Page Section Paragraph

04/16/24 Jan-00 (1) Factor 1, Corporate Experience

1 Upon reviewing the solicitation, I noticed that it emphasizes the importance of proposers' experience in construction services. However, I also noted the stipulation that experience as a subcontractor, as well as that of any subcontractors, will not be considered. While my firm has not directly acted as a prime contractor for construction services in the past, we have established a strategic partnership with a reputable construction firm that possesses extensive experience in this field.

Together, we believe we can offer a comprehensive solution that meets the requirements outlined in the solicitation. Given this collaborative approach, I wanted to seek clarification on whether proposals from firms like ours, which plan to partner with experienced construction firms, would be considered acceptable under the evaluation criteria outlined in the solicitation. Additionally, I would appreciate any guidance on how such partnerships should be presented in our proposal to ensure they are appropriately evaluated.

As per the solicitation, "Offeror must have performed as prime contractor on all submitted projects; offeror’s experience performing as a subcontractor will not be considered." Please check with your SBA office on information regarding partnership agreements.

04/22/24 7 00 21 00 4 Normally there are two volumes - one for technical items and another for price information. We did not see the listing for separate volumes or how you want the two organized. Please provide some additional details on the organization (i.e. Tab A, Tab B, etc), which will make all offerors submit similar information.

As per the solicitation, "The Price and Non-cost/price Factors shall be submitted in separate files and submitted in Portable Document Format (PDF). Price information included in the non-price/technical proposal will not be considered.

Likewise, non-price/technical information included in the price proposal will not be considered."

04/22/24 9 00 21 00 4.2 Responsibility Determination Information - There are 4 items listed, which are to be a separate Tab, but not designated as Tab A or B, etc. Clarify which Tab this should be.

Bid per Solicitation instructions.

04/22/24 9 00 21 00 4.2 Responsibility Determination Information - Items #3 and 4: For #3 do you want a tabular listing such as descriptions, identification of item, etc.?

#4 - We assume a tabular form with contract number, amount, end date, etc. - please clarify items needed.

Bid per Solicitation instructions.

04/22/24 10 00 21 00 4.(1) Factor 1; Size - Some firms are D/B firms that also perform design. If we did a design on a $1M construction project, will that qualify under your size definition? As the designer, we were involved during the construction period.

The Size requirement is defined in the solicitation as the price paid for construction services. "Final construction cost is defined as the total price paid by the customer for the construction services, including original contract award amount and any modifications executed during performance."

04/22/24 10 00 21 00 4.(1)(i)(1) (1) Experience with at least one (1) New Construction Project…. And (2) At least one (1) relevant project….

Just to be clear you do not intend to have one new construction and one renovation project be $1,000,000 or greater. We ask, since both are relevant projects.

Also, under Notes, 3rd bullet has requirements for new and renovations, which reference the size standards.

At least one (1) relevant project submitted must have a final construction cost of $1,000,000 or greater.

04/22/24 11 00 21 00 4.2.(1)(i) The first full paragraph on page 11, states: "Ongoing projects will not be considered." In some cases a project is substantially complete, but is awaiting a minor item. Will you allow substantially complete projects?

We are not allowing substantially complete projects. Ongoing projects will not be considered.

04/22/24 11 00 21 00 4.2.(1)(i) In the 2nd full paragraph on page 11 references several items required in Attachment C. Please clarify if you want those items in Box 8, 9 or 10?

Bid per Solicitation instructions.

04/22/24 11 00 21 00 4.2.(1)(i) In the 4th full paragraph on page 11 references Attachment C and allows blocks on the form to be expanded.

Does this allow us to modify some of the other blocks that have a lot of white space, but will keep the form to two pages?

Bid per Solicitation instructions.

04/22/24 12 00 21 00 4.2.(1)(ii) If we submit five (5) projects, and you score four (4) projects as acceptable, but you feel one project does not meet the relevant criteria, will you disregard this project and look at the four other projects? Or does that one project not meeting the criteria score this criteria as unacceptable?

As per the solicitation, Offerors must submit a minimum of three (3) up to a maximum of five (5) relevant construction projects. Offerors that do not submit a minimum of three (3) relevant Construction Experience Projects will be rated

UNACCEPTABLE.

04/22/24 13 &

00 21 00 (3)(i) The requirement states: "The offeror shall include all completed CPARS (interim and final) for a project." The next sentence indicates a PPQ is required if there is not a completed CPARS. We interpret this to mean if there is an interim CPARS, then a PPQ is not needed. Please clarify if the interim CPARS requires a PPQ or not?

Interpretation is correct, if offeror provides an interim CPARS for a project then a PPQ is not needed.

04/22/24 14 00 21 00 (3)(i) 2nd full paragraph - Offerors are highly encouraged to provide any information on problems encountered and the corrective actions taken on projects submitted under Factor 1 - Corporate Experience. Additionally, offerors are highly encouraged to address any adverse past performance issues. Are we to interpret these as two separate issues? The first sentence relates only to the projects submitted in Factor 1, but does the 2nd sentence relate to any project except the Factor 1 projects?

Bid per Solicitation instructions. The second sentence relates to any projects, including projects submitted under Factor 1.

04/30/204 10 Construction Experience

1 Factor 1 – Corporate Experience, states in part, “Offeror must have performed as prime contractor on all submitted projects;…”. In many cases our company has performed “turnkey” projects of similar scope, size and complexity as demonstrated by the seed project. Will the Government reconsider its requirements for subcontractors experiencing on similar projects please?

As per the solicitation, Offeror must have performed as prime contractor on all submitted projects; offeror’s experience performing as a subcontractor will not be considered.

04/30/204 11 Construction Experience

1 States in part, “Projects submitted for the offeror shall have been completed within the past five (5) years of the date of issuance of this RFP. The impact of COVID-19 has staggered many small business ability to win and execute construction contracts.

Will the Government reconsider the past years on completed from five (5) years to seven (7) years please?

Projects submitted by the offeror shall have been completed within the past five (5) years.

04/30/204 1 Amendment 0001 to Repair Bldg

05/02/24 10 Factor 1, Corporate Experience

When an Offeror is submitting a proposal as a Joint Venture and if the Joint Venture has no completed past performance, each firm within the Joint Venture must include projects as part of the proposal. Please clarify the number of projects that each Joint Venture firm must include to support the total requirement of five.

As per the solicitation, "If the Joint Venture does not have shared experience, projects may be submitted for the Joint Venture members. Offerors are still limited to a total of five (5) projects combined."

05/02/24 10 Factor 1, Corporate Experience

If the Offeror is a joint venture and part of an approved SBA Mentor Protégé - will NAVFAC still require the each JV firm even though under a SBA mentor protégé to provide a minimum number of projects? If yes how many projects out of the five can the joint venture non 8a member firm also referred to as the SBA Mentor be allowed to submit? In some cases, other agencies have allowed the mentor to submit all five projects while the 8a protégé has not submitted any.

Offerors are still limited to a total of five (5) projects combined. Bid per Solicitation Instructions regarding 8(a) Mentor- Protégé requirements.

05/02/24 10 Factor 1, Corporate Experience

The solicitation specifies that a final construction cost of $500,000 or greater or $1,000,000 or greater is required for submission. RFP states normal Task Orders Projects for the MACC will have an estimated construction cost between $20,000.00 and $2,000,000.00; is there a maximum dollar limit for a project used for past performance, such as $5M, $6M etc - or should we keep them around the $2M amount?

There is no maximum dollar limit for a project submitted under Factor 1, Corporate Experience.

This direction is contradicted via detail 4 page S-301 of the contract drawings that indicates the existing roof is to remain in place. Please provide clarification in this matter

There is no mention of the existing roof in detail 4 on sheet S-301. Detail 3 on the sheet explicitly states the existing roof to remain.

Also, please indicate whether this would be standard practice on future projects for this MACC, or if this will be on a case-by-case basis.
