SUMMARY OF CHANGES REVISED

The following have been added by full text:

AMENDMENT 0002

A. The purpose of this Amendment 0002 to subject solicitation is to accomplish the following:

1. Provide answers to requests for information as shown below. Both inquiries and answers therein are hereby incorporated as solicitation provisions:

No. Date Questions Answers 1 11/05/2018 Regarding Appendix A Attachment 02 and

03:

Table 1 – you’ve listed over 600 items that have a CSL number and very generic descriptions. For example, line item 10 – “Switch”. I’m assuming light switch but that switch, depending on the specs, can range from $2 to $45. Only the incumbent can go into MAXIMO and look up the specs for that CSL / switch and hence bid the correct item. That’s obviously extremely unfair to the other bidders but also complicates your job because you will never know whether you are comparing apples to apples among bidders.

Line items 95 to 105 have descriptions of “Plate, Eagle”. They are all obviously unique and different Eagle Plates but, unless you’re the incumbent, it’s impossible to tell what the difference is.

Just a couple of examples, but the same analogy applies to a majority of the items on your list.

60 Day (Task Order 0001) – Same as above for those items that do have CSL #s associated with the item. While this list does have better descriptions and some part numbers, many are still too vague to quote. Line item 71 – Chlorine Regents – which ones? Price of those vary wildly. LI 83 – M/C cable – 250ft? 500 ft. coil? LI 85

– Wirenut Yellow, unit of issue EA – guessing it’s not really each because that’s not how they are generally sold. These come in varying package sizes so how many per each? 25? 50?

Please review Attachment (1), Revised Pre-Priced Line Items List (Appendix A, Attachment 02 and 03) of this Amendment for updated item descriptions.

2 11/06/2018 The issuance of subject solicitation dated 5 November 2018 with a proposal due date twenty-five (25) days later on 30 November 2018 is contrary to the provisions of FAR

5.203 (h) which states:

"In addition to other requirements set forth in this section, for acquisitions covered by the World Trade Organization Government Procurement Agreement or a Free Trade Agreement (see subpart 25.4), the period of time between publication of the synopsis notice and receipt of offers must be no less than 40 days."

Please note pages 17-20, 25 and 30 of subject solicitation which incorporate the Trade Agreements Act and therefore the due date for receipt of proposals “must be no less than” 20 December 2018.

Further, FAR 5.203 (b) provides that:

The contracting officer must establish a solicitation response time that will afford potential offerors a reasonable opportunity to respond to each proposed contract action, (including actions where the notice of proposed contract action and solicitation information is accessible through the GPE), in an amount estimated to be greater than $25,000, but not greater than the simplified acquisition threshold; or each contract action for the acquisition of commercial items in an amount estimated to be greater than $25,000. The contracting officer should consider the circumstances of the individual acquisition, such as the complexity, commerciality, availability, and urgency, when establishing the solicitation response time.

In accordance with the above cited FAR requirements, Noble respectfully request that the proposal due date be changed from 30 November to, no less than, 20 December 2018, to allow preparation of a totally responsive and responsible proposal in response to this complex and expansive requirement. We believe a 20 December response date would permit the time necessary to craft optimal proposals for the Government’s consideration.

The quote due date is extended as stated under item 14.A.2. below to allow contractors ample time to submit quotes.

6 11/21/2018 We have noticed that there has not been an Amendment posted to the NECO site regarding the additional information needed to quote the 62 items from the Pre-priced list.
