Southwest facility no later than the date and time stated above.

Offerors intending to deliver the proposals in person to the facility at the address above are cautioned that this

NAVFAC Southwest facility is located in downtown San Diego. An Offeror risks the late receipt and rejection of a proposal where it delays delivering its proposal until the last few minutes before the time set for receipt of proposals.

Immediately upon proposal delivery, the Offeror shall leave the Government facility. An Offeror that does not leave the premises may be requested to leave or escorted by security personnel.

4. Pre-Proposal Conference and Site Visit

A pre-proposal conference will be held on 09 January 2019 at 01:00 PM located at Mariner’s Park. Mariner’s

Park is located a few blocks outside the Main Gate of Naval Base San Diego (map provided as Attachment G), where questions will be answered relative to this RFP. Comments, constructive criticism, and identification/notification of RFP inconsistencies are solicited as well. There is no need to obtain a base access pass for the pre-proposal conference since it is located off base.

The pre-proposal conference will include an opportunity for Prime Contractor and Small Business Subcontractor networking. Interested Prime Contractors and Small Business Subcontractors are encouraged to participate. It is suggested that attendees come prepared for this event with company literature or brochures, as time will be given for

Small Business Subcontractors to network with Prime Contractors interested in this procurement.

The site visit will take place immediately following the pre-proposal conference. A tour will be conducted at the project site with the Customer, Coastal PMD and FEAD Personnel. The Coastal PMD team will meet all attendees at the project site (map provided as Attachment H). Offerors shall plan to obtain all necessary permits to access

Naval Base San Diego prior to the site visit.

All prospective offerors are highly encouraged to attend the Pre-Proposal Conference and Site Visit. In order to make the conference as productive as possible, offerors are requested to submit, three days prior to the pre-proposal conference, any questions they may have in writing to Jody Bester at jody.bester@navy.mil. Submission of written questions will not preclude anyone from posing questions during the pre-proposal conference. Failure of a prospective offeror to submit any questions or to attend the conference will be construed to mean that the offeror fully understands all requirements of the solicitation. Prospective offerors are advised that the pre-proposal conference will be held solely for the purpose of explaining the concepts involved in the project and the specifications, terms, and conditions of this solicitation.

No minutes of this meeting will be issued. All prospective Offerors are advised that this solicitation will remain unchanged unless it is amended in writing. However, if an amendment is issued, normal procedures relating to the acknowledgement and receipt of any such amendment as described in Contract Clause “Amendment to

Solicitations” of this section shall be applicable.

Offerors shall submit the Surety Form to their Surety and request the Surety complete the form with regard to the offeror’s firm so that the offeror can include the form with the offeror’s proposal.

If the offeror is a joint venture, information should be submitted for the joint venture. If there is no information for the joint venture, information should be submitted for each joint venture partner.

The Joint Venture Agreement, Financial Questionnaire, Surety Form, and Representations and Certifications will not be rated. They will, however, be considered in assessing the offeror’s responsibility.

READ THE FOLLOWING IN CONJUNCTION WITH THE ACQUISITION REQUIREMENTS.

PROPOSALS MUST SET FORTH FULL, ACCURATE, AND COMPLETE INFORMATION AS REQUIRED

BY THIS REQUEST FOR PROPOSAL (INCLUDING ATTACHMENTS). THE PENALTY FOR MAKING

FALSE STATEMENTS IN PROPOSALS IS PRESCRIBED IN 18 U.S.C. 1001.

THE GOVERNMENT INTENDS TO EVALUATE PROPOSALS AND AWARD WITHOUT DISCUSSIONS.

HOWEVER, THE GOVERNMENT RESERVES THE RIGHT TO CONDUCT DISCUSSIONS IF IT IS LATER

DETERMINED BY THE CONTRACTING OFFICER TO BE NECESSARY. THEREFORE, EACH INITIAL

OFFER SHOULD CONTAIN THE BEST TERMS FROM A TECHNICAL AND PRICE STANDPOINT.

BASIS OF AWARD AND EVALUATION FACTORS

1. Basis of Award

(a) The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with Offerors in the competitive range; and to award the contract to the Offeror submitting the lowest priced, technically acceptable offer.

(b) As stated in the solicitation, the Government intends to evaluate proposals and award a contract without discussions with Offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the

Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

(c) The LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price. In order to permit efficient competition, the following methodology will be utilized. Proposals will be initially screened for price and placed in order of price (lowest price to highest price). The Government will then evaluate the non-price factors of the three

(3) lowest priced proposals in accordance with the criteria of acceptability set forth in the solicitation. However, the

Government, at its sole discretion, reserves the right to increase the number of proposals it will review under this methodology. If at least one (1) of those proposals is technically acceptable, and if the price is determined to be reasonable in the price evaluation, the Government will make an award to the Offeror with the technically acceptable proposal with the lowest price. If there are no technically acceptable proposals in the first group of three

(3), groups of three (3) proposals will continue to be evaluated in the order of lowest price to highest price until one offer has been determined to be technically acceptable. Accordingly, under this methodology, the non-price factors of some proposals may not be evaluated by the Government. If discussions are deemed necessary by the

Contracting Officer, all proposals will be evaluated (both non-price and price) for the purpose of establishing a competitive range. Proposals shall be provided to the evaluators without any identification of prices or any rank order of prices.

(d) Each non-price factor will be rated as either Acceptable or Unacceptable. An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.

(e) Any proposal found to have a deficiency in meeting the stated solicitation requirements or performance objectives will be considered ineligible for award, unless the deficiency is corrected through discussions. Proposals may be found to have either a significant weakness or multiple weaknesses that impact either the individual factor rating or the overall rating for the proposal. The evaluation report must document the evaluation board’s assessment of the identified weakness(es) and the associated risk to successful contract performance resulting from the weakness(es). This assessment must provide the rationale for proceeding to award without discussions.

2. Definitions

100% COMPLETE:

For construction projects: The facility is completely constructed and ready for the intended use.

Acceptable Features: A proposed method or technique in the proposal that addresses solicitation requirements such that no further explanation or documentation is necessary.

Best Value: The expected outcome of an acquisition that, in the Government’s estimation, provides the greatest overall benefit in response to the requirement. See FAR 2.101.

Clarifications: Limited exchanges between the Government and Offerors that may occur when award without discussion is contemplated. See FAR 15.306(a)(1).

Combined Project(s): Projects with multiple starting and ending points, performed under separate task orders, delivery orders, or multiple contracts combined in a single description. No credit will be given for work performed under MACC/IDIQ contracts in the aggregate or for multiple projects completed under more than one task/delivery order.

Communications: Exchanges, between the Government and Offerors, after receipt of proposals, leading to establishment of the competitive range. See FAR 15.306(b).

Competitive Range: See FAR 15.306(c).DEFICIENCY: A material failure of a proposal to meet a solicitation requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.

Deficiency: A material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.

Design-Build: Refers to combining design and construction in a single contract with one contractor. Design-build projects require design of the project by a licensed professional (i.e. engineer, architect). Projects that only require shop drawing level effort are not design-build projects.

Design-Bid-Build: Refers to the traditional delivery method where design and construction are sequential and contracted for separately, with two separate contracts and two contractors; one for an A-E contract and one for a construction contract.

Discussions: Exchanges (i.e., negotiations) in a competitive environment that are undertaken with the intent of allowing the Offeror to revise its proposal. Discussions take place after establishment of the competitive range. See

FAR 15.306(d).

Evaluation Notice (EN): PCO’s written notification to the Offeror for purposes of clarifications, communications, or discussions.

Experience: Pertains to work performed by an Offeror and Offeror’s Team, within the prescribed timeframe, which is the same or similar to the work that may be ordered under this contract in terms of size, scope, and complexity.

Experience is distinct from past performance (how well an Offeror has performed).

Five-Year or Seven-Year Period: The prescribed timeframe for this solicitation that refers to the period of time for which projects may be submitted for experience or past performance. The five-year or seven-year period is calculated by counting back five or seven years from the initial RFP issuance date.

Joint Venture (JV): A legal business entity formed between two or more companies (parties) to undertake the performance activities of a contract together. This does not include other arrangements such as “teaming agreement” or “strategic alliance,” which are not recognized as bona fide joint ventures for the purposes of this solicitation.

Lead Design Firm / Design Team: Applies to the Offeror’s primary design firm(s) and any in-house lead designer(s).

New Construction: Refers to creating entirely new facilities (or new expansions/additions to existing facilities where a new structure and foundation are provided as part of the expansion/addition).

Offeror: Refers to the Contractor submitting the proposal as Offeror, including joint ventures, whose name appears in Block 14 of Standard Form (SF) 1442 (Solicitation, Offer and Award). In the event of a conflict or inconsistency between the Offeror’s name cited on the SF 1442 and any other part of the proposal, the SF 1442 is the conclusive document in determining the Offeror who is submitting the proposal.

Offeror’s Team: Refers to the Offeror (see definition), the Offeror's outside Lead Design Firm, and/or in-house

Lead Designer(s) only; does not include subcontractors or consultants.

Page: Refers to one printed side of a piece of paper. (For example, 5 pieces of paper printed on both sides would result in 10 pages of narrative.)

Past Performance: Relates to how well an Offeror and Offeror’s Team has performed; e.g., the quality of work accomplished, schedule compliance, customer satisfaction.

Performance Confidence Assessment: An evaluation of the likelihood (or Government’s confidence) that the

Offeror will successfully perform the solicitation’s requirements; the evaluation is based upon past performance information.

Project: A design-build or design-bid-build construction activity or task, with a single starting point and a single ending point.

Recency: As it pertains to past performance information, is a measure of the time that has elapsed since the past performance reference occurred. Recency is generally expressed as a time period during which past performance references are considered relevant.

Relevancy: As it pertains to past performance information, is a measure of the extent of similarity between the service/support effort, complexity, dollar value, contract type, and subcontract/teaming or other comparable attributes of past performance examples and the solicitation requirements; and a measure of the likelihood that the past performance is an indicator of future performance.

Renovation, Repair, Alteration Project Types: Refers to projects where the work modifies existing facilities.

Risk: As it pertains to source selection, is the potential for unsuccessful contract performance. The consideration of risk assesses the degree to which an Offeror’s proposed approach to achieving the technical factor or subfactor may involve risk of disruption of schedule, or degradation of performance, the need for increased Government oversight, and the likelihood of unsuccessful contract performance.

Self-Perform: Refers to performing relevant major construction trade work in-house without subcontractors. This does not include administrative or management functions (such as quality control or safety program) and miscellaneous work (such as housekeeping or cleanup). Relevant and major construction trade work is that which is the same or similar to the work that may be ordered under this contract.

Significant Weakness: A flaw that appreciably increases the risk of unsuccessful contract performance.

Source Selection Authority (SSA): The official designated to make the source selection decision.

Source Selection Decision Document (SSDD): The document that reflects the SSA's independent, integrated, comparative assessment and decision.

Source Selection Evaluation Board (SSEB): A group of individuals representing the various functional disciplines relevant to the acquisition that is responsible for evaluating proposals against the solicitation criteria.

Weakness: A flaw in the proposal that increases the risk of unsuccessful contract performance.

3. Evaluation Factors for Award

The applicable evaluation factors and submission requirements are identified below. The solicitation requires the evaluation of price and the following non-price factors:

Factor 1 – Experience

Factor 2 – Safety

Factor 3 –Past Performance

The distinction between experience and past performance is that experience pertains to the volume of work completed by a contractor that are comparable to the types of work described under the definition of recent, relevant projects, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.

Basis of Evaluation and Submittal Requirements for Each Factor:

(a) Price:

(1) Solicitation Submittal Requirements:

The Offeror shall submit one original price proposal, using the Contract Pricing Schedule provided with the Request for Proposal in a sealed envelope separate from the Technical Proposal.

- Standard Form (SF) 1442 (Solicitation, Offer and Award)

- Bid Bond

Failure to submit a Bid Bond conforming to the requirements of the solicitation may result in an Offeror's proposal being rejected as unacceptable.

(2) Basis of Evaluation: The Government will evaluate price based on the total price. Total price consists of the basic requirements and all option items. The Government intends to evaluate all options and has included the provision FAR 52.217-5, Evaluation of Options (JUL 1990) in the solicitation. In accordance with FAR 52.217-5, evaluation of options will not obligate the Government to exercise the option(s). Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:

(i) Comparison of proposed prices received in response to the RFP.

(ii) Comparison of proposed prices with the IGCE.

(iii) Comparison of proposed prices with available historical information.

(iv) Comparison of market survey results.

Price will be evaluated on the basis of whether or not it is fair and reasonable and within the limitation stated in the

RFP. Evaluation will include analysis to determine the Offeror’s comprehension of the requirements of the RFP as well as to assess the validity of the Offeror’s approach. Proposals will be evaluated to assess the degree to which proposed price accurately reflects proposed performance.

Any inconsistency, whether real or apparent, between proposed performance and price must be clearly explained in the price proposal. For example, if unique and innovative approaches are the basis for an apparently unbalanced/inconsistently priced proposal, the nature of these approaches and their impact on price must be completely documented. The burden of proof of price reasonableness rests solely with the Offeror.

(b) Technical Factors:

FACTOR 1: EXPERIENCE:

a. Proposal Submittal Requirements:

The Offeror shall submit the following information:

Submit Attachment “C” (Construction Experience Project Data Sheet) under Tab “1.”

Submit a minimum of three (3) and maximum of five (5) relevant construction projects for the Offeror that best demonstrates your experience as a prime contractor on relevant infrastructure projects that are similar in size, scope, and complexity to the RFP. For purposes of this evaluation, a relevant project is further defined as:

Similar in size: Construction project with construction cost of $40,000,000 or more, a minimum of 50 percent of work shall be for major electrical utility infrastructure, or a construction project with a major electrical utility infrastructure with a construction cost of $20,000,000 or more. Projects with a construction cost of less than

$40,000,000 or that involve less than 50 percent of work for electrical utility infrastructure or a construction project with a major electrical utility infrastructure with a construction cost of less than $20,000,000 will not be considered.

Major electrical utility infrastructure is further defined as substations or underground electrical/communication distribution systems.

Similar in scope: New construction of electrical substations, electrical underground distribution systems, or other major urban development projects that include construction of major electrical utility infrastructure.

Similar in complexity: projects in occupied areas such as parking lots, projects in areas with various on-going construction activities or projects that involve managing multiple scope elements within a project.

The Offeror shall meet the following additional requirement:

(1) At least one (1) project shall demonstrate experience in successfully managing multiple worksites under a single project.

Attachment “C” must clearly address how the project meets the above requirements.

Projects submitted for the Offeror shall be 100% complete (see definition) within the past seven (7) years of the date of issuance of this RFP, and 100% complete as of the date of issuance of this RFP.

A project is defined as a construction project performed under a single task order or contract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole shall not be submitted as a project;

rather Offerors shall submit the work performed under a task order as a project.

The attached Construction Experience Project Data Sheet (Attachment C - DBB) is MANDATORY and SHALL be used to submit project information. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed one (1) double-sided page (or two (2) single-sided pages).

For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (i.e.: unique features, area, construction methods).

If the Offeror is a Joint Venture (JV), relevant project experience should be submitted for projects completed by the

Joint Venture entity. If the Joint Venture does not have shared experience, projects shall be submitted for the Joint

Venture members. Offerors who fail to submit experience for all Joint Venture members will be considered

Unacceptable. Offerors are still limited to a total of five (5) projects combined.

If an Offeror is utilizing experience information of affiliates/subsidiaries/parent/LLC /LTD member companies

(name and DUNS number is not exactly as stated on the SF1442), the proposal shall clearly demonstrate that the affiliate/subsidiary/parent firm will have meaningful involvement in the performance of this contract in order for the past performance information of the affiliate/subsidiary/parent/LLC/LTD member companies to be considered. The proposal shall state specific commitments if technical resources (e.g. personnel, equipment). In particular, the proposal will clearly state the specific commitments of resources of the affiliate/subsidiary/parent/ LLC/LTD member that will be located at the worksites and company offices in the city/area of the project. The proposal shall also describe specific roles of the affiliate/subsidiary/parent/LLC/LTD member companies in terms of the work it will either self-perform or manage of behalf of the Offeror in performance of the contract. Any projects submitted in excess of five (5) will not be considered.

The Offeror may utilize experience of a subcontractor that will perform critical aspects of the requirement to demonstrate construction experience under this evaluation factor. For the purposes of this solicitation, only major electrical utility infrastructure is defined as “critical aspects.” The proposal must provide a letter of commitment and an explanation of the meaningful involvement that the subcontractor will have in performance of this contract.

b. Basis of Evaluation:

The requirement for acceptability will be based upon the projects submitted by the Offeror in their proposal, with at least three (3) projects that meet the relevancy requirements for similar size, scope and complexity. Projects provided must also meet the additional requirement of a.(1).

FACTOR 2: SAFETY:

The Offeror shall submit the following information:

Submit Attachment “E” (Safety Data Sheet / Safety Narrative) under Tab “2.”

(1) Experience Modification Rate (EMR) – Submit data for three previous calendar years’ 2015, 2016, and 2017.

This rate compares company’s annual losses in insurance claims against its policy premiums. The Offeror may submit an insurance company-provided equivalent rate if no EMR exists. If the Offeror has no EMR or premium, for any year, affirmatively state so and explain why. Any extenuating circumstances that affect the EMR and negative trends shall be addressed as part of the element.

(2) OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) and Total Recordable Case (TRC)

Rates – Submit data for three previous calendar years’ 2015, 2016, and 2017. If an Offeror cannot submit OSHA

DART and TRC rates, for any year, affirmatively state so and explain why. Any extenuating circumstances that affected the OSHA DART and TRC rate data negatively shall be addressed as part of this element.

(3) Technical Approach for Safety – Describe the plan for safety that will be implemented to evaluate safety performance of potential subcontractors as part of the selection process for all levels of subcontractors. The Offeror shall submit a narrative that fully describes the safety management system that they will use to oversee the safety compliance and performance of self-performed and sub-contractor performed work. The Offeror shall describe any innovative methods that will be employed to ensure and monitor safe work practices at self-performed and all subcontractor levels. Additionally, describe the methodology to execute an effective program that facilitates sound mishap prevention techniques and processes, employee reporting of unsafe conditions, unsafe activities, and near-miss mishaps, including a description of your “Good Catch” Program. A “Good Catch” Program is defined as a program that recognizes and rewards employees for reporting unsafe and/or unhealthful situations and acts to create a climate of trust and safety. The program should also have procedures in place to address deficiencies and unsafe situations immediately and to document those actions accordingly. The technical approach to safety narrative shall be limited to one-double sided page or two single-sided pages.

Note: For a partnership or joint venture, the submittal requirements above are required for each contractor who is part of the partnership or joint venture; however, only one safety narrative is required. EMR, DART and TRC rates shall not be submitted for subcontractors

The safety factor evaluation will collectively consider the following three submittal requirements:

EMR – The Government will evaluate the EMR to determine if the Offeror has demonstrated a history of safe work practices taking into account any negative trends and extenuating circumstances that impact the rating.

OSHA DART and TRC rates – The Government will evaluate the OSHA DART and TRC rates to determine if the

Offeror has demonstrated a history of safe work practices taking into account any upward trends and extenuating circumstances that impact rates.

Technical Approach to Safety –The Government will evaluate the degree to which subcontractor safety performance will be considered in the selection of all levels of subcontractors on the upcoming project as well as the degree to which the Offeror’s safety management system will ensure safety compliance of self-performed and subcontracted work, including innovative methods to monitor safe work practices. The Government will also evaluate the

Offeror’s methodology to execute an effective program that facilitates sound mishap prevention techniques/processes, employee reporting of unsafe conditions, unsafe activities, and near-miss mishaps including its “Good Catch” Program.

While the Government may elect to use other sources of information in evaluating safety to include, but not limited to OSHA, NAVFAC’s Contractor Incident Reporting System (CIRS) in Enterprise Safety Applications Management

System (ESAMS), Contractor Performance Assessment Reporting System (CPARS) and other related databases, the burden of providing detailed, current, accurate and complete safety information regarding these submittal requirements rests with the Offeror.

FACTOR 3: PAST PERFORMANCE:

Submit Past Performance Questionnaires (Attachment “D”) and CPARS/CCASS evaluations under Tab “1” immediately following each of the project data sheets to which they pertain. Submit any other past performance information under Tab “3.”

If a completed Construction Contractor Appraisal Support System (CCASS) or Contractor Performance Assessment

Rating System (CPARS) evaluation is available, it shall be submitted with the proposal for each project included in

Factor 1. If there is not a completed CPARS or CCASS evaluation, submit a Past Performance Questionnaire

(Attachment “D”) for each project included in Factor 1. The Offeror should provide completed Past Performance

Questionnaires (PPQ) in the proposal. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). The

Government may make reasonable attempts to contact the client noted for that project(s) to obtain the PPQ information. However, Offerors should follow-up with clients/references to help ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Jody Bester at jody.bester@navy.mil.

Offerors may provide any information on problems encountered and the corrective actions taken on projects submitted under Factor 1 – Experience. Offerors may also address any adverse past performance issues.

Explanations shall not exceed two (2) double-sided pages (or four (4) single-sided pages) in total.

The Government reserves the right to contact references for verification or additional information. The

Government’s inability to contact any of the Offeror’s references or the references unwillingness to provide the information requested may affect the Government’s evaluation of this factor. In addition to the above, the

Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS) using all

CAGE/DUNS numbers of Contractors who are part of a partnership or joint venture identified in the Offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System

(FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the

Offeror.

Performance award or additional information submitted will not be considered.

This evaluation focuses on how well the Offeror performed on the relevant projects submitted under Factor 1 –

Experience and past performance on other projects currently documented in known sources (including interim project performance evaluations).

The Government will consider the currency and relevance of the information,…
