Factor 2 – Experience, Page 10 of 73, (1) Constuction Experience

Will the Government accept project experience from team member firms with a signed formal teaming agreement with the prime contractor?

Factor 2 - Experience, (a) Solicitation Submittal Requirements, (1) Construction Experience states "Experience of a subcontractor will not be considered." This includes subcontractor experience presented under a teaming agreement.

Will the Navy recognize all Contractor Teaming Arrangements as required under FAR Subpart 9.6 to meet the qualifications as the Offeror?

Per Subpart 9.603 Policy, the Government will recognize the integrity and validity of a contractor teaming arrangement, including formal Prime/Subcontractor Teams provided, the arrangements are identified and company relationships are fully disclosed in an offer or, for arrangements entered into after submission of an offer, before the arrangement becomes effective.

We believe the intent of the Solicitation is to be consistent with Subpart 9.603 in order to provide the maximum small business participation on this procurement. However, the last paragraph of Factor 2 – Experience on page 11 of 73 currently appears to exclude Prime/Subcontractor Teaming arrangements by stating “Experience of a subcontractor will not be considered”. This is in direct conflict with the intent of Subpart 9.603.

Factor 2 - Experience, (a) Solicitation Submittal Requirements, (1) Construction Experience states "Experience of a subcontractor will not be considered." This includes subcontractor experience presented under a teaming agreement. It's noted that the solicitation does not prohibit an Offeror from forming teaming arrangements. Factor 1 - Technical Approach, (a) Solicitation Submittal Requirements, (1) states "Provide a narrative describing the proposed primary construction firms and primary design firms for this contract and the rationale for proposing this arrangement. Provide the role, responsibilities, and contractual relationships between the various firms (see FAR Subpart 9.6)."

RFP Section 00100 Bidding Schedule/Instructions to Bidders – page 10, para 3. Phase One Basis of Evaluation and Submittal Requirements for each factor.

Factor 2 – Experience, (a) (1) Construction Experience states “relevant” is defined as similar size construction projects between $10 – 30M, with one construction project greater than $20M.

To maintain the SB status, we don’t see how SB firms can show much experience with projects of this dollar value. Can the requirement for “relevant experience” be reduced to projects in the $10-15M range?

Re: Page 11 of 73, Section 00100, Factor 2-Construction Experience Proposal submission requirements call for all projects to be at least $10,000,000.

As a small business, we are fully capable of bonding and successfully completing projects in the $10-$30 million range. However, the small business set-aside RFPs are so often issued with requirements to have $10 million projects in our resume. We continually find ourselves excluded from qualifying to submit proposals for these small business set-aside contracts.

We respectfully request the requirements be modified to allow projects that are $6-$8 million to be considered relevant and acceptable for evaluation.

Re: Page 11 of 73, Section 00100, Factor 2-Experience Proposal submission requirements call for all projects to be completed within 7 years of the date of issuance of the RFP.

We respectfully request the requirements be modified to allow projects that are at least 60% complete be considered relevant and acceptable for evaluation.

Projects submitted for Factor 2 - Experience must be "completed within the past seven (7) yeasr of the date of issuance of this RFP." An extended period of completion of 7 years was included to allow Offerors a greater period of time from which to draw projects. The solicitation requirements will remain unchanged.

Page 10 of 73 of the RFP, Factor 2-a.1 states that on construction project must be greater than $20,000,000.

1) Does the project need to be awarded at a value above $20M?

2) Does the project need to be completed at a value of above $20M?

3) If the project started at a value just under $20M, was over $20M due to contract modifications throughout several months of the project, and then was brought back down below $20M due to a value engineering contract MOD for the remainder of the project, does this example project receive credit as being over $20M?

1) The "Award Amount" (Solicitation Attachment B Construction and Design Experience Data Sheet) does not have to be greater than $15,000,000; however, the "Final Price" (Solicitation Attachment B Construction and Design Experience Data Sheet) must be greater than $15,000,000. 2) The "Award Amount" (Solicitation Attachment B Construction and Design Experience Data Sheet) does not have to be greater than $15,000,000; however, the "Final Price" (Solicitation Attachment B Construction and Design Experience Data Sheet) must be greater than $15,000,000.

3) The "Award Amount" (Solicitation Attachment B Construction and Design Experience Data Sheet) does not have to be greater than $15,000,000; however, the "Final Price" (Solicitation Attachment B Construction and Design Experience Data Sheet) must be greater than $15,000,000.

Page 11 of 73 of the RFP, Factor 2, the last paragraph states that “projects may be submitted for the joint venture, partnership, or mentor protégé members.”

1) Does the term “partnership” mean teaming partner, where the arrangement between the team would be documented via a teaming agreement?

Please review and respond to the question above.

No. In addition, please note that Factor 2 - Experience, (a) Solicitation Submittal Requirements, (1) Construction Experience states "Experience of a subcontractor will not be considered." This includes subcontractor experience presented under a teaming agreement.

Page 13 of 73 of the RFP, Factor 3 top paragraph of the page states “Offerors shall not incorporate by reference into their proposal PPQ’s previously submitted for other RFP’s.”

1) Please confirm that we can include previously filled out PPQ’s submitted for other RFP’s in our proposal documentation, and that incorporation by reference, without the actual PPQ document contained in the proposal, shall not be done.

RFP Section 00100, page number 10, paragraph Factor 2 – Experience (a) (1).

This requirement asks for relevant projects similar in size: construction project between $10,000,000 to $30,000,000. Based on the procurement being 100% small business set-aside, would the government consider lowering the dollar value of similar projects to $7,000,000 or more.

RFP Section 00100, page number 11, paragraph Factor 2 – Experience (a) (1).

This requirement requests: “Projects submitted for the Offeror shall be completed within the past seven (7) years of the date of issuance of this RFP.” Will projects that are substantially completed, up to 75% construction completion, be considered relevant?

No. Projects submitted for Factor 2 - Experience must be "completed within the past seven (7) yeasr of the date of issuance of this RFP." Completed means 100% complete.

Also see PPI #5.

Would the Government consider lowering the past performance requirement (currently requires one at least $20 million project and a few of $10 million and up projects) to allow the inclusion of task orders in the range of $3 million and up?

We have a bond capability of $100 million aggregate and the capability of performing the scope of works required under this solicitation.

Page 10, Factor 2 – Experience (a) (1) Similar in size states construction project between $10,000,000 to $30,000,000.

May projects be submitted that exceed $30,000,000?

In addition, Factor 2 - Experience, (a) Solicitation Submittal Requirements defines a relevant project as "similar in size, scope, and complexity to the RFP." Projects that do not meet the definition of "similar in size" may not be considered relevant.

Page 11, Factor 2 – Experience (a) (1) Provide applicable documentation on projects that were validated and/or certified through U.S. Green Building Council (USGBC) or the equivalent organization or process.

Please confirm this documentation is excluded from page count.

Confirmed. Factor 2 - Experience, (a) Solicitation Submittal Requirements, (1) Construction Experience and (2) Design Experience state that "The use of the attached Construction & Design Experience Project Data Sheet (Attachment B) is MANDATORY and SHALL be used to submit project information. If the same project is being used to demonstrate construction and design experience, submit separate Project Data Sheets for construction and design. Except as specifically requested, the Government will not consider information submitted in addition to this form." The Government has specifically requested that Offerors "Provide applicable documentation on projects that were validated and/or certified through U.S. Green Building Council (USGBC) or the equivalent organization or process."

Page 12, Factor 2 – Experience (a) (2) Also, the description should address features detailing how the work was completed in accordance with the “Secretary of the Interior’s Standards for the Treatment of Historic Properties.”

Is historical renovation expected in this this MACC?

Section 00800 Special Contract Requirements, 00803 Task Order Issuance, 3.

Requirements for Proposals states "Task Orders will be firm fixed price with a specific completion date or performance period and clearly define the specific statement of work to be performed or the performance desired." Historical renovation may be required on Task Orders.

Page 12, Factor 2 – Experience (a) (2) Projects submitted shall be completed within the past seven (7) years of the date of issuance of this RFP.

If design is 100% complete on a project but the construction is not, may we submit the project to be used for design experience?

Yes. Factor 2 - Experience, (a) Solicitation Submittal Requirements, (2) Design Experience states "A project is defined as a design effort performed under a single task order or contract/subcontract." Offerors should clearly identify on Solicitation Attachment B Construction and Design Experience Data Sheet that the design portion is 100% complete.
