About this file

This document contains responses to questions submitted for RFP No. N6247825R4060 for the P-716 Red Hill Water Treatment Facility project at Joint Base Pearl Harbor-Hickam, Hawaii. The responses address key clarifications regarding project experience requirements, non-disclosure agreements (NDAs), and Statement of Affiliation (SOA) procedures. Specifically, the government confirmed that offerors may submit projects with a reduced construction value of $2.5M for granular activated carbon water treatment vessels, and clarified that prime contractors are responsible for ensuring their subcontractors and suppliers complete NDAs and SOAs before receiving project specifications and drawings.

The pre-solicitation indicates this is a Design-Bid-Build project with an anticipated contract value between $250M-$500M, focusing on constructing a 10 million gallon per day water treatment facility. The project is limited to U.S. owned companies and U.S. citizens, with evaluation factors including experience, past performance, safety, small business utilization, and price. The contract period of performance is estimated at 1,064 calendar days, with the solicitation anticipated to be issued around June 27, 2025. Interested prime contractors must submit Statement of Affiliations by 10:00 AM Hawaii Standard Time on June 26, 2025, and will be required to register on the Procurement Integrated Enterprise Environment (PIEE) to access solicitation documents.

RESPONSES TO QUESTIONS SUBMITTED FOR

RFP NO. N6247825R4060

P-716 RED HILL WATER TREATMENT FACILITY JOINT BASE PEARL HARBOR-HICKAM, HAWAII

Q1. While awaiting the solicitation’s issuance, we note that the posting helpfully shared that “(t)he experience factor is anticipated to” require offerors to:

i. Submit at least one relevant project that demonstrates construction of packaged granular activated carbon water treatment vessels, including process control and instrumentation system integration, testing and commissioning with a construction value of at least $5M.

ii. Submit at least one relevant project that demonstrates earthwork construction involving rock excavation, boulder removal, scaling of surfaces having steep terrain, drilled shaft or well borehole installation, mechanically stabilized earth (MSE) wall greater than 10 ft high, retaining wall greater than 10 ft high, and settlement monitoring program with a construction value of at least $25M.

iii. Submit at least one relevant project that demonstrates construction of vertical turbine water well pump systems with at least 1 million gallons per day (MGD) capacity with a construction value of at least

$1M

With regard to the above-item i, please know that we have been advised by our teaming partner that meeting that item will be difficult to meet for many offerors, in particularly local offerors, as the number of

GAC installations in Hawaii in which systems of that size are used are exceedingly limited. Therefore, we kindly request your understanding and consideration to lower the construction value to at least $2.5M, which will further ensure that the NAVFAC Pacific/Hawaii receives competitive offers.

A1. Confirmed. Relevant project construction value of at least $2.5M is acceptable.

Q2. The updated Presolicitation issued on June 18, 2025, for P-716 Red Hill Water Treatment Facility, Joint

Base Pearl Harbor-Hickam, Hawaii on SAM.gov states “Prime Contractors are responsible for reviewing and approving their team (subcontractors, suppliers, and manufacturers at all tiers) to ensure everyone is in compliance and if applicable, have an approved SOA and NDA.” Please provide the laws or regulations the

Prime Contractors are to use to confirm compliance and provide information on when an approved SOA and NDA are applicable.

A2. Please see updated Pre-Solicitation Notice. Prime Contractors are required to complete and submit a

Statement of Affiliation (SOA) and Authorized Use and Non-Disclosure Agreement (NDA) to the

Government, for review and approval. Prime Contractors shall ensure that all members of the Prime

Contractor’s team (subcontractors, suppliers, and manufacturers at all tiers) that require access to and review of the RFP, specifications, and/or drawings released to the Prime Contractor, complete an NDA and

SOA. NDAs and SOAs completed by the Prime Contractor’s team members need not be provided to the

Government; however, the Prime Contractor shall ensure that its team members have completed NDAs and

SOAs, before providing team members the RFP, specifications, and/or drawings.

Q3. The Authorized Use and Non-Disclosure Agreement states “2. The Recipient shall limit disclosure of the

SPECS AND DRAWINGS referenced herein within its own organization to its directors, officers, partners, members, and/or employees, collectively referred to as its affiliate(s), having a need to know, and who have also submitted a completed “Authorized Use and Non-Disclosure Agreement” and “U.S Citizen

Certification” to the Contracting Office.”

a. Per the revised Presolicitation dated June 18, 2025, it appears that the intent is to have the Prime

Contractor distribute the SPECS AND DRAWINGS to subcontractors and suppliers once the appropriate

NDA and SOA is in place. However, the Authorized Use and Non-Disclosure Agreement does not appear to allow this.

i. Subcontractors and suppliers are not part of the Recipients organization.

ii. The Authorized Use and Non-Disclosure Agreement and U.S. Citizenship Certification need to submitted to the Contracting Office.

Please clarify, considering the language of the current NDA, how the Prime Contractor can issue

SPECS AND DRAWINGS outside of its organization (to subcontractors and suppliers). Include the processes and/or regulations that are to be followed that would allow the Prime Contractor to distribute the

SPECS AND DRAWINGS.

b. It is not clear in the Authorized Use and Non-Disclosure Agreement if the NDA and U. S. Citizen

Certification need to be provided for each individual in the Recipient’s organization who has a need to know. Please clarify if the NDA and U. S. Citizen Certification need to be provided for each individual prior to granting access.

c. Please provide the U. S. Citizen Certification referenced above.

A3. a. See updated NDA, removing the requirement to submit a “U.S. Citizen Certification” to the

Contracting Office.. See also A2, explaining the Prime Contractor’s duty to ensure that its team members have completed NDAs and SOAs, before providing team members the RFP, specifications, and/or drawings.

b. The NDA shall be completed by representatives of the Prime Contractor and representatives of the

Prime Contractor’s team members, on behalf of their respective firms. Individual employees of the Prime

Contractor and their team members, other than their representatives thereto, need not complete separate

NDAs. See updated NDA, removing the requirement to submit a “U.S. Citizenship Certification”.

c. See A(3)(a), (b) above.

Q4. Additionally, the Presolicitation puts the responsibility for reviewing and approving SOA and NDA for subcontractors, suppliers and manufacturers at all tiers on the Prime Contractor.

a. For NDAs please confirm that FAR 4.19 (c) Subcontracts applies and the Prime Contractor is only required to get NDA’s from subcontractors and suppliers who will receive the SPECS AND DRAWINGS.

b. It is not clear in the documents the applicability of the SOA to what level. Is it for only organizations that will be working on site (subcontractors)? Only for organizations where an NDA is required (receive SPECS AND DRAWINGS)? Please provide the criteria for requiring an SOA from an organization.

A4. a, b. See A2.

Q5. For the purposes of sumitting projects for the experience factor, please confirm that the Offeror may submit separate projects or combined projects that collectively demonstrate the four types of relevant experience.

A5. Confirmed. Details will be provided in the Request for Proposal.
