About this file
This is an amendment to a solicitation for a multiple award contract for the rental of material handling equipment at Norfolk Naval Shipyard. The amendment provides answers to questions from industry, updates the pricing schedule and equipment specifications attachments. Required equipment includes aerial lifts, forklifts, scissor lifts, boom lifts, telehandlers, and other material handling equipment. The contract has a one year base period and four one-year options and will be awarded to multiple awardees as indefinite delivery/indefinite quantity contracts. Task orders will be competed among awardees. Pricing is fixed for the base and option years on a firm-fixed-price per unit per month basis with unlimited usage hours. The amendment removes CLINs for lull attachments and provides clarification on equipment specifications, delivery locations, and subcontracting goals.

QUESTIONS AND ANSWERS
Q: What types of equipment, and in what quantities, will have to be replaced on or before days 1-5 of the period of performance?
A: Task Orders will be handled via the Task Order Process outlined in Section 6 of the Specification & Statement of Work (SSOW). The Equipment Transition Plan, paragraph 5.7 of the SSOW, will be dependent on the quantities of equipment for the individual Task Order solicitation. The type and quantities of equipment will be dependent on the needs of the requesting customer but shall not exceed the Max Quantity for any individual CLIN. The delivery period requirements for each range of total Task Order equipment is outlined in paragraphs 5.7.1.1. – 5.7.1.4
Q: Since there will be multiple awardees, how will you determine which awardees will be given a task order?
A: Task Order awards will be handled via the Task Order Process outlined in Section 6 of the SSOW.
Q: What’s the length of the new contract we are bidding on?
A: The Periods of Performance for each CLIN are listed beginning on page 235 of the solicitation and ending on page 246.
Q: Are exceptions allowed in the solicitation?
A: Offerors who condition their proposals or otherwise fail to comply with all material requirements of the solicitation may have their proposals rejected.
Q. To be considered for one of the multiple awards, do we have to provide pricing on all line items? Can we bid on a portion of the CLIN’s and still be considered for award?
A. Yes, as outlined in the “INSTRUCTIONS TO OFFERORS”, page 224, Volume IV, Price Proposal – Factor 4, “each Offeror shall complete all Solicitation Fill-Ins” which includes pricing for ALL basic requirement CLINs and Option CLINs. No, in order for a proposal to be considered responsive, it must include pricing for ALL CLINs. A partially responsive proposal will not be considered for award.
Q. (Page 191, Note A) In this context, what does highest overall contract value mean?
A. The cumulative Not To Exceed Contract Ceiling for each contract award will be the highest cumulative price (Basic Requirement CLINs and Option CLINs) of the highest priced awardee.
Example: If awards are made to Offerors A, B, C, and D, with Offerors A, B, and C each proposing a cumulative price of $8, and Offeror D proposing a cumulative price of $10, the Not to Exceed Contract Ceiling for all awards will be $10.
Q. (Page 193, Section 4.4.1) What standards are being using to determine compliance? OSHA, ANSI?
A. Compliance will be determined by inspecting the provided items in comparison to the requirements outlined in the Specification & Statement of Work, as well as Attachment 2, Inventory Minimum Specifications.
Q. (Page 197, first and second paragraph) Is there an exception on the PM/QM requirement for small businesses bidding direct?
A. No, this is an overarching requirement that applies to all Offerors and shall not be waived for small businesses.
Q. (Page 198, 4.15.2.1) What if the vehicle or equipment is sourced by contractor from an outside supplier with the supplier company names on the vehicle? Do we need to have our name on it or is the other supplier’s name, okay?
A. The company name on the vehicle or equipment must match the vehicle registration and insurance, whether a contract awardee or subcontractor.
Q. (Page 199, Section 4.15.5.1) How can contractors be reimbursed when denied access on a scheduled visit?
A. If a contractor incurs additional costs that they feel is attributable to the government and is outside the scope of the awarded contract and Task Order, the contractor may submit a Request for Equitable Adjustment or Claim to the Administrative Contracting Officer identified in the Task Order award.
Q. (Page 210, 5.2.2.1) What is the expected average machine hour usage in a day, a week and a month? Do you require double and triple shift pricing?
A. The Unit Price for each Quantity represents one (1) piece of described equipment for one (1) month, with unlimited hours of usage and all requirements, including preventive maintenance and repair, as outlined in the Specification & Statement of Work, Attachment 2, and any other requirements outlined in the solicitation and, if applicable, any amendments to the solicitation. The pricing provided by the Contractor on each CLIN shall be their Unit Price Ceiling. The Contractor cannot exceed the CLIN Unit Price Ceiling when submitting a proposal at the Task Order level.
Q. (Page 210, 5.2.2.1) Will the hours of usage be established in the task order?
Q. (Page 210, 5.2.2.1) Do we assume every CLIN will be used 24 hours per day and should our Not To Exceed pricing reflect the 24 hours of usage? For example, a 19’ scissor lift rate costs ‘x’ amount for a standard 8 hour shift. However, it costs the following to continue to rent the 19’ scissor lift past the standard 8 hour shift.
16 hours (1.5 rate) 24 hours (2x rate)
A. Yes, the Unit Price for each Quantity represents one (1) piece of described equipment for one (1) month, with unlimited hours of usage and all requirements, including preventive maintenance and repair, as outlined in the Specification & Statement of Work, Attachment 2, and any other requirements outlined in the solicitation and, if applicable, any amendments to the solicitation. The pricing provided by the Contractor on each CLIN shall be their Unit Price Ceiling. The Contractor cannot exceed the CLIN Unit Price Ceiling when submitting a proposal at the Task Order level.
Q. (Page 210, 5.2.2.1) If the Navy does not intend to use the equipment for 24 hours per day, how should we then present overtime use rates? Overtime is defined as any piece of equipment used more than 8 hours.
A. The Unit Price for each Quantity represents one (1) piece of described equipment for one (1) month, with unlimited hours of usage and all requirements, including preventive maintenance and repair, as outlined in the
Specification & Statement of Work, Attachment 2, and any other requirements outlined in the solicitation and, if applicable, any amendments to the solicitation. The pricing provided by the Contractor on each CLIN shall be their Unit Price Ceiling. The Contractor cannot exceed the CLIN Unit Price Ceiling when submitting a proposal at the Task Order level.
Q. (Page 210, 5.2.2.1) If any of these conditions cause equipment failures or excessive wear then what is the process for recouping the costs of these repairs & incidentals?
A. If a contractor incurs additional costs that they feel is attributable to the government and is outside the scope of the awarded contract and Task Order, the contractor may submit a Request for Equitable Adjustment or Claim to the Administrative Contracting Officer identified in the Task Order award.
Q. Are we able to subcontract out to other set asides to be considered for additional percentage for each set aside?
(i) 22% of Small Business
(ii) 5% for Small Disadvantaged Business
(iii) 5% for Women Owned Business
(iv) 3% for HUBZone
(v) 3% for Service-Disabled Veteran Owned Small Business
A. The percentages shown above are the Subcontracting Plan minimum goals, not a percentage of set asides for small businesses. Task Orders will be solicited via the Task Order Process, section 6, on pages 214-215 of the solicitation. The nature at which a Task Order will be solicited (restricted or unrestricted) is outlined in 6.2.1.
Q. As it relates to the subcontracting plan, if a company provides more than one of the certifications, can they exceed the 22%? For example, as a woman-owned small business, would the spending be 27%?
A: Yes, however, it depends on how the business is coded in sam.gov. Socioeconomic categories can be combined with overall small business percentage goals to exceed the minimum goal. However, these are just the subcontracting goals, not to be confused with small business set asides. Any set aside will be handled at the Task Order level, as outlined in section 6 of the Specification & Statement of Work.
Q. Could the Shipyard be used to provide a reference?
A: Yes.
Q. Are the references for the past performance questionnaires exclusive to Federal customers?
A: No.
Q. (Page 193, Section 4.4.1) what standards are being using to determine compliance? OSHA, ANSI?
A. The contractor provided QMS and QMP shall be the standards used to determine compliance with the contract.
The QMS and QMP may reference OSHA, ANSI, and/or the contractor’s best safety practices. NNSY will concur on the contractor provided QMS and QMP prior to finalization and implementation.
Q. (Page 212, 5.5.1.2) Are there any onsite storage areas where we can keep loaner equipment accessible to help meet 8-hour response time?
A. No.
Q. CLIN 0008: electric or gas powered?
A. Either powering method is acceptable. If electric powered, we will require charging stations. Contractor shall contact NNSY, prior to delivery, to determine best locations for the charging stations.
Please see updated Attachment 2, which makes allowance for either power method when not specified in the CLIN Description.
Q. CLIN 0033: Lull attachment for 6k lift truck. Please clarify this equipment request. A picture to reference would be helpful.
A. NNSY does not use attachments on telescoping fork trucks.
Q. Under the aerial lift equipment minimum specifications (Attachment 2), spec #5 asks for an unrestricted payload capacity of 750 pounds. Can you please specify make and models with unrestricted 750-pound capacity? Genie and JLG models are typical to providing a 500-600 pound unrestricted capacity.
A. NNSY requires aerial platforms equivalent to JLG model 60’ and up. NNSY historically uses JLG brand Aerial Platforms. 60’ and up have an unrestricted capacity of 500 lbs. and a restricted capacity of 1000 lbs. The Genie’s 150’ has an unrestricted capacity of 750lbs.
Q. (Attachment 2, Aerial Lifts, Spec #14a) Is a fall arrest platform going to be a requirement on all of the task orders or are there only specific task orders that this will applies to? How do we present this in our CLIN?
A. A fall arrest platform is not a requirement. The basket/platform section shall have dedicated anchor points specifically for attaching fall arresting equipment, such as a clearly marked padeye. NNSY will provide the personal fall arresting equipment such as harness and tether.
Q. (Attachment 2, Swing Mast Forklift, and Spec. #7) The 274” of mast extended height. Is that a minimum or maximum requirement?
A. NNSY requires a minimum of 240” mast extended height.
Q. (Attachment 2, Swing Mast Forklift, and Spec #7) Mast shift is not an industry term, but side shift is. Do you mean 22” of side shifting capabilities?
A. Swing mast forklift must include 22” side shifting capability.
Q. On Attachment 2, the following spec requirement is listed for each equipment category: Spec line # (3): “Shall be equipped with individualized keys in order that each unit shall be started by only one key pattern.”
Question: Not all equipment manufacturers allow having electrical system changed or offer unique key systems configured this way. Would the government find it acceptable if we provided pad locks with individualized key patterns to engage the battery lockout/disconnect?
A. Each individual Fork Truck shall be equipped with an industry or manufacturer’s standardized key.
