Section 00200 - Evluation Factors for Award
EVALUATION FACTORS
BASIS FOR AWARD:
The proposed task order will be awarded to the responsible Offeror offering the best value to the Government. For this order, the best value is expected to result from selection of the proposal with the evaluated lowest price, technically acceptable proposal (LPTA).
1. Basis of Evaluation – Each proposal shall be evaluated on the basis of technical acceptability, past performance, and price.
A. Technical acceptability shall be evaluated based on three (3) sub-factors. Only the proposals found to be technically acceptable will be further evaluated for award. To be technically acceptable, a proposal must be evaluated as “acceptable” for all of the following technical sub-factors.
(1) Relevant Experience
(2) Technical Approach - Schedule
(3) Technical Qualifications of Proposed Staffing
B. Past Performance information shall be evaluated to assess the Offeror’s history of successfully accomplishing recent projects of similar size and scope and to determine the quality of their recent and relevant past performance. Assessment for this area will be subjective based on consideration of all relevant facts and circumstances. Evaluation will investigate information furnished by the Offeror to ensure they have consistently demonstrated a commitment to administration, customer satisfaction, timely delivery, and quality work, goods, and services in prior contracts of similar size and scope. This is a matter of judgment and will be a subjective assessment based on investigative findings. The Government reserves the right to contact references for verification or additional information. The Government’s inability to contact any of the Offeror’s references or the references unwillingness to provide the information requested may affect the Government’s evaluation of this factor.
C. Price shall be evaluated for reasonableness and completeness.
2. Proposal Evaluation –
I. TECHNICAL ACCEPTABILITY.
A. Relevant Experience
1. Relevant Experience will be rated on an “acceptable” or “unacceptable” basis using the ratings in Table 1.
Table 1. Relevant Experience Evaluation Ratings
Rating Description
Acceptable (A) Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort.
Unacceptable (U) Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.
2. Aspects of Relevant Experience Evaluation. The evaluation results in an assessment of the Offeror’s probability of successfully performing the required effort. This assessment is based on the Offeror’s record of recent and relevant experience information that pertain to the work, products, and/or services outlined in the solicitation requirements. The Offeror shall identify its past relevant experience information as requested in the solicitation. The basis of this assessment is from two aspects: 1) Recency and Relevancy and 2) Quality of Historical Contracts. In rating past performance, the following will be considered:
a. Recency and Relevancy. This factor is evaluated to determine whether the Offeror’s past performance is recent and relevant to the effort to be acquired. For this acquisition, recency refers to work that was 100% completed within a time period of no more than THREE (3) years prior to the date of submitting this proposal. Relevancy refers to construction work as a prime contractor on a contract for NAICS 236220 and for a dollar magnitude equal to, or greater than, $1,000,000.00. The projects should include: One project with a significant mechanical component and for a dollar magnitude equal to, or greater than, $100,000.00. One project with a significant interior remodeling component and for a dollar magnitude equal to, or greater than, $100,000.00. One project with mechanical, interior remodeling, civil, plumbing, structural and/or electrical work on a building or structure and for a dollar magnitude equal to, or greater than, $400,000.00.
b. Quality: Second, the evaluation will determine how well the Offeror performed on the prior contracts. Quality refers to contracts that were satisfactorily completed within their designated periods of performance. The evaluation process gathers information from customers on how well the Offeror performed those past contracts and includes history of successful completion of projects; history of producing high-quality reports and deliverables; commitment to customer satisfaction and history of staying on schedule and within budget.
3. To be rated acceptable, an Offeror must identify no less than THREE (3) previously awarded, and completed construction contracts that are deemed to meet the recency, relevancy, and quality requirements described above.
a. Offeror has shown that project experience is recent.
b. Offeror has sufficiently documented relevant experience for projects of similar size and scope.
c. Ratings obtained by the Government must be at “satisfactory” or above. Adverse ratings will be grounds for not achieving an acceptable rating. Offerors shall be given an opportunity to discuss adverse past performance information, if the Offeror has not had a previous opportunity to comment on the information. Taken as a whole, the Government will determine if the information provided and /or obtained indicates strong past performance.
B. Technical Approach – Schedule
1. Technical Approach will be rated on an “acceptable” or “unacceptable” basis using the ratings in Table 2.
Table 2. Technical Approach - Schedule
Rating Description
Acceptable (A) Proposal clearly meets the minimum requirements of the solicitation and schedule reflects understanding of work elements, and construction phasing within an occupied building(s) without disruptions.
The government will evaluate the Offeror’s plan/approach to optimize schedule to meet milestones with the constraint of an occupied building(s) and ongoing operations. The Government will evaluate the schedule that shows adequate consideration of the main Government milestones that would include phase to phase transition, adequate time for occupants to both relocate out of the phased work area and relocation back into the completed work areas.
Unacceptable (U) Proposal does not clearly meet the minimum requirements of the solicitation.
2. To be rated acceptable, an Offeror must provide a written technical construction management approach plan to demonstrate their understanding and capabilities of completing all work in accordance with the Statement of Work and project drawings.
a. The plan should describe the proposed approach in accomplishing the scope of work within the performance period prescribed. The plan will address the following items: (1) consideration of long lead items; (2) phasing and consideration for the movement of occupants from affected areas; and (3) an over-all understanding of the sequence of work within a building that will remain occupied.
b. The plan must identify all work that can be accomplished with in-house resources and demonstrate that they are capable of obtaining any project requirements that cannot be self-performed. The technical construction management plan must identify how the Offeror will directly superintend the work, perform project and quality control management, comply with safety and environmental regulations and interface with occupied buildings.
c. Any project requirements that cannot be self-performed must be identified (e.g.
subcontractors list and manufacturers of key material components for the project) The Offeror shall provide this information with their company proposal submission.
3. Additionally, the Contractor shall submit a schedule that shows a clear understanding of the scope of work required for the project, with a work plan that will ensure achievement of task objectives and phasing. At a minimum the schedule should reflect the following:
a. A viable transition plan with contingency planning and established milestones that shows how each phase of work will be incorporated and transitioned from phase to phase. This building will remain occupied and their classroom training will continue so it is imperative to show how the phases of work will be coordinated to limit the impacts of an occupied building and active classroom training environment.
b. Staff flexibility and commitment to perform work assignments on short notice based on changing priorities as to limit impacts.
c. An overall effective strategy that accomplishes all project goals and milestones as outlined in the Statement of Work and Project design package.
C. Technical Qualifications Of Proposed Staffing:
1. Technical qualifications of proposed staffing will be rated on an “acceptable” or “unacceptable” basis using the ratings in Table 3.
Table 3. Past Performance Evaluation Ratings
Rating Description
Acceptable (A) Proposal clearly meets the minimum r equirements of the solicitation and as defined below.
Unacceptable (U) Proposal does not clearly meet the minimum requirements of the solicitation and as defined below.
2. To be rated acceptable, an Offeror must provide information regarding the technical qualifications of the proposed project staff, to include the individuals who will be responsible for the following functions:
a. Management of the project, with appropriate experience of projects of similar size and scope.
b. Quality control in accordance with General Requirements Section.
c. Safety in accordance with FAR 52.236-13 Accident Prevention (Nov 1991).
Accident Prevention includes compliance with the standards issued by the Secretary of Labor at 29 CFR Part 1926 and 29 CFR Part 1910; and compliance with all pertinent provisions of the latest version of U.S. Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1, in effect on the date of the solicitation. This individual will be designated as the Site Safety and Health Officer (SSHO).
3. Responses will be reviewed for information that shows proposed staff have the education, training, knowledge, and experience to successfully carry out the project. Reviewers will look for information that demonstrates the following:
a. Requisite qualifications, experience, and time commitment of the project manager and proposed staff;
b. Demonstrated ability of proposed staff to perform work assignments accurately and in a timely manner;
c. Staff flexibility and commitment to perform work assignments on short notice based on changing project priorities.
d. An effective quality control and cost-monitoring plan that adheres to requirements specified in the Quality Assurance Surveillance Plan.
4. Contractor shall provide list of propose major subcontractors to be used for their proposal to include at a minimum: earthwork and site utilities. Subcontractors must show documented experience with projects of similar size and scope. The Contractor’s list may include more than one (1) name for each of the divisions

(B) Have ( ) have not ( ), within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks “have”, the offeror shall also see 52.209-7, if included in this solicitation); and
(C) Are ( ) are not ( ) presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision.;
and
(D) Have , have not , within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.
(1) Federal taxes are considered delinquent if both of the following criteria apply:
(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.
(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(2) Examples. (i) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).
(ii) The Offeror has ( ) has not ( ), within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.
(2) Principal, for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager;
head of a division or business segment; and similar positions).
(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.
(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror's responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.
(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.
(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four-letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example: PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination.
