SUMMARY OF CHANGES

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

AMENDMENT 03

RFI #01: We understand that the solicitation N6247321R0011 is 100% set aside for 8(a) businesses. If a 8(a) company bids as the prime with a subcontractor, who they have a Joint Venture with, will the subcontractor’s or the JV’s experience count towards rating? The 8(a) company does not necessarily have the facilities investment experience on its own but the JV partner does and would be joining this bid as one of the major subcontractors. We would appreciate your directions on this.

RESPONSE: Pending.

RFI #02: Section of the Request for Proposal: SF33, Paragraph: L.5, Volume 1, (a), 1; L.5, Volume 2, (b), (1), (d), and (f), Page number: 59 of 79; 61 of 79, and 62 of 79J:

[REDACTED] is a wholly-owned Subsidiary of [REDACTED], an AbilityOne contractor. As such, we are not registered with the SBA under any SB category and are therefore large. Per 10 U.S. Code § 2410d, AbilityOne nonprofit agencies, such as [REDACTED], may count towards the small business subcontracting plan goals, but to be clear, we are not a SB. Additionally, there is no SB subcontracting plan required for 29 Palms, so it is our understanding that our ability to count towards a SB subcontracting plan is not what you intended in the above referenced statements.

Therefore, are we to understand that as an 8(a) set-aside procurement, you are limiting the major subcontractors (first-tier sub) that the prime 8(a) selects, to small businesses, only? Notwithstanding the 8(a) prime would self-perform at least 51% of the work, the ONLY major subcontractors they can use in actual performance, and reference in past performance, are small businesses? This arrangement excludes in totality the use of large companies, which is unnecessary given the 8(a) set aside.

RESPONSE: Pending.
