About this file
This document is an amendment to a solicitation for a design-bid-build project to construct oil water separators at Keflavik Air Base in Iceland.
The amendment provides updated instructions for proposal submission, including requiring site visits by June 22nd and responses to any inquiries by a certain date. Offerors must have experience with relevant projects, including airfield paving and oil water separator construction. Technical approaches, schedules, past performance on previous projects, and safety records must all be included. Price proposals are to be submitted separately. The evaluation criteria weighs technical factors and past performance equally, with price then considered, and the contract is to be awarded by early 2023 to the best value offer. Safety will be rated as acceptable or unacceptable.

5. REQUIRED PROPOSAL DOCUMENTS
A. EVALUATION FACTORS FOR AWARD
1. The solicitation requires the evaluation of price and the following non-price factors:
Factor 1 – Experience Factor 2 – Past Performance Factor 3 – Safety Factor 4 – Technical Solution
The distinction between experience and past performance is that experience pertains to the volume of work completed by a contractor that are comparable to the types of work described under the definition of recent, relevant projects, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.
mailto:graeme.l.silva.civ@us.navy.mil
2. Factor 3-Safety will only be rated Acceptable or Unacceptable. If an Offeror is rated Unacceptable for any factor, they will not be eligible for award, unless the deficiency(ies) is/are remedied through discussions (if held).
For the Offerors found Acceptable on Factor 3-Safety, the relative order of importance of the non-price evaluation factors is the technical factors (Factor 1-Corporate Experience and Factor 4-Technical Solution) are of equal importance to each other and, when combined are equal in importance to the past performance evaluation/performance confidence assessment factor (Factor 2-Past Performance). When the proposal is evaluated as a whole, the technical factors and past performance/performance confidence assessment factor combined (i.e., the non-price evaluation factors) are approximately equal to price.
The importance of price will increase if the Offerors’ non-price proposals are considered essentially equal in terms of overall quality, or if price is so high as to significantly diminish the value of a non-price proposal’s superiority to the Government. Award will be made to the responsible Offeror(s) whose offer conforms to the solicitation and represents the best value to the Government, price and non-price factors considered.
3. Basis of Evaluation and Submittal Requirements for Each Factor.
(a) Non-price Factors:
Solicitation Submittal Requirements:
The Offeror shall submit one (1) PDF file via email, with the following characteristics:
• Text pages 8 ½ x 11 format
• 12-point font, Times New Roman
• The electronic copy must be formatted as a single .pdf searchable file
• Include a cover page with Solicitation Number, Solicitation Title, Prime Contractor Name, Address, Phone Number, Fax Number, Unique Entity ID, Cage Code, Point of Contact, Title, phone number, and email address.
Factor 1, Experience:
(a) Solicitation Submittal Requirements:
The Offeror shall submit the following information:
(1) Construction Experience:
Submit a minimum of three (3) and maximum of five (5) relevant construction projects for the Offeror that best demonstrates your experience on relevant projects that are similar in size, scope, and complexity to the RFP.
For purposes of this evaluation, a relevant project is further defined as a commercial or industrial project that includes horizontal concrete construction (such as shallow foundations, concrete slabs, or concrete paving).
Relevant projects shall have been constructed in the country of Iceland and shall have a final construction value equal to or exceeding $500,000 USD. In addition, offerors must submit at least one (1) project relevant project that demonstrates experience with airfield paving and at least one (1) relevant project that include the construction of an Oil-Water Separator. Failure to submit at least one (1) relevant project that demonstrates experience with airfield paving and one (1) relevant project that includes construction of an Oil-Water Separator will result in an offeror being rated Unacceptable for this Factor. A proposal that is rated Unacceptable is unawardable.
Projects submitted for the Offeror shall be completed within the past ten (10) years of issuance of this RFP.
A project is defined as a construction project performed under a single task order or contract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole shall not be submitted as a project;
rather Offerors shall submit the work performed under a task order as a project.
The attached Construction Project Data Sheet (Attachment 6) is MANDATORY and SHALL be used to submit project information. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed one (1) double-sided page (or two (2) single-sided pages).
For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (i.e., unique features, area, construction methods). In addition, the description should also address any sustainable features for the project, including specific descriptions of those features. Provide applicable documentation on projects that were validated and/or certified through a Sustainable Third Party Certification program.
If the Offeror is a Joint Venture (JV), relevant project experience should be submitted for projects completed by the Joint Venture entity. If the Joint Venture does not have shared experience, projects may be submitted for the Joint Venture members. If a project was performed by a JV, and not all partners from that JV are on the JV proposed for this contract, the Offeror shall clearly demonstrate what portion of the work was performed by the JV member offering on this contract and shall not include work performed by the JV as a whole. The JV member proposed for this contract shall specifically address field work performed by that JV member including field staffing and direct field work oversight. The JV member proposed for this contract shall also address home office management performed by that JV member including the number/percentage of employees provided for the overall contract by the JV members as well as the overall percentage of work performed by the JV member. The Offeror shall also submit a SIGNED copy of the Joint Venture agreement indicating the proposed participation of each Joint Venture member. Offerors are still limited to a total of five (5) projects combined.
If an Offeror is utilizing experience information of affiliates/subsidiaries/parent/LLC/LTD member companies (name is not exactly as stated on the SF1442), the proposal shall clearly demonstrate that the affiliate/subsidiary/parent firm will have meaningful involvement in the performance of the contract. The proposal shall state specific commitments of technical resources (e.g. personnel, equipment) that the affiliate/subsidiary/parent/LLC/LTD member companies commit to the performance of this contract. In particular, the proposal will clearly state the specific commitments of resources of the affiliate/subsidiary/parent/LLC/LTD member that will be located at the worksites and company offices in the city/area of the project. The proposal shall also describe specific roles of the affiliate/subsidiary/ parent/LLC/LTD member companies in terms of the work it will either self-perform or manage on behalf of the Offeror in performance of the contract. The Offeror MAY NOT utilize experience of a subcontractor to demonstrate construction experience under this evaluation factor unless specialized subcontractor experience is stated as acceptable. Failure to submit this information may result in a lower rating.
The Offeror may utilize experience of a subcontractor that will perform major or critical aspects of the requirement to demonstrate construction experience under this evaluation factor. The Offer must provide a letter of commitment and an explanation of the meaningful involvement that the subcontractor will have in performance of this contract. More weight may be given to the Offeror’s projects than to those submitted for subcontractors.
(b) Basis of Evaluation:
The basis of evaluation will include the Offeror’s demonstrated experience and depth of experience in performing relevant construction projects as defined in the solicitation submittal requirements. The assessment of the Offeror’s relevant experience will be used as a means of evaluating the capability of the Offeror to successfully meet the requirements of the RFP. The Government will only review five (5) projects for construction. Any projects submitted in excess of the five (5) for Construction Experience will not be considered.
Offerors who submit relevant projects that demonstrate experience self-performing relevant features of work may receive a higher rating than those who do not demonstrate self-performance. Self-performance is defined as an offeror who served as the Prime Contractor on the project and performed elements of the construction with in-house resources.
Offerors that demonstrate experience with relevant projects contracted with the United States Department of Defense may be considered more favorably than Offerors who do not demonstrate this experience.
JV Offerors that demonstrate relevant project experience for each of the JV members may be more favorably considered than JV Offerors who do not have relevant project experience for each entity.
Factor 2, Past Performance:
If a completed Contractor Performance Assessment Reporting System (CPARS) evaluation is available, it shall be submitted with the proposal for each project included in Factor 1 for Construction Experience. If there is not a completed CPARS evaluation then submit Past Performance Questionnaires (PPQ) (Attachment 7) for each project included in Factor 1 for Construction Experience. The Offeror should provide completed PPQ in the proposal.
Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror shall complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). The Government may make reasonable attempts to contact the client noted for that project(s) to obtain the PPQ information. However, Offerors should follow-up with clients/references to help ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Mr. Graeme Silva, via email at Graeme.l.silva.civ@us.navy.mil.
Offerors may provide any information on problems encountered and the corrective actions taken on projects submitted under Factor 1 - Experience. Offerors may also address any adverse past performance issues.
Explanations shall not exceed two (2) double-sided pages (or four (4) single-sided pages) in total.
The Government reserves the right to contact references for verification or additional information. The Government’s inability to contact any of the Offeror’s references or the references unwillingness to provide the information requested may affect the Government’s evaluation of this factor.
Performance awards or additional information submitted will not be considered.
(b) Basis of Evaluation:
This evaluation will consider how well the Offeror’s team performed on the relevant projects submitted under Factor 1 – Experience and may also consider past performance on other projects currently documented in known sources.
The Government will consider the recency and relevance of the information, the source of the information, context of the data, and general trends in the Contractor’s performance. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the Offeror’s teams’ past performance will be used as a means of evaluating the Offeror’s team’s probability to successfully meet the requirements of the RFP.
Offerors lacking relevant past performance history will receive a NEUTRAL Confidence rating. Past performance ratings of “Substantial Confidence” or “Satisfactory Confidence” hold more value than a “Neutral Confidence” rating and will be considered more favorably in the tradeoff.
Factor 3, Safety:
The Offeror shall submit the following information: (For a partnership or joint venture, only one safety narrative is required, but it must address each contractor who is part of the partnership or joint venture.)
Technical Approach to Safety:
Describe the Offeror’s technical approach to safety for its employees as well as the plan that the Offeror will implement to evaluate and measure safety performance of potential subcontractors as a part of the selection process for all levels of subcontractors. Also, describe methods that the Offeror will employ to ensure and monitor safe work practices at all subcontractor levels. The Safety Narrative, which shall include all information requested in this paragraph, shall be limited to three single-sided pages.
The Government reserves the right to review other available sources (public/Government internal) of information.
These may include but are not limited to OSHA data, NAVFAC’s Contractor Incident Reporting System (CIRS), Contractor Performance Assessment Reporting System (CPARS), Electronic Contract Management System (eCMS), etc.
(b) Basis of Evaluation:
The Government is seeking to determine that the Offeror has consistently demonstrated a commitment to safety and that the Offeror plans to properly manage and implement safety procedures for itself and its subcontractors.
The Government will evaluate the Offeror’s technical approach to safety for its employees, as well as its plan to select and monitor subcontractors.
The Government may consult additional sources of information for evaluating safety including, but not limited to, Government agencies, OSHA, NAVFAC’s Facility Accident and Incident Reporting (FAIR) and Contractor Incident Reporting System (CIRS) databases, and other related resources. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete safety information regarding these submittal requirements rests with the Offeror.
The Safety Factor will be rated on an Acceptable/Unacceptable basis.
Factor 4, Technical Solution:
Provide a narrative describing the technical solution to the project that meets the requirements of the RFP. Include the following:
(1) Summary of the technical approach, including the means/methods, material and tools to be utilized to complete the work; mitigation plans for anticipated problems; logistical challenges and site constraints;
communication flow and coordination with the Government and key stakeholders; and an explanation of the proposed project schedule that explains the proposed contract duration and consideration of weather/climate on construction activities.
Provide a project organizational chart that shows the key positions (Project Manager, Site Safety & Health Officer, Construction QCM, Superintendent), general project organization by trade, subcontractors (if any), and the communication flow with the U.S. Government representatives. The organizational chart shall also clearly identify the lines of authority between the entities. If the experience of a subcontractor is being claimed in Factor 1, the firm must be named in the above (Factor 4) narrative and organizational chart otherwise any projects listed that are attributed to that subcontractor will not be considered.
Provide a project schedule with a Gantt chart. Include the contract duration, all major submittals and all major aspects of construction project. The contract timeframe identified in the RFP defines the acceptable contract duration. Provide a narrative that explains the proposed contract duration.
Narrative shall not exceed five (5) double-sided pages (or ten (10) single-sided pages). In addition, provide one
(1) single-sided schedule Gantt chart to graphically present the contract duration. The Gantt chart may be on a single 11” x 17” page that will not count against the page limitations for the narrative.
The Government will evaluate the narrative, organizational chart, and schedule considering the extent to which the Offeror demonstrates a clear understanding of the requirements of the project. The Government will evaluate the effectiveness of the technical solution to determine the likelihood that the work will be performed in accordance with the technical requirements of the RFP.
The Government will evaluate a comparison of the contractor’s proposed contract duration to the contract duration stated on the SF1442 and in clause 52.211-10. The Government’s evaluation of the contractor’s proposed schedule is a means of determining whether the contractor understands the scope of work and approaches the tasks in a logical and effective manner.
A higher rating may be provided for a shorter overall schedule that clearly identifies realistic and achievable construction durations.
In addition, if the contractor proposes a shorter duration, the contractor’s proposed contract duration shall become an enforceable part of the contract and will be reflected in the awarded Contract Completion Date (CCD) to the successful Offeror.
Price:
The Offeror shall submit one (1) PDF file via email, with the following characteristics:
• Include a cover page with Solicitation Number, Solicitation Title, Prime Contractor Name, Address, Phone Number, Fax Number, Unique Entity ID, Cage Code, Point of Contact, Phone Number, and E-mail Address;
• Completed SF-1442 signed with all amendments acknowledged;

ADDITONAL INFORMATION TO BE SUBMITTED WITH PRICE PROPOSAL PACKAGE:
RESPONSIBILITY DETERMINATION INFORMATION - In order to be eligible for award, the Offeror must be determined responsible in accordance with FAR Part 9, specifically 9.104-1, General Standards. No purchase or award shall be made unless the Contracting Officer makes an affirmative determination of responsibility. To be determined responsible, a prospective contractor must have adequate financial resources to perform the contract, or the ability to obtain them. The Contracting Officer shall require acceptable evidence of the prospective contractor’s current sound financial status, as well as the ability to obtain required resources if the need arises. In regard to resources, the contractor must be prepared to present acceptable evidence of subcontracts, commitments or explicit arrangements that will be in existence at the time of contract award, to rent, purchase or otherwise acquire the needed facilities, equipment, services, materials, other resources or personnel. Consideration of a prime contractor’s compliance with limitations on subcontracting shall be taken into account for the time period covered by the contract base period or quantities, plus option periods or quantities, if such options are considered when evaluating offers for award. Pursuant to FAR 9.104-4, the Contracting Officer reserves the right to request adequate evidence of responsibility on the part of any prospective subcontractor(s). In the absence of information clearly indicating that the prospective contractor is responsible, the Contracting Officer shall make a determination of non-responsibility. As a minimum requirement, all Offerors are requested to submit, as part of the price proposal submissions, the following:
In a separate Tab, in the English language, the Offeror shall provide the following information in the price proposal package:
1. One (1) Signed Bank Reference demonstrating adequate financial resources. If the Offeror’s firm has a line of credit – provide information on how many figures Offeror can borrow against the line of credit (i.e. medium 6 figures – exact line of credit is not required).
2. The Offeror shall provide the latest three complete fiscal year financial statements for the prime contractor, certified by an independent accounting firm, if practicable, or signed by an authorized officer of the organization.
Submit evidence of availability of working/operating capital, which will be used for the performance of the resultant contract. For Joint Venture arrangements, submit the latest three complete fiscal year financial statements for each company in the Joint Venture and discuss the financial responsibilities among the companies. The Government may also utilize Dun & Bradstreet reports to evaluate the financial capacity of the Offeror.
3. Point of contact from a bank or any financial institution with which the Offeror transacts business.
Although required to be submitted with Offeror’s price proposal, this information will not be evaluated as part of the price proposal. This information forms part of the basis of your firm’s responsibility determination should your firm be considered for award. Proposal packages from unsuccessful Offerors will not be returned to the Offeror, but shall be destroyed by the Contracting Officer. No certificate of destruction will be issued.
The Government will evaluate price based on the total price. Total price consists of the basic requirements and all option items. The Government intends to evaluate all options and has included the provision FAR 52.217-5, Evaluation of Options (JUL 1990) in the solicitation. In accordance with FAR 52.217-5, evaluation of options will not obligate the Government to exercise the option(s). Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:
(i) Comparison of proposed prices received in response to the RFP.
(ii) Comparison of proposed prices with the IGCE.
(iii) Comparison of proposed prices with available historical information.
(iv) Comparison of market survey results.
B. BASIS FOR AWARD
1. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with Offerors in the competitive range; and to award the contract to the Offeror submitting the proposal determined to represent the best value—the proposal most advantageous to the Government, price and other factors considered.
2. As stated in the solicitation, the Government intends to evaluate proposals and award a contract without discussions with Offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
3. The tradeoff process is selected as appropriate for this acquisition. The Government considers it to be in its best interest to allow consideration of award to other than the lowest priced Offeror or other than the highest technically rated Offeror.
4. As stated in the solicitation, all technical factors when combined are of equal importance to the performance confidence assessment (past performance) rating; and all technical factors and the performance confidence assessment (past performance) rating, when combined are approximately equal to price.
5. Any proposal found to have a deficiency in meeting the stated solicitation requirements or performance objectives will be considered ineligible for award, unless the deficiency is corrected through discussions.
Proposals may be found to have either a significant weakness or multiple weaknesses that impact either the individual factor rating or the overall rating for the proposal. The evaluation report must document the evaluation board’s assessment of the identified weakness(s) and the associated risk to successful contract performance resulting from the weakness(s). This assessment must provide the rationale for proceeding to award without discussions.
