Note: Under Executive Order (EO) 13658, an hourly minimum wage of $10.80 for calendar year 2020 applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2015. If this contract is covered by the EO, the contractor must pay all workers in any classification listed on this wage determination at least $10.80 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in calendar year 2020. If this contract is covered by the EO and a classification considered necessary for performance of work on the contract does not appear on this wage determination, the contractor must pay workers in that classification at least the wage rate determined through the conformance process set forth in 29 CFR 5.5(a)(1)(ii) (or the EO minimum wage rate,if it is higher than the conformed wage rate). All drivers working on a defined hazard material job site shall be paid a premium of $2.00 per hour over applicable rate.

WELDERS - Receive rate prescribed for craft performing operation to which welding is incidental.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

1. Provide response to Request for Information (RFI) listed below.

Q1. Is this project subject to “Buy America Restrictions”?

A1. See FAR Clause 52.225-9 Buy America included in the solicitation by reference.

Q2. If non-hazardous demolition debris is stored on a barge(s). Can the loaded barge(s) be towed to an offsite location for offloading and transportation to legal disposal facilities of the non-hazardous debris?

A2. Non-hazardous debris could be towed to an offsite location provided the materials are not listed as “marine pollutants” in the Code of Federal Regulation (CFR). Test results performed in accordance with Naval Station Newport (NSN) Environmental requirements shall confirm materials are non-hazardous and not marine pollutants.

Q3. Sec. 01-57-19 (page 10) ph. 1.6.3 Environmental Manager: Can this position be a GC contractor employee? Or does this position need to be employed by a third party?

A3. Environmental Manager (EM) may be an employee of the general contractor, and perform other (collateral) functions. Individual must be qualified to perform environmental duties as listed.

Q4. Sec. 01-35-26 (page 19) ph. 3.4.2.b Please clarify how much time Contractors should budget for the Navy to inspect contractors’ cranes once equipment is onsite.

A4. Anticipate about 4 hours for a barge crane, and about 2 hours for a mobile crane.

Q5. Sec 02-41-00 ph. 1.6.1 Please clarify the requirements for silt curtains, with pile extractions now removed from the scope of work.

A5. Silt curtains are not required to perform current scope of work.

Q6. Is the QC representative allowed to have any other roles (i.e.: Project Manager) or is QC the only role they can serve in?

A6. QC Manager cannot serve as Site Safety Health Officer (SSHO) or Project Superintendent.

Other duties are allowed.

Q7. Will the contractor be restricted at any point where they will not be able to work at the pier or can the contractor assume that for the purpose of the bid, contractors will have continuous access to some portion of the pier where work is to occur but the access may require relocating the contractor’s operation to accommodate pier activities?

A7. Prior to blockout dates for the International Seqapower Symposium (ISS), restrictions that would preclude work on all areas of the pier are not anticipated.

Q8. Will contractor employees working onsite be required to have 40 Hour Hazwoper certifications?

A8. Hazwoper certification is not required.

Q9. Please confirm that no diving operations are required and that no dive surveys are required.

A9. Fender pile repairs in current project scope can be accomplished from barges, without use of divers. No diving operations are required, and no dive surveys are required.

Q10. Please confirm that installation of chock timbers is only required where the GC installs new wale timbers.

A10. Where Repair Schedule on Sheet S-03 lists addition of chocks for Scope Category 4 repairs, it is presumed wale is in usable condition and chocks can be installed using reclaimed materials (chocks) removed from other locations. These repairs apply to locations where replacement or addition of new wale is not required. Scope Category 4 description reads in part:

“Salvage intact timber for blocking and miscellaneous repairs.”

Q11. Our treated timber supplier has let us know that they can provide a treatment certificate of compliance for preservative treatment but that they do not brand the timbers for treatment. Will this be acceptable?

A11. The Navy is not able to waive requirements listed in the Specifications prior to thorough submittal review and approval. Refer to Section 01 33 00, Article 1.8 Variations.

Q12. In Item 13D of the Solicitation there is currently no value for calendar days for Government acceptance. Can a value be inputted by the Government prior to bid submissions?

A12. Offers providing less than 90 calendar days for the Government acceptance after the date offers are due will not be considered and will be rejected.

Q13. The Statement of Work Project Description states, "Pile extractions are not included in this project..." However, Section 02 41 00 Paragraph 1.6.1 states, "Pile extraction includes requirements for silt curtains and turbidity monitoring" and Section 01 57 19 Section 1.4 states, "Vibratory pile extraction is currently not allowed..." Please confirm that no pile extraction, silt curtains, or turbidity monitoring are required for this project.

A13. No pile extraction, silt curtains, or turbidity monitoring are required for this project. Delete the following sentence from Section 02 41 00, Paragraph 1.6.1: "Pile extraction includes requirements for silt curtains and turbidity monitoring."

Note: The first paragraph of Section 01 57 19, Article 1.4 refers to the General Permit. The statement prohibiting vibratory pile extraction was included in the specification simply to clarify a revision made to the General Permit.

Q14. Please provide test results for timbers removed for previous similar jobs on Pier 2 to allow bidders to better estimate disposal costs.

Q14. Test data from prior years cannot be provided as it may not represent current conditions. In prior contracts requiring timber removal and disposal, CCA type timbers were disposed of as hazardous waste. Bids shall include estimated handling and disposal costs for hazardous waste.

Q15. How soon after the bid date can the low-bid Contractor anticipate receiving the NTP?

A15. Notice to Proceed (NTP) can be issued after payment and performance bond approval.

Q16. Scope of Work Category 2 – Please define the criteria of a “useable fender element”.

Additionally, please clarify who is responsible for determining whether or not a particular fender element is useable or unusable?

A16. Refer to Repair Schedule on Sheet 3-0. Existing fender pile elements listed as Scope Category 2 repairs have been inspected by the Navy and considered to be useable (i.e. repairable) for the purposes of this contract.

Q17. Scope of Work Category 3 – Please define the criteria of a “compromised” but un-broken pile? Additionally, please clarify who is responsible for determining whether or not a particular un-broken pile is compromised or uncompromised?

A17. Refer to Repair Schedule on Sheet 3-0. Existing fender pile elements listed as Scope Category 3 repairs have been inspected by the Navy and considered to be broken or compromised to the extent that they should be removed. An example of a ‘compromised’ pile requiring removal is shown in Photograph #7 on Sheet S-02. Category 3 work scope instructs the Contractor, who will have a closer view of the piles than Navy inspectors, to field verify condition of piles prior to removal. Piles that are not broken or compromised based on close inspection should be retained.

Q18. Drawing S-01, S-03, R-01 – S-01 shows Fender System Type A on North side from Bent 10 to Bent 110. R-01 shows Z-38 sheet pile installed between timber fender piles. Please clarify if the Category 5 (New Wale) repairs on S-03 between Bent 10 & 110 are to be of Type A as per R-01 & the Category 5 Scope of Work verbiage (“… manner consistent with original construction”), or Type B or C.

A18. It does not appear that sheet piles were installed between fender piles as shown on Sheet R-01. There is no requirement to add sheet piling. The project intention is to install new wale in a manner consistent with existing construction. Sheet R-01 was provided for Contractor’s use, assuming typical details depicted in that drawing would illustrate as-built conditions. Contractor shall field verify the extent to which drawing details represent existing construction.

Q19. Drawing S-03 – The repair on North Side between 17-18 is category 4 and states “repair damaged wale”. Please clarify how a damaged timber wale is to be repaired and if a damaged wale is in “useable condition” per the Scope of Work definition for Category 4 repairs.

A19. Revise Drawing S-03, Repair Schedule, North Side between 17-18, to read “REPLACE DAMAGED WALE, SECURE PILE”, Scope Category: “5”.

2. Replace Wage Determination RI20200001 01/24/2020 with RI20200001 02/21/2020.
