END OF CHANGES

The closing date remains unchanged. Proposals are due no later than 2:00 p.m. Central European Time (CET) on 28 February 2018.

QUESTION ANSWER AMD #

1 Please kindly confirm work to be performed under this JOC will be done in whole Poland country or just in Redzikowo.

Yes this work will be performed at Naval Support Facility Redzikowo only.

AMD # 01

2 Section 00010 ‐ Solicitation Contract Form was not listed among the required items in Price Evaluation factor ‐ Solicitation Submittal Requirements in the RFP. Please kindly clarify whether Section 00010 ‐ Solicitation Contract Form will be filled for all CLINs (from CLIN 0001 to 0005) when submitting price proposal.

Section 00010 ‐ Solicitation Contract Form is for information purposes only. Since there is no seed project for this solicitation, Section 00010 is not required to be completed and sent in with the Price Evaluation Factor ‐ Solicitation Submittal Requirements.

AMD # 01

3 Please kindly confirm that Attachment‐ 2 coefficient schedule will be filled once for base and all option years.

Therefore, there will be only one filled attachment‐2 and only one total evaluated price for all CLINs (from CLIN 0001 to CLIN 0005 – base and all option years). Or, alternately, please clarify if offerors will fill separate Attachment‐2 for all separate CLINs (from CLIN 0001 to CLIN 0005 – base and all option years)

Yes Attachment ‐2 coefficient schedule will be filled once for base and all option years. One submittal only.

AMD # 01

4 For the pre‐priced items, in the RS‐ Means unit prices there are Division ‐1 items for field office overhead such as temporary field offices, temporary utilities, field personnel… etc. However, in the RFP Section C.4 Coefficients, all field office overhead is described to be covered under the coefficients. Please clarify if contractors will cover all field office overhead under coefficients or field office overhead can be included in the pre‐priced items when pricing a task order.

Contractors will cover all field office overhead under coefficients as per RFP Section C.4.

AMD # 01

5 Reference is made to Section 00100 Instructions to Offerors, clause 1.6 System for Award Management: Due to an intention to establish a new JV for this JOC and due to the limited time frame until final bid submittal date, a successful registration (DUNS number / NCage code) for a new JV might not be achieved in time. Is it acceptable to submit the bid proposal under an existing registration of one of the two JV partners and to change to a new registration (with new DUNS number and NCage code for a JV) after the successful registration? Details of the above would be mentioned in the narrative of the bid proposal.

In accordance with Solicitation Section 00100 Instructions to Offerors, 1.6 System for Award Management: A DUNS number is required for all Offerors, including JV Offerors. In addtion to the DUNS number required for JV Offerors, JV Offerors must provide a DUNS number for each member comprising the JV. Failure to comply may cause your firm to be non responsive and ineligible for award.

AMD # 01

6 Reference is made to Section 00100 Instructions to Offerors, clause 1.7 Pre‐ Award Survey:

Until which date the information requested in this clause shall be submitted?

Amendment 01 makes a change to Section 00100 Instructions to Offerors, clause 1.7 Pre‐ Award Survey/Responsibility Determination, paragraph a. Company financial statements (balance sheet and income statements) for the past three fiscal years. This coincides with the Price Evaluation submittal requirements.

AMD # 01

7 Reference is made to Section 00800 Special Contract Requirements, clause C.1, General Information: It is stated that the work shall be performed in the NAVFAC Poland geographic area of responsibility. Can you further specify the locations of work if it is outside Redzikowo?

Work will be performed at Naval Support Facility Redzikowo only.

AMD # 01

8 There didn't seem to be a question submission template for Experience and Past Performance in the solicitation.

Documents are all there. You must click under Additional Documents on the Solicitation page on the NECO website.

AMD # 01

9 While a USG sponsored site survey will not be held, is it permissible for bidders to conduct an independent site survey, with the USG provide base access?

There will be no site visit. You are welcome to view the area on your own from outside the base but you will not be given access to the Naval Base.

AMD # 01

10 1.7 b (page 10) states it is required to provide: Company financial statements (balance sheets and income statements) for the past two years.

however page 15 item 8 (top of page) states: the offeror shall provide the latest three complete fiscal year financial statements...

Is the requirement for 2 or 3 years of financial statements?

Amendment 01 makes a change to Section 00100 Instructions to Offerors, clause 1.7 Pre‐ Award Survey/Responsibility Determination, paragraph a. Company financial statements (balance sheet and income statements) for the past three fiscal years. This coincides with the Price Evaluation submittal requirements.

AMD # 01

11 According to RFP, experience project has been performed and completed within the last 5 years. Could you please extend it to last 6 years?

Requirement remains as stated in the solicitation.

AMD # 02

12 Page 9 of 103 Pre‐Award Survey requests Financial Sheets of the past two years Page 15 of 103 Price Evaluation requests Financial Statements of the past three years.

Please confirm if the Government requires the last two or three years Company Financial Statements?

This question has been answered in Amendment 01

AMD # 02

13 RFP page 12 of 93, para. 1.10 Joint Venture mentions “Joint Venture Offerors shall provide a legalized document that establishes the JV.” We are currently in a JV executing two significant US DoD contracts in Poland under a JV agreement that is not notarized. This JV has a valid JV agreement meeting solicitation requirements and is SAMs registered.

Offerors respectfully request the Government to consider removing the “notarized” requirement as it provides an additional cost burden to JV Offerors.

Requirement remains as stated in the solicitation.

AMD # 02

14 RFP page 18 of 93, para. 4 mentions “discuss how your firm will provide labor, materials, equipment, subcontractors, and project management to multiple sites in Poland simultaneously.

RFP pg 65, C.1 mentions “work will be performed within the NAVFAC Poland geographic area of responsibility.”

Can the Government please confirm that all JOC task orders will be performed at NSA Redzikowo, Poland?

This question has been answered in Amendment 01

AMD # 02

15 RFP page 18 of 103, para 1.2 Site Visit mentions “there will be no preproposal conference/site visit scheduled under this solicitation.” Offerors respectfully request the Government to consider providing Offerors with a site visit as this will allow potential bidders to provide NAVFAC with more accurate pricing/technical proposals.

There will be no site visit. AMD # 02

16 Offerors respectfully request the Government to extend the proposal due date by two weeks.

Requirement remains as stated in the solicitation.

AMD # 02

17 RFP 18 of 103 mentions “Offerors response shall not exceed (15) pages (8.5 x 11)….do not use color for text, graphics, or images.” Please confirm if A4 sized paper will be considered in lieu of 8.5 x 11? In addition, Offerors believe the use of colors in organizational charts and other graphic representations help Offerors to present information in a logical, concise manner. Offerors respectfully request the Government to consider allowing the use of color for organizational charts and other graphical representations.

Requirement remains as stated in the solicitation.

AMD # 02

Regarding solicitation N33191‐18‐R‐ 0603.

On the solicitation “Attachment 2 – Coefficient Schedule” – under “VALUE OF WORK ESTIMATED” the amounts are pre‐populated with $80,000, $15,000 and $5000. Can you confirm bidders required to use these numbers?

Yes bidders are required to use these numbers. This is a place holder for evaluation purposes only.

AMD # 03

19 Regarding solicitation N33191‐18‐R‐ 0603.

In the solicitation section 1.12 Evaluation Factors for Award, under section “Price Evaluation Factor”, a) Solicitation Submittal Requirements, 5) Acknowledgement of all amendments.

Can you confirm that a separate page listing all amendments is required even though an Acknowledgement of all amendments is already included on the form SF 1442 #18?

Amendments may be acknowledged on the SF1442 #18 and submitted with your proposal. Pleased be advised that you are responsible for checking www.euro.neco.navy.mil for any new amendments.

AMD # 03

20 Can the Government please clarify the meaning for “Special access requirements, clearance requirements, see attachments?” Are these requirements above and beyond normal base access requirements?

There is no site visit for this solicitation so there are no attachments required to gain immediately access to the base. Should your firm be awarded the contract you will utilize the attachments to Amendment 03 for base access. Most projects will not be in a restricted area. However, if access is needed to a restricted area, escorts will be provided at the Government's expense.

21 Please clarify if there any special individual and/or company security clearances required to perform the seed project or any other future TO’s under this contract? If so, please provide details.

AMD #03

22 Please clarify if Offerors can use a Polish version price book, which has standards similar to R.S. Means?

All bidders must use R.S. Means as per the solicitation.

AMD # 03

23 Please clarify if Offerors can provide insurance as (required by Polish labor laws) identical and in lieu of Defense Base Act (DBA) Insurance?

Clause 52.228‐3 – Workers’ Compensation Insurance (Defense Base Act) referenced in the solicitation references http://www.dol.gov/owcp/dlhwc/lsdba.htm.

This site has a list of all countries waived from this requirement. Poland is not waived.

AMD # 03

24 Does the Government anticipate JOC task orders being performed at the MDA facility or Aegis Ashore Missile Defense Facilities in NSA Redzikowo?

Task orders are anticipated throughout entire the Naval Support Facility Redzikowo area.

25 Please confirm if the Government require Offerors to add bare costs as part of the coefficient.

Bare costs are part of your calculation and should be included in your proposal.

AMD # 03

26 We understand that new buildings were constructed at NSA Redzikowo.

Can the Government please confirm if these buildings and associated systems are currently under warranty? Does the Government foresee using this JOC Contract vehicle to issue Task Orders for maintaining/repairing specific buildings and systems currently under warranty or will any work required under the warranty period be performed by the construction contractor under warranty?

At the planned time of award of the JOC, many of the facilities on NSF Redzikowo will be under warranty. The Government intends to utilize all tools available to perform the required work, regardless of whether it is under warranty.

27 FAR 52.216‐19 describes the minimum and maximum orders for the Contract as follows:

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $2,500 the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor ‐

(1) Any order for a single item in excess of $1,000,000;

(2) Any order for a combination of items in excess of $1,000,000; or

However, Contrace Paragraph C.1.1 calls for a minimum and maximum of $2,000 and $3,000,000, as follows:

C.1.1 Contract Type and Term This is a fixed‐price, indefinite‐delivery, indefinite‐quantity contract, with a one‐year base period plus four oneyear option periods. The option periods may be exercised at the discretion of the Government. Delivery or performance shall be specified in individual Task Orders issued hereunder. Projects are expected to be within the minimum/maximum dollar range of $2,000 to $3,000,000.

FAR 52.216‐19 has been changed to coincide with C.1.1 as per Amendment 03.

28 Does this solicitation require us to provide all the material and equipment from the United States. Paragraph C.1 General Information of the General Requirements Section, page 65 of 103, this Solicitation sets a precedence of work IAW the National Electrical Code, the National Fire Code, etc.

Furthermore, Section 00800, Special Contract Requirements, Paragraph C‐5, RS Means Cost Data, requires the use of RS Means for cost pricing. RS means was developed from US industry practices , standards, and materials.

Locally available material in Poland or Europe might not be the exact technical equal of the US material developed around these listed codes. If shipment of material and equipment from the United States is required, a significant cost and time growth to the task orders could be anticipated.

All materials shall meet US specifications, at a minimum. European materials may be substituted if equivalent or better. RFIs for each TO will be reviewed by the Government to determine suitable equivalent materials.

AMD # 04

29 Reference is made to Section 00100 Instruction to Offerors, clause 1.8 Performance Guarantee Section 00700 Contract Clauses, 5252.228‐9305 Notice of Bonding Requirements (Dec 2000) Section 00800 Special Contract Requirements, clause C.12 Performance Guarantee or Bond Requirements

Other than described in Section 00700 Contract Clauses, 5252.228‐9305, we understand that we shall provide a performance guarantee only as described in Section 00100 Instruction to Offerors, clause 1.8 and Section 00800 Special Contract Requirements, clause C.12 which requires an amount of 10% of the amount of each individual task order, but only if equal to or greater than 150,000 USD.

Any other bonding is not required.

We would kindly ask for confirmation of the above or clarification.

Bonding is as referenced. AMD # 04

30 Reference paragraph 52.236‐1 Performance of Work by the Contractor (APR 1984). This paragraph requires that 51% of the work shall be performed by the contractor’s own organization. Does this mean the contractor‘s own labor force and equipment? What is specifically meant by its own organization?

The paragraph further describes a reduction (of the 51%) through a supplemental agreement. Is this agreement to be submitted with the solicitation, or after contract award?

The contractor’s own organization means other than subcontracted labor force and equipment. Subcontracted labor force and equipment shall not exceed 49% of the work.

If the submitter is proposing that more than 49% be completed by other than the contractor’s own organization, the supplemental agreement shall be provided with the solicitation so that it may be reviewd by the source selection board.
