In question 5 of the MACC Frequently ask questions, it states both Jv partners must have reletive experience. Does this apply to Mentor Protégé JV offerors? If so it is direct conflict with CFR 13 CFR 125.8 (e) which clearly states "A procuring activity may not require the protégé firm to individually meet the same evaluation or responsibility criteria as that required of other offerors generally." We respectfully ask for this provision for Mentor Proteges to be incorporated into the evaluation criteria as to not disadvantage Mentor Protege offers.
Conflicting Information Other/Unsure
The Government has revised the response to this RFI. Please see Amendment 0001 of the solicitation. In accordance with 13 C.F.R. 125.8(e), if the joint venture is an SBA approved Mentor-Protégé joint venture, the partners of the joint venture in aggregate must demonstrate the relevant project experience necessary to perform the contract.

The RFP requires the representations and certifications to be completed and submitted as part of Phase 1 proposals. Section 00600 is provided in both the solicitation documents and as an attachment/exhibit in word form. (a) Does the government have a preference as to which document is filled out and submitted? (ie..one is considered the same as the other) Also, in this document there are references to certification clauses that are not made part of either document (52.204-17 Ownership or Control of Offeror and 252.209- 7002, Disclosure of Ownership or Control by a Foreign Government).
(b) Is it understood that by submitting a Phase 1 proposal that the contractor does not have an immediate owner or is not owned in any part by a Foreign Government?
Intent needs clarification
RFP not defined by options/sectio ns defined in the drop down list within this document.
Contracting
(a) With regard to Section 00600, Representations and Certifications, the Government does not have a preference as to which document is filled out and submitted by the Offeror as long as the required documents are completed as stated in the RFP. The attachment/exhibit of Section 00600 is provided for the Offeror's convenience. (b) The standard provision 52.204-17 is incorporated by reference under FAR 52.204-8. The standard provision 252.209-7002 is incorporated by reference under provision 252.204-7007. Secondly, the discussion for teaming with a Design Partner to the Contractor or vice versa is not defined by the manner of the teaming arrangement. (a) Will a letter of intent be sufficient to define the teaming arrangement between designer and contractor? Section 00801 Special Contract Requirements, paragraph 29 Partnering defines “Key Personnel” as Project Manager, Assistant Project Manager, Superintendent, CQC representative, major subcontractors, and specialized supplementary personnel. The Phase 1 proposal requirements only dictate that teaming members are companies/entities that the Offeror intends to utilize for this contract.
(b) Are we to also define these “Key Personnel” within Exhibit A? If so, is there specific list of Key Personnel that is to be shown for the Designer of Record?
Intent needs clarification
RFP not defined by options/sectio ns defined in the drop down list within this document.
Contracting
(a) As stated in Factor 1, Technical Approach of the RFP, the Offeror shall submit a signed copy of any joint venture agreement, partnership agreement, teaming agreement, approved mentor-protégé agreement (MPA), or letter of commitment for each member of the Offeror’s Team identified in the technical approach narrative describing primary construction firm(s) and primary design firm(s) (e.g., joint venture member, partner, team member, first-tier Small Business subcontractor, parent company, subsidiary, or other affiliated company, etc.). In regard to VETS-4212 Reports, this section instructs offerors to "…include a copy of their confirmation notification email in their proposal…" Please confirm, should offeror also include copies of report confirmations for any Joint Venture projects that have been filed?

We have a current design/build project that we are interested in using as a reference. The Design portion of this reference is 100% complete and the construction is 90% complete. The project meets the Landfill, Earthwork, Design Build, and is over $3million dollars.
It also includes sustainable features- (retention basins) and others. This is a relevant project that we would like to use as reference.

The Government requires thatall Offerors (both large and small businesses) shall submit, on Exhibit “D” (Past Performance – Small Business Participation) under Tab “3,” the requested information for each project submitted in Factor 2 (Experience) in order to validate their prior utilization of small business subcontracting. Past performance information submitted for projects other than those submitted in Factor 2 will not be considered. Because our company is a small business, our previous projects did not require that we meet small business participation goals. We would like to request that the Government not require Exhibit D to be completed by small businesses.
Intent needs clarification
Other/Unsure
There will be no change to the RFP. As stated in the RFP under Factor 3, Past Performance, "Note: Small business Offerors shall clearly identify their small business category for each project submitted. On Exhibit “D” (Past Performance – Small Business Participation), items
(a) – (h) are for SUBCONTRACTED values only. Do not include self-performed work under these items." Please also see Government response to RFI #7 and updated Exhibit "D" in the solicitation (see sam.gov site) dated 11 August 2021 to correct typographical error from "Factor 2: Past Performance" to "Factor 3: Past Performance".

4. Evaluation Factors
Reference Section 4. Evaluation Factors, Factor 3: Past Performance, paragraph 2 (pg 19 of 123). In regard to direction for submittal of an incomplete PPQ form at the time of the proposal closing date " If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ (Exhibit “C”), which will provide contract and client information for the respective project(s). Offerors should follow-up with clients/references to ensure timely submittal of questionnaires." Please confirm, offeror does not need to submit a complete copy of the executed PPQ post-proposal closing date?
Intent needs clarification
As stated in Factor 3, Past Performance, If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ (Exhibit “C”).

Secton 00210, Factor 1 and Exhibit A
The response to Question 17 indicates “Yes, as stated in Factor 1, Technical Approach of the RFP, use Exhibit "A", Offeror Team Composition and Management. Offer shall be responsible to identify all key personnel of the primary/lead design firm.”
The Tab 1 - Factor 1, Technical Approach submission requirements and evaluation criteria reference identification and discussion of firms as well as a simple organization chart listing entities. The Tab 1 – Exhibit A instructions do not state to include names of key personnel for construction or design. Furthermore, given the nature of this MACC contract, construction and design personnel are likely to be identified for specific task orders based on location and scope of work. Based on these factors, please confirm that offerors are NOT required to identify key personnel names for construction and/or design on the Exhibit A format submitted in Tab 1 – Factor 1, Technical Approach.
Conflicting Information Contracting Please see the Government response to RFI# 17 above.
