PRE PROPOSAL INQUIRY FORM

DATE:19 Apr. 2023

Question No.

Reference (Sect/Para/Page) QUESTION GOVERNMENT RESPONSE

1 3.1.2

Based on your response, we have acknowledged that 40,000gallon in a year covers both recuring and non-recuring orders, particularly non-recurring work at pier-side in White Beach must be included. Also, you may imply that 40,000gallon is the worst case based on the past performance.

In addition to your response, we would like to bring additional questions as follows:

A. Non-recurring CLIN A706 indicates the q’ty in each period(one year) 40,000gallon.

This volume should be included in the worst scenario 40,000gallon in a year.

We are wondering why total volume of the contract and one of the CLINs volume indicate the equal. We would like to clarify the discrepancy.

B. The volume data showed average 40,000gallon discharged in 2022, however, in previous years average volume seems over 40,000gallon. We would like to propose that you may add the CLIN for the extra volume of 40,000gallon when the actual volume exceeded. Otherwise, we may take risk price sets carefully in taking consideration of the nearest actual volume enough to secure our return.

To clarify, the statement in 3.1.2 regarding 40,000 gallons and ELIN A706 is hereby removed from the PWS and ELINs, respectively. The resulting contract is firm fixed price; the Government does not intend to impose a limitation on OWW quantities under the Recurring ELINs. Historical data has been provided in the PWS to assist Offerors in their proposal development (as noted in portion B of this question). Therefore, Offerors are advised to account for risk in their price proposal. 50,000 gallons is the estimated quantity for Non-Recurring orders (i.e. services at anchorage).

2 1604000 - Wastewater 3.3

According to historical experience, 3,000GL pumper / vacuum truck is enough for pick up in many cased? If possible , please offer us historical data for these pump.

<Previous Q & A history> Q."The Government has found that pumper/vacuum trucks with a minimum holding capacity of 3,000 gallons appear to work well for collecting and transporting CHT/OWW."

Please advise us about a minimum holding capacity. According to our experience, there are only few pumper/vacuum trucks which could carry 3,000 gallons waste water in Japan. Please advise the possibility to change minimum holding capacity from 3,000 to 2,500 gallons.

A.This statement is for informational purposes only and is merely a suggestion from the Government based on historical experience. The KTR may use any size pumper/vacuum trucks as long as contract requirements are met.

In past orders, typically two 3,000GL trucks have been used at once, and offload into KTR owned holding tanks located on site. Historical data already provided is all orders, whether offloaded via barge or pump truck.

We do not have individualized data for pump truck orders.

It means that ther government don't opperate price negotiation after nomination?

<Previous Q & A history> Q."The Government retains the right to obtain additional quotes in questionable situations. The lowest price shall be used."

Please advise us about the definition of questionable situations. (In what cases the right would be exercised)

A.This is a canned statement that is not applicable to this contract. The PWS will be updated accordingly in a later amendment.

The statement regarding the requirement for obtaining additional quotes generally refers to Non-recurring work such as maintenance and repair work, wherein the specific scope of work and unit pricing are not pre-determined and negotiations may be required.

This statement is not applicable at this time since all Recurring and Non- Recurring ELINs under this contract will have unit pricing.

5 J-0200000-08 ELIN Schedule averaged from historical data of seven years of generation rates for White Beach.

→Why the time period is only limited 7years?

What was the actual average gallons on a 10 or 20 year basis?

Is there any possibility the current estimation number might be higher than 40,000 gallons?

We would like to know data from more than 7 years ago.

<Previous Q & A History> Question:

Could you add ELIN as non-recurring work for OWW with a limited quantity and issue an additional order if the quantity exceeds that quantity?

It is too risky to make the contractor responsible for hedging the risk of OWW discharging significantly more than expected.

Answer;

Please refer to the PWS for historical data. The Government's annual estimate of 40,000 gallons is based on worst case scenario, averaged from historical data of seven years of generation rates for White Beach. It is anticipated that this estimation includes both pier-side and anchorage collection. However, only OWW at pier-side is included in Recurring Work. OWW at anchorage will be ordered separately based on actual quantity collected. The Recurring work is firm fixed price and will not be subject to price adjustment regardless of actual quantity collected. It is the KTR's prerogative to structure their price proposals however they deem fit that anticipates risk.

Unfortunately, we do not have historical data beyond what has been provided. It is possible the total volume may be higher than 40,000 gallons.

Please understand the volume is dependent on ship operations in the region, which is outside of NAVFAC's control. Therefore, Offerors are advised to account for risk in their price proposal.

ELIN A706 "Collection and treatment and/or disposal of Oily Waste Water generated from all visiting ships supported by Commander Fleet Activities, Okinawa (CFAO) at White Beach Naval Facility" Under what conditions would an order using this ELIN be issued?

This was an error. The PWS and ELINS will be corrected accordingly.

Please see corrected ELIN schedule.

CLIN 0001, Base Period – Recurring Work and Mobilization *Minimum guarantees do not apply to the option period.

What exactly does Minimum guarantees mean?

Does it mean that there is a difference in the ELINs issued for the base and option periods?

"Minimum guarantee" is the guaranteed amount that the Contractor can expect to receive payment from receiving award of this contract. In this case, the minimum guarantee is equivalent to CLIN 0001, which is based on the Contractor's pricing for ELINs A001 and A002.

CLIN 0002 (total of ELINs A701 through A710) is a Non-Recurring CLIN, not guaranteed, and may only be ordered as needed at the quantities required.

All other CLINs are Option CLINs, not guaranteed to the Contractor and subject to a determination by the Government if extending the term of the contract is in the best interest of the Government.

CLIN 0003 = ELIN B001

CLIN 0004 = total of ELINs B701 through B710

CLIN 0005 = ELIN C001

CLIN 0006 = total of ELINs C701 through C710

CLIN 0007 = ELIN D001

CLIN 0008 = total of ELINs D701 through D710

CLIN 0009 = ELIN E001

CLIN 0010 = total of ELINs E701 through E710
