The following items are applicable to this modification:
SECTION SF30 - BLOCK 14 CONTINUATION PAGE
REVISED SUMMARY OF CHANGES
The following have been added by full text:
BONDING REQUIREMENTS
28.102 -- Performance and Payment Bonds and Alternative Payment Protections for Construction Contracts.
28.102-1 -- General.
(a) 40 U.S.C. chapter 31, subchapter III, Bonds (formerly known as the Miller Act), requires performance and payment bonds for any construction contract exceeding $150,000, except that this requirement may be waived--
(1) By the contracting officer for as much of the work as is to be performed in a foreign country upon finding that it is impracticable for the contractor to furnish such bond; or
(2) As otherwise authorized by the Bonds statute or other law.
(b)
(1) Pursuant to 40 U.S.C. 3132, for construction contracts greater than $35,000, but not greater than $150,000, the contracting officer shall select two or more of the following payment protections, giving particular consideration to inclusion of an irrevocable letter of credit as one of the selected alternatives:
(i) A payment bond.
(ii) An irrevocable letter of credit (ILC).
(iii) A tripartite escrow agreement. The prime contractor establishes an escrow account in a federally insured financial institution and enters into a tripartite escrow agreement with the financial institution, as escrow agent, and all of the suppliers of labor and material. The escrow agreement shall establish the terms of payment under the contract and of resolution of disputes among the parties. The Government makes payments to the contractor’s escrow account, and the escrow agent distributes the payments in accordance with the agreement, or triggers the disputes resolution procedures if required.
(iv) Certificates of deposit. The contractor deposits certificates of deposit from a federally insured financial institution with the contracting officer, in an acceptable form, executable by the contracting officer.
(v) A deposit of the types of security listed in 28.204-1 and 28.204-2.
(2) The contractor shall submit to the Government one of the payment protections selected by the contracting officer.
(c) The contractor shall furnish all bonds or alternative payment protection, including any necessary reinsurance agreements, before receiving a notice to proceed with the work or being allowed to start work.
28.102-2 -- Amount Required.
(a) Definition. As used in this subpart--
“Original contract price” means the award price of the contract; or, for requirements, contracts, the price payable for the estimated total quantity; or, for indefinite-quantity contracts, the price payable for the specified minimum quantity. Original contract price does not include the price of any options, except those options exercised at the time of contract award.
(b) Contracts exceeding the $150,000--.
(1) Performance bonds. Unless the contracting officer determines that a lesser amount is adequate for the protection of the Government, the penal amount of performance bonds must equal--
(i) 100 percent of the original contract price; and
(ii) If the contract price increases, an additional amount equal to 100 percent of the increase.
(2) Payment Bonds.
(i) Unless the contracting officer makes a written determination supported by specific findings that a payment bond in this amount is impractical, the amount of the payment bond must equal—
(A) 100 percent of the original contract price; and
(B) If the contract price increases, and additional amount equal to 100 percent of the increase.
(ii) The amount of the payment bond must be no less than the amount of the performance bond.
(c) Contracts exceeding $35,000 but not exceeding $150,000. Unless the contracting officer determines that a lesser amount is adequate for the protection of the Government, the penal amount of the payment bond or the amount of alternative payment protection must equal--
(1) 100 percent of the original contract price; and
(2) If the contract price increases, an additional amount equal to 100 percent of the increase.
(d) Securing additional payment protection. If the contract price increases, the Government must secure any needed additional protection by directing the contractor to—
(1) Increase the penal sum of the existing bond;
(2) Obtain an additional bond; or
(3) Furnish additional alternative payment protection.
(e) Reducing amounts. The contracting officer may reduce the amount of security to support a bond, subject to the conditions of 28.203-5(c) or 28.204(b).
52.228-13 ALTERNATIVE PAYMENT PROTECTIONS (JULY 2000)
(a) The Contractor shall submit one of the following payment protections:
Payment Bond Irrevocable Letter of Credit
(b) The amount of the payment protection shall be 100 percent of the contract price.
(c) The submission of the payment protection is required within 15 days of contract award.
(d) The payment protection shall provide protection for the full contract performance period plus a one-year period.
(e) Except for escrow agreements and payment bonds, which provide their own protection procedures, the Contracting Officer is authorized to access funds under the payment protection when it has been alleged in writing by a supplier of labor or material that a nonpayment has occurred, and to withhold such funds pending resolution by administrative or judicial proceedings or mutual agreement of the parties.
(f) When a tripartite escrow agreement is used, the Contractor shall utilize only suppliers of labor and material that signed the escrow agreement.
(End of clause)
The following have been modified:
RFI RESPONSES
B2185 Provide 400HZ Power to Rooms 2A25 and 2A50 – RFI’s
1.) RFP Page 9, Paragraph titled TIMEFRAME, states 120 days from time of award. The equipment lead time is 15 to 16 weeks after submittal approval. Adding 60 days would be beneficial to the government by not requiring expediting cost to be applied to the equipment and allow the contractor more time to install the equipment without adding overtime/after hours cost to complete the project. Can 60 days be added?
Government Response: The revised scope indicates 180 days.
2.) RFP Page 8, Paragraph titled DOMOLITION note 5., states place 4x8 sheets of ¾” plywood over computer room raised floor across desired path for removal of KATO unit. Will the raised floor with ¾” plywood support the six thousand pound KATO unit or will the unit need to be disassembled in place to decrease the load on the raised floor?
Government Response: The revised scope indicates disassemble and remove.
3.) RFP Page 8, Paragraph titled Lab 2A50: INSTALL note 3., states install 3” aluminum conduit. Is the Rigid Aluminum conduit and will dielectric/PVC conduit and fittings be required through all SCIF walls?
Government Response: The revised scope indicates PVC conduit.
4.) RFP Pages 8 and 9 titled FINISH and SPECIFICATIONS, this section does not call for factory startup. I believe factory startup should be required to protect the government and the contractor. It would also allow for any adjustments to the output of the unit after shipping.
Should we include factory startup cost?
Government Response: The revised scope indicates factory startup.
5.) RFP page 8 and 9 titled FINISH and SPECIFICATIONS, this does not request on site load testing. Will factory test / reports be the only unit testing required or will load testing on site be required? Please be aware that if onsite load testing is required there will be a large amount of heat from the load bank generated in the lab space and the AC may not be able to keep the room cool enough for existing equipment.
Government Response: No onsite load testing required.
6.) Pages 8 and 9 Titled SPECIFICATIONS: Noise Level <65 dB (A) @1m, I’m told that no manufacturer can meet this requirement and that UFGS 26 35 43 paragraph 2.1.12 chart allows up to 72 dba. Will up to 72 dba be allowed?
I also want to make you aware that a solid state 400HZ unit will always have a high pitch hum/whine. Just letting you know now so at the completion of the job the customer doesn’t complain, the hum/whine will be below the 65dba shown in the specification. The cooling fans for the unit is what will be higher than 65 dba.
Government Response: 72 dba will be allowed in compliance with the UFGS 26 35 43
7.) RFP Page 10 of 39, Paragraph 2.16 WARRANTY. Is it the intention of this warranty description that the frequency converter warranty will cover a two years period with the first year including full service parts and labor and the second year only including parts?
Government Response: Correct.
8.) RFP Page 9 of 39, Paragraph titled TIMEFRAME, states “120 days from time of award”. Request an additional 30 days to this timeframe. Manufacturers of solid state frequency converters have been affected by the
Presidential Embargo which included raw materials used in these devices, such as high grade steel and high grade copper. This has resulted in not only increased prices but extended deliveries as well. Raw materials buyers are not buying large quantities in hopes of a change to the embargo, rather are buying on short term basis that has resulted in the extended deliveries. Adding 30 days would be beneficial to the manufacturer’s delivery schedule and beneficial to the government by not requiring expediting costs to be applied.
Government Response: The revised scope indicates 180 days.
9.) RFP Pages 8 & 9 of 39 Pages, Paragraph titled SPECIFICATIONS, lists the performance characteristics of the frequency converter. The listed overload ratings include 300% for 10 seconds and 400% for 1 second. We request those parameters be changed to comply with UFGS 26 35 43 Guide Specification Paragraph 2.1.1.11 which requires the parameters shown below. These parameters were agreed to in industry conversations with NAVFAC Criteria Norfolk VA citing safety to personnel and equipment.
Government Response: Parameters should meet UFGS 26 35 43.
10.) Please confirm that this is NOT a design build project and that all/any engineering/calculations required to confirm code compliant constructability as described in the SOW has been previously completed. If not please provide any design/shop drawing submittals required for this project.
Government Response: This is not a Design Build.
11.) Please confirm that 3rd party commissioning will not be required for this project. If this is incorrect please specify features of work to be commissioned.
Government Response: No 3rd part commissioning required.
12.) Please confirm that no hazardous materials, have been identified nor should be accounted for as part of this proposal.
Government Response: No hazardous materials discussed or identified at any site visits to the facility.
13.) May the QC manager/SSHO also act as site Superintendent (aka Triple Hat)? Please provide/confirm the administrative staffing requirements and minimum supervision personnel qualifications for this project.
Government Response: No triple hat. Superintendent and QC can combine. Safety must be a separate individual.
14.) Please confirm that all new conduit for this project shall be ridged aluminum. If this is incorrect, please provide all other acceptable conduit options.
Government Response: The revised scope indicates PVC conduit.
15.) Will dielectric unions be required at all wall penetrations? If not all locations, please provide locations where metallic conduit can be continuous without breaks.
Government Response: The revised scope indicates PVC conduit.
16.) Please confirm that, per discussions during the site walk, the existing 400HZ converter can be shut down and removed during normal working hours and that there will not be a limited allotment of time to get the new converter operational for customer use. If this is incorrect, please provide the max amount of time for replacement and/or specify the tasks that must be completed after-hours.
Government Response: All work to be completed during normal working hours with exception to any electrical shutdowns deemed necessary.
17.) Will the final testing of the operation of the EPO button, which may shut down other equipment, have to be completed afterhours?
Government Response: The final EPO button testing shall be completed afterhours.
18.) Due to the long lead time of the new converter, 120 day duration listed in the RFQ may not allow enough time to guarantee on time completion of this project. Can the project duration be extended to at least 210 days?
Government Response: The revised scope indicates 180 days.
19.) Please confirm that the existing raised floor, with ¾” plywood cover as described in the SOW, should be assumed to be capable of handling the weight of the old converter being rolled out of the space without any additional measures necessary to distribute the weight
Government Response: The revised scope indicates disassembly of the unit.
20.) If the footprint for the new converter is smaller than that of the existing there might be a permanent line on the raised floor tiles where they have faded. Please confirm that these marks, if present, are acceptable and that the floor tile do not need to be replaced. If they are to be replaced, are there enough available spares available at the building?
Government Response: Marks from the previous unit are acceptable and no new floor tiles will be required.
