EVALUATION FACTORS

PART I – GENERAL

1.1 CONTRACT SCOPE

The work includes labor, supervision, tools, materials, and equipment necessary to perform asphaltic concrete pavement, airfield asphalt concrete pavement, roadway or parking lot asphaltic concrete pavement, airfield, roadway or parking lot concrete pavement, and other incidental related work to include but not be limited to sidewalks and curbs, marking and striping of pavement, area lighting, drainage systems, grading, and miscellaneous drainage improvements within the State of Hawaii. The areas of consideration will include, but not be limited to, Navy, Marine Corps, Air Force, and miscellaneous Federal and other facilities.

1.2 PREFERENCE FOR MAKING MULTIPLE AWARDS

This acquisition is being advertised on an unrestricted basis as an indefinite delivery indefinite quantity (IDIQ), multiple award construction contract (MACC) with no pre-established fixed contract prices and is a source selection procurement requiring non-cost/price, past performance and price proposals. This procurement consists of one solicitation with the intent to award a minimum of three (3) IDIQ contracts.

1.3 MAGNITUDE OF THE ACQUISITION

The total dollar value of this acquisition is $48,000,000 over the life of the contract or 60 months, whichever occurs first. The Government may or may not award a Seed Project in place of a minimum guarantee to the lowest price technically acceptable offeror and a minimum guarantee of $5,000 to the other successful offerors for the base period only. The minimum guarantee for the other successful offerors may be met by the issuance of a task order during the base period or option period(s). Contractors are not guaranteed work in excess of the minimum guarantee. The task order minimum and maximum will be stated as $50,000 to $15,000,000, respectively.

1.4 PROPOSAL EVALUATION

a. The Government intends to award a minimum of three contracts resulting from this solicitation to the responsible offerors with the lowest price technically acceptable proposal based on the evaluation factors in the solicitation.

b. Proposals are evaluated for technical acceptability but not ranked using the non-cost/price factors.

Tradeoffs are not permitted.

c. The number of proposals to be evaluated for technical acceptability may be limited to the five lowest priced offers. Technical proposals shall be provided to the evaluator(s) without any identification of prices or any rank order of prices. The process described will be conducted as many times as necessary, until such time as the Government identifies an acceptable amount of technically acceptable proposals. If the contracting officer later determines that discussions are necessary, the procedures in FAR 15.306 shall be followed.

d. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contracts.

1.5 ENFORCEABILITY OF THE PROPOSAL

The proposals must set forth full, accurate and complete information as required by this solicitation. The Government will rely on such information in the award of the contracts. By submission of the offer, the Offeror agrees that all items proposed (e.g., key personnel, subcontractors, etc.) will be utilized for the duration of the contract and any substitutions will be equal or better than as proposed and accepted for contract award and shall require prior Contracting Officer's approval.

PART II – EVALUATION CRITERIA

2.1 BASIS OF AWARD

a. The Government intends to evaluate proposals and award a minimum of three contracts without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.

b. The number of proposals to be evaluated for technical acceptability may be limited to the five lowest priced offers at the discretion of the Contracting Officer.

c. An overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award. An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.

2.2 EVALUATION FACTORS

The solicitation requires the evaluation of price and the following non-cost/price factors:

Factor 1 – Experience

Factor 2 – Safety

Factor 3 – Past Performance

Factor 4 – Small Business Utilization

The distinction between experience and past performance is experience pertains to the types of work and volume of work completed by a contractor that are comparable to the types of work covered by this requirement, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.

a. Price Evaluation:

1. Price.

(a) Solicitation Submittal Requirements.

(1) Signed and completed Standard Form 1442 (Solicitation, Offer, and Award);

(2) Price Proposal Schedule for the Seed Project;

(3) Bid guarantee for the Seed Project – The original hard copy bid guarantee shall be forwarded to the contracting office (address shown in block 7 of the SF1442) following the electronic proposal submission;

(4) Representations and Certifications (Document 00600);

(5) FAR 52.204-8, Annual Representations and Certifications, which requires the offeror to complete the annual representations and certifications electronically via SAM. Ensure you also complete the DFARS provisions;

(6) Any teaming agreements, Joint Venture agreements, LLC Operating Agreements, see Document 00100, paragraph 1.5 JOINT VENTURES (JV), LIMITED LIABILITY COMPANIES (LLC), LIMITED PARTNERSHIPS (LTD), ETC.;

(7) Evidence of submission of VETS-4212 Report, entitled “Federal Contractor Veterans’ Employment Report (VETS-4212 Report),” as required by FAR 52.222-37, Employment Reports on Special Disabled Veterans, Veterans of the Vietnam Era, and Other Eligible Veterans. (If not applicable, provide statement that Offeror has not had contracts subject to this requirement.);

(8) Current company balance sheets for the past three years (2017, 2018, and 2019) which will be used for responsibility determination, see Document 00100, paragraph 1.4, PREAWARD

SURVEY/RESPONSIBILITY DETERMINATION;

(9) and Small Business Subcontracting Plan per FAR 52.219-9 Alt. II (Large Businesses only)

(b) Basis of Evaluation: The Government will utilize the seed project as the basis of evaluation for price. Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:

(1) Comparison of proposed prices received in response to the RFP.

(2) Comparison of proposed prices with the Independent Government Estimate.

(3) Comparison of proposed prices with available historical information.

(4) Comparison of information reports obtained from Defense Contract Audit Agency (DCAA) or other outside agencies as required.

b. Non-Cost/Price Evaluation Factors:

1. Factor 1 – Experience

(a) Solicitation Submittal Requirements:

(1) Construction Experience.

i. Submit a maximum of five (5) construction projects in which the Offeror was the Prime Contractor that best demonstrates the Offeror's experience on recent and relevant projects that are similar in size, scope, and complexity to the RFP, using the Construction Experience Project Data Sheet (Attachment C1). For purposes of this evaluation, a recent and relevant project is defined as new construction and/or repair/resurfacing of

1) airfield asphaltic concrete pavement; 2) airfield concrete pavement; 3) roadway or parking lot asphaltic concrete pavement; 4) roadway or parking lot concrete pavement; or 5) improvements such as street or parking lot lighting, grading and drainage, utilities, and landscaping, valued at $300,000 or more, and completed within five (5) years of the date of issuance of this RFP. Contracts listed may include those entered into with Federal, State, or local governmental agencies, as well as contracts with commercial entities.

ii. A project is defined as a construction project performed under a single task order or contract. For multiple award and IDIQ type contracts, the contract as a whole shall not be submitted as a project;

rather Offerors shall submit the work performed under a task order as a project.

iii. The attached Construction Experience Project Data Sheet (Attachment C1) is MANDATORY and SHALL be used to submit project information. Except as specifically requested, the Government will not consider information submitted in addition to this form. Do not alter the Construction Experience Project Data Sheet (Attachment C1) with the exception of expanding the individual blocks on this form;

however, total length for each project data sheet shall not exceed one (1) double-sided 8.5” x 11” page (or two (2) single-sided 8.5” x 11” pages) and shall be size 11 font (minimum). Arial font is recommended but others may be used so long as it is legible.

iv. For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (i.e.: unique features, complexities, construction means & methods). The description shall identify which type of paving work each submitted project represents.

v. If the Offeror is a JV or a participant of the Small Business Administration (SBA) Mentor-Protégé Program, relevant project experience should be submitted for projects completed by the JV entity or SBA Mentor-Protégé as the prime contractor. If the JV or SBA Mentor-Protégé does not have shared experience, relevant projects shall be submitted for each JV partner or for the Mentor and for the Protégé for which they were prime contractors. At least one (1) project from each JV partner, or at least one (1) project from the Mentor and one

(1) project from the Protégé, shall be submitted. Offerors are still limited to a total of five (5) projects combined.

vi. If an Offeror is utilizing experience information of affiliates/subsidiaries/parent/LLC/LTD member companies (name is not exactly as stated on the SF1442) for this evaluation factor, the proposal shall clearly demonstrate the extent of the affiliate/subsidiary/parent firm involvement in the performance of the contract; and shall only be for those projects for which the affiliates/subsidiaries/parent/LLC/LTD member companies were prime contractors. In demonstrating construction experience for this factor, no more than two (2) projects shall be submitted from affiliates/subsidiaries/parent/LLC/LTD member companies.

vii. The Offeror may utilize experience of a subcontractor that will perform major or critical aspects of the requirement to demonstrate construction experience under this evaluation factor. The Offeror must provide a letter of commitment and an explanation of the involvement the subcontractor will have in performance of this contract. In demonstrating construction experience for this factor, no more than two (2) projects shall be submitted from subcontractors. Projects utilizing experience of subcontractors shall only be for those projects for which the subcontractor was the prime contractor.

(b) Basis of Evaluation:

(1) The basis of evaluation will include the Offeror’s demonstrated experience and depth of experience in performing relevant construction projects as defined in the solicitation submittal requirements. The assessment of the Offeror’s relevant experience will be used as a means of evaluating the capability of the Offeror to successfully meet the requirements of the RFP. The Government will only review five (5) projects, in the order they were submitted in the proposal. Any projects submitted in excess of the first five (5) will not be considered.

(2) Proposals that do not contain any projects that demonstrate experience for the Offeror will not be considered.

2. Factor 2 – Safety

Solicitation Submittal Requirements:

The Offeror shall submit the following information: The Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate; and Total Case Rate (TCR) for the specified five (5) Calendar Years (CY), as well as a safety narrative, as described below. For a partnership or joint venture, the Offeror shall submit separate DART and TCR rates for the specified five (5) CY for each contractor who is part of the partnership/joint venture; however, only one safety narrative is required. Any fatalities experienced within this 5-year timeframe must be explained in detail, to include root cause and corrective actions.

NOTE: DART and TCR shall not be submitted for subcontractors

1. DART Rate: Submit five (5) previous complete calendar years’ [CY2015, 2016, 2017, 2018, and 2019] worth of data (not an overall average). If the Offeror has no DART rate, for any year, affirmatively state so and explain why.

a. DART cases include injuries or illnesses resulting in death, days away from work, and/or restricted work or transfer to another job days beyond the day of injury/illness.

b. Calculation of DART rate: Multiply the total number of DART cases by 200,000, and then divide by the number of employee labor hours worked

3. Technical Approach to Safety: Submit a narrative that addresses the following:

a. Describe the Offeror’ s approach to implementing and executing a Safety Management System (SMS) including Management/Leadership involvement, Employee involvement, Hazard prevention, Hazard control, Worksite analysis, and Safety and health training, to include the standard(s) used to benchmark the SMS.

b. Describe the evaluation process used to select potential subcontractors.

c. Describe the processes of how the Offeror will oversee safety compliance of subcontractors at all levels throughout performance of the contract (to include the Offeror’s own in-house workforce).

d. The Technical Approach to Safety narrative shall be limited to two (2) single-sided pages or one (1) double-sided page.

4. The Government reserves the right to review other available sources (public/Government internal) of information. These may include but are not limited to OSHA data, NAVFAC’s Contractor Incident Reporting System (CIRS), Contractor Performance Assessment Reporting System (CPARS), Electronic Contract Management System (eCMS), etc.

Basis of Evaluation:

The Government is seeking to determine that the Offeror has consistently demonstrated a commitment to safety and that the Offeror plans to properly manage and implement safety procedures for itself and its subcontractors. To meet the minimum requirements, the Offeror must demonstrate the following:

1. DART rates at or below 2.99

2. TCR Rates at or below 4.49

NOTE: If the Offeror’s rates exceed the established levels above for any of the five years, it will result in a deficiency.

3. Technical Approach to Safety

a. Offeror describes a viable SMS that addresses elements; such as Management/Leadership involvement, Employee involvement, Hazard prevention, Hazard control, Worksite analysis, and Safety and health training, to include the standard(s) used to benchmark the SMS.

b. Offeror describes a methodical process of evaluating subcontractor’s safety performance in their selection process.

c. Offeror describes a logical management plan to hold both themselves and their subcontractors accountable for adhering to the safety requirements of the contract.

3. Factor 3 – Past Performance

(a) Solicitation Submittal Requirements:

(1) If a completed Construction Contractor Appraisal Support System (CCASS)/Contractor Performance Assessment Report (CPAR) evaluation is available, it shall be submitted with the proposal for each project included in Factor 1 for construction experience. If a completed CCASS, ACASS, or CPAR evaluation is not available for a project that was submitted under Factor 1, the Offeror shall submit Past Performance Questionnaires (Attachment C2) for that project. Evidence of customer satisfaction shall be from the owner and/or their representative responsible for the construction contract administration of construction projects. It shall not be from a prime construction contractor for a subcontractor. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. All PPQs shall be complete, contain client’s signature, and include all information requested in Attachment C2, NAVFAC/USACE Past Performance Questionnaire (Form PPQ-0) located the end of Document 00110. This does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. Offerors should follow-up with clients/references to help ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Mr. Robert Wong, Robert.L.Wong1@navy.mil.

(2) Offerors shall provide any information on problems encountered and the corrective actions taken on projects submitted under Factor 1 – Experience. Offerors shall also address any adverse past performance issues. Explanations shall not exceed two (2) double-sided 8.5” x 11” page (or four (4) single-sided 8.5” x 11” pages) and shall be size 11 font (minimum). Arial font is recommended but others may be used so long as it is legible.

(3) The Government reserves the right to contact references for verification or additional information. The Government’s inability to contact any of the Offeror’s references or the references unwillingness to provide the information requested may affect the Government’s evaluation of this factor.

(4) Performance award or additional information submitted will not be considered.

(b) Basis of Evaluation:

(1) This evaluation focuses on how well the Offeror’s team performed on the relevant projects submitted under Factor 1 – Experience and may also consider past and/or current performance on other projects, interim and/or final, documented in known sources. In addition to the above, the Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government. Other sources may include, but are not limited to, past and/or current performance information retrieved through the Past Performance Information Retrieval System (PPIRS) using all CAGE/DUNS numbers of Contractors who are part of a partnership or JV identified in the Offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror.

(2) The Government may consider the currency and relevance of the information, the source of the information, context of the data, and general trends, interim and/or final, in the Contractor’s performance. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the Offeror’s past and/or current performance will be used as a means of evaluating the Offeror’s probability to successfully meet the requirements of the RFP.

(3) Offerors lacking relevant past performance history will not be evaluated favorably or unfavorably in past performance and will receive an unknown (or “neutral”) past performance rating. In the context of acceptability/unacceptability a neutral rating shall be considered “acceptable”.

4. Factor 4 – Small Business Utilization

It is the policy of the Government to provide maximum practicable opportunities in its acquisitions to small business (SB) concerns, including veteran-owned small business (VOSB), service-disabled veteran-owned small business (SDVOSB), historically underutilized business zone (HUBZone) small business, small disadvantaged business (SDB), and women-owned small business (WOSB) and other small business concerns. Further, it is the policy of the Government that such concerns will have the maximum practicable opportunity to participate in contract performance consistent with its efficient performance.

(a) All Offerors (both large and small businesses) shall use Attachment C3, Small Business Participation and Commitment Strategy to submit the following requested information for evaluation of this factor:

- To demonstrate commitment to use small business concerns in the performance of this contract, identify all planned subcontractors by name that will be used to support each specific small business category (i.e., SB, HUBZone SB, WOSB, SDB, VOSB, and SDVOSB). Identify the type of product/service to be subcontracted, the estimated subcontract value, and the type of commitment (i.e., teaming agreement, letter of commitment, etc.) to each subcontractor.

- To demonstrate maximum practicable participation of small businesses, identify (in terms of dollar value and percentage of the total contract value) the offeror’s total proposed small business participation (i.e. work to be performed by small business as the prime contractor and/or work to be performed by small business subcontractors). All offerors who are not able to meet the minimum total small business participation rate (20% of the total contract value) shall provide a detailed explanation why the minimum total small business participation rate cannot be achieved.

If the offeror does not intend to subcontract, provide a detailed explanation why subcontracting would not result in efficient contract performance.

Note: A large business offeror selected for award shall be required to submit an acceptable Small Business Subcontracting Plan (Attachment C4) incorporating the proposed subcontract values and small business concerns that are specifically identified in the offeror’s Small Business Participation Plan. The Small Business Subcontracting Plan shall aspire to meet the NAVFAC small business subcontracting goals stated below.

Note: The NAVFAC subcontracting targets for FY20 are as follows:

Small Business 40% Historically Underutilized Business Zone 3% Small Disadvantaged Business 5% Service Disabled Veteran Owned Small Business 3% Woman Owned Small Business 9%

(b) Basis of Evaluation:

This factor will be rated on an Acceptable or Unacceptable basis. The Government will evaluate the offeror’s Small Business Participation Plan to determine that the offeror has identified and demonstrated a commitment to use small business concerns in one or more small business categories (i.e., SB, HUBZone SB, WOSB, SDB, VOSB, and SDVOSB) in the performance of this contract.

- Proposals that fail to identify and commit to use small business concerns in the performance of this contract may be rated Unacceptable; however, the Government may take into account reasonable explanations why subcontracting would not result in efficient contract performance.

The Government will also evaluate the small business participation plan to determine that the offeror has demonstrated the maximum practicable participation of small businesses by meeting or exceeding the solicitation’s minimum total small business participate rate (i.e. work to be performed by small business as the prime contractor and/or work to be performed by small business subcontractors). The minimum total small business participation rate for this acquisition is 20% of the total contract value.

- Large business offerors may achieve the minimum total small business participation rate through subcontracting to small businesses.

- Small business offerors may achieve the minimum total small business participation rate through their own performance/participation as a prime and also through a joint venture, teaming arrangement, and/or subcontracting to other small businesses.

- Proposals that fail to demonstrate a total small business participation rate of at least 20% may be rated

Unacceptable; however, the Government may take into account reasonable explanations why the minimum total small business participation rate cannot be achieved.

Q18. Please confirm that all surplus soil per specification section 01 74 19 must be disposed of at PVT Landfill, and that surplus soil from this jobsite cannot be recycled, disposed of on private property nor used on another project, federal or non-federal.

A18. Surplus soil shall be disposed of at PVT Landfill as indicated in Specification Section 01 74 19. Surplus soil shall not be recycled, disposed of on private property, or used on another project.

Q19. Per the boring logs provided on drawing C-107, the majority of the existing material below the AC and existing base course is classified “GC”. Per specification section 31 00 00, paragraph 1.2.2, this type of material is unsatisfactory and would have to be disposed of at the PVT Landfill. Q27. Section 32 13 13.06, subsection 2.2.1.2 (5%) – we would like to request that the air entrainment be waived for this project. Air entrainment is primarily used for freeze-thaw protection (ACI 302.1R-96 “Guide for Concrete Floor and Slab Construction”, Section 5.6.1 Air-entraining admixtures), which is not an issue in Hawaii. The other positive side-effects of AE, water reduction and workability, are already achieved with less volatile methods including use of water reducer and optimized combined aggregate gradation.

A27. Delete Paragraph 2.2.1.2 in Specification Section 32 13 13.06.

Q28. Document 00110, Part II - Evaluation Criteria, seems to indicate that “Small Business Subcontracting Plan per FAR 52.219-9 Alt. II (Large Businesses only)” is to be included in both the Offeror’s Price Proposal, as well as the Offeror’s Technical Proposal (Factor 4). However, the “Instructions to Offerors” indicates that “Small Business Subcontracting Plan per FAR 52.219-9 Alt. II (Large Businesses only)” should only be included in the Offeror’s Price Proposal and does not outline a Factor 4 under the Techincal Proposal as called out in the Evaluation Criteria. Please clarify as to how the “Small Business Subcontracting Plan per FAR 52.219-9 Alt. II (Large Businesses only)” should be included in the Offeror’s proposal.

A28. The Small Business Subcontracting Plan (Large Businesses only) is not part of Factor 4 – Small Business Utilization and is to be provided separately upon request by the Contracting Officer. Documents 00100 and 00110 have been revised to remove that submittal requirement from the Price Proposal.
