Question No.

Reference (Sect/Para/Page) QUESTION GOVERNMENT RESPONSE

1 J-0200000-08 ELIN Schedule

It seems that Non-recurring CHT services at pier side for White Beach Naval Facility is not included, but it may be possible that CHT services at the piers side will be needed if the wastewater treatment facility is not available for some reason.

We suggest adding an ELIN for Non-recurring CHT services at pier side .

Noted. Please see revised ELIN schedule.

Question No.7

Is the issuance of an option period inseparable from the issuance of Recurring work CLIN? For example, First Option Period consists of CLIN 0003 and CLIN 0004, and CLIN 0003 will never be omitted, is our understanding correct?

Yes. For example, when we exercise the 1st option period, we will exercise CLIN 0003 and 0004; and so on. CLIN 0003 will be fully funded once it is exercised, while CLIN 0004 will be funded on as needed basis only.

This FAR clause shows;

REQUESTS FOR EQUITABLE ADJUSTMENT (DEC 2022)

(a) The amount of any request for equitable adjustment to contract terms shall accurately reflect the contract adjustment for which the Contractor believes the Government is liable. The request shall include only costs for performing the change, and shall not include any costs that already have been reimbursed or that have been separately claimed. All indirect costs included in the request shall be properly allocable to the change in accordance with applicable acquisition regulations.

Question) We can read this FAR defines that you shall adjust and compensate for the additional fee against our estimated offer prices.

Can we propose you additional fee if the actual working cost is over the estimation?

Requests for equitable adjustment normally pertain to changes to contract requirements as directed by the Government only.

The resulting contract is firm fixed price. Historical data has been provided in the PWS and Offerors have already been advised to take into consideration in its price proposal the risk of fluctuations.

1604000 - Wastewater Spec Item 3.7 Operating

Records, Logs, Reports, and Procedures

Government response says "This is not applicable to this contract and will be removed from the spec items."

It seems that the description has not yet been removed from final pws. Is there any plan to issue a revised PWS in the future?

Yes, please see revised PWS.

Regarding the Amend03 for ELIN A001, A705~A708, is the OWW still considered PFOS-contaminated as you confirmed in the previous government's response? Does the government mean PFOS as PFAS?

Yes, the government is assuming that all OWW offloaded from ships is contaminated with PFAS. PFAS being the general term used to describe the family of per- and polyfluoroalky substances such as PFOS, PFOA, etc. It would have been more clear of the government has used the term PFAS instead of PFOS. With PFAS meaning PFOS plus PFOA.

Regarding the ELIN A710, all OWW received from the ships is specified as PFOS-contaminated. According to domestic standards, a combination of PFOS and PFOA that is less than 50 ppt is required for disposal. Does the government mean PFOS as PFAS that needs to be treated less than 50 ppt combined for PFOS and PFOA for disposal?

It would have been more clear of the government has used the term PFAS instead of PFOS. With PFAS meaning PFOS plus PFOA. The combined standard for PFOS and PFOA is 50 ppt. Meaning if a batch of OWW tested at 25 ppt for PFOA and 24 ppt for PFOS, the combined value would be 49 ppt, which would not be considered as requiring special disposal as PFAS containing waste. Another example, if the testing of a batch of OWW revealed PFOS levels of 51 ppt, and PFOA evels of 0 ppt, then the combined value would be 51 ppt and thus would require special treatment/disposal as PFAS conatining waste. The individual levels of either PFOS or PFOA are only significant in the sense that if they, when combined, exceed 50 ppt. OWW that exceeds the 50 ppt level for PFAS (PFOS plus PFOA) can still be disposed of, but it must be done in accordance with proper treatment/destruction methods.
