14-R-1310 RFP states, “Address average annual receipts for the past three fiscal years for each partner/member.” The following questions pertain to this statement:

a. Please confirm that only the company bidding as the prime contractor, or Joint Venture Company, is required to submit financial information. Per our understanding of notice No. 1 dated 10/31/13, the small business standard only pertains to the prime contractor or Joint Venture. Financials from teaming partners and design partners should not be required in order to show that each company is a small business.

b. Some of our teaming partners are major subcontractors. Do subcontractors need to submit financials?

c. Do design teaming companies need to submit financials?

d. If the above are confirmed, is it acceptable for the teaming companies to send their financial information directly to the Navy to avoid the spread of proprietary information?

ANSWER: Notice No. 1, question no. 1, specifically addressed “teaming partners” and provided the “size determination for teaming arrangements”; therefore it appears the response is misinterpreted. Teaming arrangements, in addition to prime contractors and joint ventures, must also meet the small business size standard.

Document 00100, paragraph 1.7.d, does not require submission of financial statements but requires that the average annual receipts for the past three years be addressed by each partner/member.
