JUSTIFICATION AND APPROVAL (J&A) FOR USE OTHER THAN FULL AND OPEN

COMPETITION

1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC) Norfolk

2. Description of the Action Being Approved: This is a sole source justification for work to be provided under Work Items (WIs): 0252, 0254, 0286, 0287, 0292, 0301, 0451, 0452, 0453, 0455, 0456, 0459, 0490, 0491, 0501, 0502, 0509, 0518, 0562, 0563, 0601, 0602, 0603, 0604, 0605, 0650, 0653, 0701, 0702, 0705, 0802, 0909 and 0912 of the Statement of Work (SOW) for the Regular Overhaul and

Drydocking (ROH) of the USS MERCY (T-AH 19) under RFP N3220520R6500. This Justification is covering only the portion of the acquisition, which is brand-name, or otherwise sole source and the approval level requirements will then only apply to the portion.

3. Description of Supply Services: MSC Norfolk requires Original Equipment Manufacturer (OEM) authorized technical field representatives and OEM parts to accomplish requirements of WIs listed below. The estimated combined dollar value of the thirty-three (33) Work Items is that will be funded utilizing FY 20 Operation / Maintenance and ESLP funds.

4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C 2304 (c) (1):

Only one responsible source and no other supplies or services will satisfy agency requirements (as implemented by FAR 6.302-1(a)).

5. Rationale Justifying Use of Cited Authority:

a. WI 0252: Main Reduction Gear Inspection (5 YR)

This work requires the services of a MSC N7 Recognized Repair Facility from the following recognized list: Curtiss-Wright, MI-Tech Inc., PJ Schwalbenberg & Associates Inc. for parts and servicing of the vessels Main Reduction Gear (MRG). The MRG is critical equipment per Safety

Management System (SMS) #10.6-002-01-AH. Only OEM-authorized service and parts providers have access to proprietary drawings and technical data, and have the expertise and knowledge to provide OEM parts, components, and qualified services. A loss of the MRG will result in the ship being dead in the water putting the crew and vessel safety at risk. OEM-authorized representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.

b. WI 0254: Thrust and Line Shaft Bearing Inspection (5 YR)

This work requires a Waukesha Bearing Technical Representative to service the vessels Main

Propulsion Shaft Thrust and Line Shaft Bearings. The Main Propulsion Shaft is critical equipment per SMS #10.6-002-01-AH. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide

OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause system failure at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.

c. WI 0286: HP and LP Steam Turbine Open and Inspection (5 YR) recognized list: Curtiss-Wright, MI-Tech Inc., PJ Schwalbenberg & Associates Inc. for parts and servicing of the vessels HP and LP TurbCOines. The HP and LP Turbines are critical equipment per Safety Management System (SMS) #10.6-002-01-AH. Only OEM-authorized service and parts providers have access to proprietary drawings and technical data, and have the expertise and knowledge to provide OEM parts, components, and qualified services. A loss of the HP and

LP Turbines will result in the ship being dead in the water putting the crew and vessel safety at risk. OEM-authorized representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company.

d. WI 0287: Automation and Propulsion Control Inspect and Test

This work requires a Technical Marines Services Technical Representative to service the ship’s

Automation and Propulsion and Control system. The Automation and Propulsion and Control system is critical equipment per SMS #10.6-002-01-AH.

Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause system failure at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts are equivalent to the

OEM service and replacement parts.

e. WI 0292: Main Feed Pump Overhaul

This work requires a Coffin Turbo Pump Technical Representative to overhaul the ship’s Main

Feed Pumps. The Main Feed Pumps are critical equipment per SMS #10.6-002-01-AH. Only

OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause system failure at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company.

f. WI 0301: ENCON-HEAT Balance Instrumentation Install

This work requires a Technical Marine Services Technical Representative to install and commission the new Heat Balance Instrumentation for the Propulsion Plant. The Propulsion Plant is critical equipment per SMS #10.6-002-01-AH. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause system failure at sea. g. WI 0451: Annual Radar Service (1 YR)

This work requires a Furuno Technical Representative to service the ship’s Furuno model FAR

2827S/12 and FAR 2837 radars, and radar uninterrupted power supplies (UPS). The radars are critical equipment per SMS #10.6-002-01-AH. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause system failure and loss of navigation at sea. OEM-authorized

h. WI 0452: Annual ECDIS Service (1 YR)

This work requires a Transas Technical Representative to service the ship’s Navi-Salor 4000

EDCIS. The ECDIS is critical equipment per SMS #10.6-002-01-AH. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services.

i. WI 0453: Annual GYRO Service (1 YR)

This work requires the supply of a Sperry Marine Technical Representative to service the ship’s main gyrocompass, model WSN-7B, and auxiliary gyrocompass, model MK23. The gyrocompasses are critical equipment per SMS #10.6-002-01-AH. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause system failure and loss of navigation at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. j. WI 0455: Annual Radio Communication Equipment Cert (1 YR)

This work requires a Manufacturer’s Authorized Technical Representative IAW ABS recognized external specialists to service the ship’s radio communication equipment. The radio equipment is critical equipment per SMS #10.6-002-01-AH. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause system failure and loss of communication at sea. OEM-authorized

k. WI 0456: Magnetic Compass Service (2 YR)

This work requires a Manufacturer’s Authorized Technical Representative to inspect and service the ship’s Baker Lyman Magnetic Compass. The Magnetic Compass is critical equipment per SMS

#10.6-002-01-AH. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause system failure and loss of depth detection at sea. OEM-authorized Representatives will only install genuine

l. WI 0459: Echo Sounder Service (1 YR)

This work requires a Manufacturer’s Authorized Technical Representative to inspect and service the ship’s Echo Sounder systems, FURUNO models: FE8020, 50B-6B, 200B-8B, FE8010, and

RD-50. The Echo Sounder is critical equipment per SMS #10.6-002-01-AH. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services.

OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause system failure and loss of depth detection at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all

OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not

n. WI 0491: Annual SVDR Recertification (1 YR) the ship’s Simplified Voyage Data Recorder (S-VDR), JRC model: JCY-1850. The S-VDR is critical equipment per SMS #10.6-002-01-AH. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause system failure and loss of log data for accident investigation in event of casualty at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.

o. WI 0501: ESLP-TLI Sensor Install Phase 2

This work requires a NAG Marine Technical Representative to install and commission Phase 2 of the new Remote Tank Level Indication System. NAG Marine is the OEM for the Remote Tank

Level Indicating System, has access to proprietary drawings/technical data, and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause system failure at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine

p. WI 0502: ESLP-TLI Sensor Install Phase 3

This work requires a NAG Marine Technical Representative to install and commission Phase 3 of the new Remote Tank Level Indication System. NAG Marine is the OEM for the Remote Tank

Level Indicating System, has access to proprietary drawings/technical data, and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause system failure at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine

q. WI 0509: ESLP- ADG Overhaul recognized list: MAN Diesel North America or Motor Service Hugo Stamp for parts and servicing of the vessels Auxiliary Diesel Generator Engines Model: 12V25/30. The Auxiliary Diesel

Generator Engines are critical equipment per Safety Management System (SMS) #10.6-002-01-

AH. Only OEM-authorized service and parts providers have access to proprietary drawings and technical data, and have the expertise and knowledge to provide OEM parts, components, and qualified services. A loss of Auxiliary Diesel Generator Engine results in loss of mission critical electrical generation which when at sea affects crew, medical services, and vessel safety. OEM-authorized representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. r. WI 0518: SSTG Open and Inspect (5 YR) recognized list: Curtiss-Wright, MI-Tech Inc., PJ Schwalbenberg & Associates Inc. for parts and servicing of the USNS Mercy’s SSTG Turbine. The SSTG Turbine is critical equipment per Safety

Management System (SMS) #10.6-002-01-AH. Only OEM-authorized service and parts providers have access to proprietary drawings and technical data, and have the expertise and knowledge to provide OEM parts, components, and qualified services. A loss of the SSTG Turbine will result in a loss of the critical electrical generation which when at sea affects crew, medical services, and vessel safety. OEM-authorized representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and

s. WI 0562: SCBA Annual Inspection (1 YR)

This work requires Manufacturers authorized service facility and Technical Representative IAW

ABS recognized external specialists to service the ship’s Self-Contained Breathing Apparatus

(SCBA) equipment. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause SCBA equipment failure and loss of firefighting capability at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine

t. WI 0563: SCBA Compressor and Fill Station Inspect and Maint (1 YR)

This work requires a Manufacturer authorized service facility and Technical Representative to service the ship’s Self-Contained Breathing Apparatus (SCBA) compressor and refill station. Only

OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly, installed or deficient parts could cause SCBA equipment failure and loss of firefighting capability at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the

u. WI 0601: Annual Tender Boat Davit Service (1 YR)

The work item requires a FASSMER Service America Technical Representative for the annual requirement to inspect, service, and test the ship’s Tender Boat launching appliances, and releasing gear. The Tender Boat davits are critical safety equipment per SMS #10.6-002-01-AH in the event of emergency escape or similar situation. Only OEM-authorized service and parts providers have access to proprietary drawings and technical data, and have the expertise and knowledge to provide

OEM parts, components, and qualified services. The loss of the Tender Boat Davits can result in the inability safely evacuate personnel in an emergency escape situation. OEM-authorized representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required

v. WI 0602: Annual Tender Boat Service (1 YR)

The work item requires a FASSMER Service America Technical Representative for the annual requirement to inspect, service, and test the ship’s Tender Boats. The Tender Boats are critical safety equipment per SMS #10.6-002-01-AH in the event of emergency escape or similar situation.

4. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: The requirement has been synopsized at the Government Point of Entry (GPE), FedBizOps website, and the

Government intends to post a Request for Proposal (RFP) along with this justification at the GPE with the intent of awarding a firm-fixed price contract to the lowest price offeror. Any prospective contractor will be required to use the OEM or OEM Authorized vendor as a subcontractor to perform the work in the related WIs.

5. Determination of Fair and Reasonable Cost: The Contracting Officer will determine the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

6. Actions to Removed Barriers to Future Competition: For reasons set forth in Paragraph 5, MSC has no plans at this time to allow prime contractors to solicit these requirements competitively, other than synopsizing the requirements. If another potential source emerges, MSC Norfolk will assess whether competition for future requirements is feasible. .
