SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS

SECTION L

L-1 CONTENT OF PROPOSALS (SUPPLIES) (11 Dec 2018)

PART A GENERAL INSTRUCTIONS

1.0 GENERAL

The Offeror shall respond to all requirements of the solicitation and not alter or rearrange the solicitation. The Offeror is advised that the Government may incorporate any portions of the Offeror’s proposal into the resulting contract.

In presenting material in the proposal, the Offeror is advised that quality of information is more important than quantity. Clarity, brevity, and logical organization shall be emphasized during proposal preparation. Statements that the prospective Offeror understands, can comply with, or will comply with, the specifications, and paraphrasing the requirements or parts thereof without supporting information are considered inadequate by the Government, and may result in assessing weaknesses and/or deficiencies.

The Offeror shall include any data that illustrates the adequacy of the various assumptions, approaches, and solutions to problems. Failure to address a specific factor or subfactor clearly may be considered a deficiency. Unnecessarily elaborate brochures or other presentation materials beyond that sufficient to present a complete and effective proposal is neither necessary nor desired.

The Government advises the Offeror that taking exception or deviating from any term or condition of the RFP may result in the assessment of a deficiency to the proposal.

Throughout these instructions, a “JV Team member” is defined as one of the entities that make up a joint venture (JV) formed for the purpose of responding to this solicitation.

Questions: Offerors may submit questions requesting clarification of solicitation requirements by emailing the contract specialist at harrison.carter@navy.mil. It is required that all questions be received within 15 calendar days of the date this solicitation is issued.

2.0 PROPOSAL FORMAT

Written proposals shall be formatted using a Times New Roman 12 pt. Normal font (no reduction permitted), single-spaced with 1-inch margins all around, and formatted for standard 8.5 x 11-inch paper. All pages should be numbered with section and page numbers. When foldout pages are used they shall not exceed 11 x 17 inches and will be counted as 1 page. Drawings may be provided separately and may be any size but should be folded to approximately 8.5 x 11-inch standard size and will count as 1 page. Graphs and tables shall be presented in no smaller than a 10 pt. font and should contain a grid, which allows values to be read directly from the graph to the same accuracy that a 10 x 10 to the ½ inch grid provides. Graphic resolution, including such data as tables or charts, should be consistent with the purpose of the data presented.

The Offeror shall provide one complete copy of the proposal to the Procuring Contracting Officer (PCO) as electronic files fully compatible with Microsoft Office 2010 and for information not supported by MS Office products, with the latest Adobe Acrobat reader on a CD/DVD-ROM. The Offeror shall ensure that the Price/Cost Volume is provided on a separate CD/DVD-ROM. Each CD/DVD-ROM is to be labeled for content and the Offeror’s name. If a discrepancy exists between the original paper copy of the proposal and the disk copy, the paper copy will take precedence. Data stored on the media shall be unlocked.

3.0 PROPOSAL CONTENT AND VOLUMES

The Offeror shall present proposal information in a manner that facilitates a one-to-one comparison between the information presented and this Proposal Instruction. Proposal information shall be structured such that its Volume/paragraph number matches the Proposal Instructions Volume/paragraph number provided in section “Part B Specific Instructions” to which it is responding, although the Offeror may add lower tier subparagraphs. The Offeror shall provide reasons it will not provide information for a particular paragraph. The proposal information instructions are structured by paragraph numbers where first, second, third, and fourth parts correspond to the volume, section, and element, etc., in the Offeror’s proposal.

Each volume of the proposal shall be submitted as one original and additional copies as specified in the table below. The table below supersedes the copies requested in Block 9 of the Standard Form (SF) 33. All volumes of the original proposal shall be delivered to the address provided in Section 4.0 prior to the closing date/time stated in this solicitation. Page limitations for each volume, if any, are also specified in the table below; title and table of contents pages do not count towards the page limit. Any pages submitted exceeding the page limit shall be disregarded and NOT evaluated.

Information submitted as an Annex to the proposal includes manuals, specifications, plans, procedures, and policies that exist as an official document of the company or facility, as well as other information requested in Part B Specific Instructions. Page limitations for Annexes, if any, are specified below. The authorized Annexes are summarized in the table below.

(d) Pursuant to FAR section 16.301-3(a)(3) and DFARS clause 252.242-7006, “Accounting System Administration,” the contractor’s accounting system shall be adequate during the entire period of contract performance for determining charges applicable to this contract. As a result, all offerors shall provide evidence from DCAA, other federal civilian audit agencies, or a private accounting firm that, as of the proposal due date, the offeror’s accounting system has been audited and has been determined adequate and suitable for administration of a cost-reimbursable type of contract. Offerors that submit evidence from a private accounting firm shall submit Standard Form 1408, completed and signed by the private accounting firm that performed the audit.

3.2 Delivery Order (DO) 0001

For DO 0001 - MRTS 3D ICL SOW (RFP Attachment L-7b), the offeror shall fill in the Contract Line Item (CLIN) Unit Price and Max Amount portions of the applicable SF 33. The offeror shall provide the tables (examples below), to identify proposed labor categories, hours, fully burdened labor rates (less profit), profit amount and total estimated price proposed for work effort defined in the applicable DO’s Statement of Work (SOW) and resulting technical proposal. Offerors shall ensure proposed labor categories, fully burdened rates and fixed-factor rates coincide with those proposed in their PAM and RFP Exhibit 2 Resource Allocation Matrix (RAM) – Firm Fixed-Price (FFP) tables. Insert the completed table(s) in the appropriate portion of the Cost/Price volume. The offeror shall identify proposed other direct cost category (e.g. travel, material, other direct costs (ODCs)), direct cost, and fixed factor (from the appropriate RAM table). The offeror shall provide an integrated master schedule (IMS) and a Basis of Estimate (BOE) with their proposal.

Each offeror shall enter the Contract Line Item (CLIN) Unit Prices and Total Price information in Section B of the delivery order.

3.3 Rate Information

The Offeror shall provide pricing information for Firm Fixed-Price Delivery Order 0001. For the purpose of DO 0001 evaluation, rates reflected in the RAM shall be fully burdened; indirect rate information need not be provided.

3.4 Ground Rules and Assumptions:

(a) As this is a competitive acquisition with adequate price competition anticipated, certified cost or pricing data in accordance with FAR 15.403-1 is not required. However, in the event that adequate price competition does not exist after receipt of proposals, the Government reserves the right to request additional cost or pricing data as necessary from both the Offeror and subcontractors. Further, the Offeror may be required to provide a Certificate of Current Cost or Pricing Data prior to award, pursuant to FAR 15.406-2.

(b) The Offeror shall provide sufficient information to support its price as well as an explanation of all ground rules and assumptions that affect the price estimates.

(c) Total dollar ceiling for all delivery orders issued under the ACTS ID/IQ contract is $99,000,000.00. Initial contract line item (CLIN) value allocations represent projected award/types based upon historical and programmed requirements as of contract award. The Government reserves the right to reallocate value across the CLINs as necessary, throughout the ordering period, to accommodate requirements received.

3.5 Price Information:

(a) Reasonableness and Consistency shall exist between the Management/Technical (methodology) and Price Volumes (application of resources). Offerors shall demonstrate that the unit prices and the total proposed prices are reasonable and commensurate with the work required by the solicitation and the management/technical approaches identified in the Management/Technical Volume of the proposal. Offerors shall show traceability with the CLINs, SOW, proposed effort, proposed manning levels, and the prices. Offerors shall refer to specific sections in the Management/Technical Volume as needed to illustrate the consistency between the Price Volume and the Management/Technical Volume. The Offeror shall explain any inconsistency between proposed performance and price, as well as any appearance of unbalanced pricing, in the proposal.

(b) The Government is not soliciting any investments. However, in order for the Government to properly assess a proposed price that appears low due to a corporate decision to absorb costs, e.g., lower than usual burdens or rates, the Offeror shall fully identify and explain any such investments.

(c) The offeror shall prepare and submit a RAM. The RAM shall depict all labor categories included in the PAM and include associated fully burdened labor rates. The offeror shall include a fixed factor(s) that represents all the appropriate overhead, G&A and profit applicable to the travel, material and other direct costs.

3.6 Incumbent Information. There is no incumbent for the ACTS requirement.

SECTION M - EVALUATION FACTORS FOR AWARD

SECTION M

M-1 EVALUATION FACTORS FOR AWARD (SUPPLIES) (10 DEC 2018)

PART A: GENERAL INFORMATION

1.0 GENERAL

The Government expects to select one offeror whose proposal offers the “best value” to the Government, using the trade-off method. "Best value" means the expected outcome of an acquisition that, in the Government's estimation, provides the greatest overall benefit(s) in response to the requirement. The offeror is advised that the lowest priced proposal meeting the solicitation requirements may not be selected for an award if award to a higher priced offeror is determined to be more beneficial to the Government. However, the perceived benefits of the higher priced proposal must merit the additional price.

2.0 EVALUATION PROCESS

For the Management/Technical factor, a combined Management/Technical /Risk rating will be assigned. This method reflects whether the proposal meets or does not meet the minimum requirements along with an assessment of the strengths, weaknesses, significant weaknesses, and deficiencies of the proposal to determine the combined Management/Technical /Risk rating. The benefit to the Government associated with assessed strengths along with technical risk will be considered in determining whether the offeror’s proposal rises to a level of being thorough or exceptional. Assessment of technical risk considers potential for disruption of schedule, increase in costs, degradation of performance, the need to increase Government oversight, or the likelihood of unsuccessful contract performance. Offerors are advised that during the evaluation process, a management/technical factor with an “Unacceptable” Management/Technical /Risk Rating may result in the entire proposal being found unacceptable and eliminated from the competition.

Under Past Performance, the Government will evaluate recent performance to determine how well an Offeror has performed work similar to the work required by the solicitation. When proposals are received from joint ventures, specifically formed by the offeror to propose on a particular acquisition, the past performance evaluation will consider each (one minimum per JV member, maximum three total) individual JV team member’s relevant past performance. After evaluating the offeror’s past performance information, a Performance Confidence Assessment Rating will then be assigned, which addresses the Government’s level of confidence in the offeror’s ability to perform the required effort successfully based on the offeror’s relevant past performance and systemic improvement. More relevant past performance will typically be a stronger predictor of future success and have more influence on the Performance Confidence Assessment Rating than past performance of lesser relevance. In the case of an offeror without a record of relevant past performance, the offeror will receive a Performance Confidence Assessment Rating of “Unknown Confidence (Neutral)” which is considered a “Neutral” rating.

3.0 EVALUATION FACTORS FOR AWARD

Proposals will be evaluated using the factors (and any subfactors), listed below.

Factor A: MANAGEMENT/TECHNICAL APPROACH (Volume 1)

Element 1.1: Personnel Allocations
Element 1.2: Delivery Order Technical Proposal
-DO 0001 Multipurpose Reconfigurable Training System 3D® (MRTS 3D®) ICL Technical
Proposal

Factor B: PAST PERFORMANCE (Volume 2)

Factor C: PRICE and ADMINISTRATIVE (Volume 3)

Element 3.1: Administrative
Element 3.2: Delivery Order Price Proposal
-DO 0001 MRTS 3D ICL Price Proposal

Factors are listed in descending order of importance. Elements within the Technical Factor are not weighted or rated subfactors. Factor C Price (DO 0001), is the price that the selection official will use to make his or her tradeoff decision.

All evaluation factors other than price, when combined, are significantly more important than price.

PART B: SPECIFIC INFORMATION

1.0 FACTOR A - MANAGEMENT / TECHNICAL APPROACH

The evaluation will include an assessment of the following:

Element 1.1: Personnel Allocation

a.The government will assess the degree to which the labor category descriptions, qualifications, experience, and educational background of the labor categories set forth in the offeror’s Personnel Allocation Matrix (Exhibit 4) are feasible for successfully performing the requirements of the ACTS ID/IQ Statement of Work (Exhibit 1a).
b.The ACTS ID/IQ Statement of Work does not contain express minimum personnel qualification requirements. Government evaluators will use their expertise to assess whether an offeror’s proposed labor category descriptions, qualifications, experience, and educational background, to include any unique attributes, knowledge, skills, or abilities, is in or outside the range of qualities necessary to successfully perform the ACTS ID/IQ SOW requirements. As such, an offeror could receive a deficiency, which would make the offeror’s proposal unawardable, or receive an evaluated strength.

Element 1.2 Delivery Order DO 0001, MRTS 3D Virginia Internal Countermeasure Launcher (ICL)

a.The government will evaluate the offeror's CWBS and Technical Basis of Estimate (TBOE) using, as a baseline, the government's Work Breakdown Structure (WBS) and TBOE found at Attachment L-4.
b.The government will assess the feasibility of the offeror's proposed labor category roles, the number of labor hours, the breakdown of labor categories, and the offeror's explanation of how and why its proposed labor mix differs from the government's to assess the likelihood that the offeror's approach will accomplish Delivery Order 0001’s requirements on schedule. The government will assess whether the offeror used labor categories from the labor categories reflected in the offeror's Personnel Allocation Matrix (PAM).
c.The government will evaluate the offeror's proposed instructional systems and systems engineering technical approaches, labor categories, number of labor hours, processes, steps, and activities for use to develop requirements, design, develop, produce, and test software products, and access likelihood of product delivery product within schedule, IAW DO 01 – VA ICL SOW Attachment L-7a.
d.The government will evaluate the quality of the offeror's proposed documentation development approach for Delivery Order 0001 and proposed approach to meeting section 3.2 of the MRTS 3D ICL Performance Specification (Attachment L-7b). The government will evaluate any submitted previously-established documented software development process or plan, such as a software development plan, included as an appendix to the offeror’s Management/Technical Volume. NOTE: Ensure date documented process or plan was established; may not have been established or created specifically to propose to the ACTS solicitation. A simple statement proposing to follow the style guide is not acceptable.
f.The government will evaluate reusability and maturity of software development processes (e.g. Capability Maturity Model Integration (CMMI) or International Organization for Standardization (ISO) certifications) and use for Delivery Order 0001. In addition, maturity certifications also could be evaluated as a strength in the government's evaluation.
g.The government will evaluate the completeness and feasibility of the Software Development Plan (SDP) (CDRL A001) in the context of Delivery Order 0001.
h.The government will evaluate the validity or feasibility of the offeror's assumptions, estimating methods, and historical analogous data to identify, manage, and mitigate the risk associated with design, development, and requirements volatility. Basic statements of "historical experience" or "subject matter expert estimate" do not provide the level of detail sought by this RFP.

i. The government will assess the likelihood that the offeror’s proposed division of work among the prime offeror, JV members (if so proposed), and its proposed subcontractors is likely to accomplish the program within schedule.

2.0 FACTOR B - PAST PERFORMANCE

There are three aspects to the past performance evaluation: recency, relevancy, and quality. The first aspect of the past performance is to evaluate the recency of the offeror’s past performance being evaluated. Past performance will be considered recent if the contract/order has been performed within five years of the solicitation release date. Past Performance that is not recent will not be considered in the evaluation.

The second aspect of the past performance evaluation is to evaluate how relevant the Past Performance being evaluated is to the requirements of this solicitation. More relevant past performance will typically be a stronger predictor of future success and have more influence on the Past Performance Confidence Assessment than past performance of lesser relevance. The Government will use the following aspects to determine relevancy for this evaluation:

a.In determining relevancy, the government will compare the contract types, total dollar amounts, dollar amounts of the effort actually performed, the location and divisions of the company that performed the effort, the period of performance of the past performance contract, and the scope, magnitude, and complexity of the past performance effort to the effort proposed to be performed under this ACTS ID/IQ solicitation. Stand-alone (non-order) contracts and orders under an IDIQ will be evaluated equally. CPARS will only be evaluated at the filing level stipulated in the proposed effort (i.e. filed at basic IDIQ or order level) Notwithstanding, an IDIQ CPARS or CPAQ will not be evaluated or compared at both the basic and order level, if an order under the IDIQ is submitted for evaluation.
b.The scope is the ACTS ID/IQ solicitation’s scope, not just Delivery Order 0001, which will be compared to the scope of work performed in the offeror’s past performance contract’s Statement of Work, Performance Work Statement, specification and/or contract to the requirements under the ACTS IDIQ solicitation’s SOW. The magnitude is the ACTS ID/IQ solicitation’s magnitude, which is estimated at a total of $99,000,000.00 (e.g. a contract or order valued at $5,000,000.00 to $20,000,000.00 annually). Scope will be evaluated as to how the submitted PPIF or CPAQ Contract Effort Description narrative addresses the areas listed in Section L., Part B., 2.3(a) Past Performance Information, which are listed in descending order of importance.
To assess scope and complexity the government will rely primarily on the page and paragraph numbers the offeror cites in its past performance contract’s Statement of Work, Performance Work Statement, Specification, or contract. While the government may review other portions of the offeror’s past performance contract for context, the offeror should not rely on the government to try to find relevant past performance within other components of its proposal.

3.0 FACTOR C - PRICE

Firm Fixed Price CLINs:

Each Offeror’s price proposal will be evaluated to determine whether it is complete, reasonable. In its evaluation, the Government will perform a price analysis to assess if the proposed Delivery Order exhibits price reasonableness and is realistic. The Government may use various price analysis techniques such a comparison of the Offeror’s proposed price to competing Offerors’ prices in response to this solicitation, comparison to the Government’s independent price estimate, among other techniques to perform the price analysis.

Unrealistically low costs or inconsistencies between the technical and price proposals may be assessed as proposal risk and could be considered weaknesses under the technical factor. Therefore, any inconsistency, whether real or apparent, between the technical proposal and price proposal should be explained in the narrative section of the price proposal.

3.1The government will evaluate the offeror’s Price Volume for its proposed total price; price reasonableness; whether the offeror’s proposed labor rates in the offeror’s Resource Allocation Matrix are balanced; and whether the offeror’s proposed Delivery Order 0001 price is realistic.
3.2As stated previously in Section M, to determine the awardee of the ID/IQ contract the government will perform a tradeoff using technical, past performance, and the price of Delivery Order 0001. Delivery Order 0001 reflects sufficiently typical work to be performed under the ACTS ID/IQ contract to provide the government a meaningful basis for comparison of technical effort and prices. Delivery Order 0001 provides a basis for a reasonable assessment of the price of performance under competing proposals. “Buying in” to Delivery Order 0001 to win award of the ACTS ID/IQ contract is not permitted because “buying in” does not provide a reasonable assessment of the price of performance under competing proposals
3.3Total Evaluated Price: The total evaluated price will be the sum of the CLIN in Delivery Order 0001.
