AMENDMENT 0002

The purpose of this amendment is to:

Provide Pre-Proposal Inquiries (PPIs) responses.

All offerors shall submit SOA Certification with Phase II proposals if selected.

The proposal due remains unchanged at Friday, 14 February 2020 at 14:00 Central European Time (CET).

All other terms and conditions remain unchanged.

Pre-Proposal Inquiries (PPIs)

1. In reference to section INSTRUCTION TO OFFERORS paragraph 1.10 paragraphs a) and b (3), page 10 of 60.

A) First question: we ask you if an existing Consortium consisting of twenty companies, of which only four companies will participate to the present solicitation, must to submit the SOA certificates of all the companies of consortium or only the SOA certificates of the companies that will participate to the solicitation and that meet the certification requirements in paragraph a.

Gov Response: All offerors shall comply with current Italian Law and SOA certification requirements listed in the Solicitation.

B) Second question: the three companies of consortium are: firm A, firm B, firm C; it is possible to participate with the following composition to meet requirements in paragraph a?

Firm A has SOA certificate OG1 class. V, OG3 class.VI, OG11 class. IV and will perform 100% OG1, OG3, OG11

Firm B has SOA certificate OG6 class II and will perform 40% Firm C has SOA certificate OG6 class III and will perform 60% Gov Response: All offerors shall comply with current Italian Law and SOA certification requirements listed in the Solicitation.

2. Reference is made to page 09 of 60 point 4 Solicitation Section 00600, “Representations, Certifications, and Other Statements of Offerors”. Offerors shall comply with the requirements in accordance with FAR 52.204-8.

Please clarify where Section 00600 is in the Solicitation.

Gov Response: Disregard section 00600 reference. See Clause in full text on page 25 of the solicitation.

3. 1.10 Societa’ Organismi D’Attestazione (SOA Certification) If Offeror is qualified under all SOA categories but does not fulfill the Classification of one Category in example:

Are Teaming Agreements also accepted in order to fulfill the SOA Classifications?

6. FACTOR TWO – EXPERIENCE > (2) Design Experience

USG, please confirm that it is possible submitting experiences of two Design Subcontractors, so to have the opportunity to rely on one or the other based on the nature of the Task Order to be designed.

If so, please clarify is it is possible to submit from 2 to 5 experiences, for both of them.

Gov Response: Per the soliciation submittal requirements, a total of five submissions is the maximum number of responses that will be allowed. See the details in the Construction section and the details in the Architect- Enginer Section.

7. The RFP at Pages 41 and 42 provides Clause 252.204-7007 ALTERNATE A, ANNUAL REPRESENTATIONS AND CERTIFICATIONS (JUN 2019). In several locations in the clause, the statement "[Contracting Officer Check as Appropriate]" is made, but no checks are included in the document.

Can the Solicitation please be provided with the desired checks made in the document?

Gov Response: (iii) Trade Agreements Certificate and (iv) Secondary Arab Boycott of Israel were selected.

8. Section 00 10 00, Paragraph 1.10 requires SOA documents and Paragraph 1.11 requires a BLG.

With which phase of the Proposal are such documents to be submitted?

Please provide instruction on how we can comply with the requirement of S.O.A. Certification requested on page 10of 60 of the RFP.

10. Reference is made to solicitation page 16 of 60, Factor 2 - Experience, Solicitation Submittal

Requirements.

The solicitation states : " Projects submitted must have been completed within the past five (5) years of the date of issuance of this RFP. For design-build projects, the design portion of the contract shall have been completed within the past five (5) years of the date of issuance of this RFP."

Due to the number of variables and evaluation factors to be satisfied please confirm that it would be acceptable to the Government if one or more of the submitted projects is substantially completed with a completion status of 90% or above, as in other NAVFAC solicitation where the wording "substantially completed" appeared in the evaluation factors. We believe that a 90% completion threshold does not prevent the Government's evaluation of a contractor's capabilities since at this completion stage the salient works have been performed by the contractor.

Gov Response: Construction and Design Projects submitted for the Factor 2:Experience Factor must be 100% complete within 5 years of the date of the RFP release.

11. Is the intent of this solicitation to limit or exclude US Firm participation?

It seems that it would be in the best interest of the Contracting Office to allow as many US firms and new and qualified JV partnerships to enter into the Sigonella construction / maintenance bid opportunities arena, as to do otherwise would limit competition and result in less than ideal full and open competition per FAR

6.101 Policy, Competition Requirements.

We respectfully request that in the spirit of fair competition and allowing new bidders into this area of operations Phase 1 requirements allow for OG/SOA certs to be from one JV partner and Past Projects also be allowed from one partner. This will allow for a much larger pool of bidders, thereby competitively sourcing an eligible contractor from a wider body of qualified contractors.

14. We respectfully request NATO / Italian Defense Ministry projects funded by USAF in Italy be allowed to be submitted as US Government experience.

Gov Response: At least one (1) construction project shall have been awarded by the U.S. Government.

15. In RFP Pg. 10, point b. (1) - 1.10 SOCIETA’ ORGANISMI D’ATTESTAZIONE (SOA)

CERTIFICATION:

” (1) An unexpired SOA Certificate (including joint venture partner, consortium partners or subcontractors that will be utilized to meet the qualification standard).”Is it necessary for the consortia to have their own SOA certificate on behalf of the consortium besides the consortium partners certificates or are sufficient also only the certificates of the consortium partners?

16. Pg. 15, Factor 2 – Experience ; (1) Construction Experience

The Projects submitted by the Offeror must have been completed within the past five (5) years or not? It is not indicated in RFP.

Gov Response: Construction projects submitted must have been completed within the past five (5) years of the date of issuance of this RFP. For design-build projects, the design portion of the contract shall have been completed within the past five (5) years of the date of issuance of this RFP.

17. In RFP Pg. 10, point b. (1) - 1.10 SOCIETA’ ORGANISMI D’ATTESTAZIONE (SOA) CERTIFICATION: refers to the possibility to use subcontractors to meet the qualification standard, this means that if we do not own one or more SOA categories can we attach the SOA certificate of a subcontractor?

18. Please, kindly confirm that it is possible to participate in this solicitation, even if SAM registration is in progress, but the offeror has already obtained DUNS number and CAGE / NCAGE code.

Gov Response: SAM registration is required for award.

19. Please, kindly confirm that it is possible to participate in this solicitation as an established Associazione Temporanea di Imprese composed by two or more companies (ATI), in accordance to D.Lgs 50/2016 (current Italian Public Contract Law which has replaced the DeLise Code D.lgs. 163/2006), by providing a relevant notarized legal document along with the proposal.

20. Please, kindly clarify if a “Società Cooperativa Consortile” – type of consortium set forth in the Italian Public Contract Law (D.Lgs. 50/2016) - is eligible to participate in this solicitation, meeting the requirements provided for under “Factor 2 – Experience” by submitting relevant projects in which the said “Società Cooperativa Consortile” is the contractor and some of its members are the entities that carried out the works.

21. Please, kindly clarify if “Avvalimento” (reliance on the capacities of other entities in order to meet the requirements set forth in this solicitation, according to art. 89 D.Lgs. 50/2016) is permitted.

22. Please confirm that it is possible submitting as Corporate Experience a Project performed in Sigonella and 92% completed, stuck from months for reasons beyond Contractor responsibility.
